The attribution of the investigation to the Public Prosecutor's Office within the framework of the criminal process is, for many, a desideratum. Currently, however, the Public Prosecutor's Office itself arrogates this same attribution, under the pretext that the investigation carried out by it or under its direction is extra processum. In this regard, the Circular 2/2022 stresses that, in addition to the classic pre-procedural investigation proceedings regulated in the Organic Statute of Public Prosecutor's Office and in the Criminal Procedure Act, prosecutors can initiate what it calls «auxiliary investigation proceedings» and «post-procedural investigation proceedings». The aim of this paper is to analyze the regime designed for these newly baptized categories of proceedings and to highlight the risks involved in their use. [ABSTRACT FROM AUTHOR]
