The article discusses the 28th Annual Conference of the European Air Law Association (EALA) that was held at the Royal Castle in Warsaw, Poland on November 3-4, 2016, focusing on the air and space law.

The 59th International Institute of Space Law (IISL) Colloquium on the Law of Outer Space was held from 27-30 September 2016 in Guadalajara, Mexico, in conjunction with the 67th International Astronautical Congress (IAC). Comprised of seven technical sessions and one session for interactive presentations, the Colloquium focused on a range of thematic issues in space law, and featured papers from almost seventy presenters. Topics discussed included the legal aspects related to the remote sensing principles, regional cooperation and Latin American space activities, large satellite constellations, space resource utilization, planetary defence, and spectrum management. The 8th Nandasiri Jasentuliyana Keynote Lecture was delivered by incoming IISL president Kai-Uwe Schrogl, entitled 'Space Law and Diplomacy'. This article describes the origins, reach and limitations of the recently enactedDanish Space Act. The analysis begins with the boldest feature of the Act, the definition of outer space as the area situated above 100 kilometres from sea surface. The article points out that such a provision may be premature bearing in mind the numerous new debates concerning 'protospace'. Furthermore, the potential of this delimitation is affected by the attempt to present it as purely for the purpose of the Act and not as an expression of opinio juris. The article proceeds to discuss issues related to liability of non-state actors, ownership and scope ratione personae and related registration concerns, and the severity of possible sanctions. The conclusion of the article, in spite of a few elements of concern, is that the Danish Space Act should be warmly welcomed and can be considered a highly professional product. Miniaturized satellites (hereinafter 'microsats') are becoming increasingly popular and more accessible to a wider range of industries operating in space. Their size and relative cost efficiency, together with the exponential rate at which technology continues to develop, has enabled their usage to expand from purely research-based missions to commercial missions operated by public and private entities alike. This article explores the factors in favour of the development of microsats and the technical challenges that have resulted from this development. The article summarizes the international regulation of the space industry, including liability for damage caused by space activities, and the ways in which regulation is implemented nationally. The article subsequently addresses the inadequacies of this framework in its regulation of the industry to date (such that registration of such space objects has in fact decreased) and discusses the further challenges the industry will face as it continues to expand, such as inappropriate registration procedures, overcrowding of radio frequencies and increased space debris, resulting in a greater risk of collisions, which has the potential to expose States to vast claims for compensation. It is clear that a more appropriate regulatory regime must be developed to address the development of the microsat industry. [ABSTRACT FROM AUTHOR]

On November 25, 2015, the President of the United States (US) signed into law the US Commercial Space Launch Competitiveness Act. This event received extensive coverage, both in the press and legal literature, mostly due to the content of its Title IV dedicated to Space Resource Exploration and Utilization. Pursuant to Title IV, US citizens shall be entitled under US law to collect, own, transport and sell asteroid and space resources that they have obtained in the course of resource recovery operations. Considering that international space law does not clarify whether space resources can be appropriated and used for commercial purposes, the enactment of the US Commercial Space Launch Competitiveness Act has been deemed by some commentators to amount to a breach of the international obligations of the US. In light of this controversy, the purpose of the present paper is to assess the consistency of the Act with international space law and to discuss the legal and political implications related to its adoption and (future) implementation. As a country with specific geographical situation (equatorial, archipelagic and disaster-prone country), it is the interest of Indonesia to mastering space science and technology and its application. To accommodate the national interest and support the space policy framework, Indonesia in 2013 enacted a comprehensive law for outer space activities, namely Law No. 21 of 2013. This article provides some highlights on the process how the progressive development of international outer space law affects such national space legislation through the adoption of its core principles and norms, both based on hard law, soft law, as well as international standards, common practices and best practices. This contribution stresses Or's contribution to the development of Air and Space Law in Asia in the framework of the International Institute of Air and Space Law of Leiden University which he chaired from 1986-2000. He actively promoted Open Skies and globalization of air transport, while referring to principles of the General Agreement on Trade in Services (GATS). An introduction to the journal is presented in which the editor discusses views on air and space law that Professor Dr. Henri Wassenbergh has expressed during his life.

The article discusses the McGill Declaration on active space debris removal and on-orbit satellite servicing, a product of the third International Interdisciplinary Congress on Space Debris Remediation held at McGill University's Institute of Air and Space Law in November 2011 in Montreal. Under the Declaration, states are encouraged to increase compliance of existing and planned systems. Active removal of space debris and on-orbit satellite servicing should also be taken by all stakeholders.

The article discusses the highlights of the International Interdisciplinary Congress on Space Debris organized by the Institute of Air and Space Law of McGill University in Canada. The First Session which was held in Montreal, Quebec in 2009, focused on the understanding and acknowledgement of the seriousness of the problem. A Draft Declaration on Space Debris that was thoroughly deliberated was issued in the Second Session held in Cologne, Germany in April 2010. Both sessions were attended by experts who participated in their personal capacities.

The article discusses the non-appropriation principle as provided in Article II of the Outer Space Treaty. The principle is considered a fundamental rule in the space law system. The principle provides that the outer space, the moon and other celestial bodies cannot be claimed by sovereignty, use, occupation or other means. To address criticisms of the principle, it is proposed that it should be interpreted as a structural norm of the international law.

On October 4, 2004, the privately built and operated SpaceShipOne flew into suborbital space. There has been no definite definition of outer space despite discussions in the United Nations Committee on the Peaceful Uses of Outer Space and its two subcommittees.

The article reports on the activities of the International Institute of Space Law (IISL) in 2010. In partnership with the International Academy of Astronautics (IAA), the 1st IAA-IISL Conference on Space Law and Policy held in Washington, DC was organized in May. A special session as part of the Colloquium on the Law of Outer Space will be presented in the International Astronautical Conference in Prague, Czech Republic. The book "The Law of Outer Space, an Experience in Contemporary Law-Making," by Judge Lachs will also be republished.
