Multi-modal argumentation with its logical, emotional, visceral and kisceral arguments is an important addition to logical argumentation, especially when real-life situations are considered. It does not discard logic but adds other modes of argumentation to complement it, to emphasize the realistic environments of communication. In this sense, the multi-modal theory is important for the area of legal argumentation, where even in the reasoning of judicial decisions traces of a flesh-and-blood personality, who decided the case and wrote the reasons, can be found.This book presents a comprehensive analysis of this informal logic in legal argumentation and its practicality within the law. It argues that by building on the dialectical and rhetorical models of legal argument, the former being important for clear cases while the latter for unclear ones, the multi-modal theory of legal argumentation brings together logic and psychology in a holistic or integral perspective. The approach is not only descriptive, identifying the traces of alternate arguments in judicial decisions, but is also normative, presenting the criteria for evaluation that multi-modal arguments need to face to attain validity in the legal context.The work will be of interest to academics and researchers in the areas of Legal Theory, Legal Linguistics, Philosophy of Law, and Communication Studies.

Desde la antigüedad, la especie humana se ha organizado en colectividades (grupos, tribus, genos, comunidades, sociedades) no solo para sobrevivir, sino para construir un mundo mejor para todos, a través del aporte de las personas. Pertenecer a estas colectividades y actuar dentro de ellas caracterizó lo que convencionalmente se llama ciudadanía. Y la ciudadanía, a lo largo de la historia, ha presentado diferentes contornos y contextos, siendo vivida de diferentes formas.Hoy, con el fenómeno de la globalización y la interconexión a nivel planetario, posibilitado por las tecnologías de la comunicación y el transporte, la ciudadanía plantea nuevos desafíos y requiere una reflexión amplia y profunda sobre lo que está sucediendo. Los desafíos cruciales que surgen son comprender el tiempo presente, diagnosticar problemas, hacer explícitas las ideologías; y, en base a ello, superar las dificultades actuales y proponer mejores alternativas para la gestión de las instituciones a nivel global, con el objetivo de promover la ciudadanía sobre bases democráticas y pluralistas. Sin embargo, esta ya no parece ser una tarea que solo una persona pueda manejar. Esta es la razón que llevó a un grupo de profesores doctores, investigadores de diversas instituciones universitarias de Brasil y España, a aunar esfuerzos en los últimos años para producir reflexiones sistemáticas y consistentes sobre temas políticos, jurídicos y sociales contemporáneos. El libro que ahora llega a los lectores es el resultado de este trabajo, y tiene como tema Ciudadanía en una perspectiva global.

Wenn mehrere Richter zur Entscheidung desselben Falles berufen sind, verschränkt sich die Aufgabe der normgebundenen Rechtserkenntnis mit der einer kollektiven Entscheidungsfindung ('group choice'). Die resultierenden Schwierigkeiten und Lösungsverfahren werden seit der Antike diskutiert. Unterschiedliche Regelungen in europäischen Justiztraditionen werden dadurch geprägt, ob das Verfahrensergebnis in einem Kollegialakt oder in einer Mehrheit von Einzelerkenntnissen besteht. Abgesehen von Problemen der Mehrheitsbildung bei quantitativen oder qualitativen Divergenzen über den Urteilstenor zwingt die Begründungspflicht zur Findung von zugleich mehrheitsgetragenen wie stimmigen Urteilsgründen. Dies führt auf die Frage, ob die juristische Methode, die Singularmethode ist, nicht einer Erweiterung bedarf, die den Einigungsprozess im Richterkollegium einer nachvollziehbaren Methodik unterwirft.

This book explores how globalisation influences the understanding of law. Adopting a broad concept of law and a global perspective, it critically reviews mainstream Western traditions of academic law and legal theory. Der Autor untersucht die rechtlich wie praktisch brisante Frage, inwieweit Individualinteressen die Gestaltungsfreiheit der europäischen Außenpolitik beeinflussen. Exemplarisch wird dazu das Instrument des diplomatischen Schutzes von Bürgern und Unternehmen beleuchtet - nach herrschendem Verständnis ein rein staatliches Privileg. Die rasante Fortentwicklung von EG und EU wirft inzwischen allerdings zahlreiche neue Fragen auf. Denn die Mitgliedstaaten haben in den letzten Jahren eine Vielzahl zentraler Politiken (etwa den Außenhandel)'vergemeinschaftet'- und damit als Einfluss- und Druckmittel gegenüber Verletzerstaaten verloren. Christian Storost fragt nach den Konsequenzen dieses Prozesses für den einzelnen. Anhand detaillierter Praxisstudien zeichnet er Schritt für Schritt die faktische Entstehung einer neuen Schutzkompetenz der EG und paralleler EU-Koordinationsmechanismen nach. Ein umfassender Rechtsvergleich zum Verständnis des diplomatischen Schutzes in den Mitgliedstaaten sowie im Rahmen der EMRK runden die Analyse ab.

Die vorliegende Dissertation entstand im Rahmen des Graduiertenkollegs'Die Zukunft des Europäischen Sozialmodells'an der Georg-August-Universität (Prof. Dr. Hansjörg Otto), Göttingen. Ihr Gegenstand ist die legitimatorische Beurteilung des Sozialen Dialogs i.S.d. Art. 138 f. EGV vor dem Hintergrund des gemeinschaftsrechtlichen Demokratie- und Rechtsstaatsprinzips. An der demokratischen Legitimation des Sozialen Dialogs bestehen zahlreiche Zweifel: Die Vorschriften über den Sozialen Dialog eröffnen den Sozialpartnern die Möglichkeit, Vereinbarungen zu schließen, die durch Ratsbeschluß zu Gemeinschaftsrecht werden können. An diesem Verfahren sind formal Kommission und Rat, nicht aber das Europäische Parlament beteiligt. Vielmehr üben die Sozialpartner auch faktisch den maßgeblichen Einfluß auf die Rechtsetzungsakte aus. Im Vergleich zu den sonstigen im EGV geregelten Rechtsetzungsverfahren, die eine Beteiligung des Europäischen Parlaments vorsehen, scheinen die Sozialpartner an seine Stelle zu treten. Diesen Eindruck bestärkt das EuG, demzufolge die Sozialpartner die fehlende Beteiligung des Parlaments ersetzen und der Gemeinschaftsmaßnahme die erforderliche Legitimation verleihen können. Ziel ist es, diese Zweifel auf ihre Berechtigung zu untersuchen. Dabei wählt Ursula Spieß unter Einbeziehung rechtsvergleichender Aspekte erstmals das gemeinschaftsrechtliche Demokratie- und Rechtsstaatsprinzip als Maßstab, nach dem sie ihre Beurteilung ausrichtet. Sie leistet damit einen Beitrag zur Beteiligung der Sozialpartner an der Rechtsetzung sowohl auf der Gemeinschaftsebene als auch auf der nationalen Ebene des Tarifrechts. Wie die Untersuchung zeigt, sind Zweifel an der demokratischen Legitimation nur zum Teil berechtigt.
