This casebook addresses selected precedent-setting rulings of various international human rights and international criminal courts with a focus on the child victims of international crimes and human rights abuses. The cases are analysed from the children's human rights perspective and the question is examined as to what extent the aforementioned courts are according these children justice. The scope of the book is thus limited to the consideration of these representative important cases concerning violations of (a) international human rights and humanitarian law and (b) international criminal law involving child victims and the judicial remedies accorded or denied these victims and their family members. This open access book contributes to ongoing discussions about how societies should respond to children who have experienced violence and abuse by delving into the Barnahus model: a multidisciplinary and co-located model whose aim is to provide both justice and recovery to victimised children. The promising model was first implemented in the Nordic region and is currently being diffused across Europe, although scientific knowledge about the model remains scarce: the Barnahus model's potential for delivering holistic services, the various tensions and dilemmas involved in the model, and how dual mandate of Barnahus can be managed all require further research. Continuing from the volume Collaborating Against Child Abuse (2017) which examined the process of Barnahus'diffusion in the Nordic countries, the current book digs deeper into the intrinsic institutional tensions of the model, as well as those that might arise during collaboration, in order to advance our understanding of what can be achieved through the model and thus improve the situation of child victims of violence and abuse. An institutional perspective is used in the book which is structured in four parts. The first three parts explore different types of institutional tensions –legal, organisational, and professional-ethical, while the fourth focuses on how these tensions may be balanced. The book's authors chart this new phase in the diffusion and translation of the Barnahus model. Their analyses will provide valuable guidance to countries that are currently considering or are already implementing the model.

Over the past several decades the seeming escalation of crimes involving sexually deviant, coercive, and aggressive behavior has become an increasingly serious problem, manifested in costs to both victims and society at large. The long-term psychological impact of sexual assault on adult and child victims has been documented numerous times. The costs incurred by society include a network of medical and psychological services provided to aid victim recovery, the investigation, trial, and incarceration of offenders-often in segregated units or special facilities-and the invisible but tangible blanket of fear that forces potential victims to schedule normal daily activities around issues of safety. Despite the gravity of the problem, there has been a paucity of empirical research directed at the etiology, course, remediation, and management of sexually deviant and coercive behavior. The 2024 UNODC Global Report on Trafficking in Persons is the eighth of its kind mandated by the General Assembly through the 2010 United Nations Global Plan of Action to Combat Trafficking in Persons. This edition of the Global Report provides a snapshot of the trafficking patterns and flows detected after the COVID-19 pandemic. It covers 156 countries and provides an overview of the response to the trafficking in persons at global, regional and national levels, by analyzing trafficking cases detected between 2020 and 2023. A major focus of this edition of the Report is Trafficking in Persons in the African continent.

This book focuses on children affected by armed conflict in the borderlands of Myanmar since the regime-change event in 2021. In the borderlands of this country, uncountable children have been killed or maimed by indiscriminate weapons, raids, artillery bombardments and air strikes. Concerning the Burmese children living in the rest of Myanmar, they have been exposed to feelings of insecurity and growing anxieties caused by deadly bombings and assassinations. No place in Myanmar is immune from armed conflict. Many displaced Burmese children fled into the neighboring countries, which did not ratify the 1951 Refugee Convention. With no refugee status, some displaced children faced the risk of being arrested and deported. Some displaced children became victims of human trafficking, or led a life of vagrancy. The stakeholders responsible for protecting children from armed conflict, have been promoting Myanmar towards reconciliation in their own ways. However, the stakeholders had to deal with three obstacles, that is, lack of consensus, insufficient cohesion and funding gap. When a national ceasefire is unavailable in Myanmar, the conflicting parties would probably welcome a humanitarian ceasefire in the borderlands of this country, rather than wearing each other out. In the case of Myanmar, a humanitarian ceasefire should be composed of three parts: immediate access to victims of armed conflict, safe passage of civilians, and release of detainees in batches. If everything goes well, an agreement for a humanitarian ceasefire in the borderlands of Myanmar, would be followed with peace talks in the foreseeable future.

Children in Police Custody shines a light on the hidden experiences of children in police detention in England and Wales. An episode in police custody is the single most common sustained experience of the criminal justice system for children. Yet child suspects have previously been largely overlooked in criminological research. Drawing on the first comprehensive study in England and Wales to review the police custody process from the perspective of children, the chapters trace the child's journey from arrest, through detention and interview, to release or remand. Adopting a rights-based approach, this work investigates whether the present legal framework provides effective protection for child suspects. Utilising the detailed insights provided by young participants in the research, and supplemented by the author's fieldwork, this analysis reveals the complex challenges facing children's legal agency in the adversarial setting of the custody block. In so doing, it evaluates the capacity of the available protections to enable children's participation in that setting. La presente obra revisa el Informe del Defensor del Pueblo Una respuesta necesaria, presentado en octubre de 2023 y cuyo objeto de estudio son los abusos sexuales en el ámbito de la Iglesia católica. Es un Informe extenso que aborda el fenómeno desde una pluralidad de perspectivas. También cuenta con varias y heterogéneas dimensiones, interesándonos aquí la científico-social. Por lo tanto, el Informe es tratado entendiendo que incluye postulados refutables y que es evaluable con criterios científicos, ignorando por lo tanto otras posibles descripciones; pero exactamente lo mismo ocurre con la Iglesia católica, que será vista como una institución mundana y no espiritual y trascendente. Es importante conservar en mente esta limitación de nuestro enfoque, que nos obliga a dejar a otros comentaristas muchas cuestiones muy importantes que plantea el Informe y los fenómenos que estudia. Tras advertir el reto de una insuficiente información metodológica –que a mi juicio refleja ingenuidad en los redactores–, la presente monografía comienza con la definición del objeto de estudio, que resulta amplia, si bien con la paradoja de que la exigencia implícita de confianza podría introducir una restricción significativa. Esta exigencia podría estar relacionada con una determinada concepción del clero (Parte I). La parte del Informe que más atención ha recibido es la encuesta, si bien no permite la inferencia de parámetros poblacionales desconocidos no sólo por no ser probabilística, sino por las dificultades derivadas de la frecuencia relativa de los eventos de interés. El carácter aproblemático de esta afirmación abre la puerta a diversas potenciales justificaciones de la encuesta, incluyendo de tipo simbólico (Parte II). Las causas a las que se atribuye el fenómeno realizan una serie de asunciones difíciles de compartir, verbigracia porque esperan (hiper)especialización e inicio tardío de las carreras criminales, ignoran que el ámbito es un criterio de cientificidad y, en todo caso, conducen a la «exuberancia embarazosa» de Matza. La concepción del poder que se maneja es prefoucaultiana y, en este sentido, obsoleta (Parte III). Por último, se revisa el enfoque de justicia restaurativa, considerando que no ofrece ni la justicia que demandan las víctimas ni el antídoto fundado en la dignidad y la reconciliación frente a la firmeza que dibujan sus defensores; así como el rol preventivo del delito que podría tener la Iglesia católica como institución, algo que –aparte de relevante como factores protectores–, los críticos –tanto los que solicitan su disolución como los que propugnan cambios tan profundos que, sin cualificación, podrían conducir a un desdibujamiento semejante según Jenkins– no deben pasar por alto (Parte IV).
