The scientific inspiration of the mother of the modern constitutions, the American Constitution, is a bad-known fact in the Hispanic world, which turns in a paradox to the Hispanic constitutions because of their nature of uncritical imitations of the aforementioned mother in the bosom of alien societies with respect to the culture of the science. Therefore, the comprehension of such an inspiration and its limitations is an indispensable condition to pass toward a constitution in harmony with the conviviality paradigm, all the more when the Colombian Constitution of 1991 has not allowed the possibility of a primary constituent authority. The article analyzes the institutional change of 1910 in Colombia. The central argument is that it is a question some consensuses as a change of rules of constant type, on the base of some historical constants (the presidential government, the mixed origin of the Congress of the Republic, the limited citizenship and the absence of the constitutional control in the first instance), arisen from 1886 (the step of the States to the Departments and the denominational definition of the State) and new rules (moderation of the presidential government, electoral changes, constitutional control and the relative extension of the political citizenship). It constituted a case of change in the modality of learnings and of agreements on behalf of the actors with major power, to generate a scene with fewer potential conflict. It consists of three paragraphs. The first one compares the reform with the Constitution of 1886, in his modalities and characteristics. The Colombian Political Constitution, on July 4th of 2011, will accomplish twenty years of Its proclamation, sufficient time to do a balance of Its formal declaration, of Its strengths and weakness and to answer the question about the socio-juridical nature of the New Colombian Constitutional Order.
