This book analyses the domestic application of international law, with a particular focus on the concept of direct applicability. It critically examines the relevant doctrine and practice and proposes a new analytical framework. It argues that international law is presumed to be directly applicable, that the criteria for direct applicability are grounds to exclude rather than establish direct applicability, and that the positive intent of the parties should not be a criterion. It contends that direct applicability is a question of domestic law and that domestic legal force is a prerequisite for direct applicability. It also advocates a relative approach.

Punitive damages nach US-Recht zählen hierzulande zu den meistdiskutierten ausländischen Rechtsfiguren. Stephan Lüke betrachtet das Rechtsinstitut der punitive damages im Kontext der US-amerikanischen, schweizerischen und deutschen Schiedsgerichtsbarkeit. Er zeigt auf, welche rechtlichen Probleme aus Sicht dieser Staaten mit einer schiedsgerichtlichen Anordnung von Strafschadensersatz verbunden sind, und entwickelt von den einzelnen Rechtsordnungen ausgehende Lösungsansätze. Der Autor widmet sich zunächst der Rechtslage in den USA, die er anhand zahlreicher Gerichtsurteile skizziert und unter Berücksichtigung des einschlägigen Schrifttums analysiert. Dann behandelt er die Situation in der Schweiz und Deutschland, wobei einerseits die Zuerkennung von punitive damages durch inländische Schiedsgerichte, andererseits die Anerkennung und Vollstreckung entsprechender ausländischer Schiedssprüche erörtert wird.

The reform of the European Constitution continues to dominate news headlines and has provoked a massive debate, unprecedented in the history of EU law. Against this backdrop Monica Claes'book offers a'bottom up'view of how the Constitution might work, taking the viewpoint of the national courts as her starting point, and at the same time returning to fundamental principles in order to interrogate the myths of Community law. Judge David Edward has enjoyed a glittering career. After a substantial,successful period in Scotland, both as a practising advocate and professor of EC law, he was appointed to the Court of First Instance upon its creation in 1989. The German Yearbook of International Law was founded in 1948 by Rudolph Laun and Hermann von Mangoldt as the'Jahrbuch für Internationales Recht'. The Yearbook is currently edited by the Walther-Schücking-Institute for International Law at the University of Kiel, and it continues to follow in its tradition of offering learned contributions to the development of international law. Although German scholars were once the primary contributors to the Yearbook, today authors from throughout the world are welcomed to publish their English language, and occasionally French language, articles. This trend has helped the Yearbook further open itself to new readers. It is the goal of the Yearbook's editors to create a free forum for the discussion of international law that is available to the largest possible international audience. To this end, the Yearbook has remained progressive by discussing timely topics of interest and concern to international legal academics and practitioners. Its editors have also modified the Yearbook's approach to the field in recent years by offering a focus section in each volume that considers issues of particular importance to the further development of international law. The Yearbook has also been successful in informing the international law community with regard to research done in German academic institutions and in presenting international viewpoints on various topics to the German community. In addition, the Yearbook publishes annual reports on the work of international organizations that make significant contributions to international law.
