Children's participation in decision‐making remains a key focus of social work practice. Yet the protection and participation of children in our society remains a setting of tension for children, families and practitioners. Drawing on evidence from a retrospective qualitative study on Family Group Conferencing, this paper uses the lens of recognition theory to highlight the experiences of young people more broadly in the social work system. The study found social workers' attitudes affected children and young people's capacity to be 'partners' in decision‐making. Feelings of misrecognition can create barriers for how children and young people perceive and interact with social work professionals. While small, this study sheds light on the experiences of young people's struggles for recognition when involved in the social work system. The Family Group Conference (FGC) is grounded in a rights‐based framework, whereby children and their families have the right and responsibility to be primary decision‐makers when child protection issues arise, and the statutory agency has the responsibility to convene the entitled members of the family network to lead the decision‐making. A distinct core component of FGC—private family time (PFT)—allows families to discuss the information and formulate their responses and plans privately during conferencing. This paper describes how a large child welfare agency in the United States adapted PFT in two ways: (1) including a parent advocate (PA) and (2) abbreviating the amount of time allowed for this discussion. Given the lack of empirical research on the PFT component, this qualitative exploratory study sought to understand the functions and perceived impacts of PA‐supported PFT during initial child protective services (CPS) conferences at which decisions of child removal or placement were being contemplated. PFT served multiple beneficial functions and impacted families in several positive ways: families gained greater awareness of safety concerns, felt empowered and confident in the preferred safety and service plan, became increasingly engaged and involved in the case decision‐making process and ultimately felt less apprehensive. Children living in out‐of‐home care are at greater risk of poor educational outcomes compared to other children. To address their educational needs, several programs have been developed. Within a qualitative paradigm, this study explored the experiences of students about their involvement in TEACHaR (Transforming Educational Achievement for Children at Risk), a specialized education programme. Eight students (aged 13 to 18 years) from the programme participated in individual, semi‐structured interviews. Responses were analysed using Interpretive Phenomenological Analysis. Participants indicated that the programme provided individualized and flexible academic support, reduced their shame and embarrassment and provided them with more than academic support. They highlighted the importance of the student–educator relationship, and the need for encouragement and motivation to pursue their educational goals. Finally, findings report on how COVID‐19 impacts on student experiences of the programme. Abstract: This paper discusses some key findings taken from a qualitative study conducted with gay and lesbian adopters and foster carers in England and Wales. The study examined the experiences of 24 self‐identified lesbians and gay men, who had been involved in adoption or fostering processes since the introduction of the Adoption and Children Act, 2002. This article will explore why participants chose to adopt or foster and their approach to relationships generated through these routes. Findings indicate that gay and lesbian applicants troubled dominant conceptualisations of family and kinship and revealed both heteronormative and nuclear constructions of parenting within adoption and fostering social work. In contrast, participants often demonstrated a reflexive and creative approach to caring for looked after children. This paper will therefore consider how professionals can recognise nuanced or complex relationships, situated beyond traditional frameworks, through drawing upon wider concepts within sociological literature. The professed aim of any social welfare or legal intervention in family life is often to bring about "better outcomes for the children." But there is considerable ambiguity about "outcomes," and the term is far too often used in far too simplistic a way. This paper draws on empirical research into the outcomes of care proceedings for a randomly selected sample of 616 children in England and Wales, about half starting proceedings in 2009–2010 and the others in 2014–2015. The paper considers the challenges of achieving and assessing "good outcomes" for the children. Outcomes are complex and fluid for all children, whatever the court order. One has to assess the progress of the children in the light of their individual needs and in the context of "normal" child development, and in terms of the legal provisions and policy expectations. A core paradox is that some of the most uncertain outcomes are for children who remain with or return to their parents; yet law and policy require that first consideration is given to this option. This paper presents findings from a qualitative study that focused on factors that facilitate professional judgement and decision‐making that is child‐centred. Appreciative inquiry informed the methodology that enabled four focus groups (n = 50) with child protection practitioners who worked with children and young people living out‐of‐home care. The study found that, firstly, child protection practitioners had clear conceptualizations of what child‐centred practice means and, secondly, articulated how functioning teams, effective organizational structures and relationships were crucial to child‐centred practice. This paper presents findings from a study of judgements concerning 137 children (13–18 years) where protection by the Swedish Social Services was applied for. The paper explores the disclosure of physical, sexual and emotional child abuse including experiences of domestic violence and the process following a disclosure. A central finding is that the majority of children (71%) could be described as having intentionally disclosed the abuse. The findings also suggest that many of the children had come a long way in an emotional and cognitive process before the decision to disclose, and that disclosure was often made in conjunction with a decision to leave the alleged abusers. These findings support previous research suggesting children's intentional disclosure as an important predictor of decisions regarding alternative care. Another finding is that the process following the disclosure was described by the children as intensely challenging with active pressure and threats from relatives and feelings of fear, guilt and ambivalence. These findings have implications for both practice and research on how the safeguarding system can help children in the process of disclosure and protect those who do disclose. Social workers working to protect children face the prospect of making very finely balanced judgements, often on the basis of incomplete information. Based on doctoral research into sense‐making by social workers, this paper explores aspects of the tipping point, i.e. where the categorization of a child's situation changes, potentially leading to a very different response to their needs. Those aspects include identifying the triggers for, and consequences of, the tipping point, and being aware that the tipping point being reached may have to do with changes in the internal world of the worker as well as changes in the circumstances of the family. This paper stresses the need for a more nuanced understanding of the tipping point, and emphasizes the need to take account of the processes of decision‐making, and of looking at both inter‐ and intra‐personal components of those processes. Further, it is argued that a cautious attitude requires to be taken towards technical–rational solutions and that there is a real need to place professional judgement and consideration of the tacit dimension at the heart of the child protection process. The Office for Standards in Education, Children's Services and Skills (Ofsted) is responsible for inspecting services that care for children and young people in England and Wales. This paper presents findings from an independent study of Ofsted inspections into children's social care in England, covering reports under three inspection frameworks during the period 2009 to 2016. The research aimed to identify the main themes of recommendations made in Ofsted reports and to explore similarities and differences between frameworks and between local authorities. The methodological approach was document analysis. A stratified sample of 60 reports was prepared on the basis of inspection framework and local authority characteristics such as local deprivation, Ofsted rating, and urban/rural category. A thematic analysis was conducted of the recommendations in each report, with emerging themes subjected to an iterative process of coding and categorization. The findings identified nine categories of themes, the most common of which were performance management, casework, oversight of practice, and multiagency working. Overall, the recommendations were strongly oriented towards process issues and compliance with standards. Recommendations were found to differ somewhat between inspection frameworks but remained largely consistent between local authorities with different characteristics. Adoption and permanence planning has been a key feature of Scotland's policy in relation to children and young people who are "looked after." Although policy and law has significantly developed in recent years, there has been comparatively little research on permanence processes in Scotland. This paper outlines key findings from the first comprehensive study of permanence planning in Scotland. It examines the process for two cohorts of children where adoption or other types of permanence orders were made. The children were selected under the long standing Adoption (Scotland) Act 1978 and the more recent Adoption and Children (Scotland) Act 2007. In total, 300 cases were examined, analysing data from the children's first contact with services through to the order made by the Scottish Courts. With growing concerns about the efficacy and costs of intrusive child protection interventions and increasing recognition of citizen rights to participation in governance, jurisdictions are looking to collaborative alternatives that divert families from the courts and out‐of‐home care. In Queensland (Australia), "intervention with parental agreement" (IPA) is one such response. Under IPA, the statutory child protection authority can work collaboratively with families, without a court order, to respond to children assessed as "in need of protection." In this paper, we use procedural justice theory as a lens to explore how IPA policy is enacted in practice. Procedural justice relates to the quality of treatment a person receives and the fairness of the process than an authority uses during decision‐making (Tyler,). It is associated with voluntary cooperation and compliance; key practice concerns when working to address child maltreatment via parental agreement rather than court ordered intervention. We report on a qualitative study that utilized semistructured, in‐depth interviews to capture the perceptions of 30 practitioners regarding the factors that shape the extent to which they enact IPA policy in a procedurally fair manner. Article 12 of the UN Convention on the Rights of the Child (CRC) provides children with the right to express their views in matters that affect them, particularly those of an administrative and judicial nature. This paper examines the academic discourse in child protection research concerning how Article 12 of the CRC is implemented and how it is manifested in child protection service (CPS) casework practices. The systematic review was performed following the principles of the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) statement and included 16 peer-reviewed articles published in English in academic journals from multiple scientific databases from January 2009 to January 2019 reporting primary research with children about their experiences of participation in CPS. Despite the widespread ratification of the CRC several decades ago, the studies in the current review establish a clear and predictable pattern of an inability of children to express themselves throughout CPS proceedings. Findings consistently indicate that children in different countries felt they were not being asked, listened to or heard, in some cases even regarding harmful and unsafe situations. We argue the academic discourse must move beyond these findings and discuss how research can contribute to dealing with these obstacles and improving practices by focussing on Article 12 in particular and human rights in general throughout CPS practices. While many evidence-based tools and measures exist to support child protection practice, in the United Kingdom, there is little evidence of their routine use in casework. This paper reports on a qualitative study exploring the use of such tools with children and families receiving statutory social care services. Fifteen social workers working in child safeguarding teams in two local authorities in Southeast England agreed to incorporate the use of outcome measures into their casework over a 6-month period. Qualitative data were collected through monthly action learning workshops held separately in each local authority. The results showed how the impact of using the measures was shaped by a combination of institutional factors, practice context and the dynamics of casework. Outcome measures were found to have benefits as well as limitations with respect to partnership working, assessment and decision-making and overall social work practice. Implications are discussed for the prospects of enhancing the use of evidence-based tools in statutory social work with children and families. [ABSTRACT FROM AUTHOR]

Abstract: This paper explores practical and ethical dilemmas for professionals when securing the protection of children in the complex non‐clinical setting of individual families. It is based on a cross‐country study on cultural encounters in interventions against child physical abuse and neglect in four countries (England/Wales, Germany, Portugal, and Slovenia). Drawing on national reports of legal‐organizational frameworks and socio‐cultural backgrounds of European child protection systems, it also presents the results of a series of focus groups with professionals. Data were analysed to identify implicit and explicit discursive constructions as well as normative representations and from this deriving the key ethical issues and dilemmas. Despite a shared normative framework across Europe, intervention cultures vary across the four countries and between the different stakeholder groups. Although each child protection system faced widespread mistrust, policy approaches differ, some relying on strong and detailed guidance whereas others stress professional skill and judgement. We conclude that despite a shared commitment to the protection of children, deliberations and perceived ethical dilemmas suggest interdependency between differences in system cultures and policy approaches that inform the character of professional interventions in the four countries. This paper examines the discretionary reasoning of the judiciary in three jurisdictions, England, Germany and Norway, in cases deciding whether a newborn child is safe with her parents or intervention is necessary. Our analysis focuses on one specific dimension of decision makers' exercise of discretion, namely, if and how the strengths and weaknesses of the mother are considered. The data material consists of all decisions concerning care orders of newborns from one large city in Germany from 2015 to 2017 (n = 27) and 2016 in Norway (n = 76) and all publicly available newborn removal decisions in England for 2015–2017 (n = 14). The findings reveal a high number of risk factors in the cases and less focus on risk‐reducing factors. The situation of the newborn is considered to be harmful, as most cases result in a care order. Judicial discretion differs by how much information, and what types of factors, are included in the justification for the decision. A learning point for decision makers and policymakers would be to actively undertake a balancing act between risk‐increasing and risk‐reducing factors. [ABSTRACT FROM AUTHOR]

This paper draws on a British Academy (BA) funded study exploring social workers' conceptions of family using a vignette and focus groups. The policy context is discussed and the data from the BA study are then compared and contrasted with families' accounts of their own situations using the data from a separate qualitative study about child protection social work. ABSTRACT This paper presents the findings of a study that looked at social workers' perspectives on parental engagement in making the difficult choice of either taking the child into care or keeping the family together. The paper first explores the specific context of children at risk in Romanian society and explains that in this middle-income nation there is an absence of evidence-based risk assessment tools, which prompts social workers to use their own 'common sense' risk assessment indicators. The findings of this small-scale, non-representative study on several public non-voluntary child protection services in Romania suggest that social workers' perceptions of specific dimensions of parental engagement in non-voluntary child protection may influence service delivery decisions and outcomes. ABSTRACT Social theorists have demonstrated the growth in dominance of two central discourses for understanding the ways that children's mental-health issues are understood today - medicalization and intensive mothering. In this context, this paper reports on a qualitative interview-based study of 16 mothers whose children had received a diagnosis with one or more mental-health or developmental issues such as Tourette's, bipolar, anxiety, depression, autism or attention deficit hyperactivity disorder. It is based on the retrospective accounts of mothers given during interviews, from the time when they noticed what they thought to be unusual behaviours and decided to try to normalize and accommodate to their children's behaviours and then to the various steps they took to seek help. The paper begins with a description of the sorts of problems that mothers noticed. It then moves to the strategies mothers then took to cope, manage and socialize their children. When these failed, mothers sought professional assistance with understanding, remediation and/or a diagnosis for the child(ren). Mothers described uncertainty, confusion and contradictions as they unremittingly sought help. This process may be called surplus suffering. The relevance of the theoretical issues is then reconsidered along with the substantive and practical consequences of the findings. [ABSTRACT FROM AUTHOR]

ABSTRACT With the orphan population escalating, communities continue to rely on relatives to provide care to orphans. Therefore, there is a need to explore the role of caregivers with regard to the well-being of orphans, the challenges they face, as well as how they could be empowered to be more responsive to children's needs. The paper acknowledges that informal caregivers play an important role in the lives of orphans. The paper also concedes that, in the process, caregivers are faced with challenges which make it difficult for them to fulfil their responsibilities and roles. As a result, they sometimes act as sources of stress to orphans, which eventually complicate the children's adjustment to the loss of their parents. Lastly, the paper paves the way to ensuring that challenges faced by informal caregivers are addressed in a manner that will make them more supportive to orphans. [ABSTRACT FROM AUTHOR]

ABSTRACT This paper draws on the findings of a research study that examined the factors that influence local decision-making in cases where a child or young person is being considered by residential workers, social workers and senior managers for placement in a secure unit. After outlining the research problem and case study approach taken, the paper focuses on explicating the findings of the study that relate to the impact of group membership, goals, roles and norms on group performance in such cases. The paper illustrates how attending to these four areas, and the way in which power relations impact on them, may help those developing and managing groups to improve decision-making practice. This paper reports on an empirical study of child protection services in a local authority where rates of investigations and interventions rose to unprecedented levels during the course of a single year. The aim of the research was to explore explanations for this rise in demand among the providers of children's social care in the area. Using an interpretative qualitative design, a series of focus groups and interviews were carried out with practitioners and managers (n = 25) from statutory services and Early Help. The findings identified a combination of long‐term and short‐term drivers of demand. Long‐term factors emphasized the impact of rising levels of deprivation combined with cuts to community‐based services for children and young people. Short‐term factors ranged from a more proactive approach to child neglect to more effective multi‐agency partnerships and joint decision making. The interaction between these factors was found to be accentuating an underlying shift to "late intervention" across the sector. The findings are contextualized in relation to contemporary debates about the crisis of demand for children's social care and the complex relationship between prevention and protection. This paper presents a qualitative analysis of front‐line practices regarding emergency removals in Finnish and Irish child protection. It examines how the responses to children's immediate danger are framed by legislation and how front‐line practitioners assess the child's situation and make emergency placement decisions. The data consist of interviews with 16 Irish and 33 Finnish social workers. These child welfare protection systems respond differently to a task that appears to be similar. The Irish team‐based practice rests on the social workers' shared assessment of the child's needs, and the formal decision is made by the courts (or police officers at night‐time); and the Finnish practice involves only one single social worker who makes both the assessment and the removal decision. The Irish system is tightly time regulated, whereas the Finnish system provides a more flexible time frame. Both approaches put a lot of stress on social workers' practice, which also includes creative workarounds (e.g., "planned emergency removals" in Finland). Recent policy has emphasized the need for advocacy services for children and young people, developments that have gone hand-in-hand with greater levels of participation of young people in decision-making. Advocacy for disabled young people is especially important, as they are a particular vulnerable group and have, traditionally, been even more excluded from decisions about matters affecting their lives. This paper reports the findings, as they relate to disabled young people, from a study that investigated the role of advocacy for looked-after children and children in need. The paper highlights some of the benefits of advocacy for disabled children, the dilemmas facing advocates between advocating and acting in someone's ‘best interests’, identifying the client and the boundaries between advocacy and social work. It argues that time given to establish a close relationship with a disabled child or young person is crucial if advocacy is to be effective and participation in decisions affecting their lives a reality. Child welfare removals of children are among the most invasive decisions a state can make toward its citizens, and typically it is the courts that make these decisions. These interventions are regularly exposed to criticism. In this paper, we examine if and how care order proceedings could be improved in England, Finland, Norway, and California, USA. We have asked the judiciary decision‐makers about their view on what should be improved. Our findings show that the organization of the proceedings, including time and staff, are identified as issues in all four systems. Furthermore, the preparations by the child welfare agency are also mentioned as an issue, for English, Finnish, and Californian decision‐makers. Very few decision‐makers indicate features related to the individual, situational, and contextual dimensions, which is interesting since this would be expected from organization theory. The strong call for change in the way proceedings are organized indicates a need for modernization as well as better use of available competency from child development experts. The respondents focus on the elements that a decision‐maker has direct experience with and knowledge about, and this is indeed worth noting for policymakers in the four systems. Child welfare practice is temporally structured and includes a variety of follow-up activities. Practice-based follow-up has not, however, been much explored when studying children's paths in the child welfare system. This paper is based on a study of children (103) who were taken into care in 2006 in 10 Finnish municipalities and their paths in care until 2011. The social workers' institutional knowledge of their 'own' clients comprises the core of the research design. The paper reflects on the nature of this data from the point of view of the notions of temporality. The analysis highlights four temporal trajectories used in retrospective analysis of children's paths in care: the linear time trajectory of the decisions and changes in the institutional positions, the temporally fragmentary trajectory of childhood and youth, the circular time trajectory of professional understanding of the child's path and the silent time trajectory. Each one documents the children's paths differently; the linear one tends to be the 'natural' and most easily available trajectory and consequently, the children's paths are documented via decisions and institutional positions. The analysis suggests that more attention should be given to the complexity of time and temporality when studying children's paths in child welfare. [ABSTRACT FROM AUTHOR]

In Australia, there is no binding protocol that proscribes the processes by which the release of personal records of adults who grew up in care occurs. Individual agencies that hold the records - both government and non-government organizations - have their own policy and practice guidelines. While not specific to care-leavers, the existence of freedom of information and privacy legislation means that the subject of the records is entitled to access information about themselves, but this is not unproblematic. Drawing on qualitative in-depth interviews with a group of Australian care-leavers, this paper discusses their experiences of accessing personal records. Accessing these records was often highly significant to identity formation, but could produce both positive and negative effects. The negative aspects of the records were that, typically, at least in part, they were incomplete, insulting, incorrect and/or incomprehensible. Currently, the range of support provided to those accessing their records varies significantly across agencies. The findings of this research suggest the need for the greater provision of supported release and the implications for social work practice are discussed. [ABSTRACT FROM AUTHOR]

ABSTRACT Child protection workers are tasked with prioritizing and facilitating safe, secure and preferably, long-term care arrangements for children and adolescents living within the child protection system. Recognizing the complexities associated with this task, this paper will propose that the application of theory - namely attachment theory and family systems theory - may aid in the conceptualization of placement decision-making within the context of child protection practice. In particular, this paper will describe a framework entitled: Towards a second-order view of child protection placement-related decision-making. This framework assumes the position that the ideals of relationship security and permanency of placement are more accessible in instances in which practitioners are able to locate themselves within temporary, stabilized but ultimately evolving systems. Specifically, the practitioner is encouraged to conceptualize where their individual selves, the broader child protection system and family system are located at any one point in time, whilst also identifying the direction in which these systems should be moving. ABSTRACT The introduction of Children in Care Councils under the Care Matters reforms in England set a challenge for local authorities to find effective ways by which children in care could contribute their views to the planning and provision of services. This paper discusses a review of progress across London which combined a survey of boroughs with focus group discussions with young people, local authority staff and elected members. The research found that considerable progress had been made in that virtually all boroughs had some mechanism for representing children in care, and that staff and young people were proud of their achievements. However, major challenges remain - to embed a culture of participation in services, to ensure continuity, to reach all children including the many placed 'out of borough' and to defend what has been achieved in the face of severe cuts in public spending. The paper highlights a tension between empowering young people and meeting targets as corporate parents. The results support other research pointing to the need for a better understanding of the relationship between participation in governance and participation grounded in ordinary life. ABSTRACT It is widely recognized as problematic that there are generally low levels of engagement with child welfare services from biological and social fathers. The result can be limited resources for children's care and potentially poor risk assessment and management. This paper reviews the published research from 2000 to 2010 about the barriers to and facilitators of better father engagement, as well as the very limited evidence on the effectiveness of work with maltreating fathers. There is relatively little known about what works in engaging men, but there are some promising indicators from family support and child protection practice contexts. These include early identification and early involvement of fathers; a proactive approach, including an insistence on men's involvement with services; and the use of practical activities. In the light of what is known about the characteristics of maltreating fathers, there is a logical fit with cognitive-behavioural approaches. Although there is no direct evidence of the effectiveness of motivational interviewing in this context, its effectiveness in allied fields of practice would suggest that it may hold some promise for the initial engagement of fathers who pose a risk to children. ABSTRACT Using aggregated national data, this paper compares outcomes of Australian 'child protection' (CP) and Norwegian 'child welfare services' (CWS). We highlight each nation's context and key elements of their CP/CWS organizations, with emphasis on policy and programme orientation. System outcomes are examined along with the implications of their different approaches. The main policy focus in Australia is protection and risk, while Norway's systemic approach stresses prevention, early intervention and support. These differences influence practitioner's intervention strategies and how the needs of children and parents are met. In Norway, approximately 80% of the children in the CWS receive some sort of supportive services. In contrast, Australian services for supporting families are narrowly targeted. Both countries share the 'best interest of the child' principle and an increased focus on children's rights, and have experienced increased service demands and rates of children in out-of-home care. The attitude of professionals to the involvement of children in decision-making is unclear. This paper discusses a recent research study that utilized qualitative and quantitative methods to explore the views of professionals working in family support and child protection about two different aspects of children’s participation in decision-making: the age at which children should make decisions and whether or not they should be involved in child protection conferences. The results showed that social workers tended to favour one of two diametrically opposed viewpoints about the age at which young people should make decisions and then in discussions with colleagues they sought to persuade others to change their perspective. Social workers who believed that young people should not make decisions until much older nevertheless thought that they should be involved in conferences whereas non-social workers did not make this distinction: for them, children who were not old enough to make decisions for themselves should not be involved in conferences. The results are discussed in the light of some of the implications for practice. Children's participation in decision making of all kinds is of increasing interest across the world as more and more countries seek to comply with Article 12 of the United Nations Convention on the Rights of the Child. The participation rights of children who are in the care of the state are of particular concern. Recent research in England suggests that Independent Reviewing Officers (IROs) can play a crucial role in ensuring that looked after and accommodated children are able to participate in care planning and review processes. This paper outlines the findings of the first Scottish study to investigate the role of Reviewing Officers in encouraging children's participation in reviews. Surveys were collected from social workers, Reviewing Officers and young people after 69 review meetings as part of an action research study. Follow-up qualitative interviews were then completed with 10 young people and a focus group held with the five participating Reviewing Officers. The findings suggest that participation in looked after reviews can best be understood as a cyclical and relational process and that taking part in action research may enhance participation practices. While the role of the Reviewing Officer was found to be important, the findings suggest that everyone involved in the care and support of the young person needs to encourage participation processes that are individualized. The case has been made for introducing a rights‐based, public health approach to child protection in England. A continuum of prevention is proposed, with multi‐agency responses calibrated more carefully to the level of risk identified by children, parents and practitioners. The aim was to allocate inter‐professional authority and resources in such a way as to ensure the safeguarding response is proportionate to the nature and level of concerns expressed and reliable in achieving good outcoSmes for children and parents alike. Recent research findings confirm the need for new models of service alignment and inter‐professional responsibility at the interface of ‘primary’ and ‘specialist’ health‐care services and ‘children's social care’, where significant safeguarding concerns are raised. This paper reports the findings of a scoping study, designed to establish the extent to which innovative practice methodologies have been implemented and evaluated in England to date. While the evidence to support the effectiveness of specific practice methodologies and contrasting logics of service design and implementation is shown to be very limited still, achieving reliability and legitimacy in the safeguarding relationships established at the service interface seems to depend on the integrity of the dialogue facilitated in each case. This paper examines how child welfare workers in England, Norway and the USA (California) perceive children's participation building on 91 qualitative interviews. First, analysing the data using Hart's ladder of children's participation, we found that all Norwegian workers perceived children's participation as some form of decision‐making, whereas 40% of English and 35% of US workers embraced views of children's participation that can be considered token or non‐participation. Second, we coded the data for main themes and found that child welfare workers in all three countries perceived children's participation as hearing the child's opinion and information gathering. The themes of age, maturity and ability to form an opinion also emerged from the data. English workers' reflections about children's participation were more nuanced than their Norwegian and US counterparts; and US workers understood children's participation as children providing valuable information during the investigation of a case more frequently than workers in England and Norway. Although the law in England and Wales requires a child's wishes and feelings to be heard in LAC (Looked After Children) reviews, there remains limited research into how far this is achieved. This study interviewed 25 children and 16 foster carers to explore how well children understand and take part in reviews, and what factors impede this. The study found that levels of participation, as experienced by children and foster carers, were very low and the methods used were relatively ineffective. Children experienced significant barriers in engaging with the review process. The paper concludes that, as a vehicle of children's participation, LAC reviews are still not working well and calls for more attention to the views of children and young people and to the effectiveness of LAC reviews. Children commonly experience considerable disruption to their care when a parent is incarcerated. Maintaining relationships between children and their incarcerated parents can present particular challenges, and for a growing number of children, continuing contact with their incarcerated parent is a key issue. Most of the research about children's experiences of parental incarceration is filtered through adults who may or may not have spoken with children. This article draws on data collected for a research project which aimed to build an understanding of the needs and issues facing children and young people living in the Australian Capital Territory, who have experienced parental incarceration. This paper considers one key finding; children and young people's perspectives on contact with their incarcerated parent. Examining the concepts underpinning the reasoning processes of social worker's decision‐making provides important insights into how social work practice is undertaken. This paper examines one of the major discourses used by social workers in decision reasoning in a non‐governmental organization child protection context in Aotearoa/New Zealand: family maintenance. This study found that family maintenance as a concept was strongly privileged by social workers. This resulted in attempts to preserve families and created a hierarchy of preferred decision outcomes. A preference for family maintenance was supported by legal, moral, psychological and Māori cultural concepts. This pattern of constructs underpinned the ‘weighing up of harms’ when considering removal, and generally reflected a child welfare orientation. In addition to this, it was found that ‘family’ was broadly defined, and could include people who had a relationship with the children, or Māori definitions of extended family, in addition to legal ones. The family courts in England and Wales are being significantly reformed in line with the coalition government's aim to speed up the process and increase the numbers of children being adopted from care. In September 2013, the Court of Appeal handed down a judgment, Re B‐S (Children) [2013] EWCA Civ 1146, that has wide‐ranging implications for professional practice and decision making in care proceedings. The judgment challenges the policy direction and provides guidance about what is required before courts can make orders separating children from their birth families, particularly in cases of non‐consensual adoption. In this paper, we outline the changes occurring in the family justice system, some key elements of Re B‐S, and examine the challenges for implementing practice consistent with the requirements of Re B‐S. It is argued that the standards set by Re B‐S are unlikely to be fully implemented without much further attention to the complexities posed by the policy and practice context of social work with children and their families involved in care proceedings. Matching describes the process of selecting the substitute home for a child who needs to be placed away from the care of his/her birth parents. However, very little theorizing is done about matching and there is also a lack of systematic investigation into models of practice currently in use. Most importantly, very little is known about front‐line matching practices in different socio‐historical child welfare contexts. This paper aims to explore the concept of matching by addressing it theoretically and empirically as a decision‐making practice in social work. Based on the analysis of phone interviews (49) and focus group interviews (five groups with 18 child welfare practitioners) in Finland, we claim that matching includes a high degree of navigation: decision‐making balances between professional discretion, legal norms and principles, subjective views of the children and their parents as well as the economic and bureaucratic conditions of the service provision administration in the municipality. Navigation is shadowed by uncertainty and compromises. The analysis suggests that the notion of matching needs further analysis as it plays an important role in child welfare decision‐making. A distinguishing feature of Swedish child protection is the direct and indirect influence on decision‐making in individual cases by representatives appointed by their elected political parties. As members of local committees, they take the most interventionist and costly decisions themselves, informed by care proposals submitted by professional social workers. Other decisions are delegated to professional social workers. In direct decision‐making, they are supposed to act as laypersons using their own judgement and experience, not as politicians. The aim of this paper is to describe and analyse these committees, their role and responsibilities, and possible influence of politics on child protection. A mixed method was used, with a survey sent to 467 representatives, structured interviews with 99 secretaries of local committees and data drawn from national statistics. The Swedish model is discussed as a hybrid system influenced not only by professional, bureaucratic, political and market governance logics but also by laypersons. One conclusion is that although child protection is directly influenced by politics, the reverse is also true. By exposing politicians to the difficult life circumstances and societal shortcomings experienced by vulnerable children, the system can, in turn, have an impact on politics at the municipal level. This is the first part of a two-part review of the literature, policy and practice relating to family group conferences ( FGCs). This first paper explores the background, the global policy context, the theoretical foundations and the process of undertaking FGCs. The literature is extensive in relation to these elements of FGCs, unlike the limited literature relating to outcomes, which is examined in the second part of this review. ABSTRACT Child welfare has long been a concern for American Indians, so much so that Congress passed the Indian Child Welfare Act (ICWA) in 1978. The ICWA was intended to address was the large number of children placed out of home as a result of abuse and/or neglect, and the corresponding lack of tribal and community input regarding their removal and placement. This paper focuses on one group of American Indian people, the Lakota, whose children are overrepresented in the child welfare system. As a promising practice, shared decision-making will be offered as a culturally appropriate model to build dialogue and cooperation between social workers and their Lakota clients. Shared decision-making holds promise to help address the important social justice issues identified by Congress and by the Lakota people in the 1970s and which remain largely unresolved some 40 years later. Residential care has had a poor reputation. There are concerns about the abuse of children in care, and evidence of poor outcomes and poor practice. In this context, residential care is often compared in a negative way to family placements. On the other hand, residential care can also provide a positive experience for some children and young people. Residential care has increasingly been contrasted with family placements, and yet children and young people describe their positive experiences in residential care as like being in a family, and refer to care staff using kin terms, such as 'dad' or 'sister'. With the growing diversity of families in Western society, there have been significant developments in sociological theories of families, and these highlight the importance of family practices and displaying family. New kinship studies in anthropology have raised questions about the nature of the family. Research on children's conceptualization of family has begun to identify features of 'family-like' relationships. These theories will be discussed in relation to the ambivalence about residential care, current thinking about residential child care and, importantly, the way in which some children and young people use the family metaphor to express their experience. ABSTRACT This paper considers therapeutic approaches to residential care with specific attention to the question of family involvement. It builds on a body of literature indicating the potential of residential care as a positive intervention for young people, and examines the contention that - even when family problems contribute to a young person's accommodation in residential care - family involvement could improve long-term outcomes. The literature reviewed indicates that family involvement is indeed important. Mixed research findings reflect the diversity of approaches to family-centred practice, but there is evidence of benefits in relation to a range of child outcomes. However, the literature also shows that family-centred residential care is not easy to achieve. More than parent-child contact, it entails genuine involvement of parents, in decision-making and in children's daily lives. Professionals - including social workers and residential care workers - must not only be concerned with the care and development of the child, but also with the role of the parent in their child's development, understood within an ecological perspective. ABSTRACT Over the past two decades, child protection authorities internationally have begun to implement models of family participation in child protection decision-making. Debate exists about the extent to which these models promote family involvement in decision-making. While a significant body of research on family and professional experience and perceptions of models of family participation in decision-making has emerged, there has been little observational research of these approaches. In this paper, we report on observational data from 11 family group meetings (FGMs) in a child protection context in Queensland, Australia. Under Queensland child protection law, these meetings are referred to as an inclusive process for child protection decision-making and planning. We draw on observational data to analyse how family inclusion in child protection decision-making is facilitated, or limited, by the FGM process. We consider tensions in the realization of a participatory ethos in child protection services systems and discuss what practitioners can practically do to enhance family participation in child protection decision-making. ABSTRACT Concern about the decision-making abilities of practitioners in child protection has led to the development and implementation of increasingly structured assessment tools, many based on forms of risk assessment. The positive and negative effects of such tools on practice have been widely researched and debated. This paper presents the findings from ethnographic research about the use of a particular set of decision-making tools that provide insights into how tools might affect the professional development of practitioners. The overall finding that the use of decision-making tools may impair professional development draws attention to the importance of the process of implementation, in particular how tools are regarded within an organization in relation to practitioner expertise. ABSTRACT Compulsory adoption of a child constitutes the most extreme intervention of the state in family life. In Israel, this intervention relies mainly on the cause of parental incapability, which has not been clearly defined by the law and is left to the court's discretion. In this paper, the social construction of a reality paradigm and the narrative approach to the law are used as conceptual frameworks for analysing the concept of parental capability in court decisions favouring compulsory adoption. The analysis of case studies revealed six central narratives of parental incapability in court decisions and the judicial practices that constructed them. The compelling power of the parental incapability narrative leading almost conclusively to the closed adoption solution is discussed, and an alternative narrative of open adoption is put forward. The decision to take a young person away from his or her family into out-of-home care and treatment is the most drastic intervention within the statutory powers bestowed upon social services. The results of reports on the quality of residential treatment reveal that state supervision has not proven to be a good substitute for parental care. In this paper we analyse the decision-making process when young persons are placed in residential care. Focus groups and individual interviews with different stakeholders were conducted. The results show that the placements are a collective process involving negotiations between the different parties with a coordinating social worker in the middle, with the aim to bring something to build hope on in often desperate situations, regardless of the specific treatment method used. To inform the process, the social workers draw on a 'collective memory' shared among colleagues in the department. Important signs of quality of a residential unit were the relational and collaborative competence from the staff. The inclination to use soft, diffuse information in decision-making shows a striking lack of evidence upon which social workers can build well-informed and knowledge-based decisions. This paper reports on a study of service users' views on Irish child protection services. Qualitative interviews were conducted with 67 service users, including young people between 13 and 23. The findings showed that despite refocusing and public service management reforms, service users still experience involvement with the services as intimidating and stressful and while they acknowledged opportunities to participate in the child protection process, they found the experience to be very difficult. Their definition of 'needs' was somewhat at odds with that suggested in official documentation, and they viewed the execution of a child protection plan more as a coercive requirement to comply with 'tasks' set by workers than a conjoint effort to enhance their children's welfare. As in previous studies, the data showed how the development of good relationships between workers and service users could compensate for the harsher aspects of involvement with child protection. In addition, this study demonstrated a high level of discernment on the part of service users, highlighting their expectation of quality standards in respect of courtesy, respect, accountability, transparency and practitioner expertise. Placing children in out-of-home care constitutes one of the strongest public interventions in families. This paper explores how Norwegian Child Welfare Service (CWS) workers present their reasons as well as their work processes in the course of deciding to place children in out-of-home care. The analysis is based on interviews with 83 social workers and concerns 109 children recently removed from their homes. Three central elements were identified in the social workers' accounts: (1) a description of worrying conditions in the family; (2) the workers' long-term back-and-forth process, which revolved around experiences from the case, particularly around interactions with the parents; and (3) a triggering factor that made the out-of-home placement take place when it did. These elements underline the need to include both substance (conditions related to the child and his/her family) and procedure (conditions related to the work on the case) to understand what leads CWS to removing children. Both types of conditions put the parents, rather than the children, in the centre of the workers' attention, which may be explained by the position and role of the CWS workers as street-level bureaucrats.
