Why are there time limits to criminal investigations in Spain if, in practice, such limits have not accelerated the pace of criminal investigations? In this article, we analyze the relevance of such time limits in order to guarantee the suspect's constitutional rights of defense and to a fair trial in a reasonable time, according to the Spanish Supreme Court Judgment no. 455/2021, of 27 May. Despite Palestine's endeavour to seek full UN membership and herewith gain the support of the international community, strong tendencies towards violating basic fair trial principles can be observed on the ground. This article provides an in-depth exploration of the current Rule of Law building efforts in the occupied Palestinian Territories by an exemplary analysis of the status of the right to defence. The study examines the legal situation of the right to defence in Palestine and how those regulations are interpreted and applied in everyday practice. Considering recent developments of access to legal defence and legal aid on the UN and EU level, this article demonstrates the importance of granting comprehensive access to defence as part of the rule of law building efforts, and also underlines the necessity of its application during the early stages of criminal procedure. The Italian Constitutional Court in its Judgments 106/2009 and 40/2012 had to define its fole in the oversight of official secrets. In previous judgments the Italian Constitutional Court had pronounced itself upon the role of the ordinary courts on this field but not upon his own role. In the judgments 106/2009 and 40/2012 the Italian Constitutional Court also deals will the question of the collision between the right to denfece and the need to protect national security.
