The article in the journal for the entire criminal law science discusses the reform of arson offenses in 1998 and their development in the last 25 years. It is debated whether the reform was successful and how practice deals with norm deficits. Special attention is paid to the public danger of arson offenses, as well as the interpretation and significance of the objects of the offense. The Federal Court of Justice has not yet recognized a general possibility of reduction in cases of lack of danger, but only in specific individual cases. The Regional Court of Amberg has sentenced a defendant to a suspended sentence of one year and three months for theft. However, the court is of the opinion that the positive criminal prognosis has not been fulfilled, as the defendant started sociotherapy shortly before the trial. By taking a quantitative and qualitative approach, this article examines the surge, transformations and decline of arson crimes in the Swiss canton of Bern from 1860 to 1940, a period of rapid industrialization that brought far reaching economic, social and cultural changes. While fraudulence and revenge were dominant motives at the beginning of the period under investigation, arsonists in the early twentieth century increasingly mentioned emotional despair or insanity as reasons for their crimes. This shows that imaginaries of home, family and the self changed as modern subjectivity emerged as a dominate habitus in Swiss society. [ABSTRACT FROM AUTHOR]

The article deals with the workers’ and peasants’ uprising in Estonia in December 1905, which brought about violence and the widespread destruction of property (particularly manors and distilleries) belonging to the Baltic German estate owners – the core of the local nobility. In 1905, according to an official register, 583 manors were damaged in the Baltic provinces of the Russian empire by arson, acts of destruction and plundering, 422 of these on Latvian and 161 on Estonian territory. Of the latter, around 100 manors, i.e. roughly 10% of all Estonian manors, suffered serious damage. Estate owners were taken hostage so that they could be exchanged for imprisoned activists. Weapons, money and valuables were stolen from the manors to help build a revolutionary army to overthrow the government. The reason for this revolutionary terror was the Estonians’ national and social antagonism towards the Baltic German nobility, which, in time of weakness on the part of the government, took an irrational and destructive path and spread an atmosphere of euphoria and anarchy. In some places, the rioters also attacked governmental institutions, destroyed documents and the symbols of the empire. Due to the lack of a basic consensus in society, and because the different models of modernization were incompatible, a peaceful resolution of the violent conflict proved impossible.
