Advances in writing technologies have fostered the gradual move from Paper-Based (PB) to Computer-Based (CB) writing assessment in foreign language (FL) education. The trend was further boosted by the outburst of the Covid-19 pandemic, which led to drastic changes in teaching and assessment practices. In higher education (HE) contexts, writing assessment in English as a foreign language (EFL) is more and more often managed by means of online learning platforms, where students create and submit written assignments on the computer. This paper examines a sample of 100 EFL exam essays completed by 100 Italian university students. Half of the essays were computer-typed on Moodle from home during the Covid-19 lockdown, whereas the other half were handwritten on paper during a face-to-face exam session after the Covid-19 emergency. The study presented herein compares the amount and types of formal errors in the CB and PB written assignments respectively. The results of the comparison may be useful to suggest hypotheses on the impact that both writing modality and environment can have on the quality of EFL writing in assessment contexts.

La professionalització dels intèrprets en l’àmbit jurídic està guanyant importància a Espanya a causa de les directives de la Unió Europea sobre els drets processals de persones sospitoses o acusades d’algun delicte. A això s’hi ha d’afegir la prolongada crisi humanitària, que ha sensibilitzat l’opinió pública sobre la qualitat de la interpretació proporcionada per diverses ONG i altres organismes que s’ocupen dels sol·licitants d’asil. Actualment, els proveïdors de serveis privats contracten els intèrprets en funció de les llengües que necessitin o que estiguin disponibles, sense exigir-los una formació específica. En aquest article, analitzem la qualitat percebuda dels serveis d’interpretació i el paper de l’intèrpret des de diverses perspectives, incloses les dels agents de les ONG (assessors jurídics, treballadors socials i psicòlegs) i els advocats que participen en aquesta mena de processos, seguint mètodes d’investigació descriptiva. A continuació, tractarem les diferents percepcions sobre la figura de l’intèrpret que tenen els diferents professionals que intervenen en el procediment de sol·licitud d’asil, amb l’objectiu d’obtenir una imatge vàlida, basada en dades, de la interpretació en el context de la sol·licitud d’asil a Espanya. S’espera que aquesta informació serveixi per omplir el buit que existeix en el desenvolupament professional dels intèrprets com a part essencial dels processos d’asil i, el que és més important, com a garantia dels drets humans. També contribuirà a sensibilitzar els professionals que desenvolupen la seva feina amb l’ajuda d’intèrprets.

Abstract: In this article, we will attempt a broad exploration of new literary forms in order to gain an overview of how literary work has taken hold of new digital technologies. We will then attempt to identify the problematic relationship between electronic and digital literature and examine the definitional issues that arise. Finally, we present an overview of the different types of digital poetry, highlighting the relationship of continuity or rupture between traditional and digital literary forms. Aquest article destaca el paper dels serveis socials locals en l’aplicació de les polítiques d’habitatge, concretament a Catalunya. És per això, que es presenta una revisió de tres instruments normatius: La Llei 18/2007, del dret a l’habitatge, la Llei 24/2015, de mesures urgents per a afrontar l’emergència en l’àmbit de l’habitatge i la pobresa energètica i la Llei 4/2016, de mesures de protecció del dret a l’habitatge de les persones en risc d’exclusió residencial. S’identifiquen els processos o polítiques públiques que ―per a la seva concreció― requereixen de la participació de les professionals dels serveis socials, destacant els reptes que es presenten i la necessària articulació entre les diferents administracions públiques per a garantir l’exercici efectiu del dret a l’habitatge de les persones que resideixen a Catalunya.

As práticas pedagógicas centradas em videojogos têm vindo a tornar-se cada vez mais populares, dado oferecerem vantagens empiricamente validadas no que diz respeito ao envolvimento dos alunos, à sua motivação e sentido de agência. Estes construtos afetivos são agora reconhecidos como componentes-chave de uma aprendizagem eficaz e significativa, favorecendo o desenvolvimento de competências cognitivas de nível superior. Contudo, enquanto se atesta um número elevado de estudos sobre o uso de videojogos educativos nas áreas das Ciências, Tecnologia, Engenharia e Matemática (STEM), é necessário ainda explorar as potencialidades desses recursos nas disciplinas de Humanidades. Analogamente, devem ser empreendidos mais esforços no sentido da investigação e implementação de atividades que atribuam aos alunos, especialmente àqueles de níveis inferiores ao do Ensino Superior, o papel de designers de videojogos, aliado ao de jogadores. Desta feita, criam-se as condições para que os alunos construam material didático autêntico, sob a forma de experiências digitais imersivas, que apresentam tanto um valor educacional como de entretenimento. Assim, este artigo funciona como um Position Paper sobre a Aprendizagem Baseada em Jogos Digitais ou Digital Game-based learning (DGBL), descrevendo as vantagens afetivas de se jogar e criar videojogos educativos na sala de aula de Humanidades, enquanto reflete criticamente sobre possíveis obstáculos ao sucesso desta prática. O nosso objetivo é estudar como a tecnologia educativa e imersiva pode satisfazer as necessidades de aprendizagem da Geração Z, tendo em consideração os diferentes fatores contextuais que definem o seu perfil.

El lema Caminos del pensar, evoca metafóricamente tanto el Camino de Santiago y la bella ciudad anfitriona, como los múltiples caminos abiertos por el pensar kantiano a tres siglos de su nacimiento. Consideramos la historia evolutiva de su pensamiento, que, desde nuestro punto de vista, no recorre uno, sino varios caminos, lo que también vale para su historia efectual. Etimológicamente la palabra 'camino' o 'caminos' sugiere el problema del método o de los métodos del pensamiento de Kant y existe en nuestro pensador incluso “un camino que todavía no ha sido nunca hollado” (KrV, A 98), a saber, el de la Deducción trascendental de las categorías. Muchos son los caminos, tanto nacionales como internacionales, que pueden traer a las investigadoras y a los investigadores kantianos a Santiago de Compostela, con ocasión del tricentenario de su nacimiento. Prenent en consideració el paper actual i futur de la intel·ligència artificial en la licitació pública, el present article es centra, des de l’òptica de les directrius de la Llei 15/2022, integral per a la igualtat de tracte i la no-discriminació, en la potencialitat que pot correspondre a la intel·ligència artificial davant la detecció i l’actuació contra les col·lusions en la contractació pública. Dins d’aquest nou dret computacional de la competència o “antitrust 3.0” es detallarà el paper capdavanter que ha assumit l’Autoritat Catalana de la Competència (ACCO) pel que fa a la posada en marxa, en fase experimental, de l’eina informàtica ERICCA, i, en paral·lel, la seva participació activa dins del projecte Computational Antitrust del Stanford Center for Legal Informatics (CodeX).

In this paper, we estimated the methane emissions by the disposal of sanitary and domestic-use paper consumed throughout Brazil from 1901 to 2016. The apparent consumption of this type of paper from 1961 to 2016, calculated from the data of the FAOSTAT system, was used to estimate the amount of waste disposed of annually in three site categories: sanitary landfill, controlled dump, and open-air, uncontrolled dump. The 2006 IPCC Guide methodology was used to calculate CH4emissions and long-term carbon storage. Nine scenarios based upon the law that establishes the National Solid Waste Policy (NSWP) were examined, considering 100% waste disposal and treatment in landfills or incineration from 2014. The total emission was estimated at 1.967 MtCH4, corresponding to 55.080 MtCO2eq by GWP-AR5, and the stored carbon at 3.724 Mt, corresponding to 13.655 MtCO2eq. CH4emission increased beyond the population growth rate due to an increase in the per capita paper consumption in the country, from 0.02 kgCH4.year-1 in 1961 to 0.30 kg CH4.year-1 in 2016. The NSWP has not yet been accomplished, and the scenarios outlined indicate that, from the point of view of CH4 emissions, it would be more advantageous to carry out incineration instead of applying other waste treatment technologies.

La práctica artística contemporánea tuvo un espacio de reflexión y creación de opinión en las páginas de Papers d’Art. De la mano de un conjunto de voces propias e independientes se visibilizaron formas de producción artística multidisciplinarias, desde la perspectiva divulgadora de una crítica que conectaba dinámicamente los significados artísticos con los sociales y culturales. Conviene resaltar el desplazamiento del significado de la concepción del arte contemporáneo en calidad de pieza clave en la cultura intelectual, incluyendo política, filosofía, ciencia u otros formatos de creación como la música y la literatura. Partiendo del análisis de la conciencia crítica de los diferentes colaboradores y la investigación historiográfica en torno a cuestionamientos estéticos y simbólicos, se despliega una revisión del conjunto de los discursos incluidos en la sección Estudios e Investigación. A group of independent voices of multidisciplinary artistic production was made audible thanks to this publication that provided a critique which forged dynamic connections between artistic meaning and social and cultural contexts. This paper highlights a shift in meaning of the conception of contemporary art as a key element in intellectual culture, including politics, philosophy, science and other creative formats such as music and literature. Based on an analysis of the critical awareness of the various contributors to the magazine and on the historiographic study of certain aesthetic and symbolic questions, a review of the articles published in the Studies and Research section is detailed. Similar to many other countries, journalistic production in China during the first half of 2020 was dominated on a thematic level by the COVID-19 pandemic. The trend included the mouthpiece of the Central Committee of the Chinese Communist Party (CCP), Renmin Ribao. Its news and commentary articles, which are widely republished by other media, influence the country’s political life, and contribute to the process of meaning generation in the news discourse and to the CCP’s effort to align Chinese citizens to official narratives. Renmin Ribao can therefore provide a relevant source to investigate the relationship between political power and the COVID-19 pandemic, starting from the hypothesis that the paper’s narrative would aim at discursively turning the international health crisis into a piece of positive propaganda. This study aims to verify whether and how the paper did so, and to question the assumption that the outlet’s media discourse can be equated to the CCP official discourse. The research is developed as a case study and blends quantitative and qualitative tools grounded on Applied Linguistics, Discourse-Historical Approach, and Frame Analysis, in order to analyse a corpus of commentaries that have appeared in the outlet’s online edition in 2020. By applying a Genre Analysis approach, the study also offers insights into the possibility to identify distinguishing characteristics and communicative goals in the different sub-genres of Renmin Ribao commentaries.

In the mid 1920s, Virginia Woolf was engaged in a dispute with the American critic Logan Pearsall Smith on “the ethics of writing articles at high rates for fashion papers”. Harper’s Bazaar, a commercial magazine to which Woolf contributed four short stories between 1930 and 1939, was a feminine periodical that exploited modernism’s distinction and high cultural capital to captivate a sophisticated, but essentially middle-class, readership by selling the illusion of upward cultural mobility. Although Woolf referred to her high-quality contributions to Harper’s Bazaar as “pot boiling stories for America” written “to make money”, it seems clear that her own engagement with a middlebrow publishing venue did not in the least affect her reputation as a highbrow intellectual and was indeed typical of the multifaceted, reciprocal relationship between the magazine and high modernism in a context in which mobility also meant redrawing the boundaries between intellectual and popular culture. The publication of modernist content within the glossy pages of Harper’s Bazaar was advantageous to both modernists seeking to maintain their celebrity status and the periodical itself, which attempted to cultivate and sustain a refined audience. Much in line with her work of the 1930s, Woolf’s short stories engaged with social and ethical issues such as the righteousness of penetrating other people’s lives and innermost truths (“In the Looking Glass”), violence and decay (“The Shooting Party”), capitalism and antisemitism (“The Duchess and the Jeweler”), human and non-human worlds (“Lappin and Lapinova”). Though often considered as non-canonical in terms of both their rather prosaic plot as well as characterisation, and the commercial venue in which they appeared, the stories Woolf wrote for Harper’s Bazaar reflect the preoccupations of the last decade of her career and are indicative of the tensions between high and low in modernist culture.

L’objectiu d’aquest article és estudiar la importància que té l’arxiu com a eina de construcció d’una identitat nacional i si a través de la seva organització es pot veure si la dita construcció nacional ha estat reeixida o no. En aquest sentit, s’agafa l’exemple de l’Arxiu Històric Nacional d’Espanya i s’analitza des de l’organització dels primers arxius en territori espanyol fins a la construcció de l’Arxiu Històric Nacional a finals del segle xix. Mitjançant aquesta anàlisi també es posa en relleu el paper que va tenir la Història en la formació de la identitat nacional i la seva interrelació amb l’arxiu. Una ciència no podria ser sense l’altre.

El present article analitza la relació epistolar entre el doctor Joan Solé i Pla i Josep Subirà Puig, dos familiars que des de Barcelona i Madrid es van comprometre amb l’ajut material i la promoció dels voluntaris espanyols i catalans a les files de la Legió Estrangera francesa durant la Primera Guerra Mundial. A través de la seva correspondència busquem analitzar les projeccions nacionals en disputa dels discursos sobre els voluntaris i comprovar una qüestió escassament treballada: la important cobertura i organització de la propaganda sobre els voluntaris impel·lida per Josep Subirà, qui, malgrat tot, va mantenir amb Solé i Pla una relació estreta marcada per la cordialitat familiar i l’entusiasme per les mútues activitats aliadòfiles.

La regió més oriental d’Ucraïna, el Donbass, viu des de fa vuit anys una sagnant guerra en què Rússia s’ha vist directament involucrada. A més, la regió ha estat objecte de la propaganda russa, que l’ha utilitzat com un dels principals motius per justificar la seva intervenció militar sobre Ucraïna, el febrer de 2022. Tots els bàndols implicats en aquest conflicte argumenten que estan protegint els interessos i els desitjos dels seus habitants. Però aquests interessos i desitjos, a més de ser sovint manipulats, han sofert moltes modificacions i pressions després d’una guerra tan llarga, que entre altres coses ha fet que prop de la meitat dels habitants hagin abandonat la regió, i la resta es vegi sota una pressió militar, política i mediàtica constant. Aquest article intenta ser una anàlisi i una reflexió sobre l’autèntica voluntat dels habitants del Donbass, com també de la manipulació que estan sofrint.

Information has been omnipresent and all-powerful for almost two centuries, and now possesses sophisticated and invasive means of imposing itself and creating opinion. It was crucial in the Enlightenment and in the preparation of the French Revolution by the intellectual and bourgeois elites. Its characteristic is to be the opposite of intangible truths, to be moving, malleable and adaptable. It is the new replacing the old. It is bracketed by history, because it ignores tradition and no longer needs the past. The creation of opinion in the 18th century introduced a concept of freedom that in fact conceals totalitarianism. People are told what to think. Information is a weapon against all forms of personal reflection and inner life. It imposes itself and imposes, making it impossible to distance oneself. It even kills the democracy it boasts about.

The collaborative volume The Science of Linguistics brings together a number of contributions on topics related to linguistic typology, sociolinguistics, onomastics, discourse analysis, multilingualism, language acquisition, and more. As such, the editors do justice to the title they have chosen, featuring authors and papers on subjects covering the wide spectrum of linguistic endeavours, that all have one thing in common: the rigorous analysis of language. This volume is dedicated to professor Ștefan Oltean, mentor, advisor, friend, or colleague of many of the contributors to this volume.

Durante los años 1853 y 1854 surgió una ola de huelgas en varios distritos industriales de Inglaterra, especialmente en los sectores textiles de Lancashire y Manchester. Este ciclo de luchas, que pugnaba principalmente por un aumento de los salarios, fue visto por Ernest Jones y el movimiento Cartista como una oportunidad para organizar una asociación obrera a escala nacional. Karl Marx, que compartía la visión de los cartistas, analizó el movimiento desde el New York Tribune, brindando apoyo a la iniciativa a la que dio lugar: el Parlamento Obrero. A continuación, se ofrece la traducción de cuatro textos periodísticos que Marx publicó en apoyo a la institución obrera –la mayoría inéditos en español–, seguidos de «Las luchas por la organización obrera en la época victoriana (1853-1854)», un estudio crítico sobre el ciclo de huelgas y las expectativas de organización obrera durante aquellos años, donde se defiende que este fallido intento de organización constituye un precedente de la sección británica de la Asociación Internacional de Trabajadores. La traducción y edición de los textos de Marx, y el estudio crítico que los acompaña, han sido realizados por Mario Espinoza Pino (Universidad de Granada).

En aquest article intentarem determinar els motius que hi ha darrere de la baixa qualitat de la feina dels intèrprets judicials en el context dels processos penals als tribunals de Barcelona. A partir d’un corpus de judicis reals enregistrats, explorem quatre possibles factors que poden afectar l’actuació dels intèrprets: durada del judici, problemes de gestió de les converses, experiència dels intèrprets i tipus de delicte que es jutja. A més, també analitzem faltes de rendiment injustificades, que es consideren un indicador important de la ineficàcia. Les conclusions es comenten en el context de la competència lingüística de l’intèrpret, el seu paper en la interacció amb tots els participants i les normes establertes dels codis de conducta professionals. En aquest article se subratlla la necessitat de millorar la qualificació dels intèrprets, però també de conscienciar els membres del poder judicial espanyol sobre el paper dels intèrprets, amb l’objectiu de protegir els drets processals de les persones que no parlen ni entenen la llengua en què es du a terme el procediment.

Concluding remarks. | (Abstract) Practice shows the existence of complex legal situations in which customary international rules applicable to the Member States interfere, even indirectly, with the competences of the Union, and vice versa. On the one hand, the implementation of a rule of customary international law by Member States could affect rights and obligations under EU law. On the other hand, the exercise of EU competences could affect the rights and obligations conferred on Member States by customary law. In these situations, the Union must reconcile two “equal and opposite” needs. On the one hand, it must ensure that Member States’ exercise of rights and obligations under customary international law does not undermine the effectiveness of EU law. On the other hand, it must prevent EU competences from interfering with the rules of customary international law applicable to the Member States. This Article aims to explore how the Union reconciles the exercise of EU competences with the exercise of Member States’ competences under customary international law. After examining the most prominent models that could theoretically be used to coordinate the two spheres of competence (section II), the attention will turn to the approach adopted by the ECJ (section III) to determine whether this approach affects the prerogatives of the EU Member States as sovereign states under international law (section IV).

Concluding remarks. | (Abstract) The principle of ne bis in idem, intrinsically linked to the concept of res iudicata, constitutes a fundamental cornerstone of criminal justice, ensuring protection against multiple prosecutions or punishments for the same offense. Nevertheless, the ever-evolving legal landscape has engendered extensive discussions concerning the potential reopening of criminal cases, particularly in light of novel evidentiary findings or fundamental procedural irregularities in the criminal proceedings at stake. This Article embarks upon a comprehensive and exhaustive inquiry into the intricate interplay between the re-examination of criminal proceedings and the ne bis in idem principle in Europe. By concentrating on key legal instruments, including the Charter of Fundamental Rights of the European Union, the European Convention on Human Rights (ECHR), and the Convention Implementing the Schengen Agreement (CISA), this study aims at exploring the theoretical, legal, and human rights implications associated with such a course of action. At the heart of this analysis lies a meticulous examination of art. 4 of Protocol 7 to the ECHR, which serves as a pivotal benchmark governing the permissibility and justifiability of reopening criminal proceedings. Within this context, it will be demonstrated that, unfortunately, the interpretation of the latter provision by the Strasbourg Court – which provides for the minimum standards of protection of ne bis in idem in EU law – has not been consistent, creating potential issues concerning legal certainty and clarity that could undermine the essence of the said principle. Against this composite background, the primary objective of this Article is to illuminate the extent to which the principle of ne bis in idem may be rendered less stringent, in exceptional circumstances, to accommodate legitimate grounds warranting the reopening of criminal proceedings within the European legal framework.

Concluding re-marks. | (Abstract) The European Union's decision to supply weapons and military equipment to the Ukrainian army, which is engaged in repelling Russian aggression, could amount to an international use of force, albeit minoris generis. In this case, the question arises as to whether it is admissible under international law on the use of force. One possible legal basis is the legal regime of collective self-defence. However, accord-ing to the classical interpretation, international law only grants States the power to act in self-defence, and the assistance benefiting Ukraine provided under Council Decision 2022/338 does not seem to be attributable to the EU Member States, even if they have brought weapons onto Ukrainian territory. On the contrary, military support for the Ukrainian army seems entirely attributable to the Union, which would have adopted the conduct of its Member States as States and international organisations might do with the conduct of individuals under international law of responsibility. This Article argues that the Council's decision to supply weapons to the Ukrainian army can be regarded as a first attempt to amend customary law, precisely to allow international organisations to act in collective self-defence in certain limited cases.

Conclusion. | (Abstract) This Article presents two arguments and explores the relationship between them. First, the principles governing coordination between the EU and its Member States in multilateral fora (mainly, sincere co-operation and unity in the EU's representation) serve to increase the Member States' influence in inter-national law-making. Thus, there is a trade-off between the autonomy of Member States to determine their own positions in multilateral fora, and their capacity to influence such fora: the lesser the former, the greater the latter. Second, such an influence can be used by the EU and its Member States to pro-mote human rights laws abroad, “uploading” high standards into multilateral treaties, which are subse-quently “downloaded” by third states through ratification and implementation. Therefore, there is a link between the mentioned EU external relations law principles (which are a “condition” for a success-ful promotion) and the obligation to promote values set in arts 3(5) and 21 TEU (which provides the “direction” of the promotion). Consequently, when Member States complain about excessive EU intru-sion into their autonomy through common positions in multilateral fora, they should bear in mind that they are not only bound by the above-mentioned legal principles, but that their obligation to promote certain values abroad is also at stake. The case of the EU's influence on the Maritime Labour Conven-tion and its impact on Chinese law and policy is used to illustrate the arguments.

Conclusions | (Abstract) If the JP ruling were a book, it would be a thriller: not only the reader may be surprised by its outcome and by the arguments developed by the CJEU to support it, but it also contains a genuine “plot twist”, as until the end one is led to believe that the CJEU would have decided in the opposite way. While in previous cases it has constantly sought to enhance the effet utile of the EU regime on air quality, here the CJEU decided that individuals cannot claim compensation for damages suffered due to Member States’ infringements of that regime. By holding that Directive 2008/50/EC cannot confer rights to individuals because it pursues a general objective, the ruling seems inconsistent not only with the case law in this field, but also with several profiles that characterize the EU legal order from a broader perspective, such as the relation between direct effect and Member States’ liability. In addition to undermining the argument that EU law may recognize a substantive right to clean air, the ruling reduces the deterrent effect of Directive 2008/50/EC eliminating civil damages from the expected costs of air quality standards violations. The revision of Directive 2008/50/EC is currently under discussion and the Commission’s proposal – drafted before the JP ruling – recognizes the right to damages. The hope is that this point will survive the legislature procedure, reducing the relevance of the JP ruling: however, this is a feeble expectation considered the (need for Council’s approval and the) impact on Member States.

Degrees of statehood? | (Abstract) There is one thing that lawyers - from both European Union and international law perspectives – can agree on: the EU is not a state. Yet the EU is now treated as a state-like entity in a variety of legal settings. Through concluding and participating in international treaties, through the CJEU interpreting and applying international agreements; and through dispute settlement bodies accepting the multiple nature of EU law, the Union now presents challenges to international law. This contribution argues that a conception of sovereignty as a functional and relational concept, rather than absolute and indivisible, would allow the Union to be accepted as a state for certain purposes in international law. The term “state” in international agreements could be interpreted to include legal persons, such as the Union, exercising degrees of statehood. If the EU continues to be regarded as a state-like entity, there will be a growing case for legal consequences to flow from this. Rather than speaking of the Union’s indeterminate or dual character in international law, it should be regarded as exercising degrees of statehood.

Conclusive remarks. | (Abstract) The present Article analyses the legal instruments used at the EU level to tackle harmful tax competition in order to consider whether the EU action in this field is an undue limitation to national fiscal autonomy. State aid rules are the only “hard law” set of rules that have been used until now. As the Court of Justice stated in the Fiat case, the extensive notion of State aid adopted by the Commission in the assessment of tax rulings is an attempt of “backdoor tax harmonisation” that violates the Treaty provisions and national prerogatives in tax matters. On the other hand, forms of coordination between fiscal authorities, such as the Code of Conduct for Business Taxation, are not sufficient and corporate tax harmonisation is not achievable at the moment because of the lack of political will. The key contention of this Article is that the strategies and instruments put in place by the EU to tackle harmful tax competition are inadequate and, in the case of State aid, unduly restrict Member States’ fiscal autonomy.

Conclusion and Outlook. | (Abstract) Areas of contested statehood present challenges to human rights on both a normative and a practical level. As areas of contested statehood face difficulties in acceding to human rights treaties and international organizations, more creative solutions have had to be found to ensure the protection of human rights in line with international standards. In recent years, Kosovo has been one of the most prominent examples of an area of contested statehood in Europe. This Article focuses on the role of one key international actor – the Council of Europe (CoE) – regarding the promotion of human rights in Kosovo. Combining doctrinal and empirical analysis, the Article discusses two key aspects of the relationship between the CoE and Kosovo: (1) the constitutionalisation and judicial application of the CoE’s human rights standards in Kosovo’s constitutional legal order; and (2) Kosovo’s interaction with the CoE’s human rights standard-setting, monitoring, and advisory mechanisms. This Article argues that these two aspects of the CoE’s and Kosovo’s relationship have been relatively impactful in embedding the CoE’s human rights standards in Kosovo. This has occurred to such an extent that Kosovo’s human rights system has now become inextricably tied to the Council of Europe’s human rights standards, despite not (yet) being a member of the CoE.

However, in the context of the rule of law backsliding, with the adoption of national laws aimed at undermining the guarantee of independence and making the judiciary subject not only to the law but also to the executive, the Court of Justice was obliged, in the Getin Noble Bank judgment, to limit this presumption in cases where there is a final judgment of a national court or of the ECHR which gives rise to a presumption of infringement of art. 19(1) TEU and art. 47 of the EU Charter. The L.G. judgment is a landmark decision, as it is the first time that the Court of Justice has overturned the “presumption of independence” on the grounds that the Polish Chamber for Extraordinary and Public Affairs cannot be considered a judicial body within the meaning of art. 267 TFEU, due to irregularities in the procedure for the appointment of its members. The aim of this Insight is twofold: firstly, to analyse the facts of the case, the context in which the reference is made, the arguments of the AG and the Court's decision, highlighting its new elements, especially in relation to ECHR jurisprudence; secondly, to examine the systemic impact of the judgment.

Conclusion | (Abstract) Access to justice in environmental matters is one of the three pillars of the Aarhus Convention, to which both the EU and its Member States are Parties. In the Convention, access to justice is subdivided into four limbs. Art. 9(3) contains the general obligation of access to review procedures for the public of acts and omissions of private persons and public authorities concerning national law relating to the envi-ronment. Art. 9(3) had to be transposed by the Parties to the Convention, taking the discretion left by the vague wording of the provision into account. At the EU level, unlike for art. 9(1) and (2), there is no formal transposition of art. 9(3) in a dedicated Directive, because of Member States’ reluctance. The so-lution found by the Commission to remedy this lack of EU legislation on the matter was the publication of a soft law instrument in 2017. Since then, we have witnessed a shift in the approach used by the EU legislator, with access to justice provisions being incorporated directly into several pieces of “sectoral” legislation (Regulations and Directives), across various environmental areas. This Insight aims at retrac-ing the history of art. 9(3) of the Aarhus Convention in the EU legal order and at analysing and evaluat-ing the recent tendency of including access to justice rights in sectoral legislation.

Conclusion | (Abstract) In case T-65/18 RENV Venezuela v Council the General Court was confronted with the question of the legality under international law of the EU’s restrictive measures against Venezuela. The judgment is of particular importance as it feeds into the burgeoning discussion regarding the juridical nature, and lawfulness, of EU restrictive measures against third States under international law. This Insight summarizes the judgment and analyses the Court’s line of argumentation and reasoning. It shows that the General Court here proclaimed an autonomous external sanctioning power stemming from the EU’s values and objectives governing the Union’s external action. The Insight argues that the General Court’s approach leaves much to be desired in terms of reasoning on the basis of international law. The Insight argues that the restrictive measures against Venezuela could be considered lawful on the basis of the international legal regime governing countermeasures in response to violations of erga omnes obligations. By eschewing engagement with the broader international legal framework, the General Court here missed an opportunity to make a substantive contribution to the (evolving) law of collective countermeasures.

Conclusion. | (Abstract) In 2019 the EU Commission launched the ambitious so-called European Green Deal, a set of proposals aimed to revise and update EU legislation and to put in place new initiatives with the goal to ensure that EU policies are in line with climate and SDGs goals. To reach the targets set out by the EU institutions, a crucial role is attributed to private investments, which can mobilize the necessary capital to make feasible the green transition. In this regard, trade agreements are an important driver for sustainable growth both in the EU and in partner countries insofar as they promote private investments in strategic sectors while at the same time they contribute to sustainable development. While the EU Commission has already started to insert trade and sustainable development (TSD) chapters in its trade agreements, another possible path has been identified in the conclusion of new-generation bilateral investment agreements. This Insight examines the recently adopted EU-Angola Sustainable Investment Facilitation Agreement (EU-Angola SIFA) as the first of this new generation of investment agreements. Specifically, this Insight points out that, while the agreement is not yet in force and it will take several years to gauge whether it successfully serves as a stimulus to attract sustainable investments, it can already be considered a further attempt to balance the necessity to attract private capitals indispensable for the green transition with the preservation of States’ regulatory powers.

It unveils its nature, predominance, and implications as a structural component of EU law and policy in this domain. The main point I intend to convey is that crisis, in and by itself, constitutes a system of governance producing very problematic effects. The association between (unwanted) migration and refugee flows with crisis in the European context has allowed for the exceptionalisation of rights and legal safeguards, with the pre-emption of unauthorised arrivals becoming the main concern. The danger, instability, and abnormality connected with crisis pervades law and policy, justifying mechanisms that contravene minimal rule of law standards, including due process guarantees and effective judicial protection. The incremental normalisation of exceptions has led to a position where the suspension of (rule of law-based) governance has become a form of governance. The prorogation of “normal” (rule of law-compliant) arrangements has given way to “exceptional” means of managing asylum, starting with the 2015 “refugee crisis” and the relocation-plus-hotspots scheme, which have now been streamlined as part of the New Pact on Migration and Asylum reforms. The resulting generalisation of derogations, the proliferation of legal fictions and rights negations that the envisaged amendments involve, is progressively normalising a situation of non-access to international protection in the EU, with deleterious consequences not only for asylum seekers, but for the integrity of the EU legal order and fundamental rights at large.

It examines the rules that apply to the verification of readiness in preparation of a Council decision on full accession and the extent to which the rules of the Schengen acquis apply to Schengen Candidate Countries prior to the lifting of internal border controls. It pays particular attention to the legal regime that applies at the borders between “old” and “new” Member States, more specifically Schengen members and Schengen Candidate Countries, and the borders between the Schengen Candidate Countries and third countries. It is argued that the prolonged exclusion from the Schengen area has resulted in a de facto duplication of the EU’s external border, accompanied with an incremental, near full application of the Schengen acquis, short of lifting internal border controls. As a result, for already well over fifteen years, Romania and Bulgaria have been part of the accompanying measures that should allow for free travel, yet its nationals have not been able to enjoy the benefits of their EU citizenship in full.

Conclusion. | (Abstract) Human mobility has always been a pre-condition for human development, yet few issues today remain subject to such elaborate legal restrictions. The Schengen acquis is exemplary of this as a composite network of legalities that extend over a broad range of human activities. This Article pioneers legal infrastructures as an analytical tool to bring into focus law’s fundamental role in shaping human (im)mobility. Section II sets the theoretical frame by conceptualizing Schengen as a legal infrastructure through a brief tour through the scholarly field of infrastructural studies. Section III then traces the emergence of the Schengen legal infrastructure through historical iterations of physicality, accretion, and entanglement. Section IV further shows how Schengen has transformed to actively mediate human mobility and normative frameworks also outside the European space. Part IV concludes briefly on the implications of our analysis for understanding Schengen as a cornerstone of European mobility law.

In contention is the Bka’s finding that Meta’s practice of combining personal data across its many services, in addition to data collected through the integration of its services into third-party websites and apps, constitutes a violation of competition law. In this case, the ECJ holds that a competition authority is at liberty to consider GDPR violations as a “vital clue” to a finding of abuse of dominance, provided it first requested the cooperation of the competent data protection authorities. Furthermore, it finds that, apart from consent, no legal bases from the GDPR justify Facebook’s data processing. Through the principle of sincere cooperation, the Court opens the door to further integration of data protection and competition, acknowledging that data collection is at the core of digital market companies’ business models. Although the case is based on German national law, there is reason to believe that the same line of reasoning could also apply to the European Commission, thus expanding its options in digital market oversight. In contrast, the Court’s analysis of the GDPR is not quite as innovative, but still helpfully lists and reaffirms existing law.

This essay looks into the very beginnings of paper photography in the Austrian Empire. It focuses on two salted paper portraits of two most iconic figures of the Slovak National Revival in the mid-19th century, Ľudovít Štúr and Jozef M. Hurban. Created around 1849 by Anastas Jovanović, a Serbian photographer and lithographer based in Vienna, both portraits are the earliest paper photographs today preserved in Slovak collections. The article elucidates not only the salted paper prints’ authorship, origin, ownership and material characteristics, but also the notion of reproduction and circulation of images during the revolutionary years of 1848 and 1849 and by the advent of photography on paper in Central Europe at the same time. Special attention is paid to social and cultural contacts between Slovaks and Serbs around 1848 as a key factor to the photographs’ production.
