This paper aims to analyze the acting of the Curator’s Council of Empresa Brasil de Comunicação (EBC), the main space of civil society participation of the communication company of public service in the country. From the analysis of documents, it seeks to analyze the profile of the actors who take part of the Curator’s Council and the segments of civil society they represent, reflecting on the relative autonomy of the organism. In addition, it is adopted a content analysis of the debates about the EBC work plans in order to think about the participation of the actors in the deliberations of the Curator’s Council. In this sense, it is adopted a maximalist perspective of participation, understanding that it goes beyond the interaction with the content, in the media sphere. Similarly, it is understood the limitations of the representation process and, therefore, the proposal is to reflect on what groups can take part of this space, since the beginning of EBC until today. Furthermore, it is understood that the process of participation of civil society and the autonomy of the Curator’s Council reflect on the relative autonomy of the enterprise as a whole.

Este artigo tem como proposta analisar como foi a atuação do Conselho Curador da Empresa Brasil de Comunicação (EBC), então principal instância de participação da sociedade civil da empresa de serviço público de comunicação do país. A partir da análise de documentos, estatutos e normas, buscou-se observar o perfil dos atores que compunham o organismo e os segmentos da sociedade civil que eles representavam, refletindo assim sobre a autonomia relativa do Conselho. Além disso, adotou-se a análise de conteúdo dos debates sobre os planos de trabalho da EBC, a fim de refletir sobre a participação dos atores nas deliberações do Conselho. Nesse sentido, partiu-se de uma perspectiva maximalista da participação, entendendo que, na esfera midiática, ela vai além da interação com o conteúdo. Da mesma forma, entende-se as limitações do processo de representação e, portanto, a proposta foi refletir sobre que grupos conseguiram espaço nesse âmbito, da origem da empresa até a edição da medida provisória 744/16, que extinguiu o Conselho Curador da EBC. Além disso, compreende-se que os processos de participação da sociedade civil e a autonomia do Conselho Curador se refletiram no período analisado na autonomia relativa da empresa como um todo.

Distinto do setor comercial, entre outros aspetos, por não ter finalidade lucrativa, o setor público de comunicação define-se correntemente pelo princípio da universalidade e do igual acesso dos cidadãos aos produtos mediáticos. Não obstante este fundamento de base, mais ou menos comum aos sistemas de radiodifusão de iniciativa pública das mais variadas origens, a designação de serviço público de média – consistente com uma tradição europeia – não é um correlato inequívoco do conceito de comunicação pública – mais harmonizado com uma tradição americana, ou mesmo sul-americana. Focado nas experiências de Portugal e do Brasil, este artigo desenvolve uma abordagem comparativa que visa compreender o enquadramento político, social e cultural da atividade dos média públicos nestes dois países. Com base numa leitura dos documentos legais que sustentam o desenvolvimento desta atividade, procura-se também discutir o setor no contexto mais vasto das políticas de comunicação portuguesas e brasileiras. Não ignorando, por outro lado, os aspetos que têm feito do serviço público e da comunicação pública um campo de debate permanente, como as questões do financiamento e da independência, o presente artigo tem ainda como objetivo identificar e discutir os desafios enfrentados pelas empresas concessionárias.

Unlike the commercial sector because, among other aspects, it does not have a profitable objective, the public sector of communication has been defined according to a principle of universality and of equal access of citizens to media products. Notwithstanding this basic ground, which is more or less common to the public service broadcasting systems from most origins, the denomination of public service broadcasting – consistent with a European tradition – is not an unequivocal correlate of the concept of public communication – more in tune with an American, at least South-American, tradition. Focused on the experiences of Portugal and Brazil, this paper develops a comparative approach that aims to understand the political, social, and cultural framework of the public media activity in these two countries. Based on an analysis of legal documents that support the development of this activity, the paper is meant to discuss the sector in the broader context of Portuguese and Brazilian communication policies. On the other hand, while not ignoring the aspects – such as funding and independence issues – that have made public service broadcasting and public communication a field of permanent debate, this article also aims to identify and discuss the challenges faced by concessionary companies.
