The Syrian crisis has been persisting for more than eleven years, but shows no signs of resolution or end yet. Various reports from the United Nations and other reputable organizations have extensively documented a multitude of atrocities perpetrated by all factions involved in the conflict. This article examines the Syrian crisis from a perspective of international law. The author analyses the legal justifications put forward by the parties involved in the conflict, including humanitarian intervention, the responsibility to protect, etc. This research paper employs an analytical and descriptive research methodology. The finding concludes that the Syrian Civil War is not likely to be over for the foreseeable future in spite of many efforts under international law. Owing to the lack of consensus in formal negotiations, unilateral statements do not create legal obligations on states. Thus, a unilateral statement is not considered a source of international law under Article 38 of the Statute of the International Court of Justice. In practice, however, these statements can be legally binding on the states making them and play an important role in the development of international law. The paper aims to examine the characteristics of unilateral declarations and statements in international law and address the Vietnam's position over the legal effects of the Diplomatic Note 1958 with special references to the South China Sea dispute. This paper will analyze the characteristics and significance of unilateral statements in international law, and argue the conditions for legal binding force. On January 4, 2020, the official Twitter account of the former US President Trump threatens to target Iran's cultural heritage sites conditioned on any Iranian retaliation on US military forces then stationed in the Middle East. The immediate context was that the US-led drone strike had killed Iran's Major General Qasem Soleimani in Iraq (Baghdad) only two days prior. This study critically analyzes whether "Tweets" uploaded to President Trump's Twitter account could reasonably be construed as a type of harm against international law instruments and framework on the safeguarding of cultural heritage. This paper provides a brief contextual overview of President Trump's Tweets; traces the historical destruction of cultural property during conflicts and discusses the preservation of heritage; delineates international laws and assesses whether President Trump and the US might be legally bound to refrain from threats to destroy cultural property; and examines the increasing role of social media in the evolution of the idea of diplomacy. This paper focuses on critical anti-corruption measures taken by the State of Kuwait and the international community, specifically as they relate to the implementation of the United Nations Convention against Corruption (UNCAC). Specific provisions of Nazaha Law, particularly those related to crimes and persons under its jurisdiction, are compared to the UNCAC, shedding light on the inherent advantages and disadvantages of the Law and whether the law constitutes a sufficient domestic anticorruption measure. By focusing on specific statutes and related jurisdictional matters, significant discrepancies between Nazaha Law and the UNCAC are noted. Kuwaiti legislators should immediately consider these discrepancies to ensure a more effective domestic policy in the global campaign against corruption. Professor Sienho Yee has recently published a paper in Chinese Journal of International Law, entitled, “Unilateral Sanctions: Kind and Degree; Long-arm and Strong Arm Jurisdiction; Real Intent and ‘Could-be’ Intent.” Yee has ably elaborated that to assess the conduct of unilateral sanctions, there is a need to consider a question of “kind” so as to a question of “degree.” Further, the so-called “long-arm jurisdiction” should be better phrased as “strong-arm jurisdiction” since sometimes long-arm jurisdiction may be lawful, whereas the current version of the long-arm jurisdiction asserted by the United States is so extreme that it is no longer lawful. To this end, attention should be paid to the level of scrutiny or standard of review that a decision-maker would apply to the assessment of intent. The United States’ Inflation Reduction Act (IRA) introduces new eligibility requirements for existing USD 7,500 tax-credit provided to electric vehicles. The new requirements condition the credit upon North American final assembly and North American-sourced materials and components. As tensions flare between the US and China, these new local content requirements reflect the US’s effort to establish a supply chain for electric vehicles that circumvents China. The blow, however, is felt elsewhere, namely by South Korean auto makers whose electric vehicle models are no longer eligible for the significant tax-credit necessary to compete in the American market. As South Korea considers submitting a complaint to relevant international bodies, this paper dissects the IRA’s relevant provisions and analyzes the applicability of international trade law rules of the WTO and the Korea-US Free Trade Agreement to the new local content requirements of the IRA. Law reacts to the progression of scientific technology in the end. Though conservative, changes are beginning to take place due to Artificial Intelligence (AI). AI is automating conventional legal works, creating a new industry namely Legal-Tech. This paper investigates the characteristics and flow of legal-AI and computational law while focusing on the applicability of AI to international law. Mainly, the paper reviews three critical areas: dispute resolution, trial prediction, and machine translation, respectively. International law has different characteristics than the domestic law applied in each country. Unlike domestic law, international law has not been aggregated from a pandect, and it is a still daunting task to draw any meaningful insights for further analysis due mainly to limited data (i.e., trial cases and precedents). The nexus between science and human rights are intertwined in many ways. Though the acknowledgment in international law have been available for decades, the right to savor the fruits of scientific advancement and its applicability has gained just small recognition of the human rights from the international community. A human rightsbased approach to science, technology, and development endeavors a concern for human rights at the heart of the international community facing with critical global challenges. Thus, the paper initially discusses the relevant international human rights instruments including laws, regulations, declarations, conventions and provides a thorough analysis. The doctrinal and qualitative study of the paper presents human rights approaches in order to show insight on the ethical implications of new technologies and investigate how policy can compete with briskly advancing science. The paper also recommends the international community to promote regulatory processes that can help in blocking the disputes by securing an equilibrium between human rights and science. The WHO reported the Covid-19 outbreak infected 486,761,597 people, involving 6,142,735 deaths worldwide as of 1 April 2022. This contagious disease has spread rapidly throughout the world, including Malaysia. Since the outbreak in Malaysia began in March 2020, the Movement Control Order (MCO) has been implemented nationwide, leaving a significant impact on its citizens, non-citizens, as well as refugees. There is some exploitation of refugees, where enforcement officers are targeting them for criminal offences. Stakeholders claimed the Malaysian government did not provide any assistance to refugees during the pandemic, including health care and economy. This article examines Malaysia’s responsibilities as a host country to refugees during the Covid-19 outbreak. The Malaysian government is proposed to continuously support refugees on humanitarian grounds based on the country’s economic development capabilities. Since its founding in 1949, the People's Republic of China has acceded to more than 300 multilateral treaties. Among them, China made reservations to 83 treaties, accounting for nearly 27.7 percent of the total. Evidently, for China, formulating reservations to multilateral treaties is an issue of vital importance in the process of concluding and executing multilateral treaties. This paper examines the three main reasons why China inclines to formulate reservations to the treaties, then argues that the reservations formulated by China, whether in procedure or in substance, are not only in full conformity with the 1969 Vienna Convention on the Law of Treaties, but also full of Chinese characteristics. This paper also analyzes several specific reservations that China shall withdraw, and addresses the limitations of China's existing treaty reservation system. Sea-level rise (SLR) is considered one of the most serious consequences of climate change. The risk of SLR compels legal consideration of this phenomenon related to many interrelated domains including the Law of the Sea. The Western Pacific region contains the most low-lying coastal countries and small island States seriously affected by SLR in the world. This research has been carried out as a contribution paper on the State practice in the Western Pacific region to the topic of "Sea-level rise in relation to international law" conducted by the Study Group of the United Nations International Law Commission in the period of 2020-2021. It aims to summarize the consequences of SLR for the Western Pacific States and outline their legal positions in relation to the sea-level rise. It also discusses specific issues, challenges and opportunities facing the Western Pacific States in supporting the maintenance of maritime baselines and limits notwithstanding physical changes caused by SLR. Tensions are high between Korea and Japan as a result of Japan's export restrictions on three essential semiconductor materials exported to Korea and the removal of South Korea from their White List of countries. The Abe Administration announced that these measures were necessary to "ensure non-proliferation of weapons-related materials." However, it is widely suspected that these measures were adopted as a retaliation against the Korean Supreme Court's decision recognizing compensation for the forced labor victims during the Japanese occupation period. The Korean government filed a complaint concerning these measures at the WTO DSB for resolution under international law. In this research, the authors will critically analyze Japan's export restrictions under international law to facilitate a peaceful resolution to the current conflict. The right to freedom of religion is one of the fundamental rights guaranteed in many international and regional human rights instruments. Several international documents safeguard freedom of religion including the right to convert from one faith to another. In Malaysia, the safeguard of this fundamental right is provided under Article 11(1) of the Federal Constitution with some limitations. The right to convert out of one' s faith is not mentioned explicitly. However, for the non- Muslims, this right to opt out of one' s faith and choose another has been regarded as an implicit part of religious liberty guaranteed by Article 11. In relation to the Muslims, the issue of apostasy is regarded as a taboo as well as a politically explosive proposition. This paper aims to examine the concept of freedom of religion under international law focusing mainly on the issue of apostasy in the context of the Malaysian Federal Constitution. This paper examines the doctrine of informalism, its place in the field of jurisprudence and why it influences the international legal system of ASEAN. It analyses the problems associated with the development of ASEAN's international legal system in the context of trade liberalization. It then seeks to answer the question of how ASEAN may enhance trade liberalization through innovations in its legal system and what aspects of an informal legal system may be maintained within a hard-law framework. It does this by analyzing rule-observance in soft law as well as analyzing some examples of flexibility-enabling mechanisms. Australia instituted proceedings against Japan before the International Court of Justice alleging that the JARPA II is violating the obligation of ICRW which prohibits the commercial whaling. Japan is strongly protesting against Australia arguing that the JARPA II has been carried out only for research whaling. This paper contains the Japan's position over the whaling in the South Pacific. The Japan's arguments are divided into two sections in this paper. First, it will check if whales are truly vulnerable following the Comprehensive Assessment of the IWC. Second, it argues the legitimacy of the JARPA II under international law. The purpose of this paper is to clarify the present state and problems of Japanese measures against the protection and preservation of the marine environment from the perspective of international law and Japanese domestic laws and regulations. The analysis is divided into three sections. Firstly, the relationship between Part XII of UNCLOS and the IMO marine environmental treaties will be addressed in brief. Secondly, Japanese implementation of the IMO treaties will be addressed in the context of the regulations regarding both dumping waste into the sea from vessels and marine pollution from vessels. Islamic international law is a branch of the Shari'ah (Islamic law). Due to the classical doctrine of the notion of 'Jihad,' there have been misconceptions and Islam has been painted as a religion encouraging violence and war. This paper appeals for the reconsideration of the classical doctrine, which was adopted at a time when there was a state of war between Islamic and non-Islamic states. Going back to the roots and referring to the Qur'an and the Sunnah: the two primary sources of Islamic law, the paper argues that Islam prohibits aggressive war and that the essence of 'jihad' is' self-defense.' After elaborating the essential conditions of the right of self-defense, the paper concludes that Islamic international law can contribute much to the present world order by providing moral and ethical values that modern international law is lacking. Modern India has been rather silent on its role in international law. This reticence remains unexplained in the comparative literature on international law. India's history with international relations theories date back to ancient times. Various Hindu texts from some eight millennia ago passed over to generations by the method of "shruti" and manuscripted later, contain one of the most complete sets of international laws and relations. "Dharma" remains the central aspect to this discourse. The opinions of the International Court of Justice (ICJ) in the Nuclear Weapons cases, particularly those delivered by Third World judges, cited these Hindu scriptures as sources of international law. This paper theorizes that modern international law needs a cross fertilisation from Hinduism and Buddhism to become a universal construct. The role of India in the centre-periphery analysis of international law begs a collective answer from the Vedas, the Bhagavad Gītā, the Manu Samhita and the Arthaśāstra. In the post-WWII period, India came quite close to resurrecting the Hindu/Buddhist international law of peaceful co-existence. In an imitative reversal of European discourse in the Panchsheel Agreement with China, India succeeded in establishing new principles of international law. The paper defines the terrorist acts as a combination of factors that have a negative impact on the economic, social and natural environment of society. The UNWTO is a hub for these joint activities to organize tourism security. The distinguishing and novel feature of the organization is that, whilst most organizations provide international security for people permanently residing in a certain territory, the UNWTO interacts exclusively with relocated persons. The work undertaken by the UNWTO specifies that the threat in the tourism industry has a character of mutual exclusion in the aspect of presenting political claims as the causes of terrorism and reducing economic and social indicators as consequences of the activities of terrorist groups. The rapid developments of research and teaching of international law in China have attracted the attention of international law academics of the world, who have looked over the landscape of international law in China with great interest. Unfortunately, existing literature has yet to completely satisfy their interests in this aspect. This article is intended to compensate for this gap by introducing representative international lawyers, publications, academic associations and research funding schemes on international law in China. More concretely, this paper will show the mainstream research sources of their Chinese counterparts as well as embrace teaching as part of the research system of international law in China. It is expected that, with their more attention into the holistic research methodology and the “One Belt, One Road" strategy, the Chinese academia of international law will contribute more to the international rule of law. The scope of the maintenance of international peace and security has been increasingly widened by the United Nations Security Council in response to actions taken not only by the Member States but also in some cases by the individuals. In fact, a range of actions and decisions were taken by the Security Council, approximately in the late 1990s and after the so-called 9/11 attacks in the context of combating terrorism, as well as in other contexts against the member States. In consequence, the affected States and individuals had to seek redress from international or national courts on different grounds such as violations of human rights. This has led the domestic courts to develop novel jurisprudence. Thus, it is necessary to pay due attention to the jurisprudence created by these courts. The Philippine claim to Bajo de Masinloc, otherwise referred to as Scarborough Shoal, finds solid basis in international law. The territorial claim of the Philippines over Bajo de Masinloc is strong relative to the claim of China as well as with respect to the principles on the acquisition of territory in international law, in particular, on the basis of effective occupation. The sovereign rights and jurisdiction asserted by the Philippines over the maritime entitlements of the features in Bajo de Masinloc are founded on principles of international law and consistent with the United Nations Convention on the Law of the Sea, which both the Philippines and China have signed and ratified. China's straight baseline regime deviates from the UN Convention on the Law of the Sea in a number of ways. Such discrepancies are likely to induce legal and political conflicts between countries, and also the settlement of which would not be easy, in particular, among the East Asian countries. In consideration of this point, the legal issues surrounding China's straight baselines and basepoints should be analyzed and evaluated not only from the perspectives of UNCLOS, but also through comparative analyses based on customary international law, State practices, and special circumstances. Many of China's State practices and laws based on straight baselines are neither in accordance with international laws, nor generally recognized as being in accordance with the international law of the sea. This paper provides important legal insights into China's straight baselines, which are unlawful from the perspectives of UNCLOS and State practices, and, in addition, suggest desirable ways to solve the problems in international laws. On January 21, 2011, the Korean navy commandos rescued the twenty-one crewmen abducted and detained by Somali pirates in the Indian Ocean. The pirates captured alive were brought to Korea for trial and the prosecutor's office of Pusan sentenced the leader of the Somali pirate group to life-imprisonment. The other four pirates received imprisonment terms from 12 to 15 years. Regardless of these domestic legal punishments, this rescue operation has raised a few critical international legal questions. The primary objective of this paper is to answer these questions. This research analyzes the international legal characteristics of the Korean Navy's rescue operation. Then, a few case-studies of military rescue operation are carried out in order to justify the Korean Navy's rescue operation. The countries in East Asia continue to have problems in maritime boundary delimitation. The collision on September 7, 2010 between a Chinese fishing vessel (Minjinyu) and a Japanese patrol boat in the waters near Diaoyu/Senkaku Islands is interesting to observe as a step in dispute settlement process. The differences between the PRC and Japan on maritime boundary delimitation for the East China Sea and the legal status of Diaoyu/Senkaku Islands are demonstrated by this incident. To see things in their context, it is necessary to observe the practices of East Asian countries in handling their maritime boundary delimitations, especially those involving islands with disputed legal status. The rules of international law relating to the pacific settlement of dispute and maritime delimitation dispute resolution, which involve a preliminary sovereignty dispute over islands, are also relevant as a much broader background. The author will examine why certain maritime delimitation cases are particularly hard to handle. The lessons drawn from this paper is inspiring for Taiwan, a long-time marginalized player in East Asian regional affairs. The author will examine the difficulties and opportunities for Taiwan in maritime boundary delimitation and offer a suggestion on how to accomplish such task with neighboring countries. A primary purpose of this paper is to critically evaluate Professor P. Singh's Article, "Colonised's Madness, Colonisers'Modernity and International Law: Mythological Materialism in the East-West Telos"published in Volume 3, Number 1 of the Journal of East Asia and International Law. In his article, Singh attempted to overlap various conceptions of modernity taken from a wide range of academic disciplines, and experimentally collapse them into one with a post-colonial point of view. In spite of incomplete argumentation and obscurity in the conceptual formulation, I found his original ideas on the internal connection of modernity with the operating mode of international law to be highly impressive. The most critical point against him was the firm and stereotypical dichotomy of the colonizer and the colonized without any potentiality of sublating the state of colonization, that is, disconnecting the colonizers with their colony and liberating the colonized from their colony. By such sublation (Aufheben) of the existing oppressive relation between the colonizers and the colonized, we can plan to build a new world of peaceful coexistence between the colonizers and the colonized of the past. But although Singh's conception of modernity is dangerously one-sided, I expect his further research to penetrate into the deep life-reality of the Indian subaltern, which would make a great contribution to the establishment of the new vision of international law in this global society. UN Secretary General Kofi Annan in the 2004 Report of the High-level Panel on Threats, Challenges and Change, "A more secure world: Our shared responsibility" (under the heading "A more effective United Nations for the twenty-first century" stated: "The United Nations was never intended to be a utopian exercise. It was meant to be a collective security system that worked." However, several authors in recent years have asserted that the victorious powers merely wanted to maintain the status quo and their privileged positions, and never intended the system to work and give up those privileges. This paper, however, argues the contention that the UN was never designed to function effectively, is a myth, and it does not take into account important aspects and innovations that presented decisive new developments that originated with the United Nations. Thus the international court, which had in the interwar period been an institution outside the framework of the League of Nations Covenant, became an integral part of the UN system, making it more closely resemble a government with legislative, executive and judicial functions. Even more prominent, concerning the executive branch, the Security Council, unlike what had been the case with the League Council, opened itself to instigate members to delegate powers for its effective functioning. This was a most significant innovation that would allow for democratic process in the organization and defence of peace. The Proliferation Security Initiative was launched in 2003 by the Bush administration right after the So San incident. Its primary purpose is to interdict the spread of WMD and their delivery systems. Due to the provocative and challenging characteristics of the Initiative, which are inconsistent with conventional international law, there are some objections against the Initiative. This paper answers the highly topical questions regarding the Initiative in three parts. The first part addresses the origin and development of the Initiative. The second part critically analyzes the background of the Initiative such as the neoconservative ideology of the Bush administration and its world strategy, international terrorism, and the U.S. arms industry. The third part scrutinizes questions concerning the preemptive use of force for self-defense and the interdiction of foreign vessels on the territorial and high seas.
