Contracts rule our digital world. Platform terms of service determine speech rights, privacy rights, and much more. This is no accident--from the very beginning, the U.S. model of internet governance was explicitly built around private ordering. In this context, it is worth asking what contract law and contract scholarship have to say about the public harms of digital dealmaking. The answer, quite surprisingly, is: not much. To be sure, the rise of the digital economy has generated over two decades of sustained scholarship and several huge national reform efforts aimed at updating contract law. But this work has largely focused on the procedural fairness of online agreements--especially mutual assent to clickwrap. If ever there were a case to be made for contract law to interrogate both the substance and the social impact of an agreement, today's platform terms of use are it. These are society-wide pacts, and while they are in part commercial agreements outlining the terms of a market exchange, they are also--unlike other commercial contracts--the basic ground rules for our digital society. Moreover, our public laws, from our speech laws to our surveillance laws, often defer to these private agreements, giving them the power to supply and even to supplant constitutional norms. This puts contract law in an uneasy place--effectively leaving private law as the chief protector of public values on the internet. Having contract law play this role is not the first-best solution. Yet as long as we allow contracts to rule our digital society--as long as our internet policy is contractarian-contract law will and ought to play a larger role in policing the public impact of these agreements. In a sense, that would mean building a more public-minded contract law of the sort imagined by scholars going back to the Progressive Era. The alternative would be to give contracts less power to set public rules online. Selon les estimations anterieures, 45% de [...], Contexte: Les donnees de surveillance du cancer sont essentielles pour mieux comprendre les lacunes et les progres realises dans la lutte contre le cancer. Nous avons cherche a resumer les repercussions prevues du cancer au Canada en 2024, en effectuant des projections sur les nouveaux cas de cancer et les deces par cancer, par sexe et par province ou territoire, pour tous les ages confondus. Methodes: Nous avons obtenu les donnees sur les nouveaux cas de cancer (c.-a-d., l'incidence, 1984-2019) et les deces par cancer (c.-a-d., la mortalite, 1984-2020) du Registre canadien du cancer et de la Base canadienne de donnees de l'etat civil--Deces, respectivement. Nous avons projete les chiffres et les taux d'incidence du cancer et de mortalite jusqu'en 2024 pour 23 types de cancer, par sexe et par province ou territoire. Nous avons calcule des taux normalises selon l'age au moyen de donnees de la population type canadienne de 2011. Resultats: En 2024, les nombres de nouveaux cas de cancer et de deces causes par le cancer devraient atteindre 247 100 et 88 100, respectivement. Le taux d'incidence normalise selon l'age (TINA) et le taux de mortalite normalise selon l'age (TMNA) devraient diminuer legerement par rapport aux annees precedentes, tant chez les hommes que chez les femmes, avec des taux plus eleves chez les hommes (TINA de 562,2 pour 100 000, et TMNA de 209,6 pour 100 000 chez les hommes; TINA de 495,9 pour 100 000 et TMNA de 152,8 pour 100 000 chez les femmes). Les TINA et les TMNA de plusieurs cancers courants devraient continuer a diminuer (p. ex., cancer du poumon, cancer colorectal et cancer de la prostate), tandis que ceux de plusieurs autres cancers devraient augmenter (p. ex., cancer du foie et des voies biliaires intrahepatiques, cancer du rein, melanome et lymphome non hodgkinien). Interpretation: Bien que l'incidence globale du cancer et la mortalite connexe sont en declin, il devrait y avoir une augmentation des nouveaux cas et des deces au Canada en 2024, en grande partie en raison de la croissance et du vieillissement de la population. Cancer has a substantial impact on the lives of people living in Canada and on Canadian health care systems. (1,2) Previous estimates suggest that 45% of all people in Canada [...], Background: Cancer surveillance data are essential to help understand where gaps exist and progress is being made in cancer control. We sought to summarize the expected impact of cancer in Canada in 2024, with projections of new cancer cases and deaths from cancer by sex and province or territory for all ages combined. Methods: We obtained data on new cancer cases (i.e., incidence, 19842019) and deaths from cancer (i.e., mortality, 1984-2020) from the Canadian Cancer Registry and Canadian Vital Statistics Death Database, respectively. We projected cancer incidence and mortality counts and rates to 2024 for 23 types of cancer, overall, by sex, and by province or territory. We calculated age-standardized rates using data from the 2011 Canadian standard population. Results: In 2024, the number of new cancer cases and deaths from cancer are expected to reach 247 100 and 88 100, respectively. The age-standardized incidence rate (ASIR) and mortality rate (ASMR) are projected to decrease slightly from previous years for both males and females, with higher rates among males (ASIR 562.2 per 100 000 and ASMR 209.6 per 100 000 among males; ASIR 495.9 per 100 000 and ASMR 152.8 per 100 000 among females). The ASIRs and ASMRs of several common cancers are projected to continue to decrease (i.e., lung, colorectal, and prostate cancer), while those of several others are projected to increase (i.e., liver and intrahepatic bile duct cancer, kidney cancer, melanoma, and non-Hodgkin lymphoma). Interpretation: Although the overall incidence of cancer and associated mortality are declining, new cases and deaths in Canada are expected to increase in 2024, largely because of the growing and aging population. Efforts in prevention, screening, and treatment have reduced the impact of some cancers, but these short-term projections highlight the potential effect of cancer on people and health care systems in Canada.

Les disparites ou iniquites evitables en matiere de sante peuvent en partie etre combattues par des soins de sante primaires et preventifs (1,2). Le fait d'etre defavorise n'est pas une [...], Contexte: Malgre des investissements importants dans un systeme de soins de sante public qui comprend des services preventifs, on continue d'observer des disparites evitables en matiere de sante au Canada. L'equipe avait pour objectif de formuler des recommandations pour des soins de sante preventifs qui puissent ameliorer l'equite en matiere de sante par la priorisation des interventions efficaces a l'intention des groupes defavorises. Methodes: La ligne directrice a ete elaboree par un comite compose de specialistes en soins primaires et de membres de la patientele, avec la contribution d'un groupe de patientes- et patientspartenaires ayant vecu diverses experiences. Apres avoir selectionne les sujets a prioriser, nous avons recense les revues systematiques, les essais randomises et controles recents sur les methodes de depistage et d'autres etudes pertinentes sur l'efficacite du depistage et de la prise en charge. Nous avons utilise l'approche GRADE (Grading of Recommendations, Assessment, Development and Evaluation) pour formuler les recommandations et avons suivi le guide AGREE II (Appraisal of Guidelines for Research and Evaluation) pour rediger le rapport. Il en a ete de meme avec les principes du Guidelines International Network pour la gestion des interets concurrents. Les recommandations ont ete passees en revue par un comite externe d'experts en contenu avant d'etre distribuees a des intervenants a l'echelle nationale pour approbation. Recommandations: Nous avons formule 15 recommandations concernant le depistage et d'autres soins preventifs et 1 recommandation de nature politique visant a ameliorer l'acces aux soins primaires. Ainsi, nous recommandons de prioriser une strategie de communication pour le depistage du cancer colorectal a partir de l'age de 45 ans et pour l'evaluation du risque de maladie cardiovasculaire pour lutter contre les iniquites en matiere de sante et promouvoir la sante. Les interventions particulieres qui devraient etre deployees pour lutter contre les iniquites comprennent l'autodepistage du virus du papillome humain (VPH) et du VIH, et le test de liberation de l'interferon y pour l'infection tuberculeuse. Le depistage de la depression, de la toxicomanie, de la violence conjugale et de la pauvrete devrait egalement permettre aux personnes touchees d'acceder plus facilement a des interventions eprouvees. Nous recommandons une prise de contact systematique avec des professionnels de la sante en soins primaires pour les personnes defavorisees. Interpretation: Les interventions preventives eprouvees peuvent aider a combattre les iniquites en matiere de sante si la priorite est accordee aux personnes defavorisees. Les medecins, les organisations de sante et les gouvernements devraient adopter des mesures fondees sur des donnees probantes et en faire le suivi s'ils veulent promouvoir l'equite en matiere de sante partout au Canada.

Avoidable disparities in health outcomes, or health inequities, can be partly addressed through primary and preventive care. (1,2) People are not inherently disadvantaged--Canada has a long and continuing history of [...], Background: Avoidable disparities in health outcomes persist in Canada despite substantial investments in a publicly funded health care system that includes preventive services. Our objective was to provide preventive care recommendations that promote health equity by prioritizing effective interventions for people experiencing disadvantages. Methods: The guideline was developed by a primary care provider-patient panel, with input from a patient-partner panel with diverse lived experiences. After selecting priority topics, we searched for systematic reviews and recent randomized controlled trials of screening and other relevant studies of screening accuracy and management efficacy. We used the Grading of Recommendations, Assessment, Development and Evaluation (GRADE) approach to develop recommendations and followed the Appraisal of Guidelines for Research and Evaluation (AGREE II) reporting guidance. We managed competing interests using the Guideline International Network principles. The recommendations were externally reviewed by content experts and circulated for endorsement by national stakeholders. Recommendations: We developed 15 screening and other preventive care recommendations and 1 policy recommendation on improving access to primary care. We recommend prioritized outreach for colorectal cancer screening starting at age 45 years and for cardiovascular disease risk assessment, to help address inequities and promote health. Specific interventions that should be rolled out in ways that address inequities include human papillomavirus (HPV) self-testing, HIV self-testing and interferon-Y release assays for tuberculosis infection. Screening for depression, substance use, intimate partner violence and poverty should help connect people experiencing specific disadvantages with proven interventions. We recommend automatic connection to primary care for people experiencing disadvantages. Interpretation: Proven preventive care interventions can address health inequities if people experiencing disadvantages are prioritized. Clinicians, health care organizations and governments should take evidence-based actions and track progress in promoting health equity across Canada.
