This edited book focuses on how States should regulate activities in space and explores strategies to advance State responsible behaviour to ensure sustainable use and effective protection of outer space for peaceful purposes. The time seems ripe to bring international law into the space sustainability discourse. The concept of sustainable development was conceptualized by the 1987 Brundtland Report, Our Common Future. Today, as then, the overlap between the security, environmental and economic dimensions, including in terms of intra/inter-generational equity, is reflected within the current ‘new space'era that is now ‘our common future'. It is statistically unlikely that humans are the only intelligent species in the universe. Nothing about the others will be known until contact is made beyond a radio signal from space that merely tells us they existed when it was sent. That contact may occur tomorrow, in a hundred years, or never. If it does it will be a high-risk scenario for humanity. It may be peaceful or hostile. Relying on alien altruism and benign intentions is wishful thinking. We need to begin identifying as a planetary species, and develop a global consensus on how to respond in either scenario.

This book flags and contemplates the lurking problem of space crimes that may escalate and expand with diversification of space activities, greater footfall on the celestial bodies and passage of time, for the lack of appropriate solutions. ​It appraises the incumbent problems to evolve solutions and make recommendations regarding space crime situations. Recognizing current situation where commercial space travel has commenced, and space tourism is not far behind, the book takes a pole position on discussing the topic with its endemic challenges. Space transportation is expected to lead to commercial mining of celestial mineral resources from the Moon and asteroids, as has been found technically feasible and commercially viable. The criminals may be individuals or collective groups or incognito terrorists. The book also discusses crimes and near-crimes that have already occurred in space but have been ignored or condoned. Absence of sovereignty on celestial bodies coupled with crimes in space or on celestial bodies, presents problems of jurisdiction, extradition, and other legal procedures. The dilemma of multi-national judicial systems, legal codes and norms of social justice need to be resolved by a specialized treaty reconciling major bends in the existing system vis-à-vis the nature of space crimes. Limitations in handling such crimes by the existing judicial system under established doctrines of international law by International Court of Justice or International Criminal Court, is highlighted in the book. Access to space technology has changed dramatically in the past 10 years. Traditionally, access to space capabilities required dedicated receivers and significant investment. With the advent of new information technologies that incorporate and disseminate the benefits of space directly to users, access to space technology is no longer so exclusive. As the seamless delivery of space capabilities, from navigation and position to data flows, makes it difficult to distinguish space capabilities from other information infrastructures, legal structures developed to govern space technologies are being forced into contact with a variety of other legal structures. This book calls for the urgent regulation of satellite mega-constellations in outer space, proposing a new model of “international regulatory coordination”, in order to ensure the sustainable balance of science and advanced telecommunications. We are currently witnessing expansion of the Internet off our planet. The proliferation of new space-based internet connectivity has been accompanied by much discussion about the potential impact on astronomy. Scientists are increasingly concerned that mega-constellations proposed by SpaceX, OneWeb, Amazon and Facebook, might wreak havoc on scientific research and transform our view of the stars. These commercial operators plan to launch hundreds of thousands of satellites into Low-Earth Orbit (LEO) in the coming decade, representing a 1000% increase on objects currently in orbit. This book examines this new space race in the context of historical rivalries, for it is clear that mega-constellations are being actively pursued by a US administration determined to dominate LEO as tensions with China rise. This creates a risk of interference with earth-based scientific activities that use optical and radio frequency techniques to study the universe. This book examines these developments in the context of the Outer Space Treaty (OST), which provides all States with the freedom of scientific investigation, exploration and use of outer space, while balancing this with obligations to avoid interference with the space activities of other States. It draws upon interviews with some of Europe's leading astronomers in order to highlight the extent to which the issue will require legal and regulatory reform of mega-constellation licensing processes, to ensure the integrity of astronomical science is preserved. Detlev Wolter untersucht in der vorliegenden interdisziplinären Arbeit die völkerrechtlichen Grundlagen für die Anwendung der sicherheitspolitischen Konzeption »Gemeinsamer Sicherheit« auf den Weltraum. Gestützt auf die Menschheitsklausel als zentralem Strukturprinzip des Weltraumvertrages und das Kooperationsgebot entwirft er eine umfassende Theorie der friedlichen Nutzung des hoheitsfreien Gemeinschaftsraums. Der Strukturwandel des Völkerrechts von einem Koexistenz- zum Kooperationsrecht mit der Herausbildung von Allgemeinwohlinteressen im Völkerrecht wird für die Sicherheit im Gemeinschaftsraum fruchtbar gemacht. Dazu werden Entstehungsgeschichte, Anwendungsbereich und Inhalt des Grundsatzes der friedlichen Nutzung des Weltraums und des Prinzips des Gemeinsamen Erbes der Menschheit anhand der Staatenpraxis in den Vereinten Nationen und der Genfer Abrüstungskonferenz beleuchtet und die global commons-Diskussion auf den Sicherheitsbereich bezogen. Die Herausarbeitung konkretisierender Rechtsstandards und Kriterien der friedlichen Nutzung bildet die Grundlage für eine völkerrechtliche Bewertung der Pläne von Präsident Bush jr. zu einer weltraumgestützten Raketenabwehr. Den Bestrebungen einer militärischen Kontrolle über den Weltraum wird die Bekräftigung gemeinsamer Sicherheitsinteressen als Chance für einen kooperativen Strategiewechsel gegenübergestellt. Im rechtspolitischen Teil schlägt der Autor ein multilaterales Abkommen über kooperative Sicherheit im Weltraum (KSW-Vertrag) mit folgenden Bestandteilen vor: Transparenz und Vertrauensbildung, strukturelle Nichtangriffsfähigkeit, schrittweise Denuklearisierung, Schutz vor unautorisierten und versehentlichen Raketenangriffen und vor Raketenangriffen unter Verletzung eines Nichtverbreitungsregimes, Verbot der aktiven militärischen Nutzung des Gemeinschaftsraums von zerstörerischer Art und Errichtung einer International Satellite Monitoring Agency. Der Entwurf für eine gemeinsame Sicherheitsordnung knüpft strukturell an eine kooperative Völkerrechtsordnung mit den Gemeinschaftswerten von Abrüstung, wirtschaftlicher Entwicklung und multilateraler Friedenssicherung an.

This book proposes a framework for assessing countries'levels of compliance with international space law and norms. It begins by exploring the development of two movements – the evidence-based policymaking and programming movement, and the rise of ratings and rankings research – and their growth across various disciplines. The analysis suggests that such efforts are useful in gauging the behavior of countries in space according to how well they adhere to existing space law and norms. To date, there is no comprehensive, periodic, and systematic measure of countries'efforts to comply with space law and norms; this work endeavors to fill that gap by offering a framework in which to assess compliance. Applying the framework results in five possible ratings that a country may be assigned, ranging from highly compliant to non-compliant. Ideally, the proposed framework can be used to promote compliance, and with it, space security and sustainability.

This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book. In closing, the use of satellite data for legal purposes is not without its fair share of problems and concerns, which are also considered to guide the evolution of this emerging field.

This book shares a range of new and diverse insights on On-Orbit Servicing (OOS), and examines its implications especially from political, legal, economic, and security perspectives. OSS has been evolving rapidly and presents both challenges and opportunities, such as in-space repairs, refuelling, refurbishment of spacecraft and servicing satellites, which could play a critical role in extending satellite lifecycles, while also representing a valuable next step in debris mitigation. At the same time, many legal questions have arisen in connection with OOS: the need to prevent hostile actions under the pretext of OSS; the distinction between governmental and non-governmental OOS operators; the status of re-worked and recycled space objects; the issue of control in terms of operations performed in orbit, i.e., in the international sphere; the status of objects manufactured in orbit and applicable law, including liability and registration; and the impacts on insurance lawand risk management. This book provides an extensive overview of the protection of cultural heritages sites on the Moon (humanity's lunar heritage) and the various threats they face. First of all, the international legal framework, especially the relevant space treaties are analyzed in terms of how they protect cultural heritages sites on the Moon. In turn, the book explores key aspects like the application of customary law, the UNESCO World Heritage Convention, or the Underwater Convention, and the possibility of adding these sites to UNESCO's World Heritage list. Is international law equipped to tackle the challenges posed by the dramatic increase in disasters? In Disaster Management and International Space Law Diego Zannoni attempts to answer this crucial question through an analysis of the main legal issues involved, addressing both prevention and relief, with a special focus on major space applications such as remote sensing and telecommunications, and the attendant specific legal regimes. It is argued that, when lives of human beings are in danger, territorial sovereignty becomes, to a certain extent, porous and bends in front of the value of human life and the urgent need to rescue. On the other hand, specific obligations were identified to cooperate in the prevention and management of disasters, particularly in terms of data sharing.

This book is based on the findings, conclusions and recommendations of the Global Space Governance study commissioned by the 2014 Montreal Declaration that called upon civil society, academics, governments, the private sector, and other stakeholders to undertake an international interdisciplinary study. The study took three years to complete. It examines the drivers of space regulations and standards, key regulatory problems, and especially addresses possible improvements in global space governance. The world's leading experts led the drafting of chapters, with input from academics and knowledgeable professionals in the public and private sectors, intergovernmental organizations, and nongovernmental organizations from all the regions of the world with over 80 total participants. This book and areas identified for priority action are to be presented to the UN Committee on the Peaceful Uses of Outer Space and it is hoped will be considered directly or indirectly at the UNISPACE+50 event in Vienna, Austria, in 2018. The report, a collective work of all the contributors, includes objective analysis and frank statements expressed without pressure of political, national, and occupational concerns or interest. In State Accountability for Space Debris Peter Stubbe examines the legal consequences of space debris pollution which, he argues, is a global environmental concern. The study finds that the customary ‘no harm'rule and Article IX of the Outer Space Treaty obligate States to prevent the generation of debris and that the international community as a whole has a legitimate interest in their compliance. A breach of these obligations entails the responsibility of a State and compensation must be provided for damage caused by space debris. The author treats responsibility and liability separately and thoroughly scrutinizes both legal regimes with the help of common analytical elements. Finally, Peter Stubbe argues that a comprehensive traffic management system is required so as to ensure the safe and sustainable use of outer space.

This volume provides an in-depth discussion on the central question – how can people express and survive dissent and disagreement in confined habitats in space? The discussion is an important one because it could be that the systems of inter-dependence required to survive in space are so strong that dissent becomes impossible. John Locke originally said that people have a right to use revolution to overthrow a despotic regime. But if revolution causes violence and damage that causes depressurisation with the risk of killing many people, is it even permissible to have a revolution? How then are people to express their liberty or dissatisfaction with their rulers? The emergence of structures of dissent and disagreement is an essential part of the construction of a framework of liberty in space (revolution is just the extreme example) and thus the topic deserves in-depth and immediate attention. Even today, the way in which we assemble organisations and corporations for the government and private exploration of space must take into account the need for mechanisms to allow people to express dissent.

With different countries ascribing to different theories of air space and outer space law, Dr. Bittencourt Neto proposes in this Brief a reassessment of the international law related to the extension of state territories vertically. Taking into consideration the vast number of proposals offered by scholars and diplomatic delegations on this subject matter, as well as the principles of comparative law, a compromise to allow for peaceful development is the only way forward. The author argues for setting the delimitation of the frontier between air space and outer space at 100 km above mean sea level through an international treaty. This would also regulate passage rights for space objects during launchings and reentries, as long as those space activities are peaceful, conducted in accordance with international law and respecting the sovereign interests of the territorial State. Access to satellite orbits and spectrum is managed by the ITU, a United Nations body that strives to extend the benefits of new technologies to the world, while ensuring equitable access to these resources. This book provides a look at the various nuances of the commercial aspects of space transport and offers a workable and practical legal and regulatory approach to be taken by the International Civil Aviation Organization. The book also addresses the perceived lack of wisdom in neglecting to consider the basic legal structure of a regulatory regime for commercial space transport as a first step and goes on to analyze ways and means of using the existing legal instruments pertaining to international civil aviation as an analogous system that can be moulded into a separate and cohesive set of multilateral legal instruments that could apply to commercial space transport. As expected, commercial space transport has taken off with a flourish. It is now evident that, from sub-orbital flights to mining asteroids, this industry will grow exponentially. Signs of its importance are reflected by various international conferences being convened on the subject both by academia and the international community. The only snag is the lack of a regulatory instrument or in the least a contrived approach to a definitive legal regime that would provide a structure, purpose and direction to commercial space transport. This blatant lacuna and neglect has resulted in the emergence of various theories by academics and a half hearted look at the subject by the international legal community.

International space law is less than 50 years old. Although the work on the codification of space law started in the late 1950s, the Outer Space Treaty was only adopted in January 1967. However, much earlier than that, even as early as 1932, the first ideas about legal rules for human activities in outer space were being considered. Very little is known about these early drafts and proposals, and the pioneering work of early scholars in the field remains relatively unknown.
