Abstract

The article examines the use of class action adversary proceedings to prevent the systematic overreaching by creditors in bankruptcy. Topics discussed include federal laws defined by the Federal Arbitration Act concerning the issue; debtor class actions; and the U.S. Supreme Court's decisions in court cases "AT&T Mobility LLC v. Concepcion" and "American Express Co. v. Italian Colors Restaurant."
