Hinter dem weiten Begriff'Kriminalität'verbergen sich zahlreiche unterschiedliche Problemlagen, die zwar in der Wirklichkeit des Lebens alle auf die eine oder andere Weise miteinander verknüpft sind, aber dennoch in wissenschaftlicher, praktischer und (kriminal-) politischer Hinsicht einer separaten Analyse bedürfen, wenn man im Grundlagenwissen weiterkommen und Anwendungswissen verbessern will. Krimina­ lität als soziales Phänomen, insbesondere Massenphänomen in modernen Gesell­ schaften, hat andere Gesetzmäßigkeiten denn Kriminalität als Einzelereignis im Alltag oder Kriminalität als Teil einer lebensgeschichtlichen Verstrickung von Men­ schen in eine Art Kreislauf von'Verbrechen und Strafe', die in bestimmten Fällen als ausgeprägte so genannte'kriminelle Karriere'imponiert. Dunkelfelduntersu­ chungen in der Kriminologie haben überall in der Welt in den letzten Jahrzehnten den Befund verfestigt, dass das Begehen von Handlungen, die einem Straftatbestand subsumiert werden können, vor allem bei den männlichen Angehörigen der Normal­ population statistisch normal und sozusagen ubiquitär ist. Das heißt, im Schnitt rund 90%junger Männer geben bei so genannten Täterbefragungen an, Straftaten began­ gen zu haben. Die meisten dieser Taten werden allerdings nicht entdeckt. Und die meisten jungen Menschen bleiben offiziell unauffällig oder kommen, selbst wenn sie einmal polizeilich angezeigt werden, allenfalls vorübergehend'in Schwierigkeiten'. Eine genauere Analyse der Ergebnisse von Täterbefragungen im Dunkelfeld zeigt nun regelmäßig, soweit die Daten überhaupt entsprechende Differenzierung erlau­ ben, dass das Begehen von Straftaten, wenn es auch normal ist, jedenfalls nicht gleich verteilt ist. Vereinfacht: viele Befragte geben nureine oder maximal 3 Strafta­ ten an, wenige Befragte geben viele Straftaten an.

This latest volume in the Penal Theory and Penal Ethics series addresses one of the oldest and most contested questions in the field of criminal sentencing: should an offender's previous convictions affect the sentence? This question provokes a series of others: Is it possible to justify a discount for first offenders within a retributive sentencing framework? How should previous convictions enter into the sentencing equation? At what point should prior misconduct cease to count for the purposes of fresh sentencing? Should similar previous convictions count more than convictions unrelated to the current offence? Statutory sentencing regimes around the world incorporate provisions which mandate harsher treatment of repeat offenders.
