Freedom of thought is one of the great and venerable notions of Western thought, often celebrated in philosophical texts – and described as a crucial right in American, European, and International Law, and in that of other jurisdictions. In contemporary Japan, 85% of children in alternative care remain housed in large welfare institutions, as opposed to family-based foster care. This publication examines how Japan has been isolated from global discourse on alternative care, urging a shift in social work and alternative care policies. As the first ethnographic account from inside child guidance centres, it makes a key contribution towards understanding the closed world of Japan's social services; including the decision-making processes by which a child is removed from the family and placed into care. In addition, regional variation in policy implementation for alternative care is outlined, with reference to detailed case studies and a discussion around organisational cultures of the child guidance centres. Where foster care is constructed as anything other than professional, it is often seen as a threat to the child's family-bond with their natal parent and therefore not used. The fact that post-socialist European Union (EU) countries are struggling with implementation of the EU's social inclusion policy is well known. But why is that so? Are the problems solely connected with how inclusion policies are enforced, or could it just as likely be the way policies are designed that creates challenges? This book explores experiences with inclusion policy implementation in seven different post-socialist EU countries. In this ethnographic investigation of a special education needs college in Australia, Jocelyn D. Avery explores how the self-identity of people with severe intellectual identities is influenced by carers and support people in their lives. Employing theoretical foundations of self-identity and embodiment and drawing largely on Mary Douglas's (1996) notions of ritual and hygiene, purity and danger, Avery argues that students in this environment are treated as though they exist in a vacuum, rather than a highly complex social environment: strategies to ‘contain'their difficult selves ultimately lead to continued confinement, as if the students themselves were ‘contaminated'. In the midst of this much-needed ethnography, Avery meditates on her own role: matters of consent, communication, and cooperation pose a challenge to anthropological engagement with severe intellectual disability, but researcher ethics and positionality have their own difficulties. The reflection provided here will provide a guide for future researchers to sensitively engage with people with disability.

This book investigates various experiences of teaching sexual and reproductive health to adolescents with disabilities. Following the adoption of the UNCRPD, adolescents with disabilities still commonly suffer from widespread violation of their rights particularly concerning sexual and reproductive health – often being viewed as either asexual or hypersexual. This book addresses the legal feasibility of ethnic data collection and positive action for equality and anti-discrimination purposes, and considers how they could be used to promote the Roma minority's inclusion in Europe. The book's central aim is to research how a societal problem can be improved upon from a legal perspective. The controversy surrounding ethnic data collection and positive action severely limits their use at the national level. Accordingly, legal and political concerns are analysed and addressed in order to demonstrate that it is possible to collect such data and to implement such measures while fully respecting international and European human rights norms, provided that certain conditions are met.Part I focuses on ethnic data collection and explores the key rules and principles that govern it, the ways in which this equality tool could be used, and how potential obstacles might be overcome. It also identifies and addresses the specific challenges that arise when collecting ethnic data on the Roma minority in Europe. In turn, Part II explores positive action and the broad range of measures covered by the concept, before analysing the applicable international and European framework.
