En términos generales, los trabajos que hacen parte de la obra colectiva «La Constitución de 1991: el ideal en medio de la tormenta» cuestionan la visión acrítica e idealizadora de nuestra Carta Política propia de las narrativas recurrentes de nuestra bibliografía reciente. De un lado, ponen en tela de juicio la percepción dominante según la cual hemos presenciado un desarrollo lineal y progresivo del discurso de los derechos, para evidenciar, en contraste, contextos de crisis y rupturas que reflejan también importantes retrocesos en la garantía y protección de los derechos, y en la propia jurisprudencia constitucional. De otro lado, también relativizan aquellos planteamientos dominantes que atribuyen los avances conseguidos exclusivamente a la labor de la Corte Constitucional, para lo cual reivindican el papel de los movimientos sociales y las organizaciones de la sociedad civil en las dinámicas transformadoras y reformistas que han permitido significativas conquistas sociales en materia de derechos durante estas tres décadas. La qüestió dels fonaments del poder polític, i del pactisme en particular, ha ocupat un lloc central en la historiografia de la Corona d'Aragó, que ha fet d'aquest darrer no sols una singularitat privativa, sinó també un signe distintiu d'identitat, gairebé tel·lúric i molt arrelat en la idiosincràsia del país. Tanmateix, la negociació política entre el rei i el regne, entre el monarca i els estaments –els braços representats a les Corts–, no era cap singularitat de la Corona catalanoaragonesa, sinó que, amb diferents matisos i intensitat, era una pràctica comuna a tota l'Europa occidental a la baixa edat mitjana. Los sistemas educativos actuales se enfrentan a nuevos escenarios sociales, culturales, económicos e ideológicos que están poniendo en entredicho los modelos que tradicionalmente los han ido conformando. Esto tiene consecuencias tanto en el plano curricular como en el organizativo de los centros escolares, especialmente en el nivel de secundaria. La sociedad knowmádica (neologismo fruto de sincopar knowlodge y nomadic) demanda cambios sustantivos en la educación, acordes con las nuevas formas de conocer, comunicar, aprender y compartir, a las que los docentes han de dar respuesta. El rol transmisor característico de la educación convencional se ve profundamente cuestionado por dichos cambios y hace indispensable pensar en prácticas disruptivas que pongan en valor nuevas epistemologías educativas y nuevas formas de entender la enseñanza. Se trata de abordar los aprendizajes desde la co-construcción entre docentes, alumnado, comunidad y otros actores implicados. Esto supone contemplar experiencias muy diversas que incluyen desde cambios en el diseño del currículum o la incorporación de ámbitos diversos de la cultura y la sociedad hasta prácticas alternativas que ponen en juego otros conocimientos. En el presente trabajo se recogen ocho estudios de caso de experiencias de educación secundaria que tratan de poner en marcha prácticas disruptivas de diferente tipo. Estos casos se han estudiado en el marco del proyecto de investigación del mismo título, en tres comunidades autónomas del territorio español: Andalucía (Málaga y Granada), Extremadura y Castilla-León (Valladolid y Palencia). This is an open access book. What is the history and current state of play of EU law and policy covering irregularised human mobility? What has been the role and contributions of the 2019-2024 European Commission as regards EU migration policy? This book investigates how migration policies have been problematised at the EU institutional level, in particular by the European Commission. It critically assesses the assumptions lying behind the Commission's political priorities, agendas and policy outputs. Through the concept of irregularity assemblages, the book examines how EU policy professionals and bureaucracies in the relevant Commission services problematise their respective mandates/portfolios; how they interact with each other and even compete; and how they frame certain forms of human mobility as being an ‘irregular migration problem'or not. After retracing key historical developments in the framing of irregularised human mobilities at the EU level, the book identifies six policy approaches in the work and structures of the 2019-2024 European Commission. It finds that a home affairs and criminalisation approach that prioritises a law enforcement understanding of cross-border and intra-EU mobility, and pursuing a Ministry of Interior-like agenda, has prevailed. This approach stands at odds with human dignity and other legitimate public policy approaches, such as those giving priority to employment and social inclusion, non-discrimination, and fundamental rights, where the administrative migration status of the individual is not the entry point. The overriding priority driving EU migration policy has been the expulsion, policing and criminalisation of people framed or categorised as ‘irregular migrants'. The analysis shows how Commission has failed to effectively perform its role as guardian of the Treaties and unequivocally enforce and comply with EU Treaty constitutive values, EU law and Better Regulation commitments in migration policies. more...

As globalization and the flow of labor across the world accelerated during the latter part of the 20th century, the presence of foreign-born workers in a country's labor market became one of the most prominent and controversial features of modern economies. Countries that facilitated the arrival of foreign-born individuals often benefited from the increase in labor supply. An important channel for the benefits is through lower prices for consumer goods and services in the host country. This is not surprising because immigration is just another form of international trade, which often leads to cost savings and more diversity in the market. The immigrants themselves have also gained from international migration as it provides an opportunity to improve one's standard of living, pass remittances to family in the country of origin, and find new opportunities for general human flourishing in newly adopted surroundings.Despite the myriad benefits that can result from the free movement of labor around the world, there is still deep concern and political debate about immigration's aftermath. The main economic concern, apart from social concerns such as social cohesion, centers on whether international migrants adversely impact labor market opportunities of natives.The labor market prospects for foreign-born individuals, both in an absolute sense and in comparison to natives, are also very different across continents, as well as between countries that are in close proximity to one another. This book presents a revised and modern vision of cyclic steam stimulation (CSS) processes to the industry and academic community linked to hydrocarbon production, particularly to the technical community related to heavy oil thermal recovery processes. The linking of geomechanical concepts in optimizing productivity and managing these assets is offered. In general, heavy oil-producing reservoirs around the world have high values of permeability prevailing in the geological formations, which has led to not considering their reduction in productivity during the aggressive processes of CSS due to the drastic changes of temperature and pressure that consequently promote essential changes in in-situ stresses, as well as permanent changes in porosity and permeability. In this sense, the analysis of the behavior of the productivity of heavy oil reservoirs when considering the geomechanical effects offers a more realistic playing field to promote productivity optimization processes. These reservoirs are generally made up of poorly consolidated and uncemented formations that, due to the limiting elements of the in-situ conditions as well as the operational variables, promote optimal operating ranges to reduce the effects of loss of permeability in the production of these resources. Therefore, this publication aims to collect and present the geomechanical phenomena associated with the thermal recovery operation with CSS, mainly the affectation of the permeability of the reservoirs that are exploited under this technique. Likewise, it proposes a CSS management strategy that uses the thermal impact on the porous medium in favor of the reservoir's productivity. The scope is to provide a link between reservoir engineering and economic optimization by using sensible permeability models and stress paths to better forecast oil production. To achieve a comprehensive methodology, laboratory testing, simulation, and theoretical developments are presented, bringing the reader a complete view of the phenomena. European Consumer Law has adapted and evolved in response to the rapid growth of e-commerce in the last two decades.
