- Abstract
In the second half of the 1960s, Czechoslovakia adopted legislation for the imprisonment of foreigners which was essentially in force until 1989. For the purposes of criminal proceedings, a foreigner was defined as a person of a nationality other than the Czechoslovak Socialist Republic or a person without a nationality, taking into account whether the person was allowed to reside permanently in the territory of the Czechoslovak Socialist Republic. Terms of imprisonment for convicted foreigners were served in accordance with the law in force and the rules of service of terms of imprisonment, but with certain variations from the service of terms of imprisonment by Czechoslovak citizens. The presented edition of documents includes the most important archival materials, providing an idea of the status of convicted foreigners in Czechoslovak correctional institutions. They demonstrate the legal rules used to derive their rights and obligations, the problems faced by the prison administration, the conditions in which the convicts lived, how they adjusted the environment in which they were forced to live, how their cultural and ethnic differences were manifested, and the issues they discussed. The collected documents are divided into three parts, each representing a different set of archival records in terms of their purpose and the information provided. The first part contains the most important legal regulations determining how to deal with convicted foreigners and what rights they have. These are the orders issued by the Chief of the Correctional Service Corps Directorate. The second part includes documents providing information on the convicts' accommodation and their assignment in prison production. The last part contains documents of various kinds illustrating the convicts' inner life. [ABSTRACT FROM AUTHOR]

The study focuses on selected extraordinary events at the Příbram (Bytíz) Correctional Institution in the period in question -- i.e. on the events that affected the operation of the prison or were so crucial that they could not be overlooked. Chronologically, it deals with the fall of two buildings in the camp in 1962 which changed the form of the prison, mentioning the case of Jan Mikoláš, the only prisoner shot dead in the camp area, more precisely, at the Bytíz workplace, and mapping the riot of the prisoners in August 1968, the largest riot in the history of the Czechoslovak prison system until 1989. Attention is paid to the case of shooting a civilian employee in 1971 and the suicide of a mentally unbalanced prisoner from 1979 when a member of the Correctional Service Corps was killed and another one was severely injured. The study also maps the attempted escapes from the Příbram (Bytíz) Correctional Institution and is supplemented by a table with an overview of all reported deaths of the prisoners in 1961-1986, both natural deaths and deaths due to suicide, occupational injury and mischance. - Abstract
The present study focuses on one of the aspects of the normalization of prison life--the prison correspondence of political prisoners as the most common and the most widespread official (sometimes also unofficial) creative verbal expression behind bars which is, however, highly regulated and censored. The author describes the complexity of the supervision of this type of communication, with an emphasis on the concurrence of various censorship interventions, outlining the basic typology of interventions and systemic limitations of correspondence in the normalization correctional institutions or, as the case may be, in remand prisons, their consequences and defensive mechanisms of the affected authors. In spite of both internal and external censorship interventions, the writing of prison letters remained a key creative and often even self-preserving mental manifestation of the prisoners. However, prison letters were important not only for the direct participants in such communication, but also for the wider cultural-opposition public at that time, and they were commonly disseminated in samizdat copies or read out together. Nowadays, with hindsight, many prison letters, which, with few exceptions, were not primarily conceived as literary or philosophical, can be perceived as distinct works of art representing the specific literary genre of prison epistolography, which in the broadest sense can be characterized as a literary task to write something when one actually cannot write anything. - Abstract
The study presents the basic principles, methodology and the previous course of the oral-historical part of the interdisciplinary research project Transformations of the Prison System in the Czech Lands in 1965-1992. Systemic and Individual Adaptations. The author uses, in particular, the memoir books written by former prisoners and narrative interviews with witnesses from the ranks of both prisoners and prison staff. Several major approaches (master narratives) to the operation of the prison system (Marxist-Leninist, technocratic and humanistic), as well their main attributes and transformations in their influence, are identified. Prison is primarily viewed as an environment permeated by constant threat. The largest space is therefore devoted to the analysis of the different types of such threat to which both prisoners and prison staff were exposed to different extents. The study thus forms the basis for follow-up research into adaptation strategies using the attachment theory. [ABSTRACT FROM AUTHOR]

- Abstract
In communist Czechoslovakia, "governance expertise" became an important component of the post-Stalinist elites' policy. The Communist Party's policy in the 1960s was significantly influenced by the idea that socialism with targeted support for science and technology would develop better and the economy would be more efficient. During the period of so-called normalization, the reforms of the Prague Spring were condemned, but expert knowledge was still highly valued. Science played a special role in the prison system, where the decreasing importance of the class concept of punishment led to the re-emergence of the demand for a solution to the issue of recidivism. The study points out that scientists from various disciplines came to work in the prison system during the 1960s, analysing statistical materials, carrying out new surveys and research, and proposing how to transform the prison environment and correctional means and organize post-penitentiary care to prevent recidivism. The aim of the present paper is to answer the questions of how the requirements for the application of science in the prison system were implemented and who supported the changes, to what extent these proposals were (not) implemented in individual prison facilities and how they were adopted by ordinary prison staff, as well as how the technocratic narrative was transformed during the 1970s and 1980s, and how these changes impacted on convicts. The Czechoslovak prison system is closely bound up with the political situation, and period before the year 1989 was no exception. Its transformation reflects changes in society and politics. The role of the prison system, attitudes to prisoners, as well as modernising trends are all a reflection of the dominant master narratives of that time. This study examines how university-educated employees who were in expert positions within the prison system (psychologists, doctors, a librarian, educators, top management) between 1965 and 1992 adapted to the prison system in place or tried to transform it at the time, and how they reflect on their engagement with it at present. By exploring these questions, we are ultimately asking how their experience as prison staff in communist prisons influenced their professional (narrative) identity and course of life, and how dominant social and political narratives under the communist rule impacted their individual lives. The study adopts a qualitative, idiographic and social constructivist narrative engagement approach to capture the interplay between the prison system and individuals within it. It finds that former employees constructed three different identity configurations reflecting their engagement with the prison system. The consequences of these configurations for prison employees, prison system and society in general are discussed.

The analysis of various forms of punishment has traditionally been a prominent subject of sociological study. However, most research on the prison system and its impact on individuals has focused on various aspects of inmates' lives. This article focuses on other important subjects in the prison system, ones whose perspective has been largely ignored - prison guards. The first part of this article introduces prison as a medium through which to analyse modern mechanisms of power and the changing conceptualisation of risks. The second part of the article examines the subjective views of prison guards. The authors conducted 17 in-depth interviews with prison guards working in Czech C-type prisons in order to understand how the prison guards themselves conceptualise their role in the prison system and how they construct the meaning of prison and punishment. The aim of the article is to analyse how the position of various participants in the prison system is negotiated and how the ideas of 'control' and 'power' are established. The authors find that prison guards experience a sense of blurred boundaries between those who are guarded and those who guard. They see themselves as having no control over the prison environment and highlight the control the prisoners have over them through institutional regulations. [ABSTRACT FROM AUTHOR]

The bachelor thesis deals with the spatial differentiation of the distribution of imprisoned persons in the world at the level of individual states. Based on the statistics taken from the World Prison Brief database, it analyses the number of prisoners in the given countries of the world. The theoretical part of the work is focused on the definition and delineation of basic terms from the field of penology and social pathology, as well as theories that are closely related to prison systems. The analytical part examines the influence of individual groups of economic, social and other factors on the share of imprisoned persons. The quantitative method of evaluating the influence of selected factors is characterized by correlation analysis. The aim of the bachelor thesis is to clearly interpret the spatial differences in the observed phenomenon and to find the main determinants that encourage the occurrence of criminal behaviour and imprisonment itself. The synthetic part focuses on the distribution of the investigated phenomenon in a macro-regional concept in order to generalize and facilitate the determination of the main determinants and specifics of the distribution of the investigated phenomenon.

(in English) This thesis deals with influencing of parsons in three different prisons in the Czech Republic (Prague - Pankrac, Pribram-Bytiz and Valdice). The theoretical part discusses prison's background where it encloses a person in the service of sentence in remand prison and a person in the service of sentence of imprisonment. Additionally, it focus on psychological aspects of serving a sentence in remand prison and serving a sentence of imprisonment. The main topic is the establishment of prison spiritual service, its description and aims. This part includes both the stories of the sentenced people and the introduction of the difference between prison spiritual service (parsons) and prison spiritual care (volunteers). The practical part is based on a qualitative research - from interviewing eight parsons (five men and three women). In this part, aims, methods, discussions and the results of the research are described. Mainly, there is included my own placement in those three prisons which has brought me plenty of experience and has enriched my own impression of those clients and the issues.

The thesis deals with special treatment of convicts, in particular a special programme of treatment in a special department. The thesis has two parts the theoretical one and the empirical one. The theoretical part defines basic notions connected with education, family, free time, pathological phenomena in society, crime. They are presented on the basis of scientific resources. Next, special treatment of convicts in a special department is described. The convicts suffer from a behaviour disorder caused by abuse of psychotropic drugs. The main goal of the empirical research was to describe, compare and analyse the opinions of the convicts on the relation between crime and family life, free time activities and also the therapeutic programme of the special department.

The broad subject of this diploma thesis would be the Czechoslovak Secret Police (StB) during the years 1945-1969; and, more narrowly, certain aspects of its organization and activities in relation to the then applicable legislation. The overriding objective, which was reflected in this legislation, was the protection of the Communist political system, the regime. This regime protection goal clearly influenced the evolution and organization of the StB and the related policies on the imprisonment of those individuals that represented a threat to the State and the State System. Similar general principles and policies have basically remained in effect into the current period. The paper begins with an Introduction and Preface, which take a look at the events and nature of the society in this post-World War II period. This material is derived from an examination of historical source materials. The remainder of the paper is divided into four additional Chapters with related subsections. The Introduction and Preface focus on the nature and state of the society in the immediate post-war period, which provided the context and background used for the development of the new legislation and the newly created institutions developed for the protection of this new social order and the punishment and incarceration...

Koncept restorativní justice je v českém trestněprávním prostředí tradičně spojován s užitím restorativních programů, zejména s mediací, v rámci tzv. odklonů od trestního řízení. Jeden z hlavních důvodů, proč byly tyto odklony do české trestněprávní úpravy zavedeny, byla zejména snaha posílit práva a postavení oběti v trestním řízení. Je však namítáno, že restorativní přístup toho nabízí mnohem více, a to i ve vtahu k po- třebám pachatelů. Vězeňství je tudíž další oblastí, kde může mít aplikace restorativních hodnot svůj velký význam. Přestože je i v rámci restorativního proudu považováno za kontroverzní, zda má restorativní jus- tice působit i v tomto prostředí, existuje nyní převážně shoda v tom, že restorativní koncept by se měl snažit ovlivnit i to, co se děje za vězeňskými zdmi. Cílem tohoto článku je představit restorativní ideje, principy a programy, které je možno implementovat ve vězeňském prostředí, a to v návaznosti na zkušenosti, které se osvědčily v zahraničí. Snahy o reformu celého vězeňského systému v restorativním duchu budou doplněny o skromnější pokusy zavést jednotlivé restorativní programy pro určité oblasti vězeňského života. Závěrem budou popsány možnosti stávající české trestněprávní úpravy a programy, které již v praxi fungují. The concept of restorative justice in the Czech criminal justice system is typically connected with the use of restorative programmes, namely of mediation, in relation to the institution of diversion from criminal justice proceedings. One of the main reasons why the corresponding institution of diversion was implemen- ted into the Czech criminal justice regulation was the intention to emphasise the role of a victim and the protection of his/her specific needs. However, it is claimed that the restorative justice concept offers much more in terms of dealing with the needs arising from the offender’s conduct. The prison system is suggested as another area where restorative values might be of great importance. Even if the issue of applying the restorative justice principles in the prison context is controversial for some of its proponents, predominantly the conformity exists that the restorative justice shall try to climb over the prison walls. The aim of this paper is to present the restorative justice ideas, principals and programmes which are suitable for imple- mentation in prison setting. Moreover, principles which work world-wide in this field shall be presented. Experiences to reform the prison system in whole are accompanied by more humble approaches that try to bring individual restorative programmes of various nature into the prison context. In conclusion, the possibilities given by the Czech criminal legislation will be presented together with the programmes already existing in practice.

Post-revolutionary period in the Czech Republic has also brought humanisation of the prison system and with it also new work positions. At present, it is usual that each prison has in addition to the members of the Prison service and the civil servants who care about the "re-education" of the condemned in the enforcement of imprisonment and persons in the performance of the links. In the thesis The breadths and limits of the special educator´s application special educationalists in chosen prisons in the Czech republic are selected as a target group. The theoretical part of the work sums up findings about the Czech prison. The first chapter deals with the Czech prison system in general. It mentions the prison´s development after 1989, it characterizes and divides Czech prisonsand particularly deals with the remand prisons discusses the treatment with prisoners and individual treatment programs, it also deals with the Prison Service especially with workers who are in a close contact with prisoners ie. educationalists and specialists. The second chapter deals with a special educationalist who works in the Czech Republic Prison Service. The author finds out which personal and professional requirements a special educationalist in prison should have. The chapter is also devoted to a special educationalist´s work description, the educational possibilities in the Czech Republic Prison Service and in details analyzes other factors that may affect special educationalist´s job. The empirical part of this thesis is based on research that was made as a qualitative probe with the help of semi-structured interview with special educationalists in chosen prisons in the Czech Republic. The interviews were made with six special educationalists in two prisons - Pribram Prison and Liberec Remand Prison. Before the interviews, the curriculum having eight thematic areas had been prepared these areas were following: initial question which was tasked to find out the content of work, the possibility of changes in overall job description, look at the education, application possibilities, material and technical conditions, the possibility of changes in the implementation of treatment programs, objectives and constrains of special educationalists´, and administration and legislation. The aim of the thesis was to compare special educationalist´s real possibilities of action in the Czech Prison Service to the current regulations governing the work content of the educational worker in prison. Individual objectives were about finding out the limits which special educationalists´ can see in their work and what their possibilities in that job in prison are. On the base of the answers, there was found out, that the real activity of special educationalists ´corresponds with current regulations. However, the research shows that special educationalists in prisons do activities which are beyond their work duties. The research also shows, special educationalists can see the administrative work activity is the biggest limit of their work. They mainly consider themselves to be rather clerks than educationalists. As the limit was also marked the lack of workers in the direct care and the excessive humanization or the pathological phenomena occurring in the prison. On the other hand, the educationalists have a possibility of a personal growth through various courses and other kinds of education which are ensured by Prison Service. They also see the positive in the creativity of their profession, because of their focus, they can choose activities that they will exercise with convicted in the context of treatment programs. This thesis provides a comprehensive view of the special educationalist in the Czech prison and informs about limits and possibilities in this special environment. It could also serve as a motivation source for graduates of special education and related disciplines to pursue this profession.

18. Financial analysis of the volume of costs in the prison system in the Czech Republic from 2000 to the present day

The main aim of this thesis is to conduct a financial analysis regarding the development of the volume of costs in the prison system at the Czech Republic from 2000 to the present day. Furthermore it will focus on the correlation between the costs of the prison system and the number of prisoners during the observed period. This topic is important as it reflects the long-term problem of imbalanced state budget and effort in decreasing of the public outlays. Nowadays, the prison service financing and its efficiency cause conflict situation on the political scene in the Czech Republic. In the theoretical part of this thesis, state budget, its structure, process of its creation and approval, will be defined. Furthermore, the manner, how the volume of prison service founds is divided and how is this budget used, will be described. Practical part will comprise an analysis based on funding development and costs of the prison service in the Czech Republic from 2000 to the present day. The analysis will be aimed at the following economical and non economical parameters. The economic ones will define the development of the costs of the prison service, the development of average costs per prisoner, the development of personal costs, the development of investment costs and the correlation between the costs of prison service and number of prisoners during the observation period. Non economical ones will involve the development of the number of prisoners, the development of the number of prison service staff and the development of the number of prisons.

19. Analysis of the PPP project in ensuring restrictive function of the state

This dissertation examines the possibility of private sector involvement in financing the Czech prison system. In the Western World, this form of provision has now become common practice. The paper explores the possibilities of both full and partial participation of the private sector in the provision of one of the restrictive services that in the Czech Republic are delivered exclusively by the state. The theoretical section discusses different alternatives regarding the financial provision through public-private partnerships (PPP projects). These are viewed as part of a wider and comprehensive area of public contracting. Due to the absence of this form of provision in the Czech Republic, all information regarding this alternative has been sourced from foreign prison systems where private forms of prison service have a long tradition (e.g. the concept of privatization by Charles Logan). The findings are then applied and compared with the foundations of the Czech prison system (whose primary role is security and specialist provision) with respect to the economic efficiency of the whole system. A case study is presented which outlines different projections regarding operating costs in a sample of three American prisons with the aim to compare the estimated and real costs depending on the form of provision, i.e. by state or through private management. The research section of the dissertation uses data from the Feasibility study of building a private prison in the Czech Republic. Using calculated values, CBA analysis is employed to evaluate three possible alternatives of financing the construction of a private prison. To evaluate the costs, the following methods were used: the Public Sector Comparator, the DBFO model (Design -- Build -- Finance -- Organize) and the BOT model (Build -- Organize -- Transfer) which primarily utilizes the work potential of prisoners in relation to the increase of return on investment in penitentiary provision. The results of the BOT model showed that the mere existence of participation of a private partner in the Czech prison system can be beneficial as it introduces an important element of competition and basic principles of market economy into the system. However, greater efficiency can only be achieved provided that a more efficient system of settlement of outstanding debts of prisoners is employed. This requires a more sophisticated policy for employing prisoners.
