This article examines the repeal of prison pay-to-stay policies in the United States. We process-trace reform efforts in Illinois drawing from novel data retrieved through multiple FOIA requests to state agencies and public records searches. Our analysis reveals how lawmakers who advocated for reforming the shadow carceral state in 2016 and 2019 through repealing prison pay-to-stay repurposed penal logics they had once used punitively in the 1980s and 1990s to enact the same policy—such as protecting taxpayers, fiscal efficiency, and rehabilitation. Our findings advance existing research by suggesting that penal logics are open to interpretation depending on the socioeconomic and historical moment. These contextual factors are also crucial to determining how lawmakers and institutions re-interpret long held penal logics when reforming the shadow carceral state. Research on the shadow carceral state identifies new species of criminal-civil and civil-criminal legal hybrids embedded in state law. We bring into conversation disparate literatures on growing family complexity, monetary sanctions, justiciable problems, and child support enforcement to examine how contemporary American families experience a system of double and triple jeopardy—the compounding risks of exposure to both criminal and civil debts at the nexus of a legal hybrid, wherein monetary sanctions (criminal) and child support orders (civil) become co-constitutive (double jeopardy), thereby amplifying the risk that a parent will also experience (civil) child support arrearage (triple jeopardy). Using data from seven sources to construct a unique dataset, we evaluate the spatial and racial risk of double and triple jeopardy, as well as the state-level factors that explain them. Our analysis provides a valid description of, and critically establishes the sociolegal precarity wherein, currently incarcerated parents observe and experience their risks of double and triple jeopardy in the child support system via its orders, collections, and enforcement powers. We find that there are, indeed, racial and spatial disparities in the risk of double and triple jeopardy, and that specific state-level factors increment and decrement those risks. This study examines the intergenerational consequences of court-imposed monetary sanctions for parents and children. Research on punishment and families has generally focused on imprisonment, yet monetary sanctions are far more commonly imposed. We extend research on intergenerational financial exchanges to conceptualize payment of monetary sanctions as stigmatized transfers, analyzing 70 semi-structured interviews with debtholders in Minnesota. Adult children reported perceiving anger and financial strain from family members who provide assistance. Those with minor children expressed hopelessness, stress, and financial strain, as they prioritized basic needs over meeting their outstanding financial obligations. Monetary sanctions are in every part of the criminal legal system. This paper explores monetary sanctions in community supervision (probation and parole). The findings from a mixed-methods, multiple-state research study illustrate how fines and fees are administered, collected, and enforced within community supervision. Supervision officers have little discretion in the number of fines and fees assessed but have more discretion in collecting the payments and punishing or sanctioning nonpayment. The findings in this paper also elucidate how individuals and their social supports experience having to pay monetary sanctions. The burden of financial sanctions is not felt only by the individual on supervision but also extends to the family. AbstractMonetary sanctions are a ubiquitous part of punishment in the criminal legal system. In recent years, highly publicized events have drawn attention to monetary sanctions at the intersection of poverty, race, and legal system contact. The current study uses Autoregressive Integrated Moving Average models to assess monetary sanction reform legislation in St. Louis, Missouri – where the U.S. Department of Justice’s 2015 Ferguson Report implicated monetary sanctions practices as a contributing to tension between the community and the criminal legal system. We find that white defendants experienced an increase in the average amount of fines received (the punishment portion of the sentence), further, the implementation of the reform (modeled as a step function) was associated with increased fee assessments for those receiving monetary sanctions. Further, racial gaps in total assessments across Black and white residents remained, even as fees for Black defendants declined. Our findings highlight how policies can improve some parts of the criminal legal system yet remain insufficient to fully address their stated goals. [ABSTRACT FROM AUTHOR]

Legal financial obligations (LFOs) associated with justice system involvement are increasingly a focus for policymakers and researchers seeking to understand sources of inequality and the factors that promote successful reentry. These conversations often rely on an assumption that LFOs are associated with or may even drive higher rates of recidivism. The empirical research in this area, however, has not kept up with the growing strength of these claims. This study reports findings that may offer a new perspective and contribute to an evidence‐based debate. Multisourced administrative data on all individuals released from carceral supervision in an East Coast state (N = 21,301) over 3 years are used to examine the complex relationship between criminal justice debt and reoffending. We detail the results of survival analyses estimating the impact of these debts on various forms of recidivism. Broadly, we find that even though the relationship between case‐level LFO assessments and future offending did not reach statistical significance, the association with the cumulative effect of monetary sanctions over the life course did. Furthermore, the impact of LFO debt is greater for certain racial groups, supporting theoretical and practical inquiries into factors informing structural disadvantage. Exponential growth in order maintenance policing and associated misdemeanor sanctions have led to disproportionate consequences for people of color. Using data from qualitative interviews with individuals in the metropolitan St. Louis, Missouri, region, the current study documents the racialized and monetized nature of police contact. This work extends extant scholarship by considering how minor contact with the police shapes individual avoidance behaviors and activity spaces, places where people work and live. We consider how the combination of monetary sanctions, warrants, incarceration, and overpolicing in the region affects avoidance behaviors, particularly for people of color. Our findings suggest that the frequently unpredictable nature of police contacts and the parochial and often profit‐focused structure of policing organizations in the region leads individuals to modify the ways in which they move through the region and, for some, to isolate. Narratives reflect the need for constant calibration of behaviors and decisions, as well as the legacy that police contact and monetary sanctions can have on everyday routines. In political science literature, it is often argued that compulsory voting can serve as a remedy against turnout inequality and thereby contribute to more egalitarian societies. However, the literature neglects differences between compulsory voting systems, and most studies consider the obligation to vote as a dichotomous variable. As a result, relatively little is known about the causal effects of particular stimuli and features of compulsory voting. By exploiting quasi-experimental conditions from direct-democratic decision-making in Switzerland, this research assesses the degree to which abstention fines account for a citizen's willingness to vote under a compulsory voting context. The findings reveal that a marginal increase in monetary sanctions for voter-abstention leads temporally to a sizeable increase in turnout. However, it does not necessarily contribute to the expression of preferences by those traditionally underrepresented in direct-democratic decision-making since a third of those motivated to vote by the threat of a heavier fine will cast an empty or invalid ballot. Decades of significant crime declines and recent reductions in the number of people confined in prisons and jails in the United States have been accompanied by the emergence of new, and the resurgence of old, forms of punishment. One of these resurgent forms is the assessment of fines, fees, and costs to those who encounter the criminal legal system. Legal financial obligations (LFOs) have become widespread across the United States and are levied for offenses from alleged traffic violations in some states to felony convictions in others. Their emergence has been heralded by some as a less punitive alternative to spending time in prison or jail but recognized by others as uniquely consequential for people without the means to pay. Drawing on data from 254 counties in Texas, this article explores the emergence and enforcement of LFOs in Texas, where LFOs play a particularly prominent role in sanctions for alleged misdemeanor offenses and serve as an important source of revenue. Enforcement of LFOs varies geographically and is related to conservative politics and racial threat. Child support arrears and criminal monetary sanctions are two forms of state-imposed debt that have gained increasing attention for their role in perpetuating inequality. Although past research recognizes that both groups of debtors tend to be socioeconomically disadvantaged and are disproportionately members of marginalized racial groups, the overlap between these populations has not been examined. Our study uses administrative data to link individuals from both groups, providing the first description and comparison of three populations of debtors—those with only criminal legal debt, those with only child support debt, and those with both types of debt—highlighting disparities and the compounding nature of both types of debt. We then draw on 30 in-depth semistructured interviews with individuals subject to state surveillance from both forms of debt, emphasizing three key themes that emerged: debt as carceral vulnerability, the relative salience of each type of debt, and perceptions of fairness. Monetary sanctions can expand the scope and depth of punishment. Most research on monetary sanctions has centered on fines and fees assessed by the court, but they are also routinely imposed as part of the probation and parole sentence. In this article, we draw on in‐depth interview data from a sample of individuals under correctional supervision to document the often hidden costs of correctional control. We further consider a subsample of participants convicted of sexual offenses to illustrate the unique way that monetary sanctions are levied on groups of people who are considered more morally culpable and worthy of carceral control. We find that monetary sanctions are regularly assessed and challenging for most participants. The stigma of a sexual offense conviction and economic precarity, particularly among Black members of the sample, further the costs of punishment. We contend that costs associated with a sexual offense are unique because they can continue in perpetuity, govern normative behavior, and are centered on an assumption of continued guilt. We argue that the monetary sanctions levied against convicted persons, especially individuals with sexual offenses, demonstrate the often hidden and expansive nature of carceral control for other marginalized groups. This research aimed to identify the causes of the low imposition of fines on the illegal trade of wild fauna in Colombia, and to identify how much of the responsibility falls on the current methodology that Colombian environmental authorities must use to calculate these fines (i.e., “Methodology for the Calculation of Fines for Infringement of the Environmental Normative”). For this purpose, a survey was applied to public officials belonging to Colombian environmental authorities. The results revealed that these entities have several reasons for not imposing fines on the illegal trade of wild fauna. The most important cause is the fact that the referred methodology does not serve the purpose of estimating fines on this illicit activity, since its variable “Degree of environmental affectation” was not designed to be calculated on fauna. This impossibility of calculating fines on the illegal trade of wild fauna has generated two types of behaviors in Colombian environmental authorities: 1) some have refrained from imposing fines on this illicit activity (thus impeding a deterrent effect); and 2) others have modified the methodology (thus breaching the principle of legality), in order to be able to the calculate the fines in the case of this illicit activity. Therefore, given that neither of these two behaviors is suitable, this research calls for the Government of Colombia to enact a new or modified methodology to calculate fines for environmental infringements that adjusts to the characteristics and environmental affectations of the illegal trade of wild fauna. Neoliberal governance has become a defining feature of our social world, fast‐tracking the commodification of human interaction, particularly within capitalist economies. Neoliberalism's intensification of capitalist social relations shifted social institutions such as education, healthcare, and criminal justice to resemble profit‐oriented enterprises. A preeminent consequence of this shift for the administration of criminal justice is the rapid expansion of monetary sanctions in the form of pay‐to‐stay fees. Our article contributes to scholarship on neoliberal governance and social institutions by exploring how lawmakers justify and frame the imposition and recoupment of pay‐to‐stay fees. We draw from a novel dataset compiled by the authors on pay‐to stay in the state of Illinois, which consists of state‐level pay‐to‐stay statutes, transcripts of legislative debates on the ratification of pay‐to‐stay statutes, and 102 civil complaints from 1997 to 2015 initiated on behalf of the Illinois Department of Corrections against currently and formerly incarcerated people to compel the payment of pay‐to‐stay fees. Our analysis suggests that in the era of neoliberal governance, consumerism is an institutional logic that lawmakers draw from to adopt pay‐to‐stay as a legal template in an effort to foster a producer–consumer relationship between incarcerated people and the state, thereby producing incarceration as a public commodity. Over the last several decades, with the rise of mass incarceration in the United States and its steep costs, governments at the federal, state, and local levels have dramatically ramped up monetary punishment. Monetary sanctions are now the most common type of criminal penalty in the United States. The growth of fines, fees, and other legal financial obligations (LFOs), and the ensuing legal debt, reflect a shifting of the system's costs onto its primarily low-income and indigent subjects. This study provides an exploration of previously underexamined ways in which monetary sanctions impose distinct burdens on the poor. Interviews with 121 defendants in Texas and New York, along with courtroom observations, demonstrate that criminal legal debt is particularly challenging for people with low incomes in three meaningful ways. First, systems set up to handle indigency claims do not adequately address the needs or complex individual circumstances of those who simply do not have the ability to pay. Oftentimes, alternatives are unavailable or statutorily prohibited. Second, the lack of alternatives to payment lead to compromising situations, which then compel indigent defendants to make difficult choices about how to allocate scant resources. Finally, being encumbered with fines and fees and participating in alternatives like community service comes with taxing time requirements that can prove uniquely challenging for those who are poor. These three findings lead us to propose a series of policy recommendations revolving around three key themes: (a) enhancement of indigency procedures, (b) equity in monetary sanctions, and (c) alleviating burdens by improving accessibility. Monetary sanctions levied on individuals on probation and parole may dramatically influence their ability to reintegrate into the community and to complete their community supervision. Yet very little work has empirically assessed how agencies respond to these obligations. This is critical, given that individuals under community supervision occupy a liminal space: free in the community yet often at risk of violation, rearrest, additional fines, or re-incarceration. In this article, we introduce an approach to the collection and management of monetary sanctions by an adult probation and parole agency in one Pennsylvania county. This specialized department focuses solely on repayment of fines, fees, and costs for a subset of probationers and parolees who have completed all other supervision requirements. We complement the conceptual overview by presenting administrative data on this caseload (N = 5,811) to describe the population under supervision and assess the factors associated with debt amount, having difficulty with repayment, and being the subject of an enforcement action for non-payment. We conclude with a discussion of the advantages and disadvantages of this model compared with historical and other existing models of debt enforcement during community supervision. Monetary sanctions in the criminal legal system are legally and procedurally complex. If not paid in a timely manner, a single conviction can result in multiple legal financial obligations, varying in kind, payment procedure, and consequences. This study examines how, and the extent to which, criminal legal debtors understand monetary sanctions. Based on interviews with 60 individuals who owed criminal legal debt in New York, we propose a typology of debtor understanding. Proximal understanding pertains to individual, case-level factors and is instrumentally oriented. Distal understanding concerns system-level matters and is oriented toward normativity and fairness. The expansion of monetary sanctions constitutes what Beckett and Murakawa describe as the "shadow carceral state," where covert penal power is expanded through institutional annexation by blending civil, administrative, and criminal legal authority. A growing body of work on monetary sanctions has begun to dissect covert penal power by tracing increased civil and administrative pipelines to incarceration, civil financial alternatives to criminal sanctions, and innovations to generate criminal justice revenue. However, institutional annexation and innovation in the form of contemporary pay-to-stay practices remain understudied and undertheorized. In this article, I first examine statutes and practices to theorize pay-to-stay as exemplary of the shadow carceral state—an outcome of legal hybridity and institutional annexation legitimated using the legal construction of "not punishment," which frames monetary sanctions as non-punitive. Second, I expand Beckett and Murakawa's framework to argue pay-to-stay practices reveal how the shadow carceral state compounds or initiates the civil death of those charged. I broaden our notion of civil death to include financial indebtedness to the shadow carceral state. I suggest covert penal power expands through the accumulation of resources extracted from people marked for civil death through criminal justice contact. Finally, I conclude that monetary sanctions such as pay-to-stay reveal how the shadow carceral state expands covert penal power through necrocapitalism, meaning institutional accumulation occurs through dispossession and the subjugation of life to the power of death. Monetary sanctions are a common tool for enforcing accountability within the criminal justice system. However, it is unclear how individuals with disabilities who have a limited capacity to work interact with the system of monetary sanctions. Drawing on courtroom observations and interviews in Washington State, we find that although the court does take disability into account when imposing economic sanctions and monitoring payment compliance, individuals with disabilities end up in a perpetual cycle of administrative hearings that can result in serious financial and health consequences for those involved. The importance of monetary sanctions as a topic of sociological inquiry derives from both their ubiquity in American criminal justice and the socioeconomic realities of many people, especially those ensnared in the criminal legal system. This essay reviews the literature on monetary sanctions across various fields, including applied research, economics, criminology, political science, public policy, and sociology. Early approaches tended to be more system evaluations, whereas later work emphasizes the structural determinants of monetary sanctions and their impacts. Restitution as a social practice can simultaneously have a punitive effect and add to a person's criminal justice debt load, while maintaining a reparative and therefore restorative component. We use principles of restorative justice to assess restitution as a concept and a practice, drawing on data from a survey experiment administered to a nationally representative sample (n = 433). We find that the common and strongly preferred conception of restitution is "direct," entailing a convicted person compensating a victim for quantifiable loss. Evidence from Victim Compensation Funds (VCFs) in all 50 states demonstrate the widespread use of "indirect" restitution, through which funds from various sources are distributed to qualifying victims. Broader trends in criminal justice policy related to the centering of the victim and a managerial approach to punishment help explain our findings. Due to increasing recognition of the collateral consequences associated with monetary sanctions, fees have begun to occupy a prominent place in critical debates. This is especially true for community corrections, where multiple fees are assessed and collected. However, the agency-level perspective has largely been omitted, especially regarding how the current landscape may facilitate—or impede—reform. Using self-report data from a state-wide sample of Chiefs of Probation and Parole, this paper provides a new perspective on the complex interplay between the policy and practices surrounding monetary sanctions. Responses suggest that the practices and philosophies surrounding the collection of fees vary significantly between jurisdictions. This obligation is also reported to challenge the traditional roles of probation officers by limiting discretion and complicating the existing tensions between their treatment and control-oriented responsibilities. Some respondents indicated meaningful reliance on fee revenue for operational and treatment budgets. Using a comparative historical analysis of legislative transcripts and primary and secondary historical documents in Illinois and Michigan, we trace the adoption of a largely understudied form of monetary sanction: pay-to-stay fees. Pay-to-stay fees are financial commitments imposed by the state on incarcerated individuals for the day-to-day cost of their incarceration. Our study identified two mutually constitutive bureaucratic motivations for the adoption of these fees—austerity as the primary rationale and deservingness as a secondary rationale. This analysis highlights an earlier conceptualization of monetary sanctions as a means of revenue generation than has previously been explored. Our findings suggest that pay-to-stay fees originated in these states from broader debates about who is ultimately fiscally responsible for the welfare state and the soaring costs of maintaining the rehabilitative ideal. This paper examines retrospective accounts of how that process occurs by exploring the following research question: how does one's involvement in the juvenile legal system, which includes monetary sanctions, shape peoples' views of law and legal institutions and with what consequences? Based on 19 interviews with adults who have legal debt from both juvenile and criminal legal systems, the paper focuses on four aspects of the long-reaching effects of juvenile legal involvement and juvenile monetary sanctions: legal socialization, adultification, legal cynicism, and future aspirations. In all these aspects, we show the organizational constraints that shape individuals' perspectives about the law and the impact of monetary sanctions on their lives. Recent critiques of the decision to make monetary sanctions a condition of probation have suggested that the practice could hinder the successful completion of probation. However, few studies have explored this relationship empirically, and among those that do, the findings are relatively inconclusive and often dependent on the sample and measures used. Building on this research, the current study examines the imposition of four monetary sanctions on a sample of felony cases involving indigent adult probationers from a Florida public defender’s office. The results indicate that although monetary sanctions have relatively little impact on probation violations generally, the effects of these penalties vary based on the severity of the violation. The paper discusses the role of punishment in a criminal justice system by elaborating its functions. It focusses mainly on monetary sanctions (fine) as a type of punishment under the criminal law and analyzes its efficiency on the basis of the punishment theories. With specific reference to the Indian Penal Code, 1860 the paper categorizes the placement of monetary sanctions in the statute into three variants: where the amount of sanction is mentioned in the provision, where the amount of fine is not mentioned in the provision and where monetary sanctions stand as an alternative to imprisonment in the provision. The paper critiques the third variant as a commodification of offence and provides suggestions to update the statute to enable the efficiency of monetary sanctions as a type of punishment in criminal law. Recent research suggests that the use of monetary sanctions as a supplementary penalty in state and federal criminal courts is expanding, and that their imposition creates substantial and deleterious legal debt. Little is known, however, about the factors that influence the discretionary imposition of these penalties. This study offers a comprehensive account of the role socio-cultural factors, especially race and ethnicity, have in this institutional sanctioning process. We rely on multilevel statistical analysis of the imposition of monetary sanctions in Washington State courts to test our theory. The theoretical framework emphasizes the need to treat race and ethnicity as complex cultural categories, the meaning and institutional effects of which may vary across time and space. Findings indicate that racialized crime scripts, such as the association of Latinos with drugs, affect defendants whose wrong-doing is stereotype congruent. Moreover, all individuals accused of committing racially and ethnically stigmatized offenses in racialized contexts may experience the courtesy stigma that flows from racialization. We find that race and ethnicity are not just individual attributes but cultural categories that shape the distribution of stigma and the institutional consequences that flow from it. During the late 20th century, imprisonment rates in the United States saw unprecedented growth, leading correctional systems across the country to face widespread overcrowding and underfunding. Subsequently, policy makers sought out alternatives to incarceration for certain categories of offenses. Community supervision, such as probation, emerged as a popular solution to both reduce prison and jail populations as well as to generate revenue to fund the rapidly expanding legal system. With the rise in community supervision came increases in the number of people on probation for lower-level and non-violent offenses. The expansion of legal financial obligations (LFO) placed additional burdens on these persons, who disproportionately sit in lower socio-economic status brackets. Using data from the 1995 Survey of Adults on Probation (SAP), the current study adds to the literature on probation and LFOs in an important way. The SAP data contain information on the amount, frequency, and type of LFO. Thus, this paper examines the distinct types of LFOs to determine the differential burden that each type of LFO has on people on probation. This paper finds that of all types of fees, those associated with victim restitution are most likely to lead to missed payments, while those that generate revenues do not contribute significantly to missed payments. Traffic stops and tickets often have far-reaching consequences for poor and marginalized communities, yet resulting fines and fees increasingly fund local court systems. This paper critically explores who bears the brunt of traffic fines and fees in Nevada, historically one of the fastest growing and increasingly diverse states in the nation, and one of thirteen US states to prosecute minor traffic violations as criminal misdemeanors rather than civil infractions. Drawing on legislative histories, we find that state legislators in Nevada increased fines and fees to raise revenues. Using descriptive statistics to analyze the 2012–2020 open arrest warrants extracted from the Las Vegas Municipal Court, we find that 58.6% of all open warrants are from failure to pay tickets owing to administrative-related offenses—vehicle registration and maintenance, no license or plates, or no insurance. Those issued warrants for failure to pay are disproportionately for people who are Black and from the poorest areas in the region.
