Are Truth and Reconciliation Commission processes enough to achieve reconciliation? This volume discusses issues that arise once the task of reconciliation emanates from the limited scope of a specific Truth and Reconciliation Commission and into the larger society and political system that originated it. Scholars spanning several research fields, from law to history to theology, discuss how transformative reconciliation can be cultivated in a society, using decolonization and other perspectives, along three lines: by specifying transformative issues and processes in law and politics, by criticizing historical perspectives on the past and its concepts as deliberations of the status quo, and by instilling the inherent dynamics of truth and reconciliation processes as permanent features within broader society. The volume embarks on an investigation of the Norwegianization policy, a historical framework that brought injustices upon minority groups, such as the Sami and Kvens (Norwegian Finns) in Norway, and parallel groups in Sweden and Finland. It extends its exploration to analogous unjust policies in South Africa, Canada, and various other contexts. Within the complex web of cultural, social, political, and economic struggles stemming from colonial policies, the roles of religion, politics, research institutions, and civil society are critically examined.

This book draws together interdisciplinary perspectives to examine the legal, moral, and socio-spatial regulation of sex work in the contemporary context. With a thematic focus on the gendered landscape of sex work, formal and informal methods of socio-spatial control, and (in)access to justice, this book explores the role of space in the regulation of sex work in diverse contexts, from the local to the global. The chapters collectively bring together complex, inter-related issues that impact the lives of sex workers throughout the world, providing evidence of the impacts of regulation on sex workers and subsequent barriers to accessing justice and rights. This book explores child vulnerability in various contexts from a cross-country, comparative perspective. It shows how vulnerability in childhood develops within subjects in relationships with other people (other children, parents, specialists, such as teachers, social workers, and judges), how it is created by welfare, health care, education, and justice systems, and is empowered by multiple crises, such as the COVID-19 pandemic, wars and natural disasters. The authors hope to enhance dialogue between childhood studies and children's rights studies through these discussions. The role of children's agency and autonomy, including their right to participate in decision-making processes related to their own life, has a special emphasis in this book. Importantly, the book discusses ethical considerations and challenges connected to the participation of vulnerable children in research. It also adds insights into domain-based child vulnerability, particularly through participatory action research with extremely vulnerable children with traumatic pasts in Estonian substitute care and Ukrainian children with refugee status in Estonia. This book examines the timely issue of police stops as a public and political issue, focussing on the European states. Contrary to much other work it focuses on wider Europe and the social and political context in which the police practice of stopping citizens emerges, develops and can be curtailed. More specifically, the volume analyses public controversies about police stops, i.e. events in which conflicts emerge about how the performance of police stops is explained and justified. This book stems from an EU COST Action research network on Police Stops which engages academics and practitioners from 29 countries. It appeals to those in law, criminology and policing studies with some potential for wider interest in cultural studies/history and public policy/politics, as well as to practitioners in police scrutiny, oversight and other professional bodies and in training organisations.

This book provides a transdisciplinary assessment of multiple countries'legal and policy frameworks vis-à-vis the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication, adopted in 2014 by the Committee on Fisheries of the Food and Agriculture Organization of the United Nations. Based on an appraisal framework used to facilitate the unpacking of those frameworks, this book collects country experiences and regional perspectives on a range of cross-cutting issues underpinning the protection of the rights and the promotion of justice for small-scale fishers and their communities.This book aims to be the first collection to present a systematic and in-depth assessment of existing national legal and policy frameworks vis-à-vis the SSF Guidelines. This assessment is done through the transdisciplinary and collaborative work of researchers, governments, and civil society organizations for the analysis of the cross-thematic questions, which the contributors of this book aim to address. Firstly, what are the relevant laws and policies that matter for securing rights of small-scale fishers and their communities? How are small-scale fisheries defined by national laws and policies? How are small-scale fisheries treated (i.e., specifically or generally) in these instruments? Are there specific provisions and references to small-scale fisheries or any of its associated terminologies (e.g., artisanal, subsistence, traditional, indigenous)? Secondly, how the relevant instruments address the 8 small-scale fisheries key issues outlined in that rapid appraisal study? What are the strengths and gaps in these instruments? Do they address issues that are not covered by the SSF Guidelines? Do they contribute to clarifying other legal issues that are relevant for sustainable small-scale fisheries? Finally, since the book also aims to explore the accessibility of these legal and policy instruments for those to which they matter the most (the small-scale fishers), the following questions were also considered: What challenges do they face in knowing and understanding the relevant laws and policies in place? Which tools, measures and processes are available in the countries to ensure small-scale fishers can claim for their rights? Virtuous institutions, such as human rights ones, have been neglected by securitization theory's focus on the national state apparatus as the key driver of security politics. T​his book critically explores how and to what extent artificial intelligence (AI) can infringe human rights and/or lead to socially harmful consequences and how to avoid these. The European Union has outlined how it will use big data, machine learning, and AI to tackle a number of inherently social problems, including poverty, climate change, social inequality and criminality. The contributors of this book argue that the developments in AI must take place in an appropriate legal and ethical framework and they make recommendations to ensure that harm and human rights violations are avoided. The book is split into two parts: the first addresses human rights violations and harms that may occur in relation to AI in different domains (e.g. border control, surveillance, facial recognition) and the second part offers recommendations to address these issues. This book provides a new framework for conducting qualitative research into Asylum Seeking Refugees based on Emmanuel Levinas'ethic of the face-to-face encounter. The methodology originates in the term Midrash—a narrative form that exposes; investigates; searches. It reconceptualises encounters between Asylum Seeking Refugees and those researching their experiences in a manner that moves beyond the possibility of ‘Othering'and the removal of ‘voice'that can characterise research into refugees. This methodology allows a complex and rich multidimensional text, with heterogeneity of voices, experiences, and subjects. As a phenomenological method of research, the internal phenomena of the researcher—feeling, intuition, and personal perception—are legitimate sites of knowledge and understanding, and are not considered separate from the external, objectively observable world. While the researcher is not researching herself, she is also not separate from the research field and data. TheMidrash methodology is an honest and explicit method of research designed to (re)invigorated the passion of academics and researchers.

The impasse currently affecting human rights as a language used to express struggles for dignity is, to a large extent, a reflection of the epistemological and political exhaustion which blights the global North. Since the global hegemony of human rights as a language for human dignity is nowadays incontrovertible, the question of whether it can be used in a counter-hegemonic sense remains open. Inspired by struggles from all corners of the world that reveal the potential but, above all, the limitations of human rights, this book offers a highly conditional response. The prevailing notion of human rights today, as the hegemonic language of human dignity, can only be resignified on the basis of answers to simple questions: why does so much unjust human suffering exist that is not considered a violation of human rights? Do other languages of human dignity exist in the world? Are these other languages compatible with the language of human rights? Obviously, we can only find satisfactory answers to these questions if we are able to envisage a radical transformation of what is nowadays known as human rights. Herein lies the challenge posed by the Epistemologies of the South: reconciling human rights with the different languages and forms of knowledge born out of struggles for human dignity.

The UN Convention on the Rights of Persons with Disabilities has facilitated the understanding that disability is both a human rights and development issue. This Open Access book is an anthropological urban study of the Emirate of Dubai, its institutions, and their evolution. It provides a contemporary history of disability in city planning from a non-Western perspective and explores the cultural context for its positioning. Three insights inform the author's approach. First, disability research, much like other urban or social issues, must be situated in a particular place. Second, access and inclusion forms a key part of both local and global planning issues. Third, a 21st century planning education should take access and inclusion into consideration by applying a disability lens to the empirical, methodological, and theoretical advances of the field. By bridging theory and practice, this book provides new insights on inclusive city planning and comparative urban theory. This book explores tribal land alienation problems in India and tribal agitation against land encroachment and alienation. It discusses India's tribal land problem and explains how despite legislation to protect tribal lands, the problem has not been resolved since neither the letter nor the spirit of the law has been implemented. Due to continuous land encroachment and alienation by outsiders, the negligence of the revenue administration and the apathy of the central and state government, the situation concerning tribal land in the country have became precarious. In this context, the book highlights the process of land estrangement among the tribes and the related movements, focusing on the Narayanpatna land movement in the Koraput district of Odisha. It argues that land remains a central issue that is extremely important for tribes as it directly affects their life, livelihood, freedom and development, and that the cultural attachment of tribes and their views regarding the idea of ‘place'(land) furnishes crucial perspectives in understanding the politics of collective resistance. It also discusses the politicization of group identity and material interest against the outside authority as the basis of the unrest among the tribes, and when the grudges of the people are hardened due to insensitivity and tyranny, the extent of tribal resistance escalates, leading to conflict between the state and its own people. This book examines how genocide survivors rebuild their lives following migration after genocide. Drawing on a mixture of in-depth interviews and published testimony, it utilises Bourdieu's concept of social capital to highlight how individuals reconstruct their lives in a new country. New and unremitting violence linked to state, inter-state, and private actors has precipitated a renewal of social movements, many of which act in concert with human rights ethos and legal conceptions. Yet, cultural studies has so far had little engagement or institutional connection with these movements. How can cultural studies as a progressive discipline think with, and make space for, rights-inflected legal and humanitarian practices? This book considers the ways in which cultural humanism and the critical approach to rights, and more broadly between culture and law, can be brought together to open a new intellectual space to allow cultural studies to better engage with the current challenges presented by social and political struggles worldwide. This book offers a materialist critique of mainstream human rights discourse in the period following 9/11, examining literary works, critical histories, international declarations, government statutes, NGO manifestos, and a documentary film. The author points out some of the contradictions that emerge in contemporary rights language when material relations are not sufficiently perceived or acknowledged, and he directs attention to the role of some rights talk in maintaining and managing the accelerated global project of capital accumulation. Even as rights discourse points to injustices—for example, injustices related to labor, gender, the citizen's relationship to the state, or the movement of refugees—it can simultaneously maintain systems of oppression. By constructing subjects who are aligned to the interests of capital, by emphasizing individual “empowerment,” and/or by containing social disenchantment, it reinforces the process of wealth accumulation, supports neoliberal ideologies, and diminishes the possibility of real transformation through collective struggle.

This book analyses post-deportation outcomes and focuses on what happens to migrants and failed asylum seekers after deportation. Although there is a growing literature on detention and deportation, academic research on post-deportation is scarce. The book produces knowledge about the consequences of forced removal for deportee's adjustment and “reintegration” in so-called “home” country. As the pattern of migration changes, new research approaches are needed. This book contributes to establish a more multifaceted picture of criminalization of migration and adds novel aspects and approaches, both theoretically and empirically, to the field of migration research.
