This open access book studies disability inclusion in humanitarian crises. It addresses the challenges of recognizing and including persons with disabilities and indicates the degree to which disability is being mainstreamed in international law and humanitarian action. Further, it explores how international organizations have promoted a rights-based understanding of disability in international law, and to what extent this understanding has gained acceptance in humanitarian policy and practice. Theoretically, Funke and Dijkzeul explore the robustness of the disability inclusion norm cluster during processes of institutionalization, translation, and implementation. The book examines these processes from a multi-level perspective, which involves a variety of actors beyond states, including organizations of persons with disabilities. Situating their analysis within the literature on humanitarian action and development, the authors argue for an increased focus on processes “below” the international level in international relations and international law scholarship to better understand disability inclusion.

This open access book is the first to offer a systematic overview of the different methods for assessing brain development and a comparative review of how such assessments have already influenced the law. Lawmakers prefer to draw clear distinctions, but biology is characterized by continua: both in terms of how development proceeds within a person and how it differs from other people. However, this does not mean that age limits are arbitrary. This book extends the author's previous research on the Dutch juvenile criminal law, which was founded on the brain development of adolescents and has been in use for more than a decade. The role of age limits in death and life sentences in the US and the new cannabis legislation in Germany are also analyzed in depth. This project combines biological, psychological and social knowledge and puts forward a pragmatic proposal to connect the two fields of brain development and law. It will be of interest to researchers, professionals (e.g. judges, legislators) and students alike.

This book draws together interdisciplinary perspectives to examine the legal, moral, and socio-spatial regulation of sex work in the contemporary context. With a thematic focus on the gendered landscape of sex work, formal and informal methods of socio-spatial control, and (in)access to justice, this book explores the role of space in the regulation of sex work in diverse contexts, from the local to the global. The chapters collectively bring together complex, inter-related issues that impact the lives of sex workers throughout the world, providing evidence of the impacts of regulation on sex workers and subsequent barriers to accessing justice and rights. This collection centres the regulated lives of sex workers, using an intersectional lens that highlights the gendered and racialised impacts of stigma. This book focuses on the spaces and practices of caring for horses, explored in a series of case studies set across the equine lifespan. For horses, everyday practices of care as well as ever-changing understandings of what is good care directly shape their living conditions and lives with humans. In this book, questions of animal ethics and welfare are approached in a tangible way by exploring the relationships and practices of interspecies care across a range of different spaces, including horse yards, training grounds, farms, rescue centres and the street. This book offers a focused and detailed insight into the health and wellbeing of prison staff, specifically focussing on prison leaders and managers. The authors bring together expertise from psychology, health, law, and criminology, to present a unique multidisciplinary examination of health and wellbeing based on interviews with Prison Governors'Association members. Examining how the participants described their health and wellbeing at work and at home, the authors reveal dysfunctional culture, disenchantment and disengagement, the heavy weight of expectations and high levels of professional uncertainty relating to the future. It argues that more governor grade specific and arguably mandated support is needed. Recommendations from the book will contribute to improving health and wellbeing amongst the governor work force, feeding into positive outcomes in relation to staff retention and prison expansion challenges.

This book takes James Gilligan's theory of shame and violence as a starting point for an application of the model across disciplines (psychology, sociology, philosophy, political science, cultural studies, history, architecture and urban studies) and levels of analysis (from the individual to the global). It critically engages with shame theory, exploring the existential origins, the emotional, linguistic, cognitive and cultural manifestations and symptoms of shame—in the mind, in the body, in public space and in the civic culture—and its relationship with other emotions, such as anger, guilt and pride. This book explores how discursive psychology (DP) research can be applied to disability and the everyday and institutional constructions of bodymind differences. Bringing together both theoretical and empirical work, it illustrates how DP might be leveraged to make visible nuanced understandings of disability and difference writ large. The authors argue that DP can attend to how such realities are made relevant, dealt with, and negotiated within social practices in the study of disability. They contend that DP can be used to unearth the nuanced and frequently taken for granted ways in which disability is made real in both everyday and institutional talk, and can highlight the very ways in which differences are embodied in social practices – specifically at the level of talk and text. This book demonstrates that rather than simply staying at the level of theory, DP scholars can make visible the actual means by which disabilities and differences more broadly aremade real, resisted, contested, and negotiated in everyday social actions. This book aims to expand conceptions of disability and to deepen the – at present, primarily theoretical – critiques of medicalization.

Freedom of thought is one of the great and venerable notions of Western thought, often celebrated in philosophical texts – and described as a crucial right in American, European, and International Law, and in that of other jurisdictions. What it means more precisely is, however, anything but clear; surprisingly little writing has been devoted to it. In the past, perhaps, there has been little need for such elaboration. As one Supreme Court Justice stressed, “[f]reedom to think is absolute of its own nature” because even “the most tyrannical government is powerless to control the inward workings of the mind.” But the rise of brain scanning, cognition enhancement, and other emerging technologies make this question a more pressing one. This volume provides an interdisciplinary exploration of how freedom of thought might function as an ethical principle and as a constitutional or human right. It draws on philosophy, legal analysis, history, and reflections on neuroscience and neurotechnology to explore what respect for freedom of thought (or an individual's cognitive liberty or autonomy) requires.

In this ethnographic investigation of a special education needs college in Australia, Jocelyn D. Avery explores how the self-identity of people with severe intellectual identities is influenced by carers and support people in their lives. Employing theoretical foundations of self-identity and embodiment and drawing largely on Mary Douglas's (1996) notions of ritual and hygiene, purity and danger, Avery argues that students in this environment are treated as though they exist in a vacuum, rather than a highly complex social environment: strategies to ‘contain'their difficult selves ultimately lead to continued confinement, as if the students themselves were ‘contaminated'. In the midst of this much-needed ethnography, Avery meditates on her own role: matters of consent, communication, and cooperation pose a challenge to anthropological engagement with severe intellectual disability, but researcher ethics and positionality have their own difficulties. The reflection provided here will provide a guide for future researchers to sensitively engage with people with disability.

This book investigates various experiences of teaching sexual and reproductive health to adolescents with disabilities. This handbook questions, debates and subverts commonly held assumptions about disability and citizenship in the global postcolonial context. Discourses of citizenship and human rights, so elemental to strategies for addressing disability-based inequality in wealthier nations, have vastly different ramifications in societies of the Global South, where resources for development are limited, democratic processes may be uncertain, and access to education, health, transport and other key services cannot be taken for granted. In a broad range of areas relevant to disability equity and transformation, an eclectic group of contributors critically consider whether, when and how citizenship may be used as a lever of change in circumstances far removed from UN boardrooms in New York or Geneva. Debate is polyvocal, with voices from the South engaging with those from the North, disabled people with nondisabled, and activists and politicians intersecting with researchers and theoreticians. Along the way, accepted wisdoms on a host of issues in disability and international development are enriched and problematized. Disabled children's lives have often been discussed through medical concepts of disability rather than concepts of childhood. Western understandings of childhood have defined disabled children against child development ‘norms'and have provided the rationale for segregated or ‘special'welfare and education provision. In contrast, disabled children's childhood studies begins with the view that studies of children's impairment are not studies of their childhoods. Disabled children's childhood studies demands ethical research practices that position disabled children and young people at the centre of the inquiry outside of the shadow of perceived ‘norms'. This book presents the outcomes of a field action project at the Tata Institute of Social Sciences (TISS). Project Chunauti (English translation: Project Challenge) focused on a group of intellectually disabled, orphan children who were survivors of abuse, exploitation and neglect, and describes their journey toward empowerment. It offers a vision and a reproducible, adaptable model for rehabilitation that can foster the social re-integration of intellectually disabled orphans at institutions. As the implementation of laws is especially important for vulnerable groups, the book also outlines a socio-legal approach that not only impacts the children directly, but can also bring about policy level reforms.Project Chunauti was born out of the need to explore options for these children and to set standards for their care, protection, rehabilitation and social re-integration. The core objectives of the project were to provide support and services, including counseling, education, life skills and vocational skills training, as well as medical and psychiatric support to help them overcome the trauma of abuse and exploitation. Its further goal was to train the staff of state-run homes and state authorities, helping them prepare and implement care plans and rehabilitation, combat child sexual abuse and malnutrition, employ positive disciplining, and better understand disabilities. The book also draws on the Project team's experiences of rolling out the replication process in Maharashtra. This book highlights the role of the courts, media and other stakeholders in the journey towards empowerment and justice. It is a combination of social-work methods, application and implementation of law and legal advocacy, as well as best practices for protecting children's rights and developing rehabilitation and re-integration projects for intellectually disabled, orphaned children in India. The interventions detailed here provide a reproducible, adaptable model of intervention for children in institutional care across the country.

Self-Selection Policing introduces and explores an approach for crime control which seeks to identify active, serious offenders by attending to the minor offences they commit. A foundation of theory and evidence is first supplied for the assertion that ‘those who do big bad things also do little bad things'. Original research presented in the book includes a study of offending by visitors to a prison, and the concurrent criminality of those committing common driving offences and failure to produce driving documents as required. It illustrates how self-selection can complement other police methods of identifying active, serious criminals by focusing on what offenders do rather than who they are and what they have done in the past. Concentrating on the ‘usual suspects'in the conventional way is often criticised as harassment and self-selection policing largely bypasses the issue of fairness this raises. The book concludes with a call for the consideration, development and wider adoption of the self-selection approach, and particularly the identification of other common minor offences which flag concurrent active criminality. The authors make important suggestions for the progression of SSP research and practice, including the identification of barriers to the implementation of the approach in wider police thinking, practice and policy. Practical guidance is also provided for those thinking of developing, testing and implementing the approach. In doing so, the book will be of particular interest for policing practitioners, as well as students and scholars of policing and crime control.

This book critically explores ways of thinking about the city and its relevance for the profession of social work. Disability Servitude traces the history and legacy of institutional peonage. For over a century, public and private institutions across the country relied on the unpaid, forced labor of their residents and patients in order to operate. This book describes the work they performed, in some cases for ten or more hours a day, seven days a week, and the lawsuits they brought in an effort to get paid. The impact of those lawsuits included accelerated de-institutionalization, but they fell short of obtaining equal and fair compensation for their plaintiffs. Instead, thousands of resident and patient-workers were replaced by non-disabled employees. Disability Servitude includes a detailed history of longstanding problems with the oversight of the sub-minimum wage provision in the Fair Labor Standards Act oversight. Beckwith shows how that history has resulted in the continued segregation and exploitation of over 400,000 workers with disabilities in sheltered workshops that legally pay far less than minimum wage.
