De bijdragen in dit Festschrift behandelen diverse onderwerpen van het binnenvaartrecht. Aan de auteurs die aan deze feestbundel hebben meegewerkt werd gevraagd hun bijdrage aan te leveren in het Nederlands, Engels, Duits of Frans, alle vier talen die Resi beheerst. Voor u ligt het resultaat van hun arbeid. De redactie hoopt dat de lezer evenals de jubilaris deze met vrucht en met plezier zal consulteren, en is ervan overtuigd dat dit Festschrift een waardevolle bijdrage zal vormen aan de rechtsliteratuur over het binnenvaartrecht.

This book surveys the economy of Wales from the first Norman intrusions of 1067 to the Act of Union of England and Wales in 1536. Key themes include the evolution of the agrarian economy; the foundation and growth of towns; the adoption of a money economy; English colonisation and economic exploitation; the collapse of Welsh social structures and rise of economic individualism; the disastrous effect of the Glyndŵr rebellion; and, ultimately, the alignment of the Welsh economy to the English economy. Comprising four chapters, a narrative history is presented of the economic history of Wales, 1067–1536, and the final chapter tests the applicability in a Welsh context of the main theoretical frameworks that have been developed to explain long-term economic and social change in medieval Britain and Europe.

The carriage of goods by sea starts off with a contract of carriage, an essentially simple and straightforward contract between two parties, the shipper and the carrier. Very often, however, a bill of lading is issued and a third party appears on the scene: the holder of the bill of lading. The holder was not involved in the making of the contract of carriage, but does have rights, and possibly obligations, against the carrier at destination. The question then is how the third-party holder of the bill acquires those rights and obligations.Analysing the different theories that have been proposed to explain the position of the third party holder, this book makes a distinction between contractual theories and non-contractual theories to explain the holder's position. Contractual theories build on the initial contract of carriage and apply contract law mechanisms while non-contractual theories construe the position of the third-party holder independently. Following the analysis and appraisal of the different theories, this book makes the case that the position of the third-party holder of the bill of lading is not obvious or self-evident; and submits that a statutory approach to the position of the holder of the bill of lading has advantages and would be preferable.

Fresh approaches to how premodern women were viewed in legal terms, demonstrating how this varied from country to country and across the centuries.There has been a tendency in scholarship on premodern women and the law to see married women as hidden from view, obscured by their husbands in legal records. This volume provides a corrective view, arguing that the extent to which the legal principle of coverture applied has been over-emphasized. In particular, it points up differences between the English common law position, which gave husbands guardianship over their wives and their wives'property, and the position elsewhere in northwest Europe, where wives'property became part of a community of property. Detailed studies of legal material from medieval and early modern England, Wales, Scotland, Ireland, Ghent, Sweden,Norway and Germany enable a better sense of how, when, and where the legal principle of coverture was applied and what effect this had on the lives of married women. Key threads running through the book are married women'srights regarding the possession of moveable and immovable property, marital property at the dissolution of marriage, married women's capacity to act as agents of their husbands and households in transacting business, and married women's interactions with the courts. This book uses, principally but not only, a case study of the Denbighshire town of Ruthin to discuss both the significance of Englishness versus Welshness and of gender distinctions in the network of small Anglo-Welsh urban centres which emerged in north Wales following the English conquest of 1282. It carefully constructs an image of the way in which townspeople's everyday lives were influenced by their ethnic background, gender, wealth and social status. In this manner it explores and explains the motivations of English and welsh townspeople to work together in the mutual pursuit of prosperity and social stability.
