This research deciphers the European Court’s standing on the dictum of excluding illegally obtained evidence in criminal procedures. It seeks to look into judicial precedents that reveal the methodology followed by the European Court in this regard to see whether the Court has inclined to actually assess the obtained illegal evidence, or even draws any attention to it. If it is proven that the Court actually evaluates the legitimacy of this evidence and assesses its acceptance, the next question would be to assess the extent to which it does so, and whether the Court has the authority to exclude the evidence all together. The research seeks to clarify the legal controls adopted by the Court to determine the scope of its powers in this matter, whether in terms of evaluating the evidence and estimating its acceptance, or in terms of the powers to rule on the illegality of the evidence in the event of a violation of one of the rights stipulated in the European Convention on Human Rights, especially the right to a fair trial and the right to respect private life. This study answers the problem from the theoretical level to the practical one. Although the Court monitored the legitimacy of evidence and its acceptance in many cases, it did not establish a clear methodology for dealing with legitimate evidence. Despite the fact that that Court has adopted a number of criteria, the Court did not go as far as to suggest any as the dominant one, and it did not go further to suggest one of them and formulate it as a real approach to dealing with evidence. However, the jurisprudence of the European Court is replete with judicial precedents that are based on criteria and foundations that are suitable to serve as the base for the establishment of clear detailed regulations regarding the exclusion rule, but that needs a serious pause from the Court and a bold step by which the Court proceeds to take an explicit position in this regard.

إن وجود مواقع التواصل الاجتماعي في كل مكان، وفي جميع الأوقات، وحجم المعلومات الشخصية التي تحتويها هذه المواقع، يجعل منها مصدرًا خصبًا وغنيًّا للأدلة المحتملة التي يمكن أن تُستخدم في الإجراءات الجنائية. وبالنظر إلى طبيعة هذه المواقع، فإنها تثير تحديات كبيرة، يتعلَّق بعضها بالمصداقية التي تتمتع بها الأدلة المُتحصَّلة من هذه المواقع. ويعالج هذا البحث المسائل القانونية الناجمة عن استخدام الدليل المُتحصل من مواقع التواصل الاجتماعي، والآثار المترتبة على ذلك في القانونين الإنجليزي والأمريكي. كما يتناول التعريف بمواقع التواصل الاجتماعي وأهميتها في الإجراءات الجنائية. ويعالج أيضًا القضايا المُتعلِّقة بالحصول على الدليل، وقبوله، والتحقق من أصالته، إضافةً إلى المسائل الدستورية التي يثيرها الدليل المُتحصل من مواقع التواصل الاجتماعي. إن قواعد الإثباتالمطبَّقة على المعلومات المخزَّنة إلكترونيًّا ليست كافية للتعامل مع الأدلة المُتحصلة من مواقع التواصل الاجتماعي. وقد توصل البحث إلى أن القواعد التي تحكم الإثبات الجنائي في القانونين الإنجليزي والأمريكي كافية للتعامل مع هذا النوع من الأدلة، إلا أن هنالك حاجة مُلحة لوضع ضوابط تحكم بعض المسائل المهمة، وعلى الأخص التَّحقق من أصالة الدليل الذي تم الحصول عليه من مواقع التواصل الاجتماعي والمقدم في الإجراءات الجنائية. وتتطلب أنواع مختلفة من الأدلة المتحصلة من مواقع التواصل الاجتماعي مؤشرات تثبت المصداقية، ويتعيَّن على الأجهزة المختصة أن تبحث عن وسائل لجمع المعلومات من شأنها أن تؤكد المصداقية. يساعد توثيق عمليات جمع المعلومات بدقة، واستخدام برامج متطورة عند الحاجة، على عدم استبعاد الأدلة المتحصلة من هذه المواقع بدعوى عدم التحقق من مصداقيتها.

This study examines the use of Remote Sensing (RS) technology in geological studies in El Azraq area. LandSat Enhanced Thematic Mapper plus (ETM+) and Radar SAR images were used to (i) classify the various geological units found in El Azraq area located in the North-East of Jordan, (ii) discriminate the lithology and structure of this area, and (iii) delineate the associated zones of hydrothermal alteration. A wide variety of digital image processing techniques were applied such as the Principal Components (PC) analysis, ratioing and Intensity, Hue and Saturation (IHS) transformation. The color composite of Principal Components (1, 2, and 3), the ratio images (3/1, 4/3, and 5/7) and the IHS (1, 3, 5) enabled us to determine the different types of igneous rocks in the study area. A remote sensed lineament map was produced using two different methods: (i) application of directional filters and edge enhancement; and (ii) data fusion of ETM+ with SAR image. The selective PC analysis of ETM+ using bands 1, 3, 4, and 5 was used in mapping iron and iron oxide bearing minerals. The same method was also applied using bands 1, 4, 5, and 7 for hydroxyl bearing minerals detection. Finally, the hyper spectral technique was used for detecting the different minerals in the study area based on the spectral library of minerals.
