​Nutraceuticals are defined as any food bioactive compounds or supplements which provide health and medicinal benefits, usually in the prevention of disease and sometimes playing a role in their treatment as well. Gerade die jüngsten Fälle von Lebensmittelrückrufaktionen haben die Brisanz von fehlerhaften Lebensmitteln - die Gesundheitsgefährdung für den Verbraucher sowie die nachteiligen finanziellen und Image-Folgen für die lebensmittelherstellenden Unternehmen - gezeigt. Im Zuge der Harmonisierung der Lebensmittelüberwachung in Europa und der Umsetzung der EG-Richtlinien in nationale Gesetze oder Verordnungen wurden die schon bestehenden Gesetze ergänzt. So haftet nach dem seit 1990 in der BRD umgesetzten Produkthaftungsgesetz der Hersteller für von ihm in Verkehr gebrachte Lebensmittel auch dann, wenn kein schuldhaftes Verhalten nachgewiesen werden kann. Andererseits ist die deliktische Haftung schon durch §823 BGB geregelt. Mit der neuen Lebensmittelhygiene-Verordnung vom August 1997, die die EG-Richtlinie auf nationaler Ebene umsetzt, wird die lebensmittelhygienische Verantwortung den Betrieben übertragen.
