This book offers a deparochial account of global justice and addresses disenchantment stemming from its West-centricity and provincial theoretical formulations. As the recurring global poverty debate restricts the duties of alleviating poverty and inequality to the developed world, this book attempts to broaden the spectrum of duties to the superrich of the developing world. Drawing from the case study of India's superrich as an exemplar of the potent agency of rising powers, the book examines the structural relationship between unbridled affluence and the (un)realisation of the human rights of the poor. It contends that India's superrich, like their counterparts in other powerful developing countries, both contribute as well as benefit from the highly decentralised global economic order that (re)produces affluence of the few and deprivation of the many within these countries. In doing so, this book argues that the superrich have a positive duty to alleviate poverty and reduce inequality beyond their free-standing moral responsibility for philanthropy.

In the years since Independence in 1962, Jamaica's foreign policy has reflected the flux and reflux of international affairs. There has been continuity in the midst of change; and while the country has sought to deepen its traditional friendships and widen its network of allies, it has also experienced occasions of externally determined crisis and major disagreement both within the Caribbean and in the wider world. Bearing in mind the profound changes which have taken place in the international sphere since independence, this book examines some of the main initiatives and responses which have characterised Jamaican foreign policy over the last sixty years.

This book examines what the justification of political power and the character of a liberal political community in the conditions of pluralism should look like, with the aim of equal respect for all. Sylvie Bláhová argues that if those who understand the principle of respect as the basis of political liberalism are to fulfill all the prerequisites of this principle, they must ensure respect within the liberal political community as a whole. The classic interpretation of political liberalism ensures respect during the process of justification of political power, yet many individuals in the liberal political community remain disrespected, mainly due to their group membership. Accordingly, Bláhová looks for a more complex interpretation of the principle of respect within political liberalism, one that ensures respect beyond the justification of political power. The author argues that the way to achieve respect in the liberal political community is to interpret the criterion of reciprocity in a dual way. Specifically, Bláhová claims that respect can be ensured only in conjunction with the principle of civic friendship, which makes respect more comprehensive. This novel interpretation can ensure unity of the liberal political community and make it stable, which is crucial in conditions of pluralism.

The Universal Periodic Review (UPR) is a peer-review mechanism, reviewing all 193 UN Member States'protection and promotion of human rights. After ten years of the existence of the UPR mechanism, this collection examines the effectiveness of the UPR, theoretical and conceptual debates about its modus operandi, and the lessons that can be drawn across different regions/states to identify possible improvements.The book argues that despite its limitations, the UPR mechanism with its inclusive, cooperative, and collaborative framework, is an important human rights mechanism with the potential to evolve over time into an effective cooperative tool for monitoring human rights implementation. Divided into three parts, the first part focuses on exploring a variety of theoretical approaches to understanding the UPR mechanism. The second part examines specific human rights themes and the relationship between the UPR mechanism and other international mechanisms. Finally, the third part questions implementation and the ways in which states/regional groupings have engaged with the UPR mechanism and what lessons can be learned for the future.The volume will be a valuable resource for researchers, academics, and policymakers working in the area of international human rights law, international organizations, and international relations. This book explores the challenges that international law faces in curtailing human rights violations arising from mineral exploitation. Beginning with the specific dynamics between mineral exploitation and human rights abuses, the analysis progressively uncovers the layers of regulatory challenges, focusing on the complexities of how economic regimes intersect with, and often undermine, human rights protections. This perspective shows how the fragmentation of international law is not only affecting the capability to protect global interests but also threatening the systemic operation of international law. In this regard, this work presents three expressions of how the fragmentation of international law impacts the response to violence in mineral exploitation. First, fragmentation influences legal operators'classification and objective setting for situations; second, it shapes the selection of response tools, limited by these objectives; and third, it creates conflicts in applying international obligations pertaining to distant special regimes, where the interpretations rendered by decisionmakers are inherently biased towards the interests of the special regime to which they pertain.

This book examines the timely issue of police stops as a public and political issue, focussing on the European states. Under the Fourth Republic since 1999, the challenge Nigerian leaders face like never before is how to create a state that matches the expectations of their diverse peoples at home and abroad. Taking this proposition as starting point, this book advances proposals for a human-right policy, referred to alternately in the work as principled foreign policy, for Nigeria under the Fourth Republic, taking advantage of the inestimable opportunity afforded by General Muhammadu Buhari's departure from the political scene on May 29, 2023, after the famine, domestically and externally, wrought by his two terms of office as President. It is a broad-ranging argument, draped in the less arcane constitutional vocabulary and material of human rights, for thoroughgoing reforms at home and abroad as the only antidote to the nation-building dilemmas Nigeria confronts in the first quarter of the twenty-first century. Buhari's departure marks the end of military teleguidance of Nigerian politics under the Fourth Republic in the camouflage of democratic rule, a birthmark of remote control dating back to the first military intervention in the country in January 1966. These momentous events within Nigeria coincide with equally epoch-making developments in the UK, Nigeria's former colonial overlord, with ripple effects in Nigeria, signified by the death of Queen Elizabeth II, after seven decades on the throne, and the emergence of Prince Charles as King of England. The Concrete Utopia conceptualizes the human rights project of the last two and a half centuries as a “backward-looking” endeavor, which, in order to move forward, must return to the utopian roots of its foundational documents. Human rights advance by judging the ills of the present world from a standpoint in the future where they might no longer exist—a fundamentally utopian gesture. This peculiar character of human rights makes them continually ripe for reinvention and for responding to changing circumstances in the world. With a particular focus on developments from the 1960s until the present, this book addresses the history of human rights movements and how human rights have been reconceived and upheld in various historical moments. Finally, it attempts to sketch out how they may be re-envisioned for the struggles of the 21st century. At a time when the human rights project has endured criticism for being toothless or even for providing a pretext for military invasions, Kaleck argues that the current global crises, from inequality, to ecological collapse, to the “age of pandemics,” can be countered by reinventing human rights work through feminist, decolonial and ecological interventions.

Written by an author with decades of practical experience in the human rights field, the book examines a variety of scenarios where individuals are unlawfully detained in violation of their most basic rights to personal liberty and exposes the many fallacies associated with arbitrary detention. Proposing solutions for future policy to scrutinise processes, this is a call for greater respect for the rule of law and human rights.

This book provides a transdisciplinary assessment of multiple countries'legal and policy frameworks vis-à-vis the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication, adopted in 2014 by the Committee on Fisheries of the Food and Agriculture Organization of the United Nations. Based on an appraisal framework used to facilitate the unpacking of those frameworks, this book collects country experiences and regional perspectives on a range of cross-cutting issues underpinning the protection of the rights and the promotion of justice for small-scale fishers and their communities.This book aims to be the first collection to present a systematic and in-depth assessment of existing national legal and policy frameworks vis-à-vis the SSF Guidelines. This assessment is done through the transdisciplinary and collaborative work of researchers, governments, and civil society organizations for the analysis of the cross-thematic questions, which the contributors of this book aim to address. Firstly, what are the relevant laws and policies that matter for securing rights of small-scale fishers and their communities? How are small-scale fisheries defined by national laws and policies? How are small-scale fisheries treated (i.e., specifically or generally) in these instruments? Are there specific provisions and references to small-scale fisheries or any of its associated terminologies (e.g., artisanal, subsistence, traditional, indigenous)? Secondly, how the relevant instruments address the 8 small-scale fisheries key issues outlined in that rapid appraisal study? What are the strengths and gaps in these instruments? Do they address issues that are not covered by the SSF Guidelines? Do they contribute to clarifying other legal issues that are relevant for sustainable small-scale fisheries? Finally, since the book also aims to explore the accessibility of these legal and policy instruments for those to which they matter the most (the small-scale fishers), the following questions were also considered: What challenges do they face in knowing and understanding the relevant laws and policies in place? The twenty-first century is seeing a battle of ideas between different conceptions of governance: people-centred and party-centred. At the same time, scientific and technological developments are posing new challenges for human rights. This book identifies new dimensions in the international protection of human rights and makes the case for a new human rights diplomacy focusing on enlarging the area of common ground among governments and enhancing national human rights protection systems.

This book seeks to answer a number of key questions about the relationship between the IMF, developing states and the impact of financial crises on human rights abuses, including: Why do some but not other IMF-assisted developing states experience the joint outbreak of currency and sudden reversal crises under the Fund's program?; What are some of the short-term political ramifications of such crises?; Why do human rights violation by governments increase sharply in the wake of twin currency and sudden reversal crisis in some but not all crisis-affected countries?

This book provides a comprehensive account of one significantly underreported aspect of violence affecting young refugee girls today, that of forced child marriage. It examines the ongoing, insidious practice via the lens of international human rights laws and contextualising human rights laws and discourses in relation to Middle Eastern, Islamic, and Jordanian understandings of international law and human rights, where the practice in directly impacting young Syrian refugee girls who are seeking refuge in Jordan with their displaced families. The book finds that in a juxtaposition of human rights definitions and obligations, between the traditional and modern, the religious and the secular, there are mixed implications for the realisation of universal human rights and that this has consequences for the most vulnerable—child refugees. As a result, Syrian children exist in a precarious situation. They are living in a foreign state with an unclear legal status, are largely unidentified, and, in effect, stateless. It is in this liminal space that Syrian children are vulnerable and voiceless and highly exposed to forced marriages and the resultant violence and possibly death. While allowed to continue, the practice of child marriage not only severely impedes upon progressive international human rights efforts to eliminate gender-based violence, slavery, and discrimination, but significantly impacts on children's physical, mental and emotional health, and their opportunities for growth and development in society. As a case study this book seeks to inform how vulnerable Syrian children have come to be increasingly confronted by child marriage and to consider why it occurred and continues to occur, even though the idea of children being forcibly marriage is considered ethically and legally objectionable within international human rights law.

This book, the first ever of its kind, is a veritable State of the World Report on Human Rights. It reproduces summaries by UN High Commissioners for Human Rights on the state of the national human rights protection systems of each UN Member State. These summaries were sent following each state's passage through the Universal Periodic Review (UPR) process of the UN Human Rights Council. Dabei wird der Untersuchungsgegenstand auf Klimaschutzklagen, d.h. auf vertikale Klagen von Privaten gegen den Staat mit dem Begehren auf verbesserte oder sonst adäquate Klimaschutzmaßnahmen, beschränkt. Nach einer Auseinandersetzung mit dem meist diffusen Begriff der Justitiabilität wird eine eigenständige Definition mit anschließendem Prüfungskanon entwickelt, der danach fragt, ob und inwieweit Klimaschutz vor deutschen Gerichten einklagbar ist; aber auch fragt, ob und inwieweit einschlägige Streitigkeiten zur gerichtlichen Klärung geeignet sind. Im Rahmen der Prüfung von Einklagbarkeit und Eignung werden die wesentlichen Herausforderungen der Klimaklagen identifiziert und – unter Berücksichtigung einschlägigen internationalen und europäischen Rechts – nach prozessualen und materiellen Verfassungsrecht geprüft.
