This book focuses on devising a comprehensive protective mechanism for the right to privacy in Pakistan. It argues that the existing legal regime lacks an effective remedy for victims of privacy violations and emphasizes the need for comprehensive legislation to safeguard this crucial right. Pursuing a multidisciplinary approach, the book thoroughly explores the issue of media intrusions into people's privacy through thematic media content analysis and highlights the significant impacts of these intrusions on victims'lives.In the process, the book addresses various conceptual aspects, their relevance, and their implications for privacy-related disputes during adjudication. Recognizing that theoretical underpinnings alone may not be sufficient to create a legal regime “from scratch,” it explores the enforcement of the right to privacy under the European Convention on Human Rights (ECHR), as interpreted and enforced by the European Court of Human Rights (ECtHR).The book subsequently goes beyond exploring international law by analyzing the impact of media-and-privacy cases on privacy protection in two major member states: Germany (a civil law jurisdiction) and the United Kingdom (a common law jurisdiction). Drawing upon these conceptual and comparative legal deliberations and findings, the book provides concrete guidelines for a new privacy law in Pakistan.

This curated book addresses, in the scholarly realm, the problems of soil degradation and provides some practical solutions for them to save soil life. It comprises ten specially invited chapters that address the global soil framework, soil challenges in India, existing policy, law and institutional framework as well as other perspectives.Soil is our biological capital. The soil health is critical for survival of the humans (and other life forms) since almost 95% of our food comes from it. It also has significant potential as a sink for carbon through sequestering. Excessive and inappropriate land use leads to various forms of land degradation that becomes contributing factor for hunger, migration and even wars. There are several multilateral environmental agreements (MEAs) including UN Convention to Combat Desertification (UNCCD) that hold relevance for addressing the global soil problematique. The UNCCD Strategic Framework (2018-2030) has declared desertification/land degradation and drought (DLDD) as “challenges of a global dimension”. As a result, sustainable soil management (SSM) has emerged as an important goal for attaining Sustainable Development Goals 2030 (SDGs 2030).In the backdrop of these globally ordained processes, India appears to be seriously pursuing the Land Degradation Neutrality (LDN) target within the framework of the UNCCD. As a corollary, India has set an ambitious goal of halting any further land degradation by 2030 and rehabilitate at least 30 million hectares of degraded wasteland, forest land and agricultural land.This ideational effort by eminent legal scholars, soil scientists and practitioners aim to promote concerted teaching and research in the field of soil law and governance in the University Faculties of Law, National Law Schools, Institutions of Eminence and other legal and scientific bodies. The ‘seeds sown'in the soil of knowledge through this effort will, hopefully, provide an impetus for more in-depth research concerning soil law and governance in India and beyond.

The book provides a comprehensive analysis of local government in federations. It fills the gap in current legal research and positions local government in federal studies through the lenses of comparative law, adopting a more nuanced approach to local government. The book considers the shortcomings between the black-letter constitution and its operational rules. Whether (and how) the regime of local government is implemented is more relevant than its formal-but-ineffective recognition. This collection of essays contains in-depth analyses of eighteen landmark cases in private international law, from Penn v Lord Baltimore in 1750 to Brownlie v FS Cairo (Nile Plaza) LLC in 2021. The contributors are experts drawn from academia and practice as well as from the bench. Case law has been a central driver in the legal development of the English conflict of laws. Beyond its relevance for these fields, the book will support practitioners in parliaments, governments and courts, thereby impacting the actual use of omnibus legislation.A new, major and controversial reform is enacted in the middle of the night. It is buried in a massive omnibus bill hundreds of pages in length, which is rammed through the legislative process at breakneck speed. The legislators receive the final version of the bill in the very last minute, and protest that they've had no opportunity to read it in detail and know what they're voting upon. The majority party's legislative leaders, however, are unimpressed, and the law is eventually passed on the basis of strict party discipline.Though it may sound far-fetched, this scenario is all too familiar in many legislatures around the world. The legislative practice of combining numerous unrelated measures in one long bill, which is often passed via a highly expedited process, has become a matter of intense debate and criticism in many countries.

In Global Constitutionalism and the Path of International Law, Surendra Bhandari succinctly offers an account of the most important growth and features of international law from the perspectives of global constitutionalism. The author examines the concept from its constitutive features and the operative standards or modus operandi. These two aspects offer a new and innovative methodology in explicating the theory of ‘global constitutionalism'. By examining three cases: international trade (WTO), human rights, and the role of Security Council, the author demonstrates how the idea of global constitutionalism is shaping and deepening the path of international law in the 21st century and elucidates the development of international law as a body of positive rules.

Last year I addressed the Netherlands Comparative Law Asso­ ciation with the following question:'Does Comparative Law Exist At All?'(My intention then was to flog the dead (?) horse of the merger of comparative law and the sociology of law.) In presenting this voluminous collection of Netherlands national reports to the eleventh congress of the Internatio­ nal Academy of Comparative Law I feel my misgivings giving way to the suspicion, that comparative law indeed exists. Of course national reports do not, as such, prove the exist­ ence of comparative law. It is the general reports together with the national reports, which embody the comparative effort. That is why the Netherlands Comparative Law Associa­ tion took the initiative to propose the publishing of the materials on a subject to subject basis instead of publish­ ing collections of national reports. From a comparative legal point of view, it is the topic that should form the basis of the publication, and not the origin of the materials. The general reporter for each topic should be prepared to take up the responsabilities of editing the volume, and would have to be given the right to select those national reports which he considers to be useful both in regard to their quality and the relevance of the material to the basic problems in the questionnaire. This proposal met with very favourable comments from the na­ tional committees and general reporters of some fifteen coun­ tries.

The present volume reproduces with slight changes the course of lectures given at The Hague in 1972 under the title of'The General Principles of Private International Law'. The substance of these lec­ tures has remained unaltered, but a number of insertions serve to cor­ rected some formal mistakes and misprints, added references to literature, some older, some more recent, without attempting to be exhaustive, and modified and supplemented the former exposition in two respects, where subsequent criticisms called for a review. This book presents the results of research project financed by the Hague Institute for the Internationalization of Law (HiiL) and carried out at the Tilburg Law and Economics Center (TILEC) of Tilburg University. The project team shows that globalization, instead of threatening national legal systems, put them in a new role and gives them continuing relevance. First of all, once one takes a more functional view of the law, based on law and economics and comparative law literature, harmonization or unification of national legal systems is no longer a foregone conclusion. Secondly, fundamental constitutional principles continue to bear in the era of multi-level and transnational governance: they become governance principles, divorced from specific institutional settings. Finally, looking beyond regulatory competition and comparative law, legal emulation provides a rich and fruitful model to explain the interplay between legal systems. This book explores these three themes, both at a theoretical level and in the light of specific examples.
