Claudia Letzien untersucht am Beispiel der USA, Deutschlands und Großbritanniens die Strafbarkeit der Bestechung ausländischer Amtsträger und die verschiedenen Sanktionen, die in diesem Zusammenhang gegen Unternehmen verhängt werden können. Die Autorin widmet sich der Problematik der Jurisdiktionskonflikte, die entstehen, wenn verschiedene Staaten ihren Sanktionsanspruch gegen ein Unternehmen durchsetzen wollen und verdeutlicht, dass diese mit dem Grundsatz ne bis in idem nicht gelöst werden können. Sie schlägt ein Verfahren vor, mit dem ein bestmöglicher Ausgleich der unterschiedlichen Interessen bei der Unternehmenssanktionierung durch mehrere Staaten in Auslandsbestechungsfällen gelingen kann.

Anti-Corruption and Compliance programmes in multinational companies have become a common standard. In order for these programmes to be effective, international guidelines and best practice provide that Top Management needs to demonstrate Tone from the Top. However, it remains unresolved what Tone from the Top implies in practice and how it influences the effectiveness of anti-corruption. This book explores theoretically and empirically, what Tone from the Top means and how it can influence decision making with respect to corruption. Data was obtained from Nigerian managers within the oil and gas industry when facing corruption in an experimental environment. An innovative research design, the Drill Bit Business Simulation, was applied which imitates the realities and corruption opportunities of the Nigerian oil and gas sector. Results show how Tone from the Top influences moral and social motivations, which in turn steer the decision of managers whether to engage in corruption. On the basis of these new insights on corrupt decision-making in companies and the influence of Tone from the Top, this book provides practical recommendations on how anti-corruption programmes can be designed to become more effective.

Competence-competence and corruption have, for different reasons, been mainstays of international dispute resolution thought and practice for the longest time. In the last few years, their intersection has become increasingly important and problematic. These lectures seek to define the problem and to provide acceptable solutions where possible. They attempt to derive support from both a stringent dogmatic approach and pragmatic attention to real-life expectations and conduct. More so than in other areas of private international law, the intersection between the powers of the arbitrator and the illegality of the subject matter or the parties'conduct poses a particular challenge. That challenge is to postulate proper solutions under the law, including principles of transnational or international law, to conduct which can take on a multiplicity of appearances owing to conflicting cultural understandings of what is and is not legal in commercial life. The statement that bribery and corruption offend transnational or international public policy does not relieve the arbitrator from the burden of scrutinizing that statement doctrinally and exploring its consequences in a period of ever-increasing globalization of economic activity and investment.
