In this exploratory study we examine a less scrutinized aspect of multistakeholder arrangements: the presence and directionality of hegemonic power in the language used in the stakeholder deliberations. Specifically, we examine the deliberations of ten stakeholder groups of ICANN's policy development body. Using meeting transcripts from 2011 to 2020, we operationalized hegemony as a latent, dependent variable (HEIN) by linking stakeholder participation to the policymaking agenda. We employed a mixed-methods approach comprising textual linguistic analysis (using DICTION 7.1), principal components analysis, and an autoregressive moving average model to identify the statistical significance of key variables that emerged from textual linguistic and principal components analyses. We found that three primary rhetorical devices – participatory evangelism, quiet politics, and glorification of the status quo – were present, which reinforce the entrenched power structure that favors some stakeholders and interfere with other stakeholders' efforts to influence Internet governance decisions. In addition, four Diction variables, Commonality, Leveling Terms, Satisfaction, and Commonality at the GNSO (Generic Names Supporting Organization) level, yielded a positive impact on the production of hegemony, and Insistence was negatively associated with HEIN. This article explores the archetype of the judge of the Court of Justice of the European Union (CJEU). As an atypical supranational institution that straddles the dual role of both international and national judge, the CJEU is influenced by the coexistence within it of different legal cultures. This affects both the profile of its judges and the way in which they carry out their work. The article focuses in particular on the eligibility requirements laid down in treaties, the role played by the so-called Article 255 panel and its shaping of the profiles of judges, and the delicate issue of mandate renewals. The author, in his capacity as a judge of the General Court, provides personal insights into the impact that the existence of multiple languages of proceedings, the use of French as the only working language, the absence of dissenting opinions and the functioning of the judges chambers have on the internal workings of the Court. Finally, the article remarks the significant changes that the CJEU is undergoing in light of the proposal of 30 November 2022 to transfer some questions referred for preliminary rulings from the Court of Justice to the General Court. The corporation remains a critical agent in the production of geographically uneven development. Furthermore, time is critical to the practices and deliberations taking place within corporations, yet it has been underappreciated within prominent economic geographical analyses. This article argues for the examination of the 'black box' of the corporation, as a site producing uneven development, and through which the temporalities of decision-making and deliberation are critical. Combined with the temporal insights of Harvey's 'social' and 'experiential' space–times, conventions theory is utilised to elucidate the importance of the corporate deliberations and practices that come to produce uneven development. A conventions approach importantly provides a framework in which to examine the role of both conventionalised behaviours and how conventions are used in heterogeneous experiential space–time deliberations and decision-making and how this is interwoven with social spaces–times. Such an approach is critical in conceptualising the corporation as a deliberative social and experiential space–time series of sites and through which it is reified as a temporary instantiation. Deliberative democracy is for many the most significant development in democratic theory in the last 50 years and it has been used in some places to solve real-world policy problems. However, measuring the impact of deliberative methods is not clearly achievable because several independent variables are manipulated simultaneously. One of the main goals of deliberation is opinion change and thus it is important to understand why opinions change. This paper utilises comparison groups in order to isolate the impact of deliberation from information in the deliberative process. We outline the results of a quasi-experiment in which deliberation took place in a citizens' assembly (CA) in Ireland. As part of this we measured the impact using pre- and post-test controls, including a group given the information the CA participants received, but without the deliberation. Decision-making in the Council of the European Union appears highly consensual at the voting stage. However, we focus on Council deliberations, where we find higher levels of contestation. What drives government opposition in the Council? Using a novel approach of studying the Council through video footage of its public deliberations (DICEU – Debates in the Council of the European Union), we demonstrate that contestation between governments is, at least in part, driven by their responsiveness to domestic public opinion. Analysing deliberations on legislative packages in the Economic and Financial Affairs Council between 2010 and 2015, we show that governments are responsive to public opinion when setting out their policy positions, but primarily when the policy issues are salient domestically. Objective: to configure the management of nursing care, according to the Resolutions of the Federal Nursing Council. Methodology: a qualitative, exploratory-descriptive, documentary type study whose data source constituted the Council's legislation Federal University of Nursing, from 1975 to 2017, available on its website. The Resolutions were organized into Microsoft Word tables and analyzed in MaxQDA® software. Results: based on the Resolutions of the Federal Nursing Council, the results of this study showed that the nurse is the professional who acts as nurse care manager. Among the 33 Resolutions that met the inclusion criteria, three categories were identified and analyzed: private assignments for nursing management; duties and obligations in the managerial scope and the professional autonomy for the managerial practice. Conclusion: the nurse has private activities, professional autonomy, duties and obligations and prohibitions directly related to their performance in the management of services and nursing care. Jim Fishkin's important book sets out a number of challenges to the conventional wisdom of political scientists and lawyers (and, for that matter, pundits and politicians) about what would count as serious "reform" of a now much-criticized system of elections and political representation within the United States and elsewhere. Drawing from both ancient Athens and the findings of contemporary political philosophy and empirical political science, Fishkin's work is essential reading for anyone interested in the health of our polities, at home and abroad, especially as they come under ever more challenges that are calling the maintenance of liberal constitutionalism into doubt. When considering the validity of international criminal tribunals, focus is typically and appropriately upon areas of substantive law and procedure and questions of prosecutorial policy. However, to the extent that it is within the capacity of judges to address and resolve challenges to the validity of the institution, in order for judges to formulate and implement effective solutions to those challenges it is imperative that an institutional culture is cultivated that is conducive to those ends. This paper explains the relationship between judicial culture and institutional legitimacy, and highlights how recent jurisprudence of the International Criminal Court (ICC) suggests that there is a need for the adoption and implementation of measures to promote the development of a robust institutional culture conducive to resolving the challenges faced by the ICC. Abstract: We model monetary policy decisions as being taken by a group of heterogeneous policy makers, organized in a committee. Intuitively, when MPC members disclose and discuss the arguments behind their view on the interest rate, the quality of the collective decision should be higher compared to merely taking a simultaneous vote. We show that in some cases this intuition need not be correct. We also find that communication is a relatively effective way to implement the ‘knowledge pooling’ argument in favor of collective decision-making, compared to expanding the size of a committee. Moreover, decision-making with internal communication appears generally more robust in situations when heterogeneity of members is not adequately captured by decision-making rules. This article addresses the difficult matter of interpreting the best interest principle, and offers advice for those who must make laws, and those who make decisions within the constraints of those laws. Our approach rests on an assumption that conclusions about best interest are best reached through a reasoned deliberative process. We suggest that legislators should not write substantive assumptions about what is best for every child into their laws; rather, they should indicate a non-exhaustive list of key relevant considerations that decision-makers can review and evaluate in each and every case. Further, the child's own perspective should be imperative in all deliberations about best interest, and a distinction must be made between objective fact and what is invoked as a substantive and contestable assumption. Abstract: We analyze group decision-making in situations in which members discuss the value of a continuous random variable, then take an up-or-down vote based on their assessments of the continuous variable. Applications include jury deliberations and tenure and promotion or partnership votes. We determine conditions under which the group can reach a consensus on the value of the continuous variable, conditions under which the group fails to reach an agreement on the up-or-down vote, and when the outcome of a successful up-or-down vote matches the consensus on the continuous variable.
