3. Substate Federalism and Fracking Policies: Does State Regulatory Authority Trump Local Land Use Autonomy?

State officials responsible for the regulation of hydraulic fracturing (fracking) operations used in the production of oil and gas resources will inevitably confront a key policy issue; that is, to what extent can statewide regulations be developed without reducing land use autonomy typically exercised by local officials? Most state regulators have historically recognized the economic importance of industry jobs and favor the adoption of uniform regulatory requirements even if these rules preempt local policymaking authority. Conversely, many local officials seek to preserve land use autonomy to provide a greater measure of protection for public health and environmental quality goals. This paper examines how public officials in three states--Colorado, Pennsylvania, and Texas--address the question of state control versus local autonomy through their efforts to shape fracking policy decisions. While local officials within Texas have succeeded in developing fracking ordinances with relatively little interference from state regulators, Colorado and Pennsylvania have adopted a tougher policy stance favoring the retention of preemptive oil and gas statutes. Key factors that account for between state differences in fracking policy decisions include the strength of home rule provisions, gubernatorial involvement, and the degree of local experience with industrial economic activities. 4. Constitutional Obligations for Public Education. 50-State Review

- Abstract
Within the constitution of each of the 50 states, there is language that mandates the creation of a public education system. The authority for public education falls to states because of a 1973 Supreme Court case which determined that the federal government has no responsibility to provide systems of public education. These constitutional education provisions vary from state to state, with some states specifically laying out the foundation of their education system while others leave the details to the legislature. Because some state constitutions date back centuries, constitutions can contain outdated language, which can decrease the relevance of the constitution to current-day policy issues. State constitutions vary on whether they include language about public school funding, religious restrictions, the education of disabled students, the age of students, the duration of the school year, and the establishment of state higher education systems. The table in this paper provides a 50-state overview of the constitutional foundation for public education in each state. It includes the location of the foundational language, which is hyperlinked to that section in the constitution. Additionally, the table looks at whether the constitution includes language on the following topics: (1) public school funding; (2) religious restrictions; (3) the education of disabled students; (4) the age of students; (5) the duration of the school year; and (6) the establishment of state higher education systems. 6. A Comparison of State Alternative Education Accountability Policies and Frameworks

- Abstract
The purpose of this policy study was to report descriptive research on state-level policy and frameworks for accountability systems of alternative education in the United States. The six states; California, Colorado, Texas, Florida, Oklahoma, and North Carolina; identified in the 2010 Jobs for the Futures policy analysis of alternative education comprised the purposive sample. Data was gathered from specified webpages and clarification with staff at state departments of education and Oklahoma's statewide evaluation of alternative education. Findings summarize the categories used for defining "at/high risk" students and describe each state framework for alternative education accountability. Pie charts of 2011 state labeling show results in states where data was available. A comparison matrix provides access to information on alternative education accountability policy and frameworks. This preliminary research provides information to inform state-level policy as decisions are made regarding alternative education accountability. Further research is needed to provide additional context through longitudinal analysis of state alternative education accountability labels. (Contains 8 figures and 1 footnote.)

10. The single-stream trend continues.

The article presents various reports on single-stream facilities in the United States. The Alpine Waste and Recycling unveiled its first single-stream recycling facility in Denver, Colorado. The facility is capable of processing roughly 10, 000 tons of cardboard, newspaper, magazines, office paper, glass, plastic, aluminum and steel per month. The Mid America Recycling Co. opened its newest single-stream facility in Garland, Dallas, Texas. The facility includes a single-stream processing system that features an optical sorting technology capable of processing residential recyclables at a rate of 25 tons per hour. The Carleton College in Northfield, Minnesota reports that its liberal arts college has implemented a new single-stream recycling and campus-wide composting program.
