1. Assessing the Marshall–Lerner condition within a stock-flow consistent model

Abstract

We derive the general equilibrium condition for the terms of trade in a two-country economy model. We show that the Marshall–Lerner condition is only a special case of this condition, in which a full exchange rate pass-through to import prices is assumed. In fact, the Marshall–Lerner condition is not even a ‘useful approximation’ of the general condition. For the full pass-through assumption has destabilising, rather than stabilizing, effects, when it is introduced in a stock-flow consistent dynamic model. More generally, the higher (lower) the pass-through, the slower (quicker) is the adjustment of the economy towards the equilibrium. This is tantamount to saying that the speed of adjustment is a positive function of the strategic behaviour of the exporters, who attempt to retain their market share by keeping their foreign currency-denominated prices unchanged.

Abstract

Le necessità di una revisione delle circoscrizioni giudiziarie è da tempo un'esigenza concreta . I cambiamenti radicali intervenuti nel contesto socio-economico in Italia negli ultimi centocinquant'anni, da quando cioè è stata impostata la geografia giudiziaria tuttora vigente1, hanno reso questo impianto anacronistico, inadeguato e certamente troppo costoso (Carnevali 2014a). Il quadro si è poi aggravato a seguito della crisi economico-finanziaria, che ha influenzato le politiche di riforma dei principali settori di policy, compresa la giustizia, nella direzione della razionalizzazione organizzativa e territoriale, ai fini del contenimento della spesa. In questo capitolo, si presenterà l'intero percorso a partire dalla fase di formulazione della policy, con particolare attenzione a come la issue è stata tematizzata e alle caratteristiche del processo di policy design. Successivamente, sarà illustrata l'implementazione della politica e i suoi effetti. In particolare, saranno messi in evidenza gli obiettivi dichiarati e quanto realmente raggiunto, evidenziando i criteri utilizzati nel processo di riforma. Inoltre, saranno indicati i risultati e le prospettive di sviluppo. Nelle considerazioni conclusive verranno precisate le criticità e le opportunità che questa policy ha messo in evidenza nell'ambito delle politiche del servizio giustizia.

Abstract

Since 2000, Trial OnLine (TOL) is a typical nationwide e-filing project aiming at managing, in a comprehensive way, documents and communications of all civil trial proceedings through digital solutions. Even though it was expected that in 2005 more than 50 courts would have taken advantage of TOL's applications, at the end of 2006 only one application (payment order) was in use and only in one court: the Tribunal of Milan. Now the situation is changed and some other online civil proceedings are progressively spreading. In this chapter, the reasons behind this deep change are investigated. The understanding of the great complexity of legal, technological, organizational, and institutional domains involved in TOL project development has been the goal of our analysis. The simplification of the technological architecture, the modification of the legal framework for promoting legally viable ICT-based practices, and, above all, a close collaboration between courts and bar associations in facilitating user access to e-justice are considered the main factors for the revitalization of TOL when project failure was around the corner.

Abstract

Il presente articolo propone il caso di un progetto per l'introduzione di un sistema per lo scambio elettronico di dati (e-filing) tra forze di polizia e uffici giudiziari. Dalla descrizione del progetto iniziale, del contesto e degli elementi normativi, tecnologici ed organizzativi conosciuti, si passa alla descrizione dell'attività di esplorazione, ridisegno e negoziazione che ha avuto luogo nell'arco di tre anni nel tentativo di trovare una mediazione soddisfacente tra le varie componenti del sistema. La chiave interpretativa che viene scelta dagli autori è quella dell'assemblaggio, inteso come processo ed al contempo risultato dell'interazione di una molteplicità di attori attraverso cui vengono messe assieme componenti eterogenee (organizzative, normative, tecnologiche ed istituzionali) in un "ordine negoziato" che consente al sistema di funzionare almeno temporaneamente. Un sistema costituito da componenti solo debolmente collegate tra loro e che tendono a mantenere le loro specificità. Come le osservazioni effettuate mettono in rilievo, il processo di innovazione derivante dalla realizzazione del progetto avviene in un territorio mutevole e solo parzialmente esplorato. In questa prospettiva, la base installata non è qualcosa che può essere esplorata una volta per tutte e data per scontata. Normativa, opzioni tecnologiche ed assetti organizzativi sono risorse solo temporaneamente stabili in una realtà in cui il tentativo dei vari attori di assemblare il sistema è caratterizzato da azioni contingenti per far fronte ad eventi improvvisi, crisi imminenti e frequenti discontinuità.
