This paper pretends to analyze the burden of proof of liability derived from the air transport agreement, both International (Montreal Convention 1999) and nationally (Commercial Code), on the understanding that there are certain situations where this could be reversed. This is because disproportionate and unbalanced facts presented in the daily practice of aeronautics. The writing has the method, a deductive research strategy, which is why we started from a general premise to reach a specific topic, "disproportionate or unbalanced situations in the development of air transport activity, which reverses the burden of the test."In conclusion, the paper proposes a reversal of the burden of proof in certain cases where the inconsistency is evident, according to the principle of judicial economy, so important in the legal traffic busy today. This paper will address some of the problems arising from the legal identification of trans people and the exercise of their rights in Colombia. After a brief théorie explanation about the notion of trans as an identitary concept, the author will describe two different approaches concerning the role of the law regarding trans people's lives and experiences. The first one, rooted on queer theory, opposes any governmental intervention. The second one, based on the human rights discourse embraced by the LGBTI social movement, is willing to demand legal recognition. This paper concludes with the analysis of the difficulties in the assignment of sex on the identification documents and its effects on the exercise of citizenship, a debate where both approaches can be highlighted and were new challenges about the legal recognition of gender identity emerge. The use of disciplines and fields of knowledge is articulated to the general structure of the sentence as literary technology that makes visible the role of the court as administrator of justice. The scientific study of the ability to localize sounds in children with normal vision began in the early 80s. However, in the case of blind children, scarce research has been conducted on this subject. This paper presents a review of articles on cognitive and motor development of blind children that evaluated sound localization behaviors in early childhood. First, pioneering studies published in the 60s are summarized and then researches from the 80s are presented. A comparative analysis of their mechanisms of 'exocization' and 'orientalization' of Chinese culture allows us to understand these works within a new trend of transpacific imagination that expresses anxieties directly related to the uncertainties created by cultural globalisation. In dialogue with the work of Edward Said and Fredric Jameson, the paper offers an exercise in theoretical speculation on the cultural transformations that the consolidation of a transnational literary community could bring. The algorithm proposed in this paper approaches to the angular speed by signals coming from an incremental encoder. This algorithm removes the oscillations that appear even at constant speed, when using the traditional algorithms, which are known as at fixed time and at fixed space. The key idea on the elimination of the oscillations is the synchronization between a signal every δ time and the pulses coming from the encoder. The most outstanding result in this paper says that the harmonic average between the output of the proposed algorithm and the output of a modification of this same algorithm turns out to have the smallest possible relative error. The relative error of the new algorithm is always smaller than half of what would be by using traditional algorithms, which shows that the algorithm is optimal. At the end of the article, and using real pulses from an encoder, some experiments were run in Matlab Simulink. These experiments serve as an experimental test of the algorithms performance. There are few studies on pathological gambling (PG) tests and prevalence for Colombian population. The aim of this paper was to obtain both psychometric properties of the Pathological Gambling Short Questionnaire (PGSQ), as well as to calculate the prevalence of pathological gambling (PG) for a non-randomized sample of university and technical courses from all Colombian capital cities. Results showed a PGSQ good internal reliability (0.74) and convergent validity with a cognitive distortions indicator -r(5618)= 0.462, p < 0.001-. The prevalence of possible pathological gamblers was similar to other studies which have used broader measures of pathological gambling (19.2%). Men, youngest people and members of low social class had higher scores in PG. According to these results, it should be confirmed PG prevalence with other measures, in order to boost legal and socio-health actions for prevention of PG in high risk groups and to know utility of PGSQ for Colombian clinical samples. The purpose of this paper was to test the predictive power of the channels of communication used by fitness monitor, the intrinsic motivation and the enjoyment of the activity, in the commitment of fitness. 287 gym fitness were involved in the study to which were analyzed the degree of perceived communication and the communicational barriers with the monitor, the intrinsic motivation, the enjoyment and the level of sport commitment. The result of linear regression analysis showed that the use of channels of communication verbal, no-verbal and the avoidance of communication barriers, as well as high levels of intrinsic motivation and enjoyment during the practice, predicted a future commitment of the participants. In this way, the use of effective communication strategies by the fitness monitor during the interaction with practitioners would increase the motivation of individuals allowing a greater adherence to practice. This paper analyzes how the sexist attitudes are related to the assumption of responsibility, as well as the predictive capacity of this variable with respect to the aggressors' minimization of the harm and a lack of attributing responsibility of 129 aggressors convicted in Spain for gender violence. There was applied the Scale of Attribution of Responsibility and Minimization and the Inventory of Ambivalent Sexism (ASI). The results indicate that a high percentage of aggressors tends to assume the responsibility for the violence exercised and do not justify the aggression. Likewise, there has been stated that the aggressors do not present a high number of sexist attitudes. Nevertheless, sexist attitudes allow to predict the minimization of hurt of the aggressors. The conclusions redound to the importance of intervention with this population, given the efficiency of the programs in the assumption of responsibility and in the decrease of sexist attitudes. This paper researches motivation for physical activity in the framework of the goal orientation theory. This work is based on data from 786 students. Hierarchical cluster analysis allowed identifying four goal orientation profiles. The most adaptive profile (high task, high ego, high expectancy) is associated with the best results. Students with high motivation for physical activity, ego, and performance expectancy are concluded to obtain more indications of support from their relatives and peers for physical activity practice, perceive themselves self-effective to complete this activity, claim their better self-perceived fitness, and show more frequent physical-sports activity. We seek in this paper to show the inquiry about the implementation in 2016 of the Motu proprio Mitis Iudex Dominus Iesus of Pope Francis at the end of the year 2015 and what are his immediate prospects, in the ecclesiastical court of Zipaquirá (Colombia). For this we have resorted to framing this study in the theology of the Pope and his life cycle, to expose the norms of the Motu proprio mentioned and its change with respect to the replaced norms of the Code of Canon Law, as well as to transcribe the questions that we have formulated to the Court Ecclesiastic of Zipaquirá and their respective answers, to finally make our comments. In them it is to emphasize that the Court of Zipaquirá has been created based on the Motu Proprio, that the brief process has not been used until now, that the double sentence as it is shown somehow successful in the measure in which the failures produced have not been appealed, that real pastoralism is gaining ground in our view of an excess of legality, lacking a greater disclosure of the Motu Proprio, as well as the future that the facilities and staff of the Tribunal promise to attend in the year 2017, almost triple the number of cases examined and sentenced in 2016, that parish priests will gradually become more involved in the preparation of cases of nullity, and that judicial decongestion and greater acceptance of those in need of the nullity process will be a reality. In this paper, we analyze the processes of cultural translation, appropriation, and transculturation of European Romanticism - particularly the French - in the essays of Esteban Echeverría. In his writings, there is an intimate relationship between romanticism, liberalism, and modernity. The author appropriates certain elements of romance, such as the concept of modernity and the principles of the French Revolution, but rejects others such as the aesthetic revolution, the radical formulation of the modern subject, popular culture as the basis of national culture, and the emancipation of women. The eclectic appropriation of romanticism not only serves to entitle the voice of the literate and its social function, but also to legitimize the liberal project of spiritual and cultural independence. This paper reviews the foundations of Jeremy Bentham's utilitarianism and the main criticisms to this doctrine, especially those which deem it incompatible with unconditional respect of human rights. Bentham's Panopticon, his proposal on prison reform published in the late eighteenth century, is discussed. Based on the analysis of the Panopticon -which is a consistent application of Bentham utilitarianism-, the author concludes that a) this doctrine promotes a humanitarian approach, although b) human rights are not guaranteed, but conditioned to the provided level of collective benefit; and c) Bentham's utilitarianism questions the universality and irrevocability of human rights. It is usual to claim that Descartes' epistemological project is such that its main objective (overturning the doubts of the sceptics) and the means to attain it (the method of doubt) are incompatible, so that Descartes necessarily blocks his own project. In this paper I argue that the above opinion comes from a blindness of sorts that prevents us from appreciating both the therapeutical nature of Descartes' method and the specific procedures that he uses to work himself into a position from which radical sceptical hypotheses no longer make sense. Far from obsolete, Descartes' strategy fares much better in terms of overcoming radical scepticism than contemporary rival approaches, whether they are overriding strategies or undercutting procedures that, stressing the groundless character of our basic beliefs, fall prey to the bewitchment of scepticism. This article focuses on the different relationships that bond the concept of auctoritas with the concept of potestas as essential notions of positive law, which are expressed in two areas: as sources of creation and protection of the legal and institutional order and as sources of denial and destruction of human life. Auctoritas considerably increases potestas when protection of order is required and, therefore, radically increases the power of destruction of human life. Law and life, then, are the foundation and the ultimate object of this intimate and complex link between auctoritas and potestas, objectified in the preservation of the law and, in turn, saturating the legal and political dimensions of human life, reducing it to bare life, that is, to a worthless object that can be managed, administered and eventually eliminated. Upon these premises, this paper aims to address the relations between auctoritas and potestas, and between them and the bare life, from the various analyzes and historical, political and legal outcomes. These analyzes allow us to state either the supremacy of the link between authority and power to ensure the validity of the legal and institutional order, or the supremacy of human life, free from this excessive link. This document provides a research conducted in the towns of Nueva Venecia and Buena Vista, townships found in the 'Ciénaga Grande de Santa Marta' (Colombia), in a territory where the state has a partially differentiated reached. This paper tries to make a critical account of the effectiveness of affirmative state action to overcome the material inequality that characterizes this population, the differential inputs of public authorities, and multilateral private intervention as means that sometimes replace public power. The research method deployed covered surveys of the population, defining the size of the sample by means of simple random sampling for non-finite populations; similarly, semi-structured in-depth interviews were applied. Applications were made to public and private entities that have developed activities in the community or issue and implement public policies, and re-describes based on the documentary work the history and context of the populations analyzed. This paper shows that, although people in the Middle Ages resorted to vengeance and private wars to solve conflicts, there were also controls other than violence. Therefore, Norbert Elias is wrong in attributing an uncontrolled aggressiveness to medieval society. Historian Marc Bloch is also wrong to suppose that violence was the consequence of an emotional instability or the uncivilized nature of the Feudal Age. On one hand, we claim that the progressive consolidation of monarchies and a renewed administration of justice since the twelfth century contributed to the reduction of violence. On the other hand, we state that this did not prevent private acts of justice from pursuing a purpose similar to that of the monarchy: peace above punishment. Finally, we conclude that these centralized powers, the papacy and monarchies, promoted their own violence against internal dissidents and Islam: the crusades, extremely violent wars. These theses are developed using the historiographic method, that is, the contrast between studies on violence today and in the Middle Ages. [ABSTRACT FROM AUTHOR]

The implications of the armed conflict in Colombia seem to be mitigated by initiatives of symbolic construction of memory, which tend to go beyond the theatricalization of memory. Undoubtedly, these initiatives contribute to ensuring the non-repetition of the violent events that gave rise to them. However, they usually do not provide spaces for reflection on the daily lives of victims, which are reconstructed through elements such as language. Based on stories told by some of the women of the Trujillo's Association of Relatives of Victims (AFAVIT), this paper aims to analyze how life is given meaning day by day, as well as the resources used to achieve this. Supporting this is the problematization on the role of language, which reflects the constant tension of survivors between telling what happened to prevent repetition or not telling it to avert the dangerous effects that threaten their physical and emotional well-being. In 1944, the government of the self-ploclaimed «June Revolution» installed a Military Zone in the basin of the Gulf San Jorge (Argentina). Its purpose was to militarize central Patagonia, as its vast and perpetually disputed oil wealth meant this territory needed to be safeguarded. The Military Government (GM) caused a series of important transformations; the analysis of the work environment in Comodoro Rivadavia shows one of these transformations. This work analyses leadership from the perspective of Social and Organisational Psychology, with scientific, empirical, objective, systematic and likely replicable rigour. The literature on leadership features a large number of diverse and heterogeneous sources stemming from several different disciplines. However, there is no agreement on what leadership is, nor is there a single explanatory model of it. This paper describes how leadership is investigated, and three dimensions are mentioned that it is expected that all theories on leadership address: leader, followers, and context. 68 studies from works published by Iberoamerican authors and covered by Redalyc and Scopus fulfilled criteria. The systematic analysis of these works had three stages: the delimitation of the search strategy and the selection of the studies; systematisation and lemmatisation of the text corpus, and statistical descriptive, unidimensional and multidimensional analysis. Results compiled using SPSS and SPAD show important contributions made by the studies in the last decade, with identification of their basic components, their theoretical explanatory models, the different methodologies used, the development of associated psychological variables, and the organisational aspects mentioned by the scientific literature in terms of leadership in organisations. Daily life demands constant making judgments or decisions. Some of those decisions may be more or less complex depending on ethical, social, historical and political context of social factors and the interaction of these factors with subjects who judge. The aim of this article is to show how Functional Theory of Cognition allows detailed cognitive decision making process analysis, in which they operate: the valuation of stimuli, integration of psychological representation of these stimuli and finally, explicit answer. This process of judgment meets three rules: addition, multiplication, average, for observing the functions that are generated between the factors involved in decisions and issuing a judgment. This theory has had important applications in the areas of clinical psychology and health, political psychology, sports psychology and developmental psychology, areas in which the paper presents the most relevant findings. My interest in increasing reflection and comprehension of disability as a socially-related issue encouraged me to start a course on the subject at the Pontificia Universidad Javeriana starting on the second term of 2008. This paper is the result of the constant research and reflection teaching involves, with especial regard to this particular course, and it presents an analysis and reflection on the notions of disability and society expressed by the 120 students that have taken the course from 2008 to 2009, and their thoughts on how the notion of disability is socially constructed. In this journey I discovered the interest of the student who is co-authoring this paper, and who was very interested in the social construction of the body. He shared his interests and knowledge and accepted the challenge of working together on the reflections presented in this paper. These discuss our findings from the work done in the classroom and other study sessions, considering expert theories on society and disability, and reflect on how the way in which we name and understand society relates to the way disability is socially constructed. The present paper analyses Dolores (1869), a short novel by Colombian writer Soledad Acosta de Samper, who undertook intense and extensive intellectual activity during her prolonged lifetime. This paper discusses the implicit relationship between the woman as an intellectual subject and her ill body as the allegory of a type of subjectivity uncomfortable for the community of learned men, through which such dissonance is retransformed into a metaphor of the pathological body (in this case, a leprous body that disintegrates in a monstrous way) as a synonym of the learned woman. In this way the writing of such a body can also infect others through a style of writing which transgresses the cannon; thus the epistolary genre, intimate, infecting the generic integrity of the republic of literature. The separation of powers and checks and balances are considered essential elements of a State based on the rule of law, for without them the creation of a Constitution is not possible. Currently, nevertheless, we not only demand abstention from the State but frequently a positive realisation of the public establishment is necessary, in order to effectively achieve the pertinent rights. The present paper intends to find a balance between a State based on the rule of law and the separation of powers and checks and balances, procuring a compatible agreement between form, reason and meaning -in constant evolution-, which should be supplied to figures that limit power, so as to make them compatible with the need of positive action from the State. The paper concludes with the idea that the value of the separation of powers and of checks and balances is a Deus ex machine, because the importance of the figure does not come from an abstract design, but from the functional structuring of the elements integrating the state organisation in virtue of which an effective constitutional machinery is put together, reflected in an efficient organisation for the realisation of the State based on the rule of law. This paper proposes a new mathematical model for the scheduling of employees. The problem consists in finding and optimal scheduling method that will balance the workload and avoid dissatisfaction and low performance problems, due to work overload or sudden changes in the workload. We will employ hypothesis testing based on the normalized Bernoulli trial, in order to do a statistical comparison between the tasks assigned by the proposed model with those assigned by the Zhirong Liang, Songshan Guo, Yanzhi Li and Andrew Lim model, which minimizes the difference between minimum and maximum workloads assigned. As a result we observed that the assignations generated by the models do not match in more than 90% of the cases. Furthermore, we found that the values of the object functions, which were gathered from solutions provided by the current model, were never better than those obtained by this paper proposes. This paper compares the influence of the temperature of the electrolyte in corrosion resistance of ceramic coatings of Chromium Nitride (CrN) produced with the unbalanced magnetron sputtering system (UBM) with industrial metallic coatings of hard chromium and organic epoxy paints. All coatings were deposited over A36 carbon steel. The evaluation of corrosion resistance was determined through electrochemical impedance spectroscopy (EIS) in a 3% sodium chloride solution. For this purpose the temperature of the electrolyte was varied from 20 °C to 80 °C, and vice versa, with an interval of 20 °C and taking measures every 24 hours. In general, organic coatings presented the least degradation in the time of the experiment; nevertheless, by the time the temperature cycle was over, the corrosion resistance was similar in the organic coatings and the ceramic ones. Interviews are the most frequently used elicitation methods in requirements engineering (RE); nevertheless, there are but few experimental research papers focused on such methods. Recently we have carried out experiments in order to analyze the effectiveness of structured and unstructured interviews. One of those papers has joined others in the field of information systems forming a basis for study. Although meta-analyzed studies seem similar in their design, a focus on threats to validity uncovers more differences than similarities. The analysis of such threats can be a tool for identifying moderator variables and understanding how to improve the design of future replications in order to create new evidence and improve the results of meta-analyses. Los sensores de reflexión ópticos para medir distancia se caracterizan por la no linealidad de la salida. Esta condición deben asumirla las unidades de procesamiento donde son utilizados. El presente artículo tiene por objeto reducir el costo computacional, en términos de espacio de memoria y tiempo de procesamiento, en la linealización de la salida de los sensores para ser usados en sistemas embebidos de bajo costo. Los resultados de dos diferentes sensores indican que la curva exponencial estimada se puede ajustar usando redes neuronales con funciones de base radial con una reducción de más del 50 % en el tiempo de procesamiento. Para el diseño de la red se estudió la eficiencia respecto al tamaño de la red y a la distribución de los centroides con resultados importantes. La reducción del tiempo y de espacio lograda permite aprovechar los recursos del sistema en otras tareas, al mismo tiempo que posibilita aumentar la frecuencia de muestreo en la adquisición. The paper analyses the way in which the cast makes use of a sexual language characteristic of porn, the way in which directors go about their profession, and their understanding of pornography in an aesthetic and performance level. Underneath lie two main questions: how and according to what parameters is the pornographic image constructed, and how does pornography creates a discourse on regulation and transgression based on certain statements about gender and sexuality. The objective of this paper was investigate the relationship between executive function and functional capacity and determine predictors engines for decline of executive functions in elderly patients with AD. A total of 24 elderly patients with EA were evaluated to estimate predictors engines. Descriptive statistical analysis, Pearson Correlation and multiple linear regressions was used. Executive functions related to the flexibility (r = 0.54), static and dynamic balance (r = 0.48) and with the agility and mobility (r = -0.41). Regression analysis pointed to balance and flexibility as predictors engines deficiency executive functions. The decline of balance and flexibility can predict the prejudice of the executive functions of elderly with AD. [ABSTRACT FROM AUTHOR]

Psychological and pharmacological treatments for eating disorder involve personal and health costs. In this paper we study the various reasons that may be associated to abandonment in both types of treatments in patients diagnosed with a disorder of eating behavior and the kind of neglect: neglect after evaluation, early and late abandonment. On the other hand, we analyze whether there is any relationship between the diagnosis and the type of abandonment. Various characteristics (age, sex, diagnosis, motives and types of neglect, and satisfaction with the unit eating disorder) in 212 patients treated at a specialized service in the treatment of eating disorder were examined during a period of two years. Our data support the hypothesis that the rate of abandonment of the most common treatments is delayed type, motivated by the improvement of the disorder of eating behavior, while no verified that there is some relationship between the diagnosis and the type of abandonment. Our results indicate that the reasons for dropping out are heterogeneous. You can set two different profiles of dropouts, one linked to improvement and to temporary disability, and other related to various reasons. [ABSTRACT FROM AUTHOR]
