Objectives: This research endeavors to examine the legal viability of ascribing international criminal responsibility to the State of Israel for its actions during the occupation and the resulting crimes against the Palestinian people. Additionally, it scrutinizes the potential establishment of such responsibility for individual leaders within the Israeli government. Methods: This research adopts a rigorous analytical approach in accordance with legal scholarship practices to address the research question within the field of international law. Research problem: The research problem centers on the evaluation of the legal feasibility of attributing international criminal responsibility to Israeli leaders and individuals implicated in atrocities against the Palestinian people during the occupation, as well as investigating the possibility of doing so. It also delves into the examination of the International Criminal Court's jurisdiction concerning crimes committed against the Palestinian people by the occupying power. The research seeks to identify and establish legal accountability for individuals responsible for these crimes within the parameters of the International Criminal Court's jurisdiction. Results: The conclusion drawn from this legal research asserts that recognizing the liability of Israeli leaders before international judicial entities necessitates intricate legal procedures within the Palestinian state and other supporting states dedicated to the just Palestinian cause. This study in a nutshell boils down to an impediment to extradition before the ICC, thanks to technology and the incidence of crime. miniature village However, this may not seem possible at the present time, because the major powers are still playing on the language of interests and threats at the same time, without realizing that the crime will eventually affect them, whether long or short, and perhaps the evidence in this field is many and difficult to count Therefore, the International Criminal Court must be granted the necessary powers away from any interests of specific countries, so that this court serves as a real station for holding all criminals accountable, regardless of their national affiliations, and this is what we hope, as what happened to humanity in terms of destruction and wars during the last period is sufficient. This study aimed to identify the reality of international cooperation in the field of extradition, as well as to identify the rules of international law that support this cooperation. Therefore, the researcher recommends that the state parties meet quickly to discuss these restrictions and work to remove them so that the court can play its required role in punishing criminals and reducing crime. The research deals with a very important and sensitive issue, which is "cyberterrorism crimes, and the role of Saudi foreign policy in confronting them from the perspective of national security and international law", and the importance of the research is evident in its novelty and modernity, the lack of writings on it, and the seriousness of cyber terrorist threats to international peace and security, and derives its importance from the importance of the role of the Kingdom of Saudi Arabia in confronting terrorism in all its forms and patterns. The researcher reviewed the concept and patterns of cyberterrorism crimes, and its scenarios in targeting the capabilities of the Kingdom and the world, as well as the efforts of Saudi foreign policy in confronting this type of terrorism, and a statement of the position of Saudi national security on this, and the cooperation of the Saudi judiciary with the international judiciary represented in the trial of perpetrators of cybercrimes at the International Criminal Court. The researcher recommended recommendations, the most important of which are: seeking to address problems related to youth, opening the door for dialogue with those who join terrorist groups, and updating the articles of the anti-terrorism law and its financing to keep pace with the rapid developments in the field of cyberterrorism. This research aims to study the legal framework for the mechanism of reviewing decisions and judgments before the International Criminal Court, where its statute adopted the principle of litigation in two degrees by recognizing the right to appeal against its final decisions, as well as in the interlocutory decisions taken by the Pre-Trial Chamber and the Trial Chamber during the litigation procedures. It also guarantees to the convicted or his family members a request to review its judgments having authority of res judicata by seeking reconsideration whenever its conditions are met. This study shows the evolution of the appeal in the international criminal justice process. The texts governing the work of the International Criminal Court have devoted the exercise of this right to many of the guarantees established by the International Bill of Human Rights in pursuit of a fair international criminal trial. Palestinians are victims of Israeli crimes, and they are seeking justice through the International Criminal Court to prosecute Israeli criminals. The crimes committed by Israelis fall within the jurisdiction of the court. However, the most important challenge that faces the prosecution is the intervention of the Security Council that hinders the process of investigation and prosecution, especially that the council is dominated by US, which is Israel›s strategic ally and the greatest opponent of the International Criminal Court since its inception. The researcher divided this research into two sections; the first dealt with the nature of the Security Council’s relationship with the International Criminal Court; and the second is dedicated to the influence of the Security Council on the Court’s exercise of its jurisdiction towards the Palestinian cause. The study used the descriptive analytical method to accomplish this research. The study concluded that the relationship between the the International Criminal Court and the Security Council affects negatively the work of the court, constitutes a major obstacle and hinders any future investigations. This necessitates countering the Security Council from interference with the work of the court, through amending articles (13/b) (16) from the basic statute of the International Criminal Court. Since the beginning of mankind until the contemporary era, the fight against impunity was the subject of a permanent and paradoxical conflict, conflict between the oppressor and the oppressed, between civil society and the state, between human conscience and barbarism. Given the continued expansion of the impunity phenomenon, the Rome Statute of the International Criminal Court, through legal texts, has come to put an end to the perpetrators of the most serious international crimes of responsibility and impunity. This statute contained a set of guarantees to impose the punishment of those guilty of international crimes and to promote accountability, to achieve the objective of this system and establish the desired international criminal justice. This study aims to identify the legal adaptation of the Anglo-American occupation of Iraq after the 2003 war, and its colonization by virtue of decision 1483 taken on May 22, 2003, and whether it could be considered as aggression especially after reaching a concise definition for this crime under article 08 bis of the Rome Statute amended in the Kampala 2010 review conference in Uganda. It also aims to define the jurisdiction of the court to condemn this crime, or the possibility of considering it as a violation or transgression of the principles and objectives of the UN Charter. The crime of forcible transfer of civilians has accompanied all the charters of the International Criminal Courts, starting from Tokyo and Nuremberg to the International Criminal Court. War crimes in the event of war, just as the crime of forcibly deporting children are considered a crime of genocide that falls under crimes against humanity. The resorting of using drones for a military and intelligence purposes in armed conflicts, has become a controversial jurisprudence for the international humanitarian law jurists, about what legal rule to be applied on this new weapon technology. does customary or treaty international humanitarian law rules, courts decisions and diligence arising from, opinions of major jurists in international law, which represent an essential reserve source for international rules, would be able to control the increasing use of this modern technolog? In case of missing a proper law rule for a certain research and discussion case, how can we adjust the serious violations that caused by drones? And how we can chase the perpetrators according to the individual criminal liability? All of these points will be mentioned as it follow in this study. The importance of this study was included in two sections : First section: Opinions of jurists. Second section : Diligence jurisprudence related to the serious violations of drones.
