This chapter investigates how, in response to trends in transnational migration, borders are governed through practices such as the confinement and deportation of foreign migrants and asylum seekers. In particular, the increasing prominence of camps or other restricted areas in which migrants or illegal aliens are held for varying lengths of time highlight a new distribution of power defined by access to mobility. An empirical investigation into these spaces shows how democratic governments manage non-citizen populations and examines the ways in which the types of restriction and surveillance brought to bear on these people reconfigure physical, moral, and political boundaries. Several issues shape policy on border detention: confinement, albeit in a humanitarian form; the administrative application of different standards of rights for various alien populations; the conflation of humanitarian care and control for populations identified as vulnerable; the redrawing of frontiers through networks and zones; and, lastly, the experience of mobility produced by the differential management of movement within the modern archipelagos of surveillance. Border policies frame a network within the territory, which maintains the individuals in spaces of administrative suspension (such as the ambiguous figure of the clandestine-asylum seeker) and in interdependent spaces of confinement (such as the network of border detention, administrative detention for sans-papiers and prisons). The paper sheds a light on how this device emerges, by which national borders are reactivated within the social sphere., Ce chapitre se penche sur le phénomène des migrations transnationales et sur le gouvernement des frontières qui y répond, à travers des pratiques d’enfermement et d’expulsion des étrangers en Europe. La construction des camps d’étrangers, dont relève ce champ d’investigation, témoigne de nouvelles distributions du pouvoir qui passent par l’accès à la mobilité. Une enquête empirique dans ces espaces nous invite à comprendre les pratiques par lesquelles les gouvernements démocratiques administrent des populations non-citoyennes, et la façon dont ces modalités de prise en charge et de surveillance opèrent une reconfiguration des frontières physiques, morales et politiques. Le confinement des étrangers entrecroise plusieurs dimensions : la construction d’un enfermement humanitaire, et les usages institutionnels et militants de différents régimes de droits qui y sont en jeu; les pratiques de prise en charge de populations identitées comme vulnérables; les reconfigurations de la frontière à travers de nouvelles formes réticulaires et zonales; et enfin, l’expérience de circulation que dessinent les archipels de surveillance, et les pratiques de gestion différentielle des mobilités dont participent les zones d’attente. Ces politiques de contrôle migratoire créent un réseau frontalier à l’intérieur du territoire, qui saisit les individus dans des espaces de suspension administrative (celle du« demandeur d’asile-sans papier » mis sous procédure d’asile prioritaire) et des espaces, inter-dépendants, d’enfermement (le centre de rétention administrative, la zone d’attente, la prison de droit commun). Comment se met en place ce dispositif qui réactive les frontières nationales à l’intérieur de l’espace social ?

International audience; In contexts of impunity, where conflict, state repression and the colossal challenge of taking on powerful perpetrators offer no hope for transition, how can we expect accountability to be realized? In this four-part series, a range of scholars and practitioners share their insights on the internal workings of power, truth and justice, in situations where forecasting is difficult, and conflicts are ongoing. What does justice look like outside of state-endorsed institutional processes, be they national or international? How do these truth-seeking initiatives challenge hegemonic narratives? Contributors examine contexts which tackle, head on, obstacles of impunity and denial, looking to understand how silenced but shared experiences of violence are transformed into public knowledge and acknowledgement. How and when does the fight against impunity open up an arena for action and change? This conversation builds on an international workshop, "Truth telling and truth seeking in contexts of impunity", supported by the Wenner-Gren Foundation and TEPSIS Research Programme.

At the Heart of the State argues against the idea of government institutions as the tools of politics and politicians and explores the inherent morality—or immorality—of such institutions supposedly designed for the public good. The result of a five-year investigation, conducted by ten scholars, At the Heart of the State describes and analyses the police, court systems, prisons, social services, and mental health facilities of France, analyzing the supposed neutrality of these government institutions. Combining genealogy and ethnography, the authors argue that government institutions are not simply concerned with the implementation of laws, rules, and procedures but also with the imposition of values, affects, and judgments.

Publicized in 2000 through the Women's International Tribunal on Japanese Military Sexual Slavery, civil society tribunals - also called tribunals of opinion, symbolic tribunals, peoples' tribunals, citizens' tribunals - are the most common form of prosecution projects in situations of impunity, and challenge the fundamental premise that the law is the exclusive domain of states. In response to these polemics, Chinkin advises not to judge peoples' tribunals against a "criteria of effectiveness" imagined for formal courts (2006, 219); and Dolgopol ([8]) suggests to look at the way that tribunals simultaneously and creatively challenge the instruments that form the machinery of states and multistate institutions. In this context, a people's tribunal as a transformative civil society effort is recognizable because "the tribunal represents a move to seize and redefine law itself": the law is "separated from its nation-state context and redeployed as plural, as local and global" (Merry [19], 79). Moreover, although they strictly mirror the procedures of a court or truth commission, the hearings allow for more creative, subjective forms of testimony through the time allocated to the witnesses, the spatial organization of the court, and, above all, the character and quality in the attention of both the audience and the judges. Practices of border detention in western democracies are the result of legal evolutions in modern rule of law, technical adjustment in the disciplinary management of alien populations and evolutions in the political speech on migrations, which are now commonly referred to in terms of control of stocks and flows. These changes have led the European Union in the past two decades to build its frontiers in terms of camps and to literally detain people within the borders. Indeed, the will of states to control movement of people have created contested spaces of sovereignties at their borders, populated by a "floating population" of asylum seekers and undocumented migrants. The paper will focus on these extra-territorial zones of border detention, the "waiting zones", implying national political devices for the administration of alien populations and security constructions around the notions of citizenship and frontier. Practices of border detention combine questions of sovereignty and disciplinary devices along two axes: administrative institution within a procedure of exception, and the management of alien populations in the spatial and political form of the camp. Then, the question is the following: How does a regime of exception within the law open the space for specific power relations that shape in return the political subjectivities of those confronted to them? What do such processes of subjectivation teach about evolving regimes of government within the liberal rule of law? Analyses are based on field observation in the "waiting zone" of Charles de Gaulle airport in France, but also on a set of interviews with detainees who were admitted to the French territory after facing several attempts of expulsion. By setting forth the shadowed hand-to-hand fight between detainees and guards (where the body in its biological functions is at stake), this anthropological insight help to think on how power relations are being reshaped at the borders. ..PAT.-Unpublished Manuscript [ABSTRACT FROM AUTHOR]

In western states, restrictive migration policies in the last thirty years have entailed a shift in the practices of control leading to the institution of systems of detention at the borders. Border confinement raises substantial issues about fundamental rights; it involves questions of legality and legitimacy, and the definition of new technologies of government. In France, the origins of border detention show how pre-existing administrative practices of detention were legalized through the adoption of "waiting zones", a new regime of detention, which enhanced both conditions of detention and disciplinary control over detainees. This developments confronts human rights activists opposing border detention since the mid-1970s with "paradoxical gains" and a tough dilemma: the rights that have been granted by the state to travelers held at the borders are not enough whereas legalization has opened the way for new control mechanisms. Understanding border confinement implies to analyse these paradoxes produced by constant negotiations between the administration, willing to tighten control over its borders, and concerns of certain groups within civil society, willing to defend basic rights and give legal a framework to control practices. In France, diffusion of penitentiary models of management and the ambiguity of law that the paper will explore further draw together the conditions for administrative legal exclusion processes. RésuméDans les états occidentaux, les politiques migratoires restrictives des trente dernières années ont entraîné un changement dans les pratiques de contrôle, menant à la construction d'institutions de détention aux frontières. L'incarcération aux frontières suscite un questionnement important à propos des droits fondamentaux, questions portant sur les notions de légalité et de légitimité ainsi que sur la définition des nouvelles technologies du gouvernement. En France, les origines de l'incarcération aux frontières démontrent comment des pratiques administratives préexistantes ont été légalisées à l'aide de l'adoption de « zones d'attentes », nouveau régime d'incarcération qui rehausse les conditions de détention ainsi que le contrôle disciplinaire sur les détenus. Pour les activistes qui font la revendication des droits humains et qui s'opposent à l'incarcération aux frontières depuis la seconde moitié des années 1970, ce développement représente des gains paradoxaux et un dilemme difficile : les droits accordés par l'État aux voyageurs incarcérés aux frontières ont demeurés insuffisants tandis que la légalisation a permis la création de nouveaux mécanismes de contrôle. L'étude de l'incarcération aux frontières implique une analyse des paradoxes créés par les négociations constantes entre, d'une part, une administration voulant resserrer son contrôle sur les frontières et, d'autre part, certains groupes civils dont les préoccupations incluent la défense des droits de base et l'encadrement légal des pratiques du contrôle. Les conditions des processus d'exclusion de l'administration légale sont soulignées, en France, par la diffusion des modèles de l'administration pénitentiaire et l'ambiguïté de la loi. Qu'est-ce que ces processus révèlent sur l'évolution des régimes gouvernementaux à l'intérieur de systèmes libéraux basés sur les droits?
