The Law of Beaumont, established by a charter issued in 1182, was granted over a period of about 150 years for up to 700 villages in present-day France, Belgium, Luxembourg and Germany. It seemingly was to provide incentives to settle or stay in such villages. Based on an analysis of the Latin text (provided with a German translation) the paper questions that the focus of the charter was accurately described in older literature and common handbook entries. In those, the impression is given that the focus was on liberation from serfdom, tax relief and municipal self-government. The paper concludes that a high degree of self-government was indeed an outstanding feature, although it remains unclear whether the citizens originally had the right to elect mayor and jurors. Particularly favourable tax burdens could not be substantiated. There is no mentioning at all of any liberation from serfdom and burdens associated with it. The focus of the charter is on a precise definition of tax burdens and of penalties for crimes and their distribution, and on rules of legal process. This paper investigates the complications experienced by Switzerland and Spain in administering the European Charter for Regional or Minority Languages (ECRML). This paper develops a critical normative analysis of charter schools. It categorizes and evaluates the main arguments in defense of charters: market competition, improved learning outcomes, autonomy and innovation, and their potential to function as "counterpublics." After finding each argument wanting, the paper proposes a tripartite critique of charters based on (i) their deleterious effects on social solidarity, (ii) the procedural injustice involved in access, and (iii) their substantively unjust outcomes. We show how charter schools undermine social and political solidarity by fragmenting communities into more homogenous subsets. Although they purport to be equally open to all, charters covertly rely on morally arbitrary characteristics such as class, race, and disability in admissions. Western scholarship has studied the mid-fourteenth-century cataclysm of the Black Death for centuries. In contrast, due to the limited number of contemporary narrative sources, in East Central Europe, until recently historians discussed it only marginally. In the past decades, not independent of the emergence of new methods, such as archaeogenetics and palynology, and novel approaches to studying the Black Death such as climate and environmental history, scholars have increasingly turned to the analysis of the multiple waves of the second plague pandemic in this region. Recent studies have drawn attention to the apparent lack of data on the Black Death in the region while pointing to the potential role of the later waves, such as the pestis secunda and tercia, as well as later medieval and early modern recurrences of the epidemic in the historical demography of Bohemia, Poland, and Hungary. The paper provides an overview of the written evidence of the Black Death in Hungary and publishes in extenso some of the most important documentary evidence of the episodes of the epidemic in the Kingdom of Hungary. It argues that, unlike in the case of Bohemia and Poland, the first wave of the plague can be relatively well pursued by a critical analysis of the written evidence. [ABSTRACT FROM AUTHOR]

Purpose: Interventions are essential for the management of built heritage because they extend the lifespan of buildings and enable them to be enjoyed by multiple generations. International organisations and institutions, such as UNESCO and ICOMOS, have adopted doctrinal documents over time, stimulating best practices in built heritage management worldwide. Although these documents are often referenced in academic work, they are seldom systematically researched. Which interventions are referenced or omitted? Are they defined? What trends are noted in the understanding of best practices as interventions? Design/methodology/approach: This research consists of a systematic content analysis of nine international doctrinal documents, which were selected from nearly seventy international doctrinal documents—mainly adopted by UNESCO and ICOMOS. The main aim is to reveal and compare the concepts used for reference interventions and further use the definitions to reveal and discuss the relationships between them. The trends of these interventions being used were determined based on the frequency of mentions per intervention term in the selected documents. Findings: Regarding the definition of the intervention concepts, there are three main findings. First, instead of being treated as a single concept, 'conservation' has been presented as an umbrella concept for other interventions and thus has been the most popular concept since the first version (1992) of the New Zealand Charter was implemented. In contrast, 'preservation' remains a single concept, among the highest scales, to maintain the integrity of built heritage, including use. Second, 'repair' was found to play a paradoxical role between 'restoration' and 'reconstruction', which created divergent opinions in the documents. Third, since the notions of 'use' have expanded from the functions of monuments (International Charter for the Conservation and Restoration of Monuments and Sites: The Venice Charter, 1964) to the 'associations of places' (The Burra Charter: The Australia ICOMOS Charter for Places of Cultural Significance, with associated Guidelines and Code on the Ethics of Co-existence, 1999; The Burra Charter: The Australia ICOMOS Charter for Places of Cultural Significance, 2013), which include activities, traditional habits, accessibility, etc., the complexity of mentioning different forms of 'use' has led to some (re)interventions, such as 'adaptation', 'adaptive reuse', and 'rehabilitation', being put into grey areas and used interchangeably. Due to the war against Ukraine, the European Union Temporary Protection Directive, establishing a new migration status of temporary protection, was activated for the first time. The substance of the minimum requirement for providing healthcare services in the Directive appears unclear but is supposed to correspond to human rights standards. This article analyses the standards established in the European Social Charter (revised), recognising several health-related rights. The paper clarifies the material scope of health-related rights and analyses to what extent the Charter applies to persons enjoying temporary protection. The application of health-related rights in the Charter varies depending on citizenship, whether refugee status was additionally sought, and whether a person is seen as a resident or regular worker. Controversy is intensifying with the rapid spread of charter schools and their domination of the education reform agenda. As charter enrolment increases in the USA, inequities in education worsen. This article contributes to the debate on contemporary education policy by critically examining charter issues from the US literature and stakeholder data. We add insights to research on charter controversy from public discourse and stakeholder groups. Our narrative animates pros and cons in the charter debate through stakeholders' eyes, in effect contributing voices from the field. A case study of a public charter school in Virginia provides a revealing prism for understanding charter schools. Content analysis was performed on data from nine interviews held during the pandemic with founding members (parents, etc.). As found, the charter narrative of success and struggle around public perception, racial equity, segregation, funding, approval, effectiveness, and accreditation was a school story. Charter policy effects on social groups – parents, teachers, community members, and leaders – in their association with the charter's evolution were identifiable. The conflicting views resonate with polarising tensions nationwide. Regarding international implications of the analysis, the move to privatise and reform public education through independent schools with autonomy continues to impact European countries. This article explores the question of land entitlement in Lesotho in relation to the right to development enshrined in the African Charter. The Charter guarantees that the right to development is to be achieved with due regard to 'the equal enjoyment of the common heritage'. The article argues that land is a common heritage, which ought to be utilised in a manner that meets a people's collective aspirations for socioeconomic and cultural development. The article enquires how and to what extent the statutory and customary law regimes in Lesotho guarantee entitlement to the land as a common heritage, from the standpoint of law. Shipping is a highly cyclical, volatile, and unpredictable industry. In recent history, economic shocks like the COVID-19 pandemic have heavily disrupted supply chains and tested the resilience and adaptability of shipping lines from both operational and financial perspectives. Therefore, the commercial success of shipping lines is increasingly determined by an optimal balance between reliable logistics operations and financial performance. Given this, chartering strategies of shipping lines are pivotal in achieving fleet optimisation and financial sustainability. Using a Mann–Whitney U test and a data envelopment analysis (DEA), this study provides a view on chartering strategies and efficiency levels of shipping lines in response to the COVID-19 pandemic. The findings reveal that chartering strategies have changed considerably since 2020 and that most shipping lines have pursued a peculiar strategy with a different mix in terms of chartered vessels' size, age, and period of charter. Shipping lines which showed the most marked differences in chartering strategies also yielded higher efficiency scores under DEA, whereas those that did not sustain large changes scored lower in terms of efficiency. This study provides significant insights on and managerial guidance for understanding and benchmarking chartering strategies and their impact on efficiency gains. Films and texts differ in terms of their possible logical structures and freedom of presentation on an output medium. While texts can be structured at any depth, the capabilities for structuring films are generally limited. In the presentation of textual documents, the sentence order is usually preserved, whereas video documents often allow rearrangements that lead to new alternations of shots. The fundamental difference between textual and video structures is taken as a starting point. Then, based on a detailed analysis of two different layouts of the film The Sunbeam by D. W. Griffith, a formal criterion for distinguishing between internal, discursively motivated and external, diegetically motivated alternations is developed. Departing from mainstream accounts of the post-Katrina New Orleans state takeover and the more recent "unification" of schools under local governance, this case study utilizes the plantation (Hartman, 1997; Woods, 1998, McKittrick, 2011) as a theoretical device and the silenced archive (Trouillot, 2015) as a method of inquiry to better understand why and how a Black public high school was obliterated. Data analysis indicates that despite the takeover and the damning of John McDonogh Senior High, this school was a lynchpin of struggle for democratic public schooling. Additionally, findings suggest that the charter school movement deployed community engagement, an evolving technology, to obliterate a collective vision that fell beyond the parameters of "choice." In closing, the article points to an absence of empirical evidence on the all-charter structure, the ever-present use of the city as a laboratory for restructuring efforts elsewhere, and a pressing need for building and sustaining researchers who are accountable to African American communities in New Orleans. SYNOPSIS: Although South Africa's Apartheid system legally ended with the advent of democracy in 1994, by 2021 only 15 percent of chartered accountants were Black. This is despite the fact that 80 percent of the South African population is Black. We examine this underrepresentation through interviews with 22 Black South Africans who earned their chartered accountancy certification in the second decade of the 21st century. This study reveals the similarities and differences between the experiences of those we interviewed and those who initially broke into the profession in the 20th century (see Hammond, Clayton, and Arnold 2009). In both eras, entry to the field was constricted by professional closure. While the officially mandated educational and employment barriers that previous generations faced have been dismantled, Black aspirants continue to face immense barriers to entering the profession. Charter school authorizers shape which charter schools open, where they open, and who they serve. We draw on principal agent theory to investigate how the priorities and practices of nine authorizers intersected with charter school applications' attention to the needs of historically marginalized students. Using data from interviews and applications, we find authorizers vary in orientations toward equity and the ways in which they signal that orientation to charter applicants. Our analysis suggests a robust relationship between authorizer mission and the content found in charter applications, demonstrating the influence of authorizing practices on the contents of charter school applications. The article discusses the ranking of charter schools in the U.S. based on student performance in reading and mathematics on the National Assessment of Educational Progress (NAEP). Topics discussed include the assessment of state-level achievement, the top ranking states based on charter-school student achievement which include Alaska, Colorado and Massachusetts, and the gap in the test scores between Black and white charter-school students.

The article scrutinizes the ex-post constitutional compatibility with the autonomy of the EU legal order of the Investor to State Dispute Settlement (ISDS) mechanism established in Article 26 of the Energy Charter Treaty (ECT). Whereas the compatibility of intra-EU aspects of ECT arbitration is examined primarily in the light of the EU Court of Justice’s (CJEU) Achmea and Komstroy judgments, the compatibility of its extra-EU aspects is examined primarily in the light of its Opinion 1/17. Since those Court decisions are indeed in line with the previous case-law, the article does not need to delve into earlier case-law. Although the issue is analysed from the standpoint of EU law, awards of the arbitral tribunals before which the ECT is invoked have been taken into consideration especially to ascertain whether the CJEU’s concerns for preserving the autonomy of the EU legal order against any possible legal effects of these awards were justified. The article also analyses the principal options to remedy the incompatibility of the ISDS mechanism under the ECT with the autonomy of the EU legal order. [ABSTRACT FROM AUTHOR]
