The open access edited volume addresses children's rights and their ability to act in the digital world. The focus is on the position of children as subjects with their own rights and developing capacities. Their consideration by parents, courts and legislators is critically examined. Aspects of digital parenting, especially educational practices and strategies in the context of social media, are analyzed with regard to the tension between protection and participation of children. The edited volume brings debates on privacy and data protection together with those from tort, family and intellectual property law, while also examining the role of families and children in the regulation of data and digital economies, especially online platforms. Legal reflections from Germany, Israel, Portugal and the United States of America are complemented by perspectives from media studies, political science, educational science and sociology of law.

Die Herausforderungen der Digitalisierung sind groß - bisweilen wirken sie unüberwindbar. In der antiken Tragödie erscheint in hoffnungslosen Situationen nicht selten der Deus ex machina, die mittels Bühnenmaschinerie einschwebende Gottheit, und wendet die Situation zum Guten. Ähnlich werden in der Digitalisierungsdebatte mitunter jeweils die Technik oder die Grundrechte beschworen. Zum einen soll die digitale Technik selbst das Potenzial in sich tragen, gesellschaftliche Probleme zu lösen und Antworten auf die großen Fragen unserer Zeit zu geben. Zum anderen wird der Deus in den Grundrechten gesehen, die als Forderung der Digitalisierung entgegengestellt werden. Das Verfassungsrecht hat den Anspruch, das Verhalten und Zusammenleben von Menschen zu ordnen und zu gestalten und seinen zukünftigen Entwicklungen Ziele vorzugeben. Die wichtigsten Ziele sind die in den Grundrechten verbürgten Versprechen freier Entfaltung, gleicher Behandlung und demokratischer Teilhabe. Diese müssen auch unter den Bedingungen der Digitalisierung erfüllt werden.

A obra é resultado dos estudos realizados pelo Grupo de Pesquisa sobre Direito à Mobilidade Humana e Decisões Tomadas por Inteligência Artificial, instituído no âmbito da Escola Nacional da Defensoria Pública da União. We are publishing this book as the result of a research project carried out by the University of Las Palmas de Gran Canaria in Spain and AFM Krakow University in Poland. Some parts of it were already announced during a scientific Conference organised remotely in Kraków in October 2020. Angesichts der fortschreitenden Konvergenz der Medien wird der EU Rechtsrahmen für audiovisuelle Mediendienste hinterfragt. Why should anyone care about the medium of communication today, especially when talking about media law? In today's digital society, many emphasise convergence and seek new regulatory approaches. In Medium Law, however, the ‘medium theory'insights of Harold Innis, Marshall McLuhan and the Toronto School of Communication are drawn upon as part of an argument that differences between media, and technological definitions, continue to play a crucial role in the regulation of the media. Christiana Gransow untersucht anhand von zehn Rundfunksystemen die Implementierungen des Public-Value-Tests. Der Vergleich zeigt, sobald ein Regulierungsmechanismus besteht, der die Angebote der öffentlichen Medienanbieter auf deren Beitrag zur Erbringung des gesetzlichen Auftrags untersucht, wird der Umfang des gesetzlichen Auftrags im Hinblick auf die Onlineangebote und -aktivitäten bewusst weit vom Gesetzgeber gefasst. Die qualitative Untersuchung legt offen, dass lediglich 8 der analysierten Mediensysteme eine Form des Ex-ante-Tests umsetzten und wiederum nur 6 Fallbeispiele das Prüfverfahren anwandten, die allerdings nicht frei von Mängeln sind. Large companies like Facebook respond by pointing to their existing anti-bullying mechanisms or coordinate with nongovernmental organizations to organize anti-cyberbullying efforts. Do these attempts at self-regulation work? In this book, Tijana Milosevic examines the effectiveness of efforts by social media companies—including Facebook, Twitter, YouTube, Snapchat, and Instagram—to rein in cyberbullying by young users. Milosevic analyzes the anti-bullying policies of fourteen major social media companies, as recorded in companies'corporate documents, draws on interviews with company representatives and e-safety experts, and details the roles of nongovernmental organizations examining their ability to provide critical independent advice. She draws attention to lack of transparency in how companies handle bullying cases, emphasizing the need for a continuous independent evaluation of effectiveness of companies'mechanisms, especially from children's perspective. Milosevic argues that cyberbullying should be viewed in the context of children's rights and as part of the larger social problem of the culture of humiliation.Milosevic looks into five digital bullying cases related to suicides, examining the pressures on the social media companies involved, the nature of the public discussion, and subsequent government regulation that did not necessarily address the problem in a way that benefits children. Die Audiovisuelle Mediendienste-Richtlinie hat für die Werbeform der Produktplatzierung in audiovisuellen Mediendiensten weitreichende rechtliche Änderungen herbeigeführt. Mediendiensteanbieter können diese Werbeform nun unter bestimmten Voraussetzungen im Fernsehen und in Telemedien verwenden. Die Arbeit untersucht die Voraussetzungen für die Werbeform der Produktplatzierung, wie sie sich aus der AVMD-RL ergeben, und überprüft die Umsetzung der entsprechenden Vorschriften in Deutschland und im Vereinigten Königreich. Hierbei zeigt sich, dass bezüglich der Regelungen auf allen Ebenen noch offene Rechtsfragen bestehen, für die in diese Untersuchung Lösungswege aufgezeigt werden. Zudem kommt die Autorin im Hinblick auf die Regelungen in Deutschland zu dem Ergebnis, dass diese bezüglich des öffentlich-rechtlichen Rundfunks nicht verfassungskonform sind. Today, consent is a fundamental concept in the European legal framework on data protection.
