The article examines the essence of information technology in the contemporary world and its impact on management operating systems. The authors define the concept of "information technology" and the basic principles of its functioning. In addition, the paper identifies the most common methods and approaches to modeling management operating systems. The authors analyzed the impact of information technologies on the development of Ukrainian enterprises. They also presented the latest information technologies in enterprise management and their essential contribution to the economy, exports, and employment. The study analyzed the dynamics of IT services development in Ukraine and their impact on its economy. It also presented a general analysis of operating systems in Ukraine and considered the possibilities of integrating information technology and innovative educational approaches. In addition, the paper examines the impact of information technology on the management of operating systems' security and presents the economic and technological effects that arise from implementing information technologies. The key goal of this research paper is to analyze the specific features of legislative construction of Article 245 of the Criminal Code of Ukraine, in particular, the method of statutory reflection of the elements of the subject matter and subjective side of this criminal wrongful act used therein, and also to study the relevant European experience. This will enable to develop proposals aimed at improving the provisions of current national criminal legislation, which are intended to guarantee the protection of flora by means of Ukrainian criminal law. In the course of relevant comparative legal research and formulation of conclusions, the author used a number of different scientific methods of cognition, in particular: modeling, comparative, dialectical, systemic as well as statistical methods. A conclusion has been reached that the newer version of the criminal law norm under study should, firstly, retain criminal liability for trespass to any type of vegetation, and not only violations relating to forests, and secondly, within its framework, liability for a) encroachment not only on green spaces around settlements, along railways, but also on any other green spaces, including those not located in appropriate places; b) destruction/damage of vegetation on lands of any category from among those provided for by the Land Code of Ukraine. In addition, the authors argue that it is necessary to establish penalties for intentional and negligent destruction of flora that differ in severity, which is explained by the significantly different degree of public harmfulness. 5. The health-restoring potential of musical art in the postwar period.

The academic paper explores the prospects of using music therapy for people who have participated in hostilities or have been in the epicentre of military operations and have experienced post-traumatic stress disorder. The present research encompasses the historical documentation of attempts to apply music therapy during the First and Second World Wars, the evolution of music therapy in the latter part of the XX century, and the potential for growth in the context of contemporary conflicts, in particular, the ongoing Russian aggression against Ukraine since 2014. Three main types of music therapy practices have been identified: perceptual, motor practices, and music-making. It has been revealed that the positive impact of music therapy practices is not only noted by the patients themselves but also measured instrumentally, which gives objective grounds to emphasize the importance of the health-restoring potential of musical art. At the same time, the analysis of publications shows that music therapy practices are not widespread, but rather sporadic initiatives of individual rehabilitation centers and volunteer organizations. In addition, the attempt to find out which musical works should be used for music therapy practices also brings no results due to the lack of relevant studies. [ABSTRACT FROM AUTHOR]

The research paper outlines several issues related to the impact that the organized crime nowadays has on global community. Various issues of "group" criminality, its goals and motivations are discussed at length. The difficulty of precisely defining such phenomenon is explored. Two major pieces of international legislation, the United Nations Convention against Organized Crime and the EU Council Framework Decision 2008/841/JHA of 24 October 2008, are discussed in order to reveal some key parameters for introducing national criminal law provisions against organized crime. By using comparative and other research methods, American, Mexican and Ukrainian approaches to outlining issues of organized crime and responding to them are explained. As a role model, historical roots, structural model and impact of Mafia-type organizations in the United States have been outlined. Also, successful impact of the U.S. Racketeer Influenced and Corrupt Organizations Act on such types of criminal activity has been revealed. Finally, the structure of criminal community in Ukraine as a typical form of organized crime in this country has been described through the legal analyses of its five key elements. This paper explores the benefits of incorporating the prepared speaking format into the final assessment in English for Specific Purposes, as a response to pandemic and the full-fledged war in Ukraine. The aim was to maintain students' achievements and reduce examination-related anxiety triggered by war stress. As literature review suggests, anxiety blocks cognitive process and ability to critical thinking, the development of which requires focused and sustained attention and correlation of emotions and cognition. Since the critical thinking development is one of the key competences of the XXI century, the format of the designed preexamination tasks is based on questioning techniques with trajectory on cognitive levels of Bloom's Taxonomy, originally developed to help educators set educational objectives. In the suggested format it underwent a transformation, shifting from a teacher-centered approach to a student-centered one with the aim to enhance students' critical thinking and the ability to ask higher cognitive questions. This study was carried out through a qualitative longitudinal approach with semi-structured interviews, a survey, and observation as data collection methods. The findings demonstrated the viability and a crucial role of prepared speaking format in eliminating anxiety, by providing the achievement-oriented strategies focusing students' attention on effective task engagement. The current trends in digitalisation of education have a significant impact on the study of the humanities, including history. The purpose of this article is to analyse the achievements in the use of innovative technologies in the study of Ukrainian history and to determine their impact on the quality of education. The realisation of this task is based on the use of the method of content analysis of scientific literature selected using the PRISMA methodology. The results of the study show that interactive technologies are quite effective in teaching the history of Ukraine. VR and AR are important tools that allow students to more effectively perceive complex historical material. The use of online platforms and social media contributes to the dissemination of historical knowledge, providing access to lectures by leading historians, interactive tasks, online conferences, etc. A number of problems have also been identified on the way to introducing innovative technologies in history teaching. First of all, it is the high cost of equipment and maintenance, the resistance of some teachers to innovations, etc. The conclusions note that the use of innovative information technologies in the study of the history of Ukraine significantly expands the possibilities of the educational process. The implementation of legislative support for public policy on national memory in Ukraine is realised through the enactment of legislative acts, including the Constitution of Ukraine and Ukrainian laws. The country's prevailing political situation and social moods have primarily shaped it. This article aims to examine the legislative framework of Ukraine (1991-2024) that facilitates the formation and implementation of public policy on national memory within the state. The study demonstrates that active legislation has occurred over the past ten years and continues to the present day. It is established that the legislative base in the sphere of national memory comprises conceptual, organisational, and regulatory acts, which delineate the scope of their functionality. Significant achievements have been made in the legislative support of public policy on national memory in Ukraine. It is evident that the issue of adopting a special law that would define the fundamental principles of national memory policy in Ukraine, ensuring comprehensive regulation of its formation and implementation, still needs to be solved. The completeness of memory policy regulation at all levels of the administrative system is defined, and problematic issues are identified. This article examines illegal orders and orders in the field of the banking system from the point of view of constitutional law. The study includes a review of constitutional norms and principles related to banking, analysis of specific cases of issuance of illegal orders, as well as study of mechanisms for protecting the rights of subjects of banking relations. The purpose of the article is to analyze illegal orders and orders in the banking system in the context of constitutional rights and freedoms. The methodology of the article includes such methods as: analysis method, historical-legal method, comparative method, logical method. As a result of the study, it was concluded that the Constitution of Ukraine enshrines basic rights and freedoms that directly affect the functioning of the banking system. In particular, this is the right to property, entrepreneurial activity, and the right to legal protection. The study showed that these constitutional guarantees are key to protecting the rights of subjects of banking relations from illegal orders and orders. The results of the study emphasize the need to improve the legal regulation of banking activity in Ukraine, in particular by eliminating existing shortcomings in the legislative framework and strengthening the mechanisms for protecting the rights of subjects of banking relations. The implementation of the proposed recommendations will contribute to ensuring legality and law and order in the banking sector and increasing trust in the banking system of Ukraine. 13. European legal standards of digitalization of the judiciary.

The article reveals the content of the concept of European legal standards in the area of digitalization of the judiciary adopted as mandatory or as recommendatory typical legal principles and norms fixed (contained) in common sources of law (acquis communautaire) of the European legal system. They are the minimum legal requirements for the organization and implementation of e-justice for the EU member states. The application of these standards takes place in the course of their implementation by national laws of both the EU member states and states that are guided by the legal values of the EU and/or seek to acquire EU membership, like Ukraine. The normative basis, goals and principles of ejustice in the EU are thoroughly analysed. The key positions on the digitalization of the judiciary, which are set out in the EU legal documents containing the relevant legal standards, are defined. Attention is drawn to the fact that the main elements of e-justice, implemented in Ukraine under the influence of European standards, can be considered the following: (i) conducting electronic office work, centralized storage of cases and other procedural documents in a single database; (ii) exchange of documents and information; (iii) electronic method of determining a judge (judgerapporteur) to consider a particular case; (iv) using information and communication technologies to investigate electronic evidence; (v) trial participation in the hearing via videoconference; (vi) adoption and publication of judicial acts in electronic form. The article analyzes one of the means of criminal procedure proof -- presumption. By analyzing the corresponding norms of CPC of Ukraine, legal positions of the European Court of Human Rights, Supreme Court of the USA and the views of fellow researchers, the authors present their vision of issues within the scope of the study. 17. Enhancing future officers' physical preparedness in the process of professional training: a higher military education institution case study.

The article reveals the results of a study of physical preparedness of cadets studying at the tactical level of military education in a Higher Military Educational Institution of the State Border Guard Service of Ukraine. The authors of the article determine that in the result of physical training, the future officers form a complex ability that combines intention for constant professional physical development and selfimprovement, readiness to utilize applied and methodological knowledge on physical culture, applied motor skills and personal safety skills, defense and attack skills using special means and techniques of hand-to-hand combat, ability to use physical force and special means. A group of 275 cadets of 3-4 courses who were studying at the tactical level of military education was selected for the study. The generalized data allowed to conclude that the majority of cadets have an average level of formation of knowledge, abilities, skills and their average value of physical preparedness equals 3,420 on a fivepoint scale. The authors note that in the context of the traditional educational process, cadets are not sufficiently motivated to engage in physical education and their level of physical preparedness is affected by age characteristics and service employment. Tourists are frequent victims of criminal offences, but the investigation of such crimes is usually complicated by several factors, which allow offenders to often stay unpunished. The aim of the research is to study the possibilities of using technical equipment during detection, investigation, and prevention of crimes against tourists. The research employed a doctrinal approach, a statistical method and other methods. The study identified the factors of victimization of tourists and the main scenarios under which crimes are committed. The main areas of application of technical equipment for the detection and investigation of crimes in tourism are established: the use of photo and video recording devices, traceology, weapons examination, handwriting examination, document, examination, identification of a person by appearance, phonoscopy, odourology, research of physical evidence, forensics, forensic profiling, etc. The problems of using technical equipment to detect and investigate crimes in the tourism sector are identified using the example of Ukraine, particularly the impossibility of using interrogation video footage as evidence during a judicial investigation. The obtained conclusions can be useful for optimizing the work of law enforcement agencies by providing a wide range of modern innovations to increase the effectiveness of detection and investigation of crimes in tourism. The system of information support of the authorities of the Ukrainian early modern state, as well as implementing internal and external policies, contributed to protecting Ukrainian lands from external aggression and the expansion of Ukrainian interests in the world. The main purpose of the study is to analyze this statement. The methodological basis of the research is a comprehensive analysis of archival sources and historiography, which is based on the main principles of historicism and scientific objectivity. The scientific novelty of this publication is to prove the hypothesis that thoughtful information activity in its various segments was an important component of the policy of the Ukrainian early-modern state and contributed to protecting its lands and interests from foreign encroachments. Conclusions. Information activity was an important component of the security activities of the Ukrainian Cossacks and a means of implementing power policy. The principles and approaches developed in working with information will help reveal the secrets of the Cossacks' information skills and will contribute to the deepening of interest in the study and revival of Cossack traditions, which is necessary both for filling research gaps and for training specialists in the field. The purpose of the article is to identify effective alternative forms of labour dispute resolution based on the analysis of theoretical information and practical experience of their application in the modern world and the possibility of their use in Ukraine. The methodological basis of the work is the methods of analysis and synthesis, comparative law, logical and legal, abstract and logical methods, and the method of generalisation. The author identifies the features and advantages of using the main alternative forms of labour dispute resolution: conciliation, direct negotiations, mediation, arbitration, and mediation. The author examines the international experience of using alternative forms of labour dispute resolution (France, Bulgaria, Poland, and the United Kingdom). The reasons for the low prevalence of the use of alternative forms of labour dispute resolution in Ukraine are: lack of legislative regulation or gaps in it; low level of public awareness; lack of qualified specialists (arbitrators, mediators). The author identifies the appropriate measures for the effective implementation of alternative forms of labour dispute resolution in Ukraine, which will reduce the burden on the judicial system, and resolve labour conflicts more quickly, efficiently, and with lower material costs. The article analyzes the essence and features of transparency and publicity of local budgets in Ukraine and abroad using advanced foreign experience. The need to ensure transparency and publicity of local budgets is substantiated. International ratings of openness and transparency of local budgets are considered. Successful projects and practices in ensuring budget transparency and publicity are analyzed. The features of ensuring budget transparency and publicity in war conditions are determined. Recommendations are proposed to increase the transparency and publicity of local budgets in Ukraine in the face of new challenges. To achieve the goals of this article, general scientific and special methods were used, such as the structural-functional method (to study individual tools, successful projects, and practices in ensuring transparency and publicity of local budgets), comparison method (comparison of data openness across countries, successful projects, and practices in ensuring budget transparency and publicity). Mind mapping is a powerful tool for teaching English as a foreign language, particularly in the context of learning and mastering English as a second language (L2). Visualizing the content contributes to a more effective memorization and error-free reproduction, even after some time. In the Ukrainian pedagogy, the didactic potential of "cognitive graphics" and specific means of its implementation calls for deeper studies and systemic representation as the concept itself is a multi-disciplinary phenomenon on the intersection of neuro-/psycholinguistics, psychology, theory of language communication, cognitivism, and web-design. That is why the aim of this work is to ascertain the essence of mind mapping as powerful means of teaching and learning English, to show its relations with ICT in designing an effective set of academic tasks and stimulating the student's digital competence. The innovative character benefits the perception, and thus, the interiorization of the course content, increases the academic performance of students and their confidence in their abilities providing internal motivation for further work. As a result, the student's selfassessment receives additional clarity, communication in L2 gets extra motivation, critical analysis skills and soft skills develop better creating a sturdy foundation set of skills for a highly professional graduate from a Ukrainian university. The rapid development of society and the impact of information technology have significantly changed the legal field and contributed to the creation of a legal framework for the digital environment. Successful development of digital relations in Ukraine requires effective legislative regulation. The favorable appearance of this process is determined by effective strategic planning, active participation of the government and an appropriate legal framework. From this point of view, it is considered important to consider issues of legal regulation of the digital environment in the context of the activities of state and law enforcement agencies. The purpose of the work is to research the regulatory and legal provision of the digital environment with an emphasis on the regulation of digitalization of state legal and law enforcement activities. Research methodology includes such methods as: historical, systematization, analysis and synthesis, structural-functional and comparative analysis. The result of the scientific analysis of scientific research and regulatory and legal regulation of the relevant relations was the study of the legal plane of digital transformations in Ukraine. Internal legislative norms were studied, relevant laws aimed at digitization were analyzed, their purpose was determined; the existing legislative basis for building a digital society and economy in Ukraine is highlighted. The analysis of strategic documents on digitalization in the spheres of public administration and law enforcement was carried out. The internal concepts of the development of e-government have been studied. The experience of foreign countries in the regulation of the digital environment and electronic management was studied, progressive means of regulation of the studied issues abroad were determined. This article examines fiscal risks and their management in Ukraine and abroad, drawing on international best practices. The main aim is to analyze global risks in the short and long term and evaluate how public finances have been managed in Ukraine and other countries during economic crises, while suggesting areas for improvement. The study utilized various scientific methods, including the structuralfunctional method to uncover risk management mechanisms within public finance systems and the comparative method to contrast key indicators of Ukraine's public finance system with those of other nations. Key findings include the identification of primary tools used nationally and internationally to mitigate the impact of fiscal shocks during crises. Budgetary practices from different countries were also examined, emphasizing fiscal rules, social expenditure allocation, and incentives for innovation and investment. The research highlights how global challenges and economic crises have led countries to adopt different approaches based on their economic development and risk management integration into fiscal processes. Recommendations are provided to enhance fiscal risk management measures in Ukraine, particularly in the ongoing wartime context. In conclusion, this article underscores the importance of effective fiscal risk management and offers specific suggestions to strengthen fiscal risk management practices in Ukraine, considering current circumstances and unforeseen challenges. The purpose of the article is to study the possibilities to administer judicial proceedings with the use of information technologies at the current stage of judicial reform in Ukraine. The research methods are: formal and logical, analysis and synthesis, comparative and legal, generalization, forecasting, etc. The issue of the possibility and expediency of introducing full-fledged electronic justice in Ukraine in terms of the martial law has been considered. The authors have characterized the Strategy for the Development of the Justice System and Constitutional Judiciary for 2021-2023 in the context of ensuring the development of ejudiciary. The organizational and legal, financial and technical problems on the implementation of the Electronic Court and the Unified Judicial Information and Telecommunication System have been defined. The authors have characterized the factors that must be taken into account while adopting a law on the effective regulation of remote and electronic justice in terms of the martial law or the state of emergency. It has been emphasized that the main indicator for the effective functioning of remote justice should be maintaining a balance between ensuring the right to access to justice and ensuring the safety of court proceedings participants. The experience of the authors regarding the implementation of the components - value-worldview, process-activity, emotional-resource during the motivationalcognitive, constructive-active, reflectiveprognostic, value-identification stages is highlighted. The aim of the study was to determine multilingualism in Ukraine with the identification of intercultural and globalization factors. The study involved statistical methods and comparative analysis. It was established that the phenomenon of multilingualism is characteristic of the Ukrainian people. During the period of its establishment, Ukraine was constantly under the socio-cultural influence of neighbouring states, which showed elements of chauvinistic ascendancy. However, the typical combinations of languages that were characteristic of multilingual groups of the population of Ukraine are being transformed in accordance with the current requirements. In particular, an increased influence of the official languages of the international community is recorded. The phenomenon of multilingualism for the Ukrainian people is contradictory, as it is mostly artificial, caused by intercultural factors of foreign countries. However, technological development, globalization processes and Ukraine's Euro-Atlantic aspirations form the basis for a fundamental change in attitudes towards this phenomenon and the use of multilingualism as an advantage of Ukrainian society. Further research is aimed at obtaining the concept of systemic solutions for the positive use of the multilingualism of the Ukrainian people, in particular through the implementation of language combinations using languages recognized by the international society. The transformation of society is due to the development of the information society and the gradual transition to the knowledge society, the impact of digitization on all spheres of life of society and citizens. Recently, the issue of the transformation of social security in the context of the development of digitalization of all spheres of the life of the state and society has been brought up to date. The purpose of the article is to analyze the legal framework for ensuring social security in the context of digitalization in Ukraine with a view to developing the ways to improve the policy in this area. The methodology of the article is based on a complex, interdisciplinary approach, the principle of historicism for conducting a legal analysis of normative legal acts in the field of social security of Ukraine for 1990-2022 in the conditions of digitalization. The results demonstrate the dynamism of technology development and digitalization of society with slow legislative changes in the field of social security. Since the beginning of 2007, legislative provisions in the researched field and conceptual principles of digitalization of the socio-economic system have been implemented in Ukraine. Complex digitization is aimed at comprehensive and deep transformation of existing analogues of economic and social systems and spheres into new value and quality to ensure social security of the state, society and citizen. Therefore, the authors note the importance of introducing key legislative acts regarding the effective implementation of digital technologies in the further development of social security in accordance with the strategic goals of the state and modern technological trends. The article examines the model of public administration in the field of national security that meets the requirements of martial law. The purpose of the study is to determine the format of the existing public administration in the national security sector, taking into account the challenges of the legal regime of martial law by solving such research tasks as outlining the essence of public administration in the field of national security; research of subjects endowed with administrative powers in the field of national security; determination of the directions of transformation of public administration in the specified area. The research methods are the method of analysis, the method of observation and study of documents, the method of comparison, the method of modeling, and logical methods. As a result of the conducted research, the expediency of Ukraine taking into account the directions of reforming managerial influence on public relations in the field of national security, which are recognized at the level of the European Union, is substantiated. As a condition for the implementation of the necessary changes in the regulation of the security sphere, it is separated from the sphere of defense and the introduction of appropriate changes to the Law of Ukraine "On National Security". The specifics of the institutional support of social relations in the field of national security are identified and the directions for the implementation of the proper doctrine of national security are outlined. The author's definition of the term «information and analytical support of the state defense order in Ukraine» is proposed as a complex of organizational and legal systematic measures aimed at the collection, processing, analysis and generalization of information materials in order to ensure effective planning, coordination, monitoring and control of the execution of State defense orders, which includes the use of modern information technologies, analytical methods and expert assessments, promoting effective management within the defense sector of the state.
