Local Autonomy as a Human Right contends that local communities struggle to preserve their territorial autonomy over time despite changes to the broader political and geographic contexts within which they are embedded. Freedom in the World, the Freedom House flagship survey whose findings have been published annually since 1972, is the standard-setting comparative assessment of global political rights and civil liberties. The survey ratings and narrative reports on 195 countries and fifteen territories are used by policymakers, the media, international corporations, civic activists, and human rights defenders to monitor trends in democracy and track improvements and setbacks in freedom worldwide. The Freedom in the World political rights and civil liberties ratings are determined through a multi-layered process of research and evaluation by a team of regional analysts and eminent scholars. The analysts used a broad range of sources of information, including foreign and domestic news reports, academic studies, nongovernmental organizations, think tanks, individual professional contacts, and visits to the region, in conducting their research. The methodology of the survey is derived in large measure from the Universal Declaration of Human Rights, and these standards are applied to all countries and territories, irrespective of geographical location, ethnic or religious composition, or level of economic development.

Beginning with an exploration of what rights are and how the human rights discourse developed, Abdullah Saeed explores the resources that exist within Islamic tradition in support of human rights. Die juristische Durchsetzung internationalen Rechts stellt eine relativ neue Alternative für die Weltgemeinschaft dar, eine Verbesserung der Menschenrechtslage in Autokratien herbeizuführen. Der Autor überprüft den von Menschenrechtsverfahren in Nachbarländern auf Autokraten ausgehenden Abschreckungseffekt. Im ersten Teil der Arbeit wird auf Basis der Selektoratstheorie die abschreckende Wirkung von Menschenrechtsverfahren auf die Repressionsentscheidung eines Autokraten spieltheoretisch modelliert. Das Ergebnis der Gleichgewichtsanalyse dieses spieltheoretischen Modells wird im zweiten Teil der Arbeit empirisch überprüft. Dabei wird aufgezeigt, dass die Ausweitung der individuellen Rechenschaftspflicht von politischen Führern in Autokratien eine regimetypspezifische Abschreckungswirkung entfaltet. Je nach Regimetyp kommt es mit einer ansteigenden Anzahl an Nachbarländern mit Menschenrechtsverfahren zu einer Verbesserung oder einer Verschlechterung der Menschenrechtslage. Folglich stellt die juristische Durchsetzung internationalem Rechts keine Maßnahme dar, mit der eine allgemeine Verbesserung der Menschenrechtslage in Autokratien erzielt werden kann.

In Nursing Civil Rights, Charissa J. Threat investigates the parallel battles against occupational segregation by African American women and white men in the U.S. Army. As Threat reveals, both groups viewed their circumstances with the Army Nurse Corps as a civil rights matter. Each conducted separate integration campaigns to end the discrimination they suffered. Yet their stories defy the narrative that civil rights struggles inevitably arced toward social justice. Threat tells how progressive elements in the campaigns did indeed break down barriers in both military and civilian nursing. At the same time, she follows conservative threads to portray how some of the women who succeeded as agents of change became defenders of exclusionary practices when men sought military nursing careers. The ironic result was a struggle that simultaneously confronted and reaffirmed the social hierarchies that nurtured discrimination.

When considering the structures that drive the global diffusion of human rights norms, Brian Greenhill argues that we need to look beyond institutions that are explicitly committed to human rights and instead focus on the dense web of international government organizations (IGOs)-some big, some small; some focused on human rights; some not-that has arisen in the last two generations. While most of these organizations have no direct connection to human rights issues, their participation in broader IGO networks has important implications for the human rights practices of their member states. Featuring a rigorous empirical analysis, Transmitting Rights shows that countries tend to adopt similar human rights practices to those of their IGO partners, whether for better or worse. Greenhill argues that IGOs constitute a tightly-woven fabric of ties between states and that this network provides an important channel through which states can influence the behavior of others. Indeed, his analysis suggests that a policy of isolating'rogue'states is probably self-defeating given that this will reduce their exposure to some of the more positive IGO-based influences on their human rights. Greenhill's analysis of the role of IGOs in rights diffusion will not only increase our understanding of the international politics of human rights; it will also reshape how we think about the role of international institutions in world politics.

Peter Uvin links human rights with development theory and practice to show how practitioners can surmount tough obstacles to successfully effect strategies for reducing conflict and improving human rights outcomes.

The book aims at offering an overview of the current human rights practice, indicating some main specific features able to provide a meaningful explanation of the complex phenomenon. It attempts to highlight its moral, social and legal dimensions, its theoretical and institutional origin, but also the specificity of the current phase of the protection of rights, and its uses in the domestic and international domain. It aims at showing the connection between the idea of law as a social practice and the practice of human rights, the former working as explanatory framework, the latter characterized by specific features. The original point is the negative method of defining the subject: “negative” because the idea of human rights as a social practice is not compatible with a rigid classificatory semantic. From the theoretical perspective, human rights as implemented today are only partially in a continuum with the revolutionary proclamations (French and American). The Holocaust introduces a new approach: they are not vindications of “our” rights, but of the rights of others, those who are at risk or whose rights are being violated. This simple idea explains many aspects of the current human rights practice: the necessity of identifying the duty holders, the way of understanding the international community and the role of rights in it, the forms of protection and promotion, the dynamic against discriminations. And it allows explaining also some possible misunderstandings, like the idea that human rights are natural rights, or tricks for humanitarian intervention, or cultural biased. Human rights'key notes are normativity, universality and globality. The notion of dignity and the need of specification of rights in the concrete conditions of individuals exclude minimalist accounts of rights, and the idea that some rights are less urgent or important than others. Human rights as a practice are compatible with a high number of theoretical perspectives and with different political doctrines, even though they have a cultural origin. They are not compatible with hegemonic dominations and with war. They are criteria of legitimacy and justice, but they are not the solution for everything. The book is divided in four sections: Concept, Identity, Content, and Uses.

This is the first attempt to provide an in-depth moral assessment of the heart of the modern human rights enterprise: the system of international legal human rights. It is international human rights law--not any philosophical theory of moral human rights or any'folk'conception of moral human rights--that serves as the lingua franca of modern human rights practice. Yet contemporary philosophers have had little to say about international legal human rights. They have tended to assume, rather than to argue, that international legal human rights, if morally justified, must mirror or at least help realize moral human rights. But this assumption is mistaken. International legal human rights, like many other legal rights, can be justified by several different types of moral considerations, of which the need to realize a corresponding moral right is only one. Further, this volume shows that some of the most important international legal human rights cannot be adequately justified by appeal to corresponding moral human rights. The problem is that the content of these international legal human rights--the full set of correlative duties--is much broader than can be justified by appealing to the morally important interests of any individual. In addition, it is necessary to examine the legitimacy of the institutions that create, interpret, and implement international human rights law and to defend the claim that international human rights law should'trump'the domestic law of even the most admirable constitutional democracies.

In her innovative study of human rights discourse, Lena Khor takes up the prevailing concern by scholars who charge that the globalization of human rights discourse is becoming yet another form of cultural, legal, and political imperialism imposed from above by an international human rights regime based in the Global North. To counter these charges, she argues for a paradigmatic shift away from human rights as a hegemonic, immutable, and ill-defined entity toward one that recognizes human rights as a social construct comprised of language and of language use. She proposes a new theoretical framework based on a global discourse network of human rights, supporting her model with case studies that examine the words and actions of witnesses to genocide (Paul Rusesabagina) and humanitarian organizations (Doctors Without Borders). She also analyzes the language of texts such as Michael Ondaatje's Anil's Ghost. Khor's idea of a globally networked structure of human rights discourse enables actors (textual and human) who tap into or are linked into this rapidly globalizing system of networks to increase their power as speaking subjects and, in so doing, to influence the range of acceptable meanings and practices of human rights in the cultural sphere. Khor's book is a unique and important contribution to the study of human rights in the humanities that revitalizes viable notions of agency and liberatory network power in fields that have been dominated by negative visions of human capacity and moral action.
