Biometric and psychological data of humans are the most sensitive data on human behavior. The book's objective is to provide a holistic understanding of key challenges and propose novel, workable, substantive and methodological solutions for navigating current and future legal and ethical needs and dilemmas regarding the processes of developing and using emotional AI. Although both the academic community and political decision-makers continue to intensively discuss issues in the ethical regulation of AI, there is still a very limited understanding of both the opportunities and the risks in connection with emotional AI specifically. Yet, emotional AI is one of the most promising areas of AI developments and applications. Thus, legal incentives such as IPRs are crucial to supporting investment in these fields. Further, these innovations might have negative effects on the privacy and autonomy of natural persons, raising both legal and ethical concerns. Thus, their legal and ethical acceptability, as well as their societal acceptance, might be challenged by several legal provisions in the EU, such as the GDPR; regulations on communications, social platforms, and marketing; and the draft AI Act. Yet, the current legal landscape for emotional AI in Europe is anything but clear – an aspect that becomes even more apparent when we consider the global picture of the regulatory framework for emotional AI. In this book, a diverse team of internationally respected experts addresses these issues, engaging in a multidisciplinary study into techno-economic-legal developments concerning emotional AI, its impacts, and the need for action. Following the 2019 Vienna Manifesto, the book calls for a digital humanism that describes, analyzes, and, most importantly, influences the complex interplay of technology and humankind, for a better society and life, fully respecting universal human rights. The book is organized in three parts: Part I “Background” provides the multidisciplinary background needed to understand digital humanism in its philosophical, cultural, technological, historical, social, and economic dimensions. The goal is to present the necessary knowledge upon which an effective interdisciplinary discourse on digital humanism can be founded. Part II “Digital Humanism – a System's View” focuses on an in-depth presentation and discussion of the main digital humanism concerns arising in current digital systems. The goal of this part is to make readers aware and sensitive to these issues, including e.g. thecontrol and autonomy of AI systems, privacy and security, and the role of governance. Part III “Critical and Societal Issues of Digital Systems” delves into critical societal issues raised by advances of digital technologies. While the public debate in the past has often focused on them separately, especially when they became visible through sensational events the aim here is to shed light on the entire landscape and show their interconnected relationships. Artificial intelligence (AI) has the potential to radically transform our society. It may lead to a massive increase in the capabilities of humankind and allow us to address some of our most intractable challenges. It may also entail profound disruption to structures and processes that have sustained our society over centuries. These developments present a unique challenge to the socio-economic constitutional arrangements which govern our world at national, regional and international level. The deployment of increasingly powerful AI systems, able to function with increasing degree of autonomy, has led to concerns over loss of human control of important societal processes, over the disruption of existing economic, social and legal relationships, and over the empowerment of some societal actors at the expense of others, together with the entrenchment of situations of domination or discrimination. It has also made increasingly clear how tremendous the potential benefits, that these technologies may bring, are to those who successfully develop and deploy them. There is therefore great pressure on governments, international institutions, public authorities, civil society organisations, industry bodies and individual firms to introduce or adapt mechanisms and structures that will avoid the potentially negative outcomes of AI and achieve the positive ones. These mechanisms and structures, which have been given the umbrella term ‘AI governance', cover a wide range of approaches, from individual firms introducing ethical principles which they volunteer to abide by, to the European Union legislating an AI Act, which will prohibit certain types of AI applications and impose binding obligations on AI developers and deployers. The fast pace of innovation in the development of AI technologies is mirrored by the fast pace of development of the emerging field of AI governance, where traditional legislation by public bodies is complemented with more innovative approaches, such ashybrid and adaptive governance, ethical alignment, governance by design and the creation of regulatory sandboxes. Every new tractor now contains built-in sensors that collect data and stream it to cloud-based infrastructure. Seed and chemical companies are using these data, and these agribusinesses are a form of big tech alongside firms like Google and Facebook.The Immaculate Conception of Data peeks behind the secretive legal agreements surrounding agricultural big data to trace how it is used and with what consequences. Agribusinesses are among the oldest oligopoly corporations in the world, and their concentration gives them an advantage over other food system actors. Kelly Bronson explores what happens when big data get caught up in pre-existing arrangements of power. Her richly ethnographic account details the work of corporate scientists, farmers using the data, and activist “hackers” building open-source data platforms. Actors working in private and public contexts have divergent views on whom new technology is for, how it should be developed, and what kinds of agriculture it should support. Il tempo di crisi che viviamo oramai da diversi anni ha determinato le premesse perché le istituzioni europee, alle quali a torto o a ragione vengono attribuite nel comune sentire responsabilità nel peggioramento delle nostre condizioni di vita, debbano affrontare una perdita di consenso. Oramai ciò avviene anche in quelle parti del continente, come il nostro Paese, la cui opinione pubblica aveva fin qui sempre sostenuto con sincera partecipazione il progetto europeo.La Corte europea dei diritti dell'uomo non fa eccezione. In un momento nel quale inevitabili timori per il futuro si accompagnano alla percezione della messa in discussione, che è reale, del modello europeo di stato sociale, anche la Corte, con la sua immagine di pro-tettrice di soggetti che, specie in un momento di penuria di risorse, rischiano di essere percepiti come “nemici”, come i detenuti, gli im-putati nei processi penali, i migranti clandestini, eccetera, si trova a doversi confrontare con polemiche e sentimenti negativi sia a livello di opinioni pubbliche sia a livello di alcuni governi.Per questa ragione la riflessione degli Stati intorno al futuro del sistema europeo di protezione dei diritti umani, un esercizio che ul-timamente ha ricevuto nuovo impulso con le conferenze intergover-native di Interlaken (2010), Izmir (2011) e Brighton (2012), e che al momento è sfociato nella Dichiarazione di Brighton dell'aprile 2012 – a sua volta all'origine dei nuovi Protocolli n. 15 e n. 16, oramai adottati ed aperti alla firma, ed in attesa delle ratifiche necessarie per la loro entrata in vigore – è stato per la prima volta influenzato da preoccupazioni diverse da quelle strettamente legate al buon funzio-namento del sistema, alla sua efficienza, alla sua autorevolezza. Ac-canto a questi temi, che per fortuna sono quelli che hanno motivato la maggior parte degli Stati partecipanti, non sono mancate spinte di segno diverso, le quali originano dalla sensazione, viva presso alcune cancellerie, che la Corte abbia travalicato il suo ruolo, specie por-tando alla sua massima espansione la sua dottrina non-originalist se-condo la quale la Convenzione europea dei diritti dell'uomo (in se-guito: la Convenzione) è uno strumento vivente, che va interpretato alla luce dell'evoluzione economica, sociale e scientifica della socie-tà, operazione che secondo alcuni governi avrebbe condotto la Corte a prevaricare decisioni democraticamente prese dai parlamenti degli Stati.Si spiega certamente così l'inclusione nel preambolo della Con-venzione, ad opera del Protocollo n. 15, dei riferimenti alla sussidia-rietà ed al margine di apprezzamento, un'operazione, quest'ultima, non priva di ambiguità, soprattutto se si pensa che la dottrina del margine di apprezzamento, che verrà presentata nel preambolo come di applicazione generale, in realtà gioca un ruolo esclusivamente in relazione ai diritti limitabili della Convenzione e non rispetto a quelli assoluti.Anche per dissipare certi equivoci e prevenire talune ambiguità, la Corte ha deciso di dedicare la sua annuale riflessione in occasione dell'inaugurazione dell'anno giudiziario nel mese di gennaio 2015 (il seminario “Dialogo tra giudici” che si svolge in quella occasione) proprio alla sussidiarietà ed ai suoi diversi aspetti, prevedendo due sessioni, l'una dedicata alla sussidiarietà vista dalla Corte e l'altra allo stesso fenomeno visto dagli Stati.Il Convegno i cui atti si presentano in queste righe è intervenuto molto opportunamente in questo contesto, stimolando una riflessio-ne, oltre che sulle novità originate dalla Dichiarazione di Brighton, su quello che è veramente il tema cruciale e la chiave del futuro del sistema europeo di tutela dei diritti umani, vale a dire la corretta ap-plicazione della Convenzione all'interno degli ordinamenti degli Sta-ti. Item banking, the storage and classification of test items, is an essential part of systematic assessment. The workshop brought together scholars from around the world to discuss and critically analyze the issues and problems associated with Subjective Probability Measurement (SPM) or the more generic research area called self-assessment. - Abstract
Lyndon B. Johnson and the Politics of Arms Sales to Israel seeks to reconstruct and elucidate the processes behind the decisions made by the Johnson Administration during the years 1965-68 to sell Israel M-48 tanks, A-4 Skyhawk planes and F-4 Phantom planes. This examination is based on a distinction between three factions which competed for influence within Washington's high-policy elite: the traditionalists (whose major representative was Secretary of State Dean Rusk); the pragmatists (whose most outspoken representative was Robert Komer of the National Security Council); and the domestically oriented policymakers (the central decision-maker who quintessentially exemplifies this category being President Johnson). This book is a sequel to: John F. Kennedy and the Politics of Arms Sales to Israel, which examined the first arms deal between the US and Israel.

The principles of equality and non-discrimination are a cornerstone of constitutional law and of international and European human rights law, and there is increasing recognition of the fact that any system of taxation must comply with them. This book examines how these principles influence the tax regimes of eight European jurisdictions. The authors examine the impact of the equality and non-discrimination principles on tax law and policy, with particular reference to their application in national courts and the European Court of Human Rights. The discussion focuses on an individual's right to appeal to the courts, the procedures for judicial review, and the core question of whether objective and reasonable justification exists for instances of unequal treatment of equal cases. Principles of Knowledge Representation and Reasoning contains the proceedings of the Fourth International Conference on Principles of Knowledge Representation and Reasoning (KR'94) held in Bonn, Germany, on May 24-27, 1994. The conference provided a forum for reviewing the theory and principles underlying knowledge representation and reasoning. Topics covered range from reasoning about mental states and spatial reasoning with propositional logics to default logic as a query language. Comprised of 60 chapters, this book begins with a description of a formal language for representing and reasoning about time and action before turning to proof in context and how it can replace the most common uses of reflection principles.
