This book provides a rigorous investigation into the adoption and culture of human rights in Nigeria, with a focus on the human rights attitudes of Nigerian students. Exploring the perceived paradox of enthusiastic endorsement of human rights instruments and their poor application in Nigeria, the author uses an empirical-theological research design to understand how young people in Nigeria evaluate human rights and which factors trigger their evaluation. In doing so, this book is the first to empirically examine the predictors of human rights attitudes among Nigerians and provides new insights into the degree of social significance of the religiosity of adolescents in the country. It also offers a compelling quantitative analysis differences in human rights attitudes among Nigerian youth along religious lines. Given the importance of a culture of human rights in our increasingly diverse societies and the salience of religion on this matter in Nigeria, and across the Africancontinent, this book provides a valuable perspective on the interrelationships between religion, value orientations, personality traits, socio-political context, and human rights. Being concerned with the future of human rights in Nigeria, the author argues that it is crucial to understand ‘the religious factor'among Nigerian students today. This open access book critically examines the policies and practices related to climate-related human mobility in Asia-Pacific and the legal and policy protection framework for climatically displaced migrants (CDMs) through an interdisciplinary human rights-based approach. While covering the policy and theoretical dimensions of mobility, it also evaluates the issue through empirical studies. The book illustrates how interdisciplinary rights-based approaches address and identify gaps in the protection framework for the region regarding dimensions of climate change displacement, migration, forced migration, susceptibility to climate change, and typology of climate change-induced displacement. Presenting multiple case scenarios, it recommends a legal mechanism based on human rights in a region brimming with variety and multiculturalism. Bringing together voices from the Asia-Pacific Academic Network on Disaster Displacement, the book examines issues that are immediately relevant in countries where they are living and working. In addition to academic perspective, the chapters also bring perspectives from positions held in national human rights institutions and government. This book explores child vulnerability in various contexts from a cross-country, comparative perspective. It shows how vulnerability in childhood develops within subjects in relationships with other people (other children, parents, specialists, such as teachers, social workers, and judges), how it is created by welfare, health care, education, and justice systems, and is empowered by multiple crises, such as the COVID-19 pandemic, wars and natural disasters. The authors hope to enhance dialogue between childhood studies and children's rights studies through these discussions. The role of children's agency and autonomy, including their right to participate in decision-making processes related to their own life, has a special emphasis in this book. Importantly, the book discusses ethical considerations and challenges connected to the participation of vulnerable children in research. It also adds insights into domain-based child vulnerability, particularly through participatory action research with extremely vulnerable children with traumatic pasts in Estonian substitute care and Ukrainian children with refugee status in Estonia. As a clue, the book examines the concept of dignity and looks forward to a new definition. So far, the concept of dignity has been peripheral to the concerns of liberal social sciences. This book uses the concept of dignity as a source of light to illuminate the fundamental critique of liberal social sciences and philosophy. Can the theory of justice or discourse ethics truly realize the well-defined society it envisions in a fundamentally contingent, uncertain, and ambiguous situation? Can societies be inclusive of minorities relegated to the periphery with their dignity undermined? Can we resist the temptation to construct huge hierarchical stairs, forcing individuals to place themselves on one of its steps, and thus lining up different and diverse entities in along sequence, and eventually bringing about totalitarianism? This book has a three-level telescopic structure. At the very front, there is a scope of reexaming the political liberalism in the light of dignity. Behind it is a scope of reconstructing a theory of justice in modern society. Further behind it, there is a scope encompassing reflection on the methodology of liberal social sciences and philosophy. We leave it to the reader's imagination as to which scope to read this book through, and what image will emerge from the three scopes taken together. This book explores the challenges that international law faces in curtailing human rights violations arising from mineral exploitation. Beginning with the specific dynamics between mineral exploitation and human rights abuses, the analysis progressively uncovers the layers of regulatory challenges, focusing on the complexities of how economic regimes intersect with, and often undermine, human rights protections. This perspective shows how the fragmentation of international law is not only affecting the capability to protect global interests but also threatening the systemic operation of international law. In this regard, this work presents three expressions of how the fragmentation of international law impacts the response to violence in mineral exploitation. First, fragmentation influences legal operators'classification and objective setting for situations; second, it shapes the selection of response tools, limited by these objectives; and third, it creates conflicts in applying international obligations pertaining to distant special regimes, where the interpretations rendered by decisionmakers are inherently biased towards the interests of the special regime to which they pertain.

This book examines the timely issue of police stops as a public and political issue, focussing on the European states. Contrary to much other work it focuses on wider Europe and the social and political context in which the police practice of stopping citizens emerges, develops and can be curtailed. More specifically, the volume analyses public controversies about police stops, i.e. events in which conflicts emerge about how the performance of police stops is explained and justified. This book offers an extensive research work to explore the accessibility of women with disabilities and financial insolvency to social safety net program in rural Bangladesh. The book examines the impact of intersectional identities in accessibility to the human rights in a contextual setting. The authors have also scrutinized the existing policies to identify policy gaps and provide some policy recommendations from this insightful study. Apart from narrower view of the targeting method or implementation of social safety net program on targeting beneficiaries, this research has combined gender and disability in a study framework with making a focus on the Allowances Program for Insolvent Persons with Disabilities provided by Government of Bangladesh. They have argued that intersectional identities (gender, disability, financial insolvency) have influenced over the accessibility to social safety net program as well as identified the challenges of accessibility which provides a broader view of practices of public administration of Bangladesh and enlightens on social and cultural context creating barriers in accessibility to human rights of women with disabilities. The authors argue for bringing changes of the service delivery of the program by bringing change in policies according to human right-based treaties. This book is useful to policy makers, international donor agencies, government officials, and NGOs.

This book focuses on the economic analysis of refugee law and the protection of refugee rights. It offers a law and economics model applied to migration and states. The book focuses on the most critical ‘push'factors that impact lawmakers in enacting and modifying asylum law. Furthermore, the book examines the economic advantages and disadvantages of a centralized supernational asylum law (acquis communautaire) that could, eventually, eliminate competition between legal orders in asylum law and do away with the negative externalities caused by ‘asylum shopping'. The book critically analyses international refugee law, pursuing an interdisciplinary approach. Its principal goal is to explore refugee law through the lenses of the law and economics approach and against the backdrop of a human rights approach. After explaining the evolution of the human rights approach, the book elaborates on the legal and economic factors that impact refugees, on the one hand, and public policy, on the other. In conclusion, a balance that considers the national preferences of destination countries and the protection of refugee rights is proposed.

Under the Fourth Republic since 1999, the challenge Nigerian leaders face like never before is how to create a state that matches the expectations of their diverse peoples at home and abroad. Taking this proposition as starting point, this book advances proposals for a human-right policy, referred to alternately in the work as principled foreign policy, for Nigeria under the Fourth Republic, taking advantage of the inestimable opportunity afforded by General Muhammadu Buhari's departure from the political scene on May 29, 2023, after the famine, domestically and externally, wrought by his two terms of office as President. It is a broad-ranging argument, draped in the less arcane constitutional vocabulary and material of human rights, for thoroughgoing reforms at home and abroad as the only antidote to the nation-building dilemmas Nigeria confronts in the first quarter of the twenty-first century. Buhari's departure marks the end of military teleguidance of Nigerian politics under the Fourth Republic in the camouflage of democratic rule, a birthmark of remote control dating back to the first military intervention in the country in January 1966. These momentous events within Nigeria coincide with equally epoch-making developments in the UK, Nigeria's former colonial overlord, with ripple effects in Nigeria, signified by the death of Queen Elizabeth II, after seven decades on the throne, and the emergence of Prince Charles as King of England. A new monarch in Britain adds to the opportunity that falls open for the reconfiguration of Nigeria's external relations with ramifications for the application of human rights in those relations. Despite its known disabilities, Nigeria has the potential infrastructure, including its sizable population, to conduct a human-right policy, if its leaders rationalize the country's resources more wisely.

This book presents new perspectives on gender-based violence (GBV) in South Africa. It argues that violence against women is a manifestation of unequal gender relations and harmful manifestations of hegemonic masculinity, which are governed by patriarchal beliefs, institutions and systems. It includes chapters on quantitative research that assess not only the levels and determinants of violence against women but also men's attitudes towards gender-based violence, perceptions of violence, the legislative frameworks governing violence against women in South Africa, and the current cases and jurisprudence relating to this scourge. In spite of its focus on South Africa, the book also provides insights for comparative scholars exploring the value of different constitutional articulations of human rights and how they support (or fail to support) efforts to combat violence against women. This book contributes to the discourse on disability in Africa as an issue of systemic exclusion characterized by the discrimination and often complete segregation of persons with disabilities (PWDs) in various African countries. Despite the inclusive promise of the Convention on the Rights of Persons with Disabilities (CRPD) as well as the Protocol to the African Charter on Human and Peoples'Rights on the Rights of Persons with Disabilities in Africa, the situation has not actually improved for PWDs in Africa. Given the powerful evidence of the devaluation of PWDs in connection with the COVID-19 pandemic, it is high time to reflect on the experiences of persons with disabilities in education, along with other forms of discrimination they encounter. The book's respective chapters assess how well the existing legal frameworks, policies and practices in most African countries have met the needs for inclusion of children and adults with disabilities. The social and economic rights of persons with disabilities are protected in the constitutions of most countries and enshrined in the normative frameworks that most African leaders have adopted and ratified. These commitments need to be borne in mind when thinking about the present and the future. Inclusive development is an investment and must be viewed as part of a package of reforms that are connected to substantive social protection and improvements in realizing other socio-economic goods. Indeed, a range of alliances are needed to advance the goals of ‘leaving no one behind', ensuring ‘education for all', and delivering on the African Union's call for the development of policies, programmes and requisite budgets for the realization of inclusive education for persons with disabilities.

This book examines the implications of information security which plays such an important role in modern digital infrastructure. Information security technologies restrict the (mis)use of this infrastructure, while also constantly being probed by researchers, intelligence agencies and criminals. One can see this cycle of making and breaking everywhere in the digital sphere. An important example of this cat-and-mouse game is the development of quantum computers, which may in the near future break some widely used encryption technologies. This cycle also has implications for human rights: weakening encryption may affect privacy, for example. But the relationship between human rights and information security has not been investigated in-depth before. In this study, state obligations relating to information security are analysed under the European Convention for Human Rights and the EU Charter for Fundamental Rights, focusing on issues as human rights-compatible encryption policy, on how governments should deal with vulnerabilities in software, and whether governments can curtail the development and export of quantum computers. This book analyses the human rights-compatibility of quantum computing governance and offers unique insights into the connection between human rights and information security that will be relevant for legal practitioners, policy-makers and academics involved in this field of research. Den sanktionierten Personen wird vorgeworfen, als Teil des Staatsapparates, sei es als Staatsoberhaupt, Regierungsmitglied oder Angehöriger der Sicherheitskräfte, Menschenrechtsverletzungen gegen die eigene Bevölkerung zu begehen. Zu diesen zählen in diesem Kontext insbesondere die Unterdrückung oppositioneller Bewegungen, aber auch allgemein die Untergrabung von Demokratie und Rechtsstaatlichkeit. Aus diesen Charakteristika ergeben sich sowohl auf europa- als auch völkerrechtlicher Ebene Besonderheiten, die eine nähere Betrachtung verdienen. This book presents a study of alternative penalties to the death penalty in China, aiming to promote theoretical exploration of death penalty reform in China as well as long-term penal reform. Currently, China is endeavouring to control the use of the death penalty and is gradually moving towards its abolition. The factors influencing the choice of the punishment option to replace the death penalty are complex and varied and include the traditional punishment culture, penalty concepts, the political system, the punishment system, public opinion and human rights, etc. Given the differences between China and developed Western democratic states, when we examine these influencing factors, we cannot ignore the culture of the punishment and the special political and legislation system in China. In this light, this work examined and analysed the factors that influence the choice of punishment option to replace the death penalty in this special political system with its clearly Chinese characteristics. Criminal policy and public opinion are two significant and typical factors involving obvious political considerations in China. The former normally reflects and carries out the will of the Government as expressed to the national management; the latter responds to the majority of citizens'view on the current legal system and it is, to a great extent, the basis for national leadership's running of the country. Even though life imprisonment without release (hereinafter, LWOR) has been stipulated by the Ninth Amendment for the crime of corruption, it should not be the preferable option as the alternative sanction to the death penalty because it is a kind of cruel torture and violates the constitutional principle of human rights protection. On the contrary, life imprisonment with possibility of release (hereinafter, LWPR) would be an option, but the termination mechanisms for inmates should be set out in accordance with the principle of proportional justice; aggravatedlife imprisonment can be chosen to replace the death penalty in China. In addition, there needs to be improvements made to the relevant criminal systems. By examining China's death penalty reform and long-term imprisonment reform, this book not only explains the methodology of the reform theoretically, but also pays attention to the issues of legislation and judicial practice. This book is of interest to scholars and researchers in the fields of criminal justice, penal reform issues, and crime control in China.

This book examines the international forums in which states develop cyber norms—“rules of the road” for how governments use information and communication technologies. This book discusses the principle of open justice with a focus on the mechanism of video streaming of court proceedings. The principle of open justice is multidimensional and involves both the human right to a fair trial and freedom of expression. The book distinguishes between three components of open justice: public hearings, media coverage of proceedings, and publication of judgments. All three have been and/or could be substantially affected by the digital revolution: public hearings could benefit from video streaming, the media coverage from social media, and the publication of judgments from online databases. The book analyses recent advances and challenges related to the digitalization of open justice. Particular attention is paid to the relevant case law of European courts, to the impact of the GDPR with an emphasis on the sensitive issue of pseudonymizing judgments, and to a comparison of various national practices. This book develops a critique of the equality paradigms and principles to be found in the majority of today's legal orders. It accompanies the reader taking her/him/x from a critique of non-discrimination and equality to the ‘opposite'end of the spectrum, that is, to collective rights, collectivization processes and a manifestation of recognition that is based on difference. This interdisciplinary, theoretical journey explores a multiplicity of (legal) orders in terms of how they provide spaces of articulation for ‘difference'. Volume 24 of the Yearbook of International Humanitarian Law (IHL) is dedicated to investigating IHL's universalist claims from different perspectives and regarding different areas of IHL. There are any number of studies on Turkish secularism. However, to date there has never been a comprehensive analysis of the constitutional protection of secularism, one that systematically covers all relevant aspects. Addressing that gap, this book presents a comprehensive and coherent analysis of the constitutional framework of this principle within the Turkish legal system.Secularism is a common fundamental principle of all three Turkish constitutions (1924, 1961, 1982). The principle has been granted an irrevocable status and has been strictly constructed within the Turkish constitutional system. Despite the guarantee of irrevocability, however, its interpretation and application have undergone a drastic transformation in response to changing social and political circumstances.Today, the complaints filed before the domestic and international judiciary predominantly concern the Turkish State's neutrality and impartiality towards religion and the exercise of freedom of religion by religious minorities. While many observers have interpreted these problems in light of the contemporary policies pursued in the field of religion, a closer look reveals that the problem lies deeper in Turkey's general constitutional framework. While the 1982 Constitution declares the principle as an unamendable characteristic of the Republic and protects it with multi-layered mechanisms, certain anti-democratic features of the Constitution, including the President's predominant role in forming the high-ranking judiciary, affect the proper and consistent application of the principle of secularism.The consolidation of the secular state order depends on various factors other than a suitable constitution. However, it goes without saying that constitutions can help or hinder efforts to find solutions. Therefore, this book identifies the deficiencies in the Turkish constitutional and legal framework regarding the protection of secularism. It presents the historical development and definition of a secular state, analyzes the jurisprudence of the Turkish Constitutional Court and the European Court of Human Rights, studies the application of the party prohibition mechanism as a means of protecting the principle, and assesses the constitutional amendments of 2001, 2010 and 2017. With the growing capabilities of artificial intelligence, governments are integrating AI technologies into administrative and even judicial decision-making, aiding and in some cases even replacing human decision-makers. Predictive policing, automated benefits administration, and automated risk assessment in criminal sentencing are but a few prominent examples of a general trend. While the turn towards governmental automated decision-making promises to reduce the impact of human biases and produce efficiency gains, reducing the human element in governmental decision-making also entails significant risks. This book analyses these risks through a comparative constitutional law and human rights lens, examining US law, German law, and international human rights law. It also highlights the structural challenges that automation poses for legal systems built on the assumption of exclusively human decision-making. Special attention is paid to the question whether existing law can adequately address the lack of transparency in governmental automated decision-making, its discriminatory processes and outcomes, as well as its fundamental challenge to human agency. This is an open access book.Animals are the traditional blind spot in human rights theory. This book brings together the seemingly disparate discourses of human and animal rights, and looks at emerging animal rights as new human rights. It approaches the question whether animals can and should have human rights through a comprehensive review of contemporary human rights philosophy, discussing both naturalistic and political justifications of human and animal rights. On philosophical as well as practical grounds, this book argues that there are compelling conceptual, principled, and prudential reasons for modernizing the human rights paradigm and integrating animals into its protective mandate. Moreover, this book proposes the novel One Rights approach as a new (post-)human rights paradigm for the Anthropocene. One Rights advances a holistic understanding of the indivisibility and interdependence of human and animal rights. This book explores how thesystematic subjugation, exploitation, and extermination of animals simultaneously contributes to some of the gravest social and environmental threats to human rights, such as animalistic dehumanization and climate change. T​his book critically explores how and to what extent artificial intelligence (AI) can infringe human rights and/or lead to socially harmful consequences and how to avoid these. The European Union has outlined how it will use big data, machine learning, and AI to tackle a number of inherently social problems, including poverty, climate change, social inequality and criminality. The contributors of this book argue that the developments in AI must take place in an appropriate legal and ethical framework and they make recommendations to ensure that harm and human rights violations are avoided. The book is split into two parts: the first addresses human rights violations and harms that may occur in relation to AI in different domains (e.g. border control, surveillance, facial recognition) and the second part offers recommendations to address these issues. Despite committed effort to integrate postcolonial theory and decolonizing practices in human rights education in social work, there is scant literature offering a more balanced global perspective. This book addresses that need. Included here are discursive voices contributed by social work colleagues whose work is impacted by postcolonial realities. The task of decolonizing social work as a human rights profession calls for the inclusion of contesting perspectives from social work activists, human rights advocates and educators whose critical standpoints are drawn from the historical context of Global North-South relations. Multinational corporate groups are important actors in today's global economy, with the power to impact the masses through their activities. National legal systems, which usually have no extraterritorial authority, remain insufficient to regulate the activities of multinational corporate groups, which operate worldwide, not only in the countries where the parent companies reside (home country), but also in countries where the subsidiaries operate (host countries). The mentioned lack of an effective legislation leads to an unjust imbalance – to the benefit of multinational corporate groups and to the detriment, especially, of involuntary creditors, such as tort victims of corporate activities, which predominantly concern human rights abuses and environmental violations. Against this backdrop, the book firstly assesses the position of multinational corporate groups in international law and then discusses potential reforms to corporate law that would allow for a multi-stakeholder approach. It analyses certain aspects of Turkish tort law that could potentially accommodate liability claims against the parent companies of multinational corporate groups for damage incurred due to their transnational subsidiaries'activities (referred to as ‘foreign direct liability'in legal doctrine). To this end, the potential legal grounds of fault liability and strict liability are assessed under Turkish law, with a particular focus on the duty of care, in comparison with the corresponding case law in the UK and the Netherlands. Mandatory human rights due diligence is also analysed with a view to proposing a new regulation in Turkish law. Lastly, the aspects of foreign direct liability claims related to private international law are assessed in order to answer the questions of jurisdiction and applicable law within the scope of a comparative legal study.
