The present article is the result of research on current tendencies of international trade regulation. Research was based on an inter-disciplinary method where approaches of political economy and international relations were used to analyze the major challenges of multilateral trade regulation in the World Trade Organization. The China effect, the lack of political support of the United States during the administration of expresident Donald Trump, as well as internal failures of the system are all considered as possible causes of the current crisis of the World Trade Organization. Nevertheless, the clash of the Chinese state capitalist system with the multilateral trading system based on market economies is considered as a major factor of the current crisis. The Trade War is a manifestation of this crisis. Current trade regionalization is discussed as another dangerous driving force present in the world trading system. Solution based on perspectives of transnational law is also proposed to avoid the development of patchwork globalization. [ABSTRACT FROM AUTHOR]

One of the most significant possible impediments of the implementation of the Colombian Peace Agreement is vested in the various failures of rulemaking in Colombia. The present article introduces the theory of globalized nation-state based on a selected literature review on theories regarding economic and political processes of contemporary societies. The theory of globalized nation-state proposes to resolve the State paradox and co-optation of the Colombian State introducing political debate with the participation of all members of society in rulemaking. For this reason, it is argued that the proposed theory of globalized nation-state is applicable for the analysis of the implementation of the Colombian Peace Agreement, especially its First Chapter regarding Comprehensive Rural Reform. The present article discusses the development of agricultural policies between the 1970s and the two periods of government of President Álvaro Uribe-Vélez. The agricultural policies are analyzed in their wider framework of relevant, general aspects of the economy in Colombia. It is argued that the challenges of agricultural policies are constant and repetitive since the beginning of the analyzed period: debate about production structure - large scale production versus small farming, production for industrial use and food production; levels of protection of national market versus integration into the international market; competitiveness versus lack of technological development and general infrastructure. The present article discusses the dairy sector related issues of the Common Agricultural Policy (CAP) in the European Union, being, for this purpose, one of the most important agricultural sub-sectors. The historic development of CAP demonstrates its protectionist nature from its origins; although its recent reforms seem to recognize growing market orientation. The CAP has been influenced by changing policy paradigms, whereas multifunctionality prevails and result in the exceptional treatment of agriculture. Public policy actors exercise significant influence on the development of CAP. Therefore, the post-2013 CAP projections are analyzed considering the different interests of dairy sector stakeholders. This article aims at discussing the Santos government agricultural policies in relation to dairy farmers in Colombia. The dairy sector has been regarded as the agricultural sub-sector most negatively affected by FTAs signed by the Colombian government, especially with the United States and the European Union. Consequently, there is a need for clear public policies for milk producers in Colombia. There are some changes in the approach to agricultural policies by the Santos government. However, it will be argued that conceptual clarity is needed on the priorities of these policies, especially considering aspects of export orientation, local production and rural development. This article discusses current European Union foreign policy developments and their application in Latin America including the possibility of negotiating a bi-regional partnership agreement between the European Union and the Andean Community. The way from an Association Agreement to a Free Trade Agreement is also analysed presenting the different viewpoints of the negotiating parties and possible ideological differences. The Eurolatinamerican interregional space theory and its application in the bi-regional integration process are also presented. In the conclusions concerns are expressed regarding the future of biregional partnership negotiations especially between integrations with asymmetries. [ABSTRACT FROM AUTHOR]

This article is the result of an interdisciplinary research project "Legal, Economic and Social Policies for the Sustainable Development in Colombia" of the research group Grupo Interdisciplinario en Desarrollo y Derecho "Interdisciplinary Group in Development and Law" implemented at the Pontificia Universidad Javeriana Law School. As a sub-project of the above mentioned research project the limitations of Corporate Social Responsibility were studied through a field research implemented at the Mining Project Cerrejón of the Department La Guajira in Colombia. Cerrejón is the largest open air coal mine in the world. The Mining Project has been developing since 26 years. During this period the indigenous community wayüu has been facing the challenges to share their original habitat with the Mining Project. This relationship between indigenous wayüu community, the Mining Project Cerrejón and the Departmental Government of La Guajira presented contradictions and has resulted in cooperation as well as fights and misunderstandings between the various actors. The social project PAICI implemented by the Mining Project Cerrejón is one of the outstanding examples of the community related aspects of Corporate Social Responsibility and not only in the mining sector. On the other hand, this project benefits only around 20% of the indigenous wayüu in the Department La Guajira , wayüus who in substantial numbers have lost their land, some of them without proper resettlement and compensation as a result of the expansion of the Mining Project. There are several questions to raise: how to match different interests such as development of a mining project, social-cultural-economic development of an indigenous group with the priorities and responsibilities of public policy making. In this article the theory of sustainable governance is proposed to analyze these questions with the firm conviction that development should find its compromises for the benefit of all actors through the functioning of an advanced system of public policies to manage conflicting interests.
