The electronic offer shares with the offer the general conditions specified as follows: This offer must be absolute and final, expressing the will of one of the contracting parties to contract, as a result of which the intended contract is concluded once it is accepted by the other contracting party. It is also required that it be clear and specify the basic terms of the contract. An electronic offer is distinguished from an offer in that it includes some data regarding the offeror and the subject of the contract, as specified in Chapter 65-4 of Law 53-05 in its first paragraph: "Everyone who proposes, in a professional capacity and in an electronic manner, must supply goods, provide services, or transfer assets commercial or one of its elements, to make available to the public the applicable contractual terms in a way that enables them to be preserved and reproduced." However, the application of legal requirements to the electronic contracting process clearly demonstrated the technical and legal difficulties in protecting the parties to the contract.
