A new fax compression technique that can squeeze 200 pages of text or software code onto a single piece of paper has been developed by Palo Alto, California-based InfoImaging Technologies Inc. 3D Fax compresses pages to be faxed into a single indecipherable image that can be sent via fax machine or computer to its destination, where it can then be scanned, allowing 3D fax software to separate out the various pages of text or code. This article presents a discussion on whether reverse engineering is a lawful way to acquire trade secrets embodied in mass-marketed products, in light of a case pending with California Supreme Court. The precedent set in this case could, in turn, influence courts in other jurisdictions. A key issue in the case, one that legal scholars and intellectual property lawyers have debated for many years--is whether an anti-reverse-engineering clause in a mass-market license should be enforceable. California trade-secrecy law explicitly provides that reverse engineering is a lawful way to acquire a trade secret, as do the laws of other jurisdictions. Several reasons support reverse engineering as a sound principle of trade-secret law. Purchase of a product in the open market generally confers personal property rights in the product, including the right to take the product apart, measure it, subject it to testing, and the like. The law also regards the sale of a product in the open market as a kind of publication of innovations it embodies and a dedication of them to the public domain unless the creator has obtained patent protection for them.

An Industrial Advisory Group met in June 1996 in Silicon Valley, California to investigate how Association for Computing Machinery (ACM) might better serve the concerns of the computing industrial development community. The owner pushes a button on the card that prompts it to ask for a password; once the password is confirmed the device uses its ID squawk to identify itself and an online server confirms it to permit a transaction. The only way thieves could possibly use the card is if they could copy the owner's voice with an extremely high degree of accuracy. Beepcard intends to use smaller chips to thin it down, as well as include a nonreplaceable battery to allow 10 transactions per day for two years.
