This contribution reports on an ongoing study into the impact of the COVID pandemic on the rights of vulnerable litigants in the handling of court cases concerning supervision orders and custodial placements of juveniles. The research is based on interviews with judges, lawyers and other professionals in the youth protection chain and a survey among litigants. The central question is whether the handling of these cases should be considered acceptable from the perspective of procedural and fundamental rights. In addition, the procedural justice experienced by litigants is examined. The preliminary results, based on desk research and interviews, is that of varyingly successful improvisations with telephone and digital hearings, in which procedural and fundamental rights could not be fully realized. This is mainly due to technical problems and the complexity of judicial case management under these circumstances. The interviewees differed about whether the bottom of what is acceptable was reached and how often this was the case. The final report will take stock of this and draw lessons for the future.

This quantitative empirical research project describes how notaries evaluate disciplinary jurisdiction. Findings show that perceived procedural justice matters for notaries’ trust in the disciplinary jurisdiction of their cases. For example, those respondents who had been involved in a disciplinary case themselves, rated the disciplinary judge with a 5.3 on a 10-point scale when procedural justice was perceived by them to be relatively low. In contrast, when respondents who had been involved in a disciplinary case perceived procedural justice to be relatively high they rated the disciplinary judge with 7.6 on the same 10-point scale. This suggests that perceived procedural justice matters among an interesting type of professionals (notaries) who are involved in an interesting procedure in their profession (a disciplinary evaluation of their professional handling) in which important decisions are made. The current paper can contribute to the development of a barometer of notary disciplinary law.

Dit artikel reflecteert op de stand van zaken waar het gaat om de behartiging van het milieubelang door middel van het privaatrecht. Een dergelijke reflectie begint in het verleden: hoe zijn wij gekomen waar wij nu zijn? En strekt zich uit naar de toekomst: welke ontwikkeling is te verwachten en wat is wenselijk? In deze bijdrage staan deze vragen centraal. Daarbij ligt de focus op civiele vorderingen tegen de overheid gericht op wijziging van beleid of regelgeving, omdat deze in strategische zin vooralsnog de grootste betekenis toekomen.

De vraag of de rechter voldoende toegankelijk is voor alle groepen burgers krijgt veel aandacht in de politiek en ook de rechtbanken streven naar verbetering van de eerstelijnsrechtspraak op dit punt. In deze bijdrage verkennen wij de toegang tot de eerstelijnsrechtspraak in de ons omringende landen. Hoe verhoudt de toegang in Nederland zich tot de situatie in deze landen en wat kan daarvan worden geleerd?

Four phases of the Corona crisis are distinguished: a first acute phase, the gradual transition to a new normal, the economic downturn and the long run. The article describes what happened in the courts in the first and in the beginning of the second phase, and what is subsequently likely to happen. In the acute phase the court buildings shut down, and adjudication came largely to a halt. The courts were late in opening up, and as a result backlogs of, in particular, criminal cases increased. The courts extended their use of digital tools (e.g. tele-hearings) that, while allowing cases to proceed, did not fully protect the rights of parties. While so far the volume of commercial cases and bankruptcies has not increased, a (rapid) increase is inevitable. Contract breach will be wide spread, and will give rise to fundamental legal issues. For economic recovery it is essential that the courts give clear and consistent guidance in these matters quickly. This requires the courts to reduce the currently long duration of civil cases, and to use the available procedures to get expeditious decisions of the Supreme Court. The courts will also need to develop their ICT-instruments rapidly to guarantee the rights of parties. After a difficult first phase, the courts now face the challenge to effectively guide society through the Corona crisis and its aftermath, and thereby play its role in the trias politica.

De beleidsbrief van minister Dekker heeft de vraag naar de rechtsstatelijke waarborgen die de diverse vormen en aanbieders van ADR bieden nog relevanter gemaakt dan deze al was. In dit artikel wordt niet geconcludeerd dat er al grote misstanden plaatsvinden. Ook wordt niet gepleit voor een intensieve overheidsbemoeienis met de zich in de komende jaren verder ontwikkelende markt voor geschiloplossing. Wel wordt verwacht dat er een duidelijke visie wordt ontwikkeld over de rol die de overheid zou moeten hebben en dat de overheid de vinger aan de pols houdt. In deze bijdrage geven de auteurs een aanzet voor deze visie en doen een oproep tot discussie

De verwikkelingen rond e-Court hebben wel iets weg van een realitysoap. Sinds de oprichting ervan in 2010 is er vrijwel steeds veel gedoe rond het bedrijf. Dat gedoe bereikte begin dit jaar een voorlopig hoogtepunt. Er was sprake van een heus mediastormpje over alles wat er mis was (en is) met e-Court en waarbij termen als ‘robotrechter’ en ‘een groot en niet transparant zwart gat’ werden gebruikt. Het resultaat is een onvervalste cliffhanger. E-Court lijkt op het ogenblik geheel stil te liggen en het is nog maar de vraag of de digitale machinerie weer op gang zal kunnen worden gebracht. Zit er een volgend seizoen voor de serie in of is e-Court uitgegleden over de zeep die zij zelf produceerde en ligt zij nu uitgeteld op de grond? In deze bijdrage zal ik een poging doen om een begin van een antwoord te geven. Maar om dat te kunnen doen, moet uiteraard worden toegelicht wat de werkwijze van e-Court nu eigenlijk is en moet eerst kort worden beschreven wat aan de huidige onrust voorafging.

Het notariële tuchtrecht is van wezenlijk belang voor het notariaat. Het is niet alleen de weerslag van de notariële beroeps- en gedragsregels, het weerspiegelt ook het maatschappelijk verwachtingspatroon ten aanzien van het notariaat. Uitspraken in tuchtrechtprocedures kunnen een forse invloed op de praktijk van alledag hebben. Tuchtrecht is immers mede bedoeld om het professionele gedrag te sturen

In deze bijdrage wordt ingegaan op de mate van autonomie van kinderen met betrekking tot het geven van geïnformeerde toestemming voor een geneeskundige behandeling. Dit vraagstuk wordt bekeken vanuit rechtsvergelijkend perspectief. In Nederland zijn aan de bevoegdheid om toestemming te geven strakke leeftijdsgrenzen gekoppeld, terwijl in België van geval tot geval bekeken wordt of de minderjarige patiënt bekwaam is om toestemming te geven voor de medische behandeling. De auteur weegt in dit artikel de twee systemen tegen elkaar af vanuit het perspectief van het kind en bekijkt in hoeverre de beide stelsels oog hebben voor de autonomie van minderjarigen.

Deze bijdrage biedt een overzicht van publicaties op het terrein van internationaal familierecht die in de periode van oktober 2017 tot en met september 2018 zijn verschenen.

Om de kwaliteit van de rechtspraak op peil te kunnen houden, moeten voldoende talentvolle juristen ook in de toekomst de weg naar het rechterschap weten te vinden. Hier lijkt het momenteel aan te schorten. Vanwege het grote belang van een goede rechterlijke macht voor rechtsstaat en samenleving en het functioneren van de juridische sector, is brede actie geboden.

Na jarenlange inleidende schermutselingen komt de invoering van een class action nu echt dichterbij. Het instrument is bedoeld als stok achter de deur om de collectieve afwikkeling van massaschade effectiever te maken. Het wetsvoorstel dat hiertoe strekt probeert tegelijkertijd de mogelijke negatieve effecten tegen te gaan door strikte voorwaarden aan het gebruik ervan te verbinden. In deze bijdrage wordt een eerste indruk van het wetsvoorstel gegeven. Daarbij staat de vraag voorop of die voorwaarden niet onnodig ten koste gaan van de effectiviteit van de civiele collectieve actie zoals die al jaren met veel succes in praktijk wordt gebracht. Verwordt de stok achter de deur zo niet tot een keurslijf dat juist aan het opkomen voor rechten en belangen in de weg zal staan?

Recent onderzoek wijst uit dat het met de waarborgen die claimorganisaties bieden voor goede belangenbehartiging niet goed is gesteld. De naleving van de daarvoor opgestelde Claimcode schiet nog sterk tekort. Het ziet er naar uit dat de wetgever de toegang tot de rechter voor deze organisaties fors gaat beperken. In deze bijdrage wijzen wij erop dat hierdoor een handhavingstekort aan de kant van consumenten dreigt te ontstaan. Hieraan kan worden tegemoetgekomen door toezichthouders een actievere rol te laten spelen bij de afwikkeling van collectieve consumentenclaims. De wettelijke basis is er al, maar leidt een sluimerend bestaan. Het is tijd om deze schone slaapsters te wekken.

Sportschoenen, benzine, koffie, smartphones. Veel van onze dagelijkse producten worden geproduceerd in het buitenland. Soms onder omstandigheden die wij hier in Nederland niet acceptabel zouden vinden. Dit roept ethische, politieke én juridische vragen op. Hoe ver reikt de maatschappelijke verantwoordelijkheid van Westerse ondernemingen die deze producten, veelal tegen lage kosten, laten produceren in minder ontwikkelde gastlanden en hier op de markt brengen? Rust er op hen een zorgplicht om te voorkomen dat hun eigen activiteiten, of die van hun lokale dochtermaatschappijen of toeleveranciers, resulteren in schade aan mens en milieu in de betreffende gastlanden? En als zulke schade ontstaat, kunnen deze internationaal opererende ondernemingen daarvoor dan in hun Westerse thuislanden aansprakelijk gesteld worden? In dit rapport wordt verslag gedaan van een onderzoek naar zorgplichten van Nederlandse internationaal opererende ondernemingen inzake IMVO. Gekeken is naar relevante Nederlandse regelgeving en rechtspraak op het gebied van het ondernemingsrecht, het civiele aansprakelijkheidsrecht en het strafrecht. Daarnaast is bekeken hoe deze juridische status quo zich verhoudt tot de UN Guiding Principles en tot de stand van zaken in de ons omringende landen, alsook wat de invloed is van IMVO-gerelateerde regelgeving en rechtspraak op het vestigingsklimaat in die landen.

De beslechting van internationale handelsgeschillen wordt steeds meer een onderdeel van ‘The Global Marketplace’. De laatste jaren snoepen in deze zaken gespecialiseerde ‘commercial courts’ marktaandeel af van de ‘gewone’ civiele rechter. Met het initiatief tot de oprichting van een Netherlands Commercial Court, met gespecialiseerde rechters en Engels als procestaal, tracht de Nederlandse rechtspraak aan deze ontwikkeling enig tegenspel te bieden. Zal dit initiatief stand kunnen houden in het internationale geweld?

Sinds 1 juli 2012 kan de civiele feitenrechter gedurende een procedure een prejudiciële vraag voorleggen aan de Hoge Raad, om vervolgens, na beantwoording van die vraag, de onderliggende procedure verder af te kunnen ronden. De regeling heeft als doel een bijdrage te leveren aan de (tijdige) rechtsvorming door de civiele kamer van de Hoge Raad. In deze bijdrage wordt deze regeling geëvalueerd en maken wij tussentijds de balans op: bereikt de wet haar doel?

Cross-border division of companies with limited liability Cross-border division of companies with limited liability is the legal act pursuant to which a company, governed by the law of a state, divides – by legal division – as a consequence of which: (i) assets and liabilities of the dividing company transfer under universal title of succession by operation of law to one or more acquiring companies, that is (or are) governed by the law of another state; and (ii) the shareholders of the dividing company become shareholders of the acquiring company or companies. The acquiring company or companies may already exist prior to the division or can be newly formed in the framework of the cross-border division. The dividing company ceases to exist in the framework of the cross-border division (a “full division”) or continues to exist (a “partial division”). The law of the EU, as it stands, does not explicitly provide for written legislation on cross-border division. Only a few Member States of the EU drew up legislation on cross-border divisions. However, cross-border division is possible on the basis of the freedom of establishment (section 49 and section 54 Treaty on the Functioning of the EU (“TFEU”)). The Court of Justice of the EC/EU confirmed that company transformation operations constitute particular methods of exercising the freedom of establishment. Also cross-border division falls within that scope. The freedom of establishment has a wide scope: it is applicable to all kind of companies that fall within the scope of section 54 TFEU and is applicable to all kind of corporate restructuring methods that are allowed under the national laws of the Member States of the EU. Although the scope of the freedom of establishment is wide, the freedom of establishment cannot “introduce” the possibility of cross-border division for companies that cannot be involved in a national division under the laws of a Member State of the EU. As to the conflict of laws with respect to cross-border division, a “distinctive cumulative approach” should be followed: the laws applicable to the companies involved in the cross-border division will both be applied, but a distinction has to be made between certain parts of the cross-border division and the procedure upon cross-border division. Applying this “distinctive cumulative approach” results in a balanced application of the law applicable to the dividing company on the one hand and the law applicable to the acquiring company on the other hand: if the application of the law of one Member State is sufficient, only the rules of the law of that Member State will be applied, but if the application of the laws of both Member States involved is necessary, then the laws of both Member States must be applied. Although cross-border division is already possible, the EU legislator should draw up legislation on cross-border division. That will help companies to benefit from the internal market of the EU and will also improve the proper functioning of the internal market of the EU.

Op tal van terreinen legt de overheid verplichtingen op aan organisaties om informatie te verstrekken aan klanten, werknemers of derden. Deze zogenaamde informatieplicht is een juridisch instrument ten behoeve van de bescherming van een zwakkere partij en moet die partij in staat stellen om geïnformeerde, adequate keuzes te maken. De informatieplicht kan worden vormgegeven door middel van het publiekrecht en het privaatrecht. In de financiële sector bestaan beide typen zorgplichten naast elkaar.

Ontbinding, bankgarantie, boetebeding In de huurovereenkomst tussen eisers als verhuurders en Amsterdam Horeca Holding B.V. (hierna AHH) als huurder was vastgesteld dat nog geen bankgarantie of waarborgsom was gesteld. Daarbij was bepaald dat het stellen van een bankgarantie of waarborgsom voor de ingebruikname van het gehuurde moest plaatsvinden en dat dit een voorwaarde was voor het verschaffen van het huurgenot. In weerwil van deze bepaling lijkt AHH de winkelruimte vervolgens in gebruik te hebben genomen zonder een bankgarantie te stellen (of andere zekerheid te verschaffen). Eisers vorderen daarop in onderhavige procedure primair ontbinding van de huurovereenkomst wegens het niet stellen van de bankgarantie, en subsidiair het alsnog stellen van de bankgarantie. Daarnaast vorderen eisers betaling van de contractuele boete op grond van de toepasselijke algemene bepalingen. De huurder verschijnt niet in de procedure. Niettemin wijst de kantonrechter bij verstek de primaire vordering tot ontbinding en de vordering tot betaling van de boete af. De subsidiaire vordering tot het alsnog stellen van de bankgarantie wordt wel toegewezen, waarbij de kantonrechter echter opmerkt dat deze vordering niet afdwingbaar is nu geen betaling van het betreffende bedrag als waarborgsom en ook geen dwangsom is gevorderd. Mede daarom oordeelt de kantonrechter dat ook de proceskosten van eisers voor hun rekening moeten blijven.

Avonturen in de effectenlease liepen slecht af als gevolg van een samenloop van omstandigheden, waaronder een te gretig winstoogmerk aan de zijde van de financiële aanbieder en een te grote lichtvaardigheid aan de zijde van de afnemende consument. In deze bijdrage wordt de (inmiddels gestandaardiseerde) schadedeling onder de loep genomen die in de rechtspraak is gevolgd op de erkenning van de wederzijdse verantwoordelijkheid in dezen.

Ons aansprakelijkheidsrecht wordt gevormd in de dagelijkse juridische praktijk. Het is belangrijk te beseffen dat in die praktijk de partijen, advocaten en rechters bloot staan aan diverse psychologische invloeden, zoals het ‘anchoring effect’. En dus is er alle reden om meer te willen weten over mogelijke verbanden tussen (privaat)recht en psychologie.

From the turn of the century on, the term social company (maatschappelijke onderneming) came into use for private organizations which serve the public interest, for example education, health care and council housing. In 2009 a bill was put forward, which proposed a special legal form for social companies. This legal form would be a modality of the association (vereniging) or the foundation (stichting). The bill has been withdrawn before coming up for discussion by the parliament. The prehistory of the bill is being described and the bill is being analysed. From this analysis six bottlenecks emerged. The characteristics which distinguish social companies from other companies are investigated. This distinction displays a social interest laid down by statute, which is served by the legal personality, and the compulsory presence of a supervising body. To social companies it is of vital importance to publicly give account for its actions and to make this public. The distribution of profit to financiers is on the merits not contrary to the nature of the social company. There are no clear parallels of the Dutch legal history found. Instead there are more recent examples of forms of capital stock companies which are oriented towards social interests. The forgoing bottlenecks are evaluated with the help of the conclusions of the research. To conclude an outline containing a statutory regulation is given, based on criteria of functionality, at which the social company will be a modality of the N.V. or B.V.. With this the need of social companies to be recognized as such is being fulfilled. Moreover, a generic legal framework is created which can reduce the demands for sector specific regulations both in laws and in governance codes.

In dit inleidende hoofdstuk wordt een aantal algemene kwesties uiteengezet. We bespreken wat civilologie wat ons betreft is, schenken enige aandacht aan de doelstelling en relevantie van zowel dit boek als die civilologie, gaan iets naderin op ‘de definitie’ van gedragspresumptie en gedragseffect, bespreken de verdere indeling van dit boek en bieden een eerste methodologische verantwoording bij de bijdragen.

This research focuses on the development of the profession of the judicial officer (or bailiff) and the impact of these developments on their education. The Dutch judicial officer developed from humble servant to self-conscious professional. This independence of the profession is visible in the Gerechtsdeurwaarderswet (2001). The judicial officer is considered to be an independent professional with private liability, which has no connection to the court, but works as an independent professional with its own profession. The judicial officer is a practically oriented legal professional. His profession is regulated by law (Gerechtsdeurwaarderswet), and has its own public organization since 2001, the ‘Koninklijke Beroepsorganisatie voor Gerechtsdeurwaarders (KBvG)’. Judicial officers are also subject to disciplinary law with both professional and behavioral rules. A judicial officer has specialized knowledge and expertise. He is an expert in seizure law and serving summonses. The judicial officers also have an autonomous and responsible position. They have a monopoly position on the issue of summons, and enforcement law, and thus exert government coercion. The judicial officer aims for the realization of values. In a constitutional state they act as gatekeepers of civil procedure (through issuing subpoenas) and the enforcement of court judgments. He acts from an independent position from which he represents both the interests of the creditors and of the debtors. The legal practice was first isolated from the market to protect the objectivity and to assume social responsibility, but the law of 2001 introduced liberalization: the release of rates for clients and the letting go of the district boundaries. Several published commentaries and interviews clearly show that introduction of market forces has had an profound effect on the daily work of the judicial officer. 1. The relationship between the judicial officers changed. They became competitors rather than colleagues. 2. The relationship with clients changed. The clients of judicial officers also increased their scale, making major clients increasingly powerful. Interviewees spoke about working below cost and for them risky constructions of pre-financing. They also confirmed the existence of no-cure-no-pay contracts and other performance based agreements. Almost all interviewees indicated that the commercialization increasingly entailed risks for the judicial officer. 3. The relationship with the debtors changed. It resulted in less attention to the debtor. The current self-image is hardly determined by an ethical dimension and the collegiate organization. The public interest is thus served less, and their own moral identity disappears. The interviews with the (candidate) judicial officers and other stakeholders confirm this. In this context it is of great importance for the education of candidate-judicial officers to focus on the core values, because due to market forces, de focus on values has decreased and sometimes even appears to disappear. It also shows that a reinforcement of profession ethics is required in to maintain the core values of the profession in a market driven environment. Even the European statute mentions the importance of a high standard of professionalism and ethical values. The core values of the judicial officer are responsibility, independence, objective and integrity.

The Dutch provisions on prejudgment attachment are special in the sense that they have a liberal character. This means that – compared to similar provisions in other countries– obtaining leave to impose attachment for a claim that has not yet been established by law is relatively simple. Prejudgment attachment is characterized by an inherent conflict of interests of the attaching party (who wants to secure his claim, pending a decision by the court) and the attachee (in being able to dispose of his assets without hindrance and in being protected from unlawful attachment). Prejudgment attachment can have far-reaching consequences for the attachee. The subject of this study is the balance of the Dutch system of prejudgment attachment and that of the proposal for European bank attachment.

Dutch schools have a duty of care to their pupils. Breaches of this duty of care may result in a school being liable if a pupil suffers harm as a consequence. This duty of care is the focus of this book, which aims to offer academics and professionals insight, guidance and tools to achieve more clarity on the scope of the duty of care and its desirable uniform assessment. This may enable schools to take preventive measures and adapt their policies and behaviour. It may also contribute to consistency in legal practice in relation to the legal assessment of that duty of care. After a brief description of the law of education and the historical background of the school’s duty of care in Chapters 2 and 3, Chapter 4 presents a general description of the duty of care of schools, in an attempt to determine the legal basis and basic principles. Thereafter, a concrete analysis is presented for the following four categories: accidents (ongevallen; Chapter 5), physical education and sports practice (bewegingsonderwijs en sportbeoefening; Chapter 6), bullying, abuse and violence (pesten, misbruik en geweld; Chapter 7) and finally, the quality of education (kwaliteit van het onderwijs; Chapter 8).

As is shown by the asbestos problem, the legislator and the courts still mainly operate ex post. An important question therefore is how the law can deal with the regulation of new health risks in the future and thus, how an adequate balance between the precedence of economic interests and the precedence of social health and safety can be determined ex ante, in order to prevent new social health problems, and a new booming of tort law, from arising. In this respect it is important to stress that he causation of damage, even of foreseeable damage, as such is not wrongful. The causation of foreseeable damage only becomes wrongful, if insufficient precautions were taken. The question then is: how much precaution is required and, more specifically, what is the criterion to determine how much precaution is required in a concrete case? In my view, an answer to this question must predominantly consist of the separation of the regulation issue (including the enforcement of regulatory measures) and the compensation issue, so that both questions are no longer interlinked. The asbestos jurisprudence has shown that tort law apparently is flexible enough, given new or changing external developments or bottlenecks, to generate new solutions for damage problems that would be out of its reach when applying regular tort law, but also that the degree to which tort law is allowed room to develop such solutions and thus move outside its own parameters, strongly depends on the presence and of scope of other compensation mechanisms (e.g. social security). The existence of social security can temper the development of a social compensation issue. In order to retain the rationality and realism of tort law and social security law, regulators should therefore be prepared to formulate new answers in order to deal with new social risks (viz. the answer of the industrial accident and occupational disease insurance at the beginning of the last century in order to deal with the old social risks), with an eye to exercising a tempering influence on the use of tort law

Wrakingsverzoeken worden steeds vaker ingediend, maar níet vaker gehonoreerd. Dit suggereert dat het middel ‘oneigenlijk’ wordt ingezet. De effectiviteit van de regeling komt echter onder druk te staan als miskend wordt dat deze een correctiemechanisme is voor uitzonderlijke gevallen. Oneigenlijk gebruik knaagt derhalve aan de fundamenten van onze rechtspleging. Auteurs maken een rechtsvergelijkende analyse van de wrakingsprocedures in een tiental andere rechtsstelsels als inspiratie ter verbetering van het eigen recht. Uit deze analyse vloeien een aantal aanbevelingen voort met betrekking tot mogelijke contouren voor een aangepaste Nederlandse regeling. De contouren van deze nieuwe wrakingsregeling bevatten aan de ene kant prikkels om het oneigenlijk gebruik te temperen terwijl tegelijkertijd de legitimiteit van het instrument, en daarmee het maatschappelijk draagvlak, wordt vergroot. The number of cases in which Dutch judges are challenged is growing, but the number of disqualifications remains the same. This implies an increasing misuse of this instrument, which is meant to provide a correction mechanism in exceptional cases of compromised judicial impartiality only. The question has been raised whether the Dutch procedural rules concerning disqualification of judges should be reconsidered in view of this new reality. This article reports the findings of a legal comparative analysis of disqualification procedures in ten other legal systems, and on that basis provides a number of recommendations for a new procedure for disqualification of judges in the Netherlands.

This PhD thesis focuses on how Dutch liability and damages law can contribute to the enforcement of ECHR rights, assuming as a starting point that liability and damages law should be constitutionalised. In other words, the question is how ECHR rights should be enforced through liability and damages law. The answer to this central research question needs reference to the nature of liability and damages law and the nature of ECHR law. There are five key themes that support the description of the nature of both sets of regulations. These themes are the basic principles, the basis, the legal rule, the criteria, and enforcement. The comparison between ECHR law and liability and damages law as it currently stands has resulted in the first part of the conclusion, which is that we should not look for the solution regarding the enforcement of fundamental rights in the liability for unlawful acts law only. An important point in the comparison is the observation that the bases in the two sets of regulations are essentially different. Liability and damages law, on the one hand, is based on the basic principles of to live honestly, not to injure another, to give to each one that which belongs to him and each shall bear his own damage. The basic principles reveal that harm is a core element in liability and damages law as it is currently structured. ECHR law, on the other hand, is based on the basic principles of human dignity and fundamental freedom. These basic principles have made ECHR law a system that aims to prevent rights violations and, where no longer possible, to sanction violations. Protection of fundamental interests is therefore the core element. Current liability and damages law, as opposed to ECHR law, more specifically aims to remedy an unfair situation which consists of harm caused by the disadvantaging party on the disadvantaged party, through the property of the disadvantaged party and the disadvantaging party. Harm and the correlative relationship between disadvantaged and disadvantaging party are therefore the core elements. The comparison of the nature of liability and damages law and the nature of ECHR law, and also the approaches - found in the foreign legal systems as studied – that serve to interconnect the ECHR and liability and damages law, have resulted in a conclusion in two parts. The first part of this conclusion states that we should not look for the solution regarding the enforcement of fundamental rights in the liability for unlawful acts law only, a conclusion that cannot be read without the second part of the two-part answer, which is that a new basis in liability law - in addition to the unlawful act - can be used more directly and more specifically geared towards ECHR rights in order to enforce ECHR rights. The author believes that the nature of fundamental rights justifies a new basis in liability law in addition to the unlawful act, creating a specific approach to enforce fundamental rights: the breach of a fundamental right.

Het recht onder het EVRM, zoals zich dat vormt in de rechtspraak van het EHRM, leidt tot inconsistenties in het Nederlandse schadevergoedingsrecht: een naaste van een persoon die slachtoffer is geworden van een schending van het recht op leven kan tegenwoordig immers alleen vergoeding van eigen immateriële schade vorderen als de schending is gepleegd door een overheidsorgaan. Deze inconsistentie verdient aandacht, maar men realisere zich dat we hier raken aan bredere problematiek. Wij menen daarom dat er in de discussie over de inconsistentie eerst aandacht moet zijn voor de bredere vragen: hoe werken fundamentele rechten door en welke derde verdient waarvan vergoeding? Centraal staan daarbij steeds de overkoepelende kernvragen: wie verdient rechtens een remedie en waarom?

Auteursrechten die toebehoren aan de maker – de originaire rechthebbende – zijn niet vatbaar voor beslag en blijven buiten schot bij faillissement. Dat is het systeem dat art. 2(3) van de Auteurswet (‘Aw’) en art. 21 Faillissementswet (‘Fw’) sinds 1912 (of eigenlijk al 1881) kennen. Het toenemend aantal faillissementen van de laatste jaren heeft de aandacht op deze vermogensrechtelijke ‘status aparte’ voor het auteursrecht gevestigd en duidelijk gemaakt dat dit een onhoudbare situatie is. Het economisch belang van auteursrechten is met de opkomst van Informatietijdperk en de media- en ICT-sector, enorm toegenomen en niet meer vergelijkbaar met het wereldbeeld van 1912. In het op 18 juni 2012 ingediende voorstel voor de ‘Wet auteurscontractenrecht’ is nu voorzien dat deze auteursrechtelijke privileges niet meer gaan gelden voor auteursrechten van werkgevers en rechtspersonen.1 Dat is een stap vooruit, maar die stap is niet groot genoeg. Nu de aanpak van faillissementsfraude en de bescherming van crediteuren door de minister ook hoog op de agenda is geplaatst,2 is afschaffing van deze beslag- en faillissementsexceptie voor het auteursrecht op zijn plaats.

Het Sturgeon en Böck-arrest van het Hof van Justitie EU zette de luchtvaartbranche op zijn achterste benen. De verplichting tot het betalen van gestandaardiseerde compensatie bij annulering van een vlucht werd uitgebreid naar vertragingsgevallen. De luchtvaartmaatschappijen weigerden de uitspraak te erkennen en wezen compensatievorderingen van passagiers massaal af. Zo’n 2000 zaken werden aangehouden in afwachting van het Nelson en TUI-arrest dat duidelijkheid moest scheppen over de vraag in hoeverre het Sturgeon en Böck-arrest in strijd is met het Verdrag van Montreal. Die duidelijkheid kwam er: het heeft duidelijk gemaakt dat het Hof niet met zich laat sollen. Luchtvaartmaatschappijen kunnen niet meer weigeren om in geval van vertraging de standaardcompensatie te betalen. Het is tijd dat zij het verzet opgeven en hun verlies nemen.
