This book examines administrative silence in a comparative manner in the EU law and 13 jurisdictions from Europe. Administrative silence is an issue that lies at the intersection of legal and managerial aspects of public administration, a concept that is both reflecting and testing the principles of legal certainty, legality, good administration, legitimate expectations, and effectiveness. Inactivity or excessive length of proceedings appears to be of interest for comparisons, particularly in the context of the recent attempts to develop European convergence models. The book offers in-depth insights into legal regulation, theory, case law and practice regarding positive and negative legal fictions in the selected European jurisdictions.

In the Netherlands, there has been a series of changes of law in order to simplify and improve the complex and fragmented system of environmental law. However, the improvement of sectoral legislation has not led to the desired result. The Dutch legislature now considers a fundamental reform of environmental law necessary. The Environment and Planning Act brings together 26 acts and about 120 governmental decrees in the areas of spatiality and planning, infrastructure, nature, and water in order to create a single act for the physical environment. This book focuses on one of the key instruments of environmental law, the environmental permit. The goal is to introduce a fully integrated environmental permit system. Richmond, Virginia, took center stage globally in the summer of 2020 as an epicenter of antiracist protests in the wake of the police murder of George Floyd. In a period of just a few weeks, overwhelming public support grew for removing Richmond's Confederate monuments. Activists then transformed the remaining statue of Robert E. Lee into a shrine to African American resolve, to the Black Lives Matter movement, and to Black victims of police brutality. Coming to terms with Richmond's tortured racial history, however, is much more difficult than toppling symbols of white supremacy. This book explores these dynamics via a multidisciplinary framework of historical research, public policy analysis, and political analysis, showing the inner dynamics of politics and governance in Richmond. The authors reveal why change and progress has often been so difficult to achieve and why that matters, with a focus on three fundamental policy areas: education, economic development, and housing. The result is a comprehensive assessment of urban governance in a major southern city in the early twenty-first century, as well as an accounting of the policy and human consequences of both its limited successes and its recurring failures.

This book offers a novel approach to studying war and peace by foregrounding motherhood in times of conflict and peace processes from a sociological perspective. Through qualitative research resting on individual and focus group interviews with 55 mothers who had lived through the Northern Ireland conflict, this book examines the gendered nature of coping with conflict and its aftermath in peace processes. Drawing on the idea of everyday life peacebuilding, it discusses how the family is located in the processes of social transformation in conflict-affected societies, and illuminates that mothers play central yet largely unnoticed roles in maintaining and restoring sociability in a conflict-affected society. The book illustrates that mothers have been hidden and underappreciated ‘everyday peacebuilders', as well as hidden and trivialised victims of the conflict.

Climate change is a driver of poverty, poor mental health, inequity, and increased intersectional vulnerability, with significant differential global impacts on individual and community health and well-being. For example, people living in low resource settings in high income countries (HICs) and in low and middle-income countries (LMICs) are at greater risk, often experiencing fragile socioeconomic, political and health infrastructures, and conflict-affected settings (FCAS) that place them at greater risk and vulnerabilities to climate change related mental health impacts. The broad goal of this book is to place a social justice and inclusive lens on climate change and mental health equity focusing on these three key elements: people, place, and community. Constructing Victimhood seeks to go'beyond innocence and guilt'to expand the criminological, victimological, and transitional justice image of who we'see'as victims, what we'hear'as experiences of victimisation, and who makes these determinations. The book argues that the construction, reproduction, and politicisation of victimhood is structured not only by notions of innocence and guilt and the existence of complex victims, but by larger questions concerning the existence of complex hierarchies of victimhood that supersede simplistic notions of'good'and'bad'victims. Lawther also considers the exercise of voice, the role of silence and the silencing of certain variants of victimhood (in gender-based crimes for example), the politicisation of victims'groups and the impact of unresolved legacies of violent conflict. The author argues that in the failure to cast the transitional justice gaze more widely it is not only the'voices in the cracks'that will be overlooked, but entire experiences of victimhood and victimisation. If transitional justice is to live up to its claims of being'victim centred', widening its conceptual and practical boundaries to recognise the multiple and overlapping variables that construct and reproduce victimhood is essential. Pursuing this line of enquiry, Constructing Victimhood aims to change our understanding of victimhood in post-conflict and transitional contexts.

The trauma associated with sexual abuse can contribute to arrested development, as well as a host of psychological and emotional disorders, that some children and adolescents may never overcome.
