The article discusses the significance of merit in notification of appeals filed by litigators as perceived by appellate panels. It is noted that appeals prepared preemptively with the jury in mind may lack in claims or defenses supported by legal theory resulting in rejection of the initial pleading. Inclusion of an appellate specialist in the legal team is indicated as a major cost consideration while lack of a ruling on discovery disputes may also preclude future appeals.
