This paper focuses on the Kantian conception of a law of war, in particular on the controversial figure of the unjust enemy from the “Right of nations” of the Rechtslehre, which has given rise to Kant being considered a just war theorist by some (e.g. Carl Schmitt and B. Orend). I reject this interpretation and defend that Kant cannot be assigned this label without distorting his critical view of war, which means understanding, on the one hand, its role in the progress of humanity, and, on the other hand, to accept the veto of practical reason that prohibits it. For this purpose, I return to Howard Williams’s argument against B. Orend and try to add force to his argument by incorporating the notion of “permissive law” into the right to war when dealing with an unjust enemy. [ABSTRACT FROM AUTHOR]

A proposta de paz perpétua escrita por Kant depende do cumprimento de artigos que dirimem conflitos entre indivíduos e estados nacionais, dentre eles: a necessidade de se estabelecer uma ordem cosmopolita de hospitalidade e respeito ao próximo. A presente pesquisa reside na inquietação kantiana a respeito do direito cosmopolita entre os indivíduos no cenário multicultural sob a ótica da interculturalidade. A problemática reside em estabelecer uma ligação entre a inquietação kantiana e a complexidade da efetividade dos direitos humanos diante das diferentes culturas. Os dados coletados a partir da pesquisa bibliográfica demonstram que a atual ideia de direitos humanos necessita uma ressignificação e a superação de antigos conflitos teóricos que impedem a ressignificação da dignidade humana e, por consequência, não permite a inserção destes direitos em distintas culturas.

Uno de los sueños, anhelos o esperanzas más grandes del pensamiento general de los seres humanos, ha sido el deseo por vivir en paz. Anhelo que por su gran complejidad de realización suele categorizársele como utópico. Este artículo documental reflexivo aborda la problemática desde la convicción que presupone hablar y pensar en una paz perpetua y desenvuelve su estructura conceptual a partir de la idea del deber, concretamente, un deber aprender. Se examinarán las ideas de algunos autores de la talla de Immanuel Kant, Martin Heidegger, Max Scheler, José Ortega y Gasset, que han aportado su pensamiento a la problemática. Se concluirá afirmando que es deber de la razón aquí, hacer todo lo posible para que la vida prevalezca, anteponerse a los hechos, de este modo, a medida que la vida en sí deje de ser la victima de sí misma, la paz perpetua poco a poco se desplegará en el accionar humano como su fundamento, su forma natural de vivir, su forma natural de ser. Es responsabilidad del hombre moldear y agilizar el proceso de aprendizaje que le imparte su existencia y extraerle el conocimiento fundamental a cada experiencia para que se añada a la experiencia general humana, la cual vendría siendo su historia, de tal modo, la paz perpetua estaría garantizada.

In this article, the author examines the relationship between the integration of people and peace from the perspective of the planetary republics of the century of lights and the consolidated experiences of the United States and the European Union. The methodology use is a documentary and bibliographical review and critical analysis, through which the author discusses the evolution of integrationist ideas related to peace and to the possibilities of its universalization through public international law. Los fundamentos teológicos y teleológicos ofrecidos por Francisco de Vitoria y John Locke respectivamente para justificar el colonialismo son refutados por Kant en sus escritos tardíos. Esa refutación abre el camino a una comprensión más ambiciosa del cosmopolitismo kantiano. Este no se limita a la hospitalidad con el extranjero sino que exige respetar la igualdad de derechos, la diversidad cultural y a la autonomía política de los pueblos de la tierra como es necesario para preservar la paz mundial. Una lectura sistemática de las tesis de Kant sobre el colonialismo permiten afirmar que el suyo es un cosmopolitismo republicano y no uno de mínimos, lo que abre nuevas perspectivas a la investigación de la filosofía política, moral y jurídica kantiana.

This is a comparative study of the concept of nature in Kant and Fichte's proposals for perpetual peace. I will argue that Kant and Fichte's ideas of perpetual peace present two very different ways of dealing with nature: whereas Kant's proposal consists of administrating the natural unsociable inclinations of human beings, departing from the assumption that the unsociable sociability of men is not only inherent to human nature but also the motor of the historical progress of humanity, Fichte, on the contrary, advocates for a total repression of these inclinations, departing from the postulate that the historical progress of humanity concerns exclusively the spiritual or intelligible dimension of human existence. En las últimas décadas ha sido creciente el protagonismo del opúsculo de Kant, Hacia la paz perpetua (1795), inspirado en las reflexiones del Abbé de Saint-Pierre. Leibniz, sin embargo, no suele ser considerado entre los antecedentes políticos de las reflexiones kantianas sobre la paz perpetua. Éste trabajo pretende poner el acento en la originalidad de la aportación leibniziana, subrayando su crítica a los planteamientos del Abbé de Saint-Pierre. Para Leibniz existiría una “imposibilidad política” para establecer la “paz perpetua”; por eso, propone trascender el nivel del federalismo político y situarse en el campo de la cooperación científica donde se carezca de intereses o, mejor dicho, éstos sean universalizables, a fin de poder instaurar las garantías necesarias para una paz duradera.

El objetivo de este artículo es mostrar por qué razones la liga de naciones independientes es la interpretación más adecuada del derecho de gentes kantiano, así como la más coherente con el resto de la filosofía política kantiana. Para apoyar esta tesis, sostengo que los principios normativos que guían la construcción kantiana de una condición jurídica internacional son tanto el de la soberanía como el del respeto por los derechos de los hombres y que el primero es demandado por el segundo.The aim of this paper is to show why the league of independent nations is the most accurate interpretation of Kant's law of peoples, as well as the most coherent with the rest of his political philosophy. To back this thesis, I contend that the normative principles that guide a Kantian international rule of law are both sovereignty and human rights, and that the former is demanded by the latter.

Revisionist historians have convincingly argued that Spanish American independence was not the result of simmering grievances that galvanised a national or Creole identity against Spain. Instead, this scholarship insists that Spanish American national identities did not exist at the time and that independence was an unforeseen process that must be understood in the context of the Napoleonic invasion of Iberia. But, if independence was undesirable before 1808 and if national identities arose at a latter period, how do we explain the early independence projects of ‘precursors’ like Juan Pablo Viscardo y Guzmán? By contextually reconstructing the logic behind Viscardo's projects, this article offers a new perspective on the intellectual conditions of possibility for Spanish American independence. It argues that though he certainly identified as a Creole from Peru, Viscardo actually deployed an Enlightenment global science of commerce, not Creole patriotism or nationalism, to legitimate Spanish American independence. Trata-se de mostrar nesse ensaio a importante contribuição de Kant para a ideia moderna de república e republicanismo. Ainda hoje pouco associada ao filósofo, sempre identificada seja com a tradição liberal, seja com a tradição comunitarista (ou ainda, com um certo “republicanismo liberal”), tal noção de republicanismo é, no entanto, central no interior do kantismo. Importa, assim, mostrar o quanto essa ideia encontra-se associada à filosofia kantiana, explicitar os seus aspectos essenciais e, por fim, situar estes no projeto kantiano de uma paz perpétua, levando-se em consideração a criação de instituições políticas fundadas nos princípios do direito e no respeito à dignidade humana.

Proponents of perpetual peace have often identified politics as a problem standing in the way of peaceful relations between humans. They believed that, while politics exacerbates the differences separating nations, commerce brings human beings together. In this article, I trace the development of arguments against politics and for commerce from the late fifteenth to the early nineteenth century. I argue that thinkers espoused an idealized view of commerce as an activity that fostered the development of a peaceful international community, while gradually eliminating economic inequalities. I also highlight how these arguments still resonate with today’s debates on globalization. Os defensores da ideia de paz perpétua veem frequentemente a política como um impedimento para estabelecer relações pacíficas entre todos os seres humanos. Para eles, a política exacerba as diferenças que separam as nações, enquanto que o comércio une os seres humanos. Neste artigo, examina-se o desenvolvimento de argumentos contra a política e a favor do comércio desde finais do século xv até ao início do século xix. Demonstra-se como muitos pensadores adotaram uma visão idealizada do comércio enquanto atividade que leva à criação de uma comunidade internacional pacífica, eliminando gradualmente desigualdades económicas. Salienta-se ainda como estas questões ecoam nos debates contemporâneos sobre globalização. Les défenseurs de l’idée de la paix perpétuelle voient fréquemment la politique comme un empêchement à ce que s’établissent des relations pacifiques entre tous les êtres humains. Pour eux, la politique exacerbe les différences qui séparent les nations, alors que le commerce établit des liens entre les êtres humains. Dans cet article, nous nous penchons sur le développement d’arguments contre la politique et favorables au commerce depuis la fin du xve siècle jusqu’au début du xixe siècle. Il y est démontré comment nombre de penseurs adoptèrent une vision idéalisée du commerce en tant qu’activité menant à la création d’une communauté internationale pacifique et éliminant graduellement les inégalités économiques. Nous y soulignons aussi combien ces questions résonnent encore dans les débats contemporains sur la globalisation.
