This Open Access book carefully examines the legal and historical bases of the territory of Japan as a modern State from the Meiji period to 2002. A new preface summarizes key developments in the situation up through 2022.Japan's current territory is stipulated by the Potsdam Declaration (1945) and the Treaty of Peace with Japan (1951); it includes the Northern Territories, the Senkaku Islands, and Takeshima. Japan has demanded the return of the Northern Territories, comprising the islands of Etorofu, Kunashiri, Shikotan and Habomai, which are occupied by Russia. China has claimed sovereignty over the Senkaku Islands, which are validly controlled by Japan; Japan has claimed sovereignty over Takeshima, which is occupied by the Republic of Korea.This book analyzes the current status of these territorial topics, drawing on historical documents and international legal precedent, and it suggests peaceful methods to address them. India's rise as a global power in the 21st century will be backed with a strong blue economy. The high volumetric trade activities through its coastal region, mainly due to its geostrategic location and efficient links with the vast potential market in the hinterland and other landlocked states, provides it unmatched leverage. Among such promising enterprising, attracting global investments and trade, the non-conventional security threats within the Indian Ocean region and India's ports and coast cannot be ignored. Therefore, to address these challenges, the law at the seas formulated by various global organisations and other national and international regulatory mechanisms become essential for all those directly or indirectly involved in India's maritime security. Over the years, many state coastal security agencies have evolved with specific potential and restrictions, which creates a certain conditionality of the existing non-conventional security challenges and maritime conflicts with its neighbours. The successful use of security-related technology to outpace such non-conventional threats creates a demand for further bolstering such technologies for India's advantage. Besides, these prevailing threats to the ports and coastal region, the environmental security challenges also directly impact humans and cannot be undermined. This book studies recent attempts to restructure maritime security sectors through capacity building. It innovates both theoretically and empirically. It proposes a new framework for understanding maritime capacity building, drawing on work in peacebuilding and security sector reform. The framework is then applied across empirical case studies from the Western Indian Ocean (WIO) region written by scholars from the Global South. The WIO region is a paradigmatic case to study maritime security and capacity building in action. Countries in the region face the full gamut of maritime security challenges, while their indigenous capacities to deal with these are often weak. In consequence, the region functions as an engine of innovation for maritime capacity building more widely. The lessons and best practices from the region have importance consequences for addressing maritime security across the globe.

This book examines how international order at sea is challenged, changed and maintained. The book surveys challenges to the international order at sea in the Asia-Pacific, the Indian Ocean Region, the Atlantic Ocean and the Arctic Ocean. It explores the interaction between and cooperation among leading, emerging and smaller naval powers, both naval and coastguard responses, required for the maintenance of good order at sea. Six broad and interlinked issues are identified that will influence the future international order at sea: the balance between the maritime and the continental domains; the balance between great power rivalry and cooperation; the contest between access and denial; the operational balance between preparing; building and training for warfighting as opposed to operations other than war; how to manage ‘disorder'security challenges that very often transcends territorial waters and national boundaries, and finally, the balance between safeguarding national interests and contributing to collective efforts preserving the international order at sea.

In 1949 the International Court of Justice (ICJ) handed down its first judgment in the Corfu Channel Case. In diffusing an early Cold War dispute, the Court articulated a set of legal principles which continue to shape our appreciation of the international legal order. Many of the issues dealt with by the Court in 1949 remain central questions of international law, including due diligence, forcible intervention and self-help, maritime operations, navigation in international straits and the concept of elementary considerations of humanity. The Court's decision has been cited on numerous occasions in subsequent international litigation. Indeed, the relevance of this judgment goes far beyond the subject matter dealt with by the Court in 1949, extending to pressing problems such as trans-boundary pollution, terrorism and piracy. In short, it was and remains a thoroughly modern decision — a landmark for international law; and one which today warrants reconsideration.Taking a critical approach, this book examines the decision's influence on international law generally and on some fields of international law like the law of the sea and the law of international responsibility specifically. Piracy, international disputes over undersea oil and gas, and chronic overfishing have left our oceans in turmoil. How can we resolve these issues? International law states that a coastal country has territorial rights for 12 miles into the sea, yet, in practice many countries have virtually no control over their own waters. Denise Russell provides a thorough examination of the politics of the sea, from environmental issues, to water economics and governance of the waters. During international bargaining, who gets the better deal, and why, is one of the questions at the heart of the study of international cooperation. In Who Gets What? Áslaug Ásgeirsdóttir analyzes seven agreements signed throughout a twenty-year span between Iceland and Norway to allocate shared fish stocks. While the Law of the Sea regime provides specific solution concepts for negotiators, it does not dictate the final outcome. Looking at the actual negotiation process and the political and economic constraints negotiators operate under, Ásgeirsdóttir examines how domestic interest groups can directly influence the negotiating process, and thus affect international agreements over scarce resources. Who Gets What? demonstrates empirically that a nation with more domestic constraints on its negotiators gets a better deal.
