3. Towards Designing a Validated Framework for Improved Clinical Legal Education: Empirical Research on Student and Alumni Feedback

The pedagogical advantages of employing a Clinical Legal Education (“CLE”) teaching and learning strategy have been acclaimed in literature for almost a century and it continues to be ideally suited to cater to modern education expectations. As an agent for social change, CLE offers law students an effective gateway to participate in, and be influenced by, fundamental social justice problems while it also improves access to justice for the indigent. Though the clinical literature is replete on expected benefits for clinical law students, very little (if any) verifiable empirical research, independently sourced and evaluated, has been published to assess the veracity of these claims in support of CLE. After receiving a funding grant from the University of Stellenbosch Fund for Innovation and Research into Learning and Teaching, the University of Stellenbosch Law Clinic appointed an independent, external agency to conduct empirical research through an extensive measure and evaluation exercise. The aim of the project was to source, document and analyse robust empirical research data about the Faculty of Law’s CLE module, Practical Legal Training 471. The project involved the sourcing and collation of formal student evaluation feedback reports spanning a period of nine years. Additional alumni and current student data were gathered either by online questionnaire or by telephonic interview. The research was aimed at eliciting quantitative as well as qualitative responses. The purpose of this article is to describe the applicable methodology and aims of the research project, to unpack and discuss the resulting empirical data, and to draw certain conclusions based on the findings of this research about CLE’s impact on law students’ experience specifically relating to their practice-readiness and social justice sensitivities. It is suggested that this research will prove both interesting and useful to law teachers involved in relevant programmes at other higher education institutions. The data and evidence detailed herein will assist them to conduct their research and to make substantiated recommendations for the development of CLE programs on a broader national and international level. This research will also add to the body of knowledge on students and student learning and allow for recommendations regarding the creation of a broader implementation framework for improved CLE.

Für Akteursanalysen zur Technologiediffusion müssen entsprechende Simulationsmodelle erst noch entwickelt werden. Hierfür werden erste konzeptionelle Überlegungen diskutiert.

This article investigates how new digital technologies are established in agriculture. It does so by drawing upon empirical data from a qualitative case study with a Swiss based but internationally operating start-up that has recently obtained the first authorisation to spray crop protection products on vineyards and fruit plantations with their home-made drone. Conceptually the article takes inspiration in Actor-Network-Theory (ANT) and challenges common understandings of overly urban centred approaches of how new technologies find entry in public policies. The authors argue that instead of seeing a straightforward process of implementing the new drone technology, there has been a joint-effort between the private company and federal institutions to experiment, improve and regulate the functioning of the sprayer drone. A process that is, so is argued, heavily marked by knowledge transfers and formalisations of new private-public alliances, that have been channelled through three particular spatial categories, relating to policy experiments, socio-technical experiments and strategic experiments.

Artykuł lokuje się na pograniczu dwóch socjologicznych subdyscyplin: socjologii sportu i socjologi polityki oraz nauk o polityce. Podejmuje temat nieobecny dotąd w polskiej literaturze przedmiotu, tj. kwestię karier politycznych ludzi sportu: byłych sportowców i sportsmenek oraz trenerów i działaczy sportowych. W wyselekcjonowanej na potrzeby artykułu próbie znalazło się dziewiętnaścioro polityków. Materiał źródłowy objęty analizą został pozyskany z różnych źródeł: z archiwów mass mediów, z oficjalnych serwisów z zasobami archiwalnymi polskiego parlamentu, z publicznych wypowiedzi sportowców-polityków oraz ich biografii i autobiografii. Kilka –niewykluczających się – interpretacji zjawiska politycznych karier ekssportowców zaprezentowano i rozważono w odniesieniu do zgromadzonego materiału empirycznego.

The Shuhi of Muli County, Sichuan province, inhabit the Tibetan-Chinese borderlands. In this paper, we focus on Shuhi kinship practices that accord the house the importance it appears to have for the Shuhi themselves. We demonstrate that the Shuhi engage in kinship practices that are ‘hearth-oriented’ (Hsu 1998b: 67–99) in a dynamic process affected by the current political economic changes in reformist China and religious revivalism in Tibet. The ‘hearth-oriented’ kinship practices we discuss include issues of who among the offspring continues to live in the house of their parents, how places of worship in a house are oriented in relation to the physical environment and the divine landscape, and how practices regarding the naming of houses are changing from deictics of place to lineage and family names. Based on empirical data, gathered between 1996–2011, we show that there are significant differences in all practices, which reflect a Tibetan-Chinese gradient along the north-south axis of Shuhi settlements. Zusammenfassung. Fragestellung: Kognitive Störungsmodelle der sozialen Angststörung (SAD) wie das von Clark und Wells (1995 ) postulieren u. a. negativ verzerrte Kognitionen als entscheidende Komponente in der Entstehung und Aufrechterhaltung der Störung. Beurteilungsbias über eigene Bewältigungsmöglichkeiten lassen sich ebenso ableiten. Anders als im Erwachsenenalter ist die Studienlage im Kindesalter unbefriedigend. Die vorliegende Studie geht der Frage nach, ob sich Kognitionen und selbstwahrgenommene Bewältigungsmöglichkeiten von Kindern mit und ohne SAD in angstinduzierenden Situationen unterscheiden. Methodik: 60 Kinder mit SAD (n = 30) und ohne psychische Störung (n = 30) im Alter von 9 bis 15 Jahren (Altersstufen 9–10, 11–12, 13–15 Jahre) wurden hinsichtlich der Anzahl negativer, positiver und Bewältigungsgedanken vor, während und nach einer stressinduzierenden Situation mittels Bestätigungsmethode untersucht. Die antizipierte Bewältigungsmöglichkeit wurde vor der Situation erfasst. Ergebnisse: Kinder mit SAD unterschieden sich zu keinem Messzeitpunkt in negativen und Bewältigungs-, jedoch in positiven Gedanken von Kindern ohne psychische Störung unter Berücksichtigung des Alters. Die älteren SAD-Gruppen berichteten von signifikant weniger positiven Kognitionen, während die jüngere mehr angab als die Kontrollgruppe. Die Gruppen unterschieden sich nicht in ihrer erwarteten Bewältigungsmöglichkeit. Schlussfolgerung: Die Ergebnisse verweisen auf die Bedeutung positiver Kognitionen für ein Störungsmodell der SAD im Kindesalter und unterstützen eine alterssensitive Anpassung.

Niklas LUHMANN is well known for his deliberate departure from the classical focus on studying individual actions and directing attention on the actors' relatedness through so called (autopoietic) communication systems. In contrast to the gain of a new perspective of observation his focus on autopoietic systems is simultaneously its biggest methodological obstacle for the use in social and management sciences. The present contribution considers the above shift on a theoretical level and with a specific qualitative method. It argues for a deeper understanding of systemic sense making and its enactment in a systematic and comprehensible way. Central to this approach is its focus on groups. Using group discussions as the method of data collection, and the "documentary method" by Ralf BOHNSACK (2003) as a method of data analysis, the article describes a methodologically grounded way to record the self-referential systems proposed by LUHMANN's system theory. The theoretical considerations of the paper are illustrated by empirical vignettes derived from a research project conducted in Switzerland concerning the social responsibility of business. Zusammenfassung Der Beitrag stellt die Entwicklung und empirische Testung eines Instruments zur Erfassung der Lernumwelt in der Promotionsphase vor. Das Instrument besteht aus 33 Items, die insgesamt elf verschiedene Strukturiertheits-, Unterstutzungs- und Anforderungsmerkmale abbilden. Faktorenanalysen zeigen, dass das Messmodell eine hohe Anpassungsgute aufweist. Mehrgruppenanalysen bestatigen die Anwendbarkeit des Instruments in unterschiedlichen formalen und fachlichen Promotionskontexten. 13. Nachfrage nach gesundheitsorientierten Urlaubsformen in Deutschland

Seit vielen Jahren wird der Gesundheitstourismus oder eine seiner Unterformen als ein zukunfts-trächtiger Wachstumsmarkt betrachtet. Treiber sind u. a. Rahmenbedingungen in Gesellschaft und Wirtschaft, die eine wachsende Nachfrage nach gesundheitsorientierten Urlaubsformen plausibel erscheinen lassen. Vor diesem Hintergrund fragt der Beitrag auf empirischer Basis mit den Daten der Reiseanalyse, ob es in der deutschen Tourismusnachfrage einen Trend zum Gesundheitsurlaub gibt. Dafür wird die Entwicklung verschiedener Indikatoren im Konsumentenverhalten zum Ge-sundheitsurlaub (Motive, Präferenzen, faktisches Verhalten) überblickshaft dargestellt. Die Daten zeigen auf allen Ebenen eine allenfalls stabile, eher aber rückläufige Nachfrage für die Vergan-genheit wie auch die absehbare Zukunft. Mögliche Gründe für diese Situation werden diskutiert.Schlüsselbegriffe: Gesundheitsurlaub; Trend, Tourismusnachfrag Health tourism and other segments in tourism focussing on health issues are widely considered as a growth market. Drivers for this growth and the related future potentials may derive from framework conditions within the German society. The paper tries to identify trends with respect to health oriented vacation forms within the German holiday travel demand. Based on the annual survey “Reiseanalyse”, empirical data on motivation, preferences and factual behavior are pre-sented. The results do not reveal an upward trend in the past and do not indicate a growth of the segment in the future. Possible underlying reasons for these findings are discussed.

As we know, speech perception and production are strongly influenced by sign-specific "socio-pragmatic indexicality" (cf. Purschke 2014), that is, by the mental conceptions (of meaning, style etc.) people associate with individual linguistic features. I assume that, in German-speaking areas, the "subjective (notion of the) dialectality" of a non-standard feature represents a basic form of socio-pragmatic indexicality and is closely connected to language variation and change, in that the more regionalisms are regarded as non-standard features, the more they vary synchronically and diachronically. Following Purschke (2014), I define the subjective dialectality of regionalisms as being based on their feature-specific "salience" and "pertinence", that is, on both the pure awareness and further evaluation of such features as non-standard variants. A discussion of theoretical issues is followed by the presentation of empirical data from a speech perception study (in the style of Herrgen/Schmidt 1985). Scale-based judgments by Northern, Central and Southern German listeners provide evidence about the subjective dialectality of 15 Bavarian regionalisms. They further reveal how subjective dialectality is related to listeners' origins and regional language competence. Comparing the subjective data with two Bavarian speakers' language use reveals the relation between subjective dialectality and synchronic variation in the analysed regionalisms.

The German personal pronoun Ihr is the origin of an interesting difference in the address system of Russian Germans and Germans. Whilst the usage of this pronoun has shifted strongly in the last 100 years in Germany, it has been revealed that Russian Germans still use it in the same way as their predecessors. But since these observations date back more than ten years, the purpose of this study was to explore the current usage of personal pronouns among Russian Germans in the Altai Krai. For that purpose fourteen Russian Germans from the German National District and Barnaul were interviewed. This study combines quantitative and qualitative methods, as each respondent was presented a survey and went through a guided interview. As a result, two decision trees for the interviewed Mennonites on the one hand, and Catholics and Lutherans on the other hand, could be composed. The interviewed Russian Germans obviously still adhere to power semantics in the family, among friends and at work. While the Catholics and Lutherans were still employing Ihr, Mennonites used See in order to formally address one interlocutor. This study has also been able to identify Russian Germans' usage of the German dialect in the family and with friends.

Da im deutschsprachigen Raum bisher kaum empirische Daten zur Anwendung der Observed Emotion Rating Scale (OERS) bei demenzerkrankten Personen vorliegen, sollte im Rahmen des Pilotprojekts «Agitation» untersucht werden, wie Erfasserinnen den Einsatz des Instruments OERS erleben. Zu diesem Zweck konnten 12 Probandinnen gewonnen werden, die in drei Pflegezentren im Kanton Zürich Beobachtungen mit dem Instrument OERS durchführten. Der überwiegende Teil der Probandinnen verfügte über pflegerische Qualifikationen bzw. Erfahrung im Umgang mit demenzerkrankten Personen. Die Datensammlung erfolgte anhand von drei Fokusgruppeninterviews, die mittels einer qualitativen Inhaltsanalyse ausgewertet worden waren. Die vorläufigen Ergebnisse aus den Fokusgruppeninterviews wurden von denselben Probandinnen anhand eines Fragebogens validiert. Die Kategorien «fehlende Eindeutigkeit», «fehlende Kodiermöglichkeit», «Demenzschwere», «Einschätzen von Emotionen», «Einflussfaktoren» und «Anwenderschulung» zeigten, dass das Wissen um die Demenzerkrankung genauso bedeutsam ist wie eine geübte Handhabung der OERS. As barely any empirical data on the application of the Observed Emotion Rating Scale (OERS) on sufferers of dementia is available for German-speaking Europe, the pilot project titled “Agitation” aimed to see how those persons entering the data get along with the OERS instrument. For this purpose, 12 test persons were persuaded to carry out observations with the OERS instrument in three care centres located in the Swiss Canton of Zurich. The test persons were predominantly holders of nursing qualifications and/or experienced in caring for patients suffering from dementia. Data collection was undertaken on the basis of three focus group interviews which were evaluated via qualitative content analysis. The preliminary results gained in the focus group interviews were validated by the same people using a questionnaire. The categories were titled “Missing Clearness”, “Missing Possibility to Encode”, “Level of Dementia”, “Estimation of Emotions”, “Influencing Factors” and “User Training”. These indicated that knowledge of dementia is just as important as skilled use of OERS.

Bisher liegen für den deutschen Sprachraum keine empirischen Daten über die Kombination einer Verhaltenstherapie mit einer psychopharmakologischen Begleitmedikation vor. Auch in der internationalen Versorgungsforschung finden sich zu dieser epidemiologischen Fragestellung nur wenige Informationen. Die vorliegende Untersuchung überprüft anhand von Anträgen auf Verhaltenstherapie in der kassenärztlichen Versorgung welche Medikamente oder Substanzgruppen begleitend für bestimmte Störungen im Rahmen einer Kinder- und Jugendlichenpsychotherapie eingesetzt bzw. für indiziert gehalten wurden. Bei insgesamt 1021 Verhaltenstherapieanträgen aus dem Jahrgang 2001 konnte retrospektiv eine Vielzahl von Variablen, u. a. zur Diagnosestellung, zum soziodemographischen Status, zur schulischen Situation und zum Leistungsniveau, zu somatischer Symptomatik, Therapieindikation, Störungsentwicklung und beabsichtigten Interventionen ausgewertet und Zusammenhänge mit einer begleitenden Pharmakotherapie hergestellt werden. Es zeigt sich, dass jede fünfte Verhaltenstherapie psychopharmakologisch ergänzt wird und dass dabei 80 % dieser Begleitmedikation auf Psychostimulanzien entfallen. Entsprechend erhält die Hälfte der Kinder und Jugendlichen mit einer einfachen oder kombinierten hyperkinetischen Störung eine medikamentöse Unterstützung. Patienten mit anderen Diagnosen werden hingegen nur zu einem sehr geringen Anteil auf Psychopharmaka eingestellt. Auf die Unterschiede und speziellen Merkmale zwischen der psychopharmakologisch behandelten bzw. unbehandelten ICD-10 Gruppe F 90 bzw. F 90.1 wird speziell eingegangen. Es wird diskutiert, inwieweit das beschriebene Vorgehen mit den vorhandenen Leitlinien konform ist. Also the international research does not treat this topic suffciently. For this reason this work examines on the basis from reports of requests for behavioral therapy, which medications or groups of substances were used for which child and adolescent psychiatric disorders treated by behavioral therapy. It examines additionally whether correlations of such combinations exist to specific socio-demographic or school-characteristics. Out of 1021 first and subsequent requests for behavioral therapy from the years 2001 variables were retrospectively evaluated regarding intear alia diagnosis, sociodemographic data, school situation, somatic comorbidities or therapies and therapy indication. Results reveal out of five children or adolescents one has an behavioral therapy plus an additional psychopharmacological treatment. 80 % of these medications are psychostimulants. Half of the children and adolescents suffering from ADHD or conduct disorders are treated with such, while diagnosis of other domains contribute to combined therapies only with a small percentage. Differences between non-treated and psychopharmacologically treated children and adolescents with ADHD or conduct disorders are presented. Zusammenfassung Die Leistungsfahigkeit der deutschen Kreditwirtschaft muss sich im internationalen Wettbewerb standig bewahren. Auf Basis empirisch valider Daten wird aufgezeigt, dass der deutsche Bankenmarkt effizient ist und auf dieser Grundlage gute Perspektiven im internationalen Vergleich hat. Dabei werden durch die Analyse auch „gangige“ Vorurteile widerlegt. Dies betrifft insbesondere die Thesen „overbanked“, „fragmentiert“, „overbranched“ oder „hoher Staatsanteil“. Abstract The efficiency of the the German banking market have proved successful under the global and international competition. In this article it is analysed on a valid empirical data base that the German banking market is efficient and have under the current conditions and structures very well perspectives. The study refute some general prejudices like the German banking market are overbanked and -branched, fragmented or have a too high share of public banks.
