Children's Courts in Australia are important parts of the systems which protect children and deal with young people who offend. They make decisions about the best interests of these vulnerable children and young people and require that children are represented in court. The paper reports on views of 46 stakeholders about quality of and access to representation in the care jurisdiction of the Childrens Court in Australian Capital Territory. Most stakeholders were adamant that for all parties to receive as fair a hearing as possible, they needed representation. Children commonly experience considerable disruption to their care when a parent is incarcerated. Maintaining relationships between children and their incarcerated parents can present particular challenges, and for a growing number of children, continuing contact with their incarcerated parent is a key issue. Most of the research about children's experiences of parental incarceration is filtered through adults who may or may not have spoken with children. This article draws on data collected for a research project which aimed to build an understanding of the needs and issues facing children and young people living in the Australian Capital Territory, who have experienced parental incarceration. This paper considers one key finding; children and young people's perspectives on contact with their incarcerated parent. This was reflected in four thematic clusters: quality of relationships; participation in decision making; the challenges and benefits of contact and practical issues. [ABSTRACT FROM AUTHOR]

ABSTRACT It is widely acknowledged that there are significant benefits when statutory child protection agencies and parents are able to engage cooperatively with one another to ensure the well-being of children. Despite promising innovations there are ongoing concerns that the current child protection model alienates and confuses many parents. It is hypothesized that a significant reason for this is that statutory agencies have become reliant on formalistic assessment, and as a consequence interactions with parents have become dominated by a focus on assessment-compliance. A qualitative study of 40 parents who had recently been investigated in Australia is reported. The analysis suggests that many parents find characteristics of assessment processes intrusive and that this undermines engagement. It is concluded that there should be greater debate about the role that assessment plays in child protection practice. [ABSTRACT FROM AUTHOR]
